The main thesis of this article is that resistance and subversion are part of everyday life in most cultures, and that they are integral to the process of development. Many of our theories of social and moral development either fail to account for resistance, and treat it largely as anti-social, or view it as unusual activity sometimes undertaken by those who have reached a high level of development. Several examples are presented to illustrate that resistance and subversion are common among (...) people in positions of little power in the social hierarchy--especially on the part of women in patriarchal societies. Moreover, research has demonstrated that social conflict and resistance based on moral aims occur in childhood, adolescence and adulthood. Especially among adults, conflicts occur over inequalities embedded in the structure of social systems that allow greater power and personal entitlements to some groups (e. g. social hierarchies based on gender, socio-economic class, ethnic or racial status). In their everyday lives adults come into conflicts with others and resist moral wrongs embedded in cultural practices that serve to further the interests of those in higher positions in the social hierarchy. Resistance frequently entails deceptive actions aimed at transforming aspects of the social system judged unfair and detrimental to the welfare of groups of people. (shrink)
Among anthropologists and sociologists, it is widely believed that moral rules are best understood as a type of social norm. Moral philosophers, however, have largely been hostile to this suggestion. In recent years, the impulse to distinguish moral rules from others types of social norm has received what many take to be empirical support from the work of ElliotTuriel and his collaborators, who have argued that there are two distinct “domains” of social cognition, the “moral” and the (...) “conventional.” Many philosophers have taken this as proof that moral rules are fundamentally different from “conventional” social norms. I argue that moral philosophers should not be relying upon Turiel’s view to defend the moral/conventional distinction. First, I show that Turiel is claiming much less than many have taken him to be claiming, because he puts a lot of what philosophers have traditionally thought of as “morality” on the side of convention, or else in the broad region between the two that he refers to as “multidimensional contexts.” Second, I argue that his concept of the “conventional” is so narrow that the overwhelming majority of social norms – such as the standard rules of etiquette – wind up falling into the “multidimensional” category. This stems from his failure to distinguish between genuine conventions and what I refer to as “norms with conventional elements.”. (shrink)
One of the most important assumptions in liberal societies is that citizens should be tolerant of a diversity of values. We are challenged by this assumption to justify restraint when we confront what we oppose, disapprove of, or perceive to be immoral, even if we have the power to suppress perceived immoralities. Based on the work of ElliotTuriel, Jonathan Haidt, and Gerald Gaus, the argument developed in this article is that the best way to address the challenge (...) is to distinguish between public morality and other normative categories such as convention and private morality. Descartes is widely portrayed as the arch proponent of “the epistemological transparency of thought” (or simply, “Transparency”). The most promising version of this view—Transparency-through-Introspection—says that introspecting (i.e., inwardly attending to) a thought guarantees certain knowledge of that thought. But Descartes rejects this view and provides numerous counterexamples to it. I argue that, instead, Descartes’s theory of self-knowledge is just an application of his general theory of knowledge. According to his general theory, certain knowledge is acquired only through clear and distinct (...) intellection. Thus, in his view, certain knowledge of one’s thoughts is acquired only through clear and distinct intellection of one’s thoughts. Introspection is a form of intellection and it can be clear and distinct. Ordinarily, however, introspection isn’t clear and distinct but is instead confused with dubitable perceptions of bodies. To make introspection clear and distinct, we need to “sharply separate” it from all perceptions of bodies by doubting all perceptions of bodies. Without such radical doubt, introspection remains confused and we lack certain knowledge not just of the specific features of our thoughts, but even of the minimal claim that a thought exists. Far from being the high priest of Transparency, Descartes is radically opposed to it. (shrink)
Three kinds of things may be creative: persons, processes, and products. The standard definition of creativity, used nearly by consensus in psychological research, focuses specifically on products and says that a product is creative if and only if it is new and valuable. We argue that at least one further condition is necessary for a product to be creative: it must have been produced by the right kind of process. We argue furthermore that this point has an interesting epistemological implication: (...) when you judge a product to be creative--attributing creativity--you are not just judging it to be new and valuable. Clear and distinct perception is the centrepiece of Descartes’s philosophy — it is the source of all certainty — but what does he mean by ‘clear’ and ‘distinct’? According to the prevailing approach, what it means for a perception to be clear is that its content has a certain objective property, like truth. I argue instead that clarity is at least partly a subjective, phenomenal quality whereby a content is presented as true to the perceiving subject. Clarity comes in degrees. (...) Any weak degree of clarity, available to the senses, can be merely subjective, since what it presents as true may not actually be true. But complete clarity, available to intellectual perception, has an objective dimension, since what it presents as true is always some truth, some bit of reality. Further, I argue that the other perceptual qualities that Descartes identifies — obscurity, confusion, and distinctness — are all defined in terms of clarity. Of particular note is the fact that distinctness is not a positive feature to be added to clarity: a distinct perception is just a completely clear perception. (shrink)
This paper provides a new solution to the problem of moral permissions for the moral error theory. The problem is that the error theorist seems committed to the claim that all actions are morally permitted, as well as to the contradictory claim that no action is morally permitted. My solution understands the moral error theory as the view that folk moral discourse is systematically in error by virtue of suffering from semantic presupposition failure, which I show is consistent with a (...) Kratzerian semantics for deontic modals in natural language. Formally, the solution is to treat the ordering source parameter within Kratzer’s semantics as undefined in the case of folk moral discourse. The paper concludes with thoughts about the import of the solution proffered for the alleged independence of the moral error theory from normative ethics. (shrink)
It has been argued by some that the present non-existence of future persons entails that whatever obligations we have towards them are not based on rights which they have or might come to have. This view is refuted. It is argued that the present non-existence of future persons is no impediment to the attribution of rights to them. It is also argued that, even if the present non-existence of future persons were an impediment to the attribution of rights to them, (...) the rights they will have when they come into existence constitute a constraint on present actions. Both arguments build on a suggestion of Joel Feinberg's. Next, three arguments are considered which, while they do not highlight the non-existence issue, are related to it. The view that the causal dependence, of (some) future people on present policies, erodes or weakens the claim that rights considerations should constrain our present actions concerning them, is considered and rejected. The view that future people can only have rights to what is available at the time at which these people come into existence is considered and rejected. So too is the view that the attribution of rights to future people involves, in virtue of resource scarcity, an unacceptable arbitrariness. (shrink)
This article looks at the popular, yet controversial, pedagogical exercise originated by Jane Elliot in the early 1970s. The "Blue-Eyed, Brown-Eyed" activity is analysed as a possible tool of moral education utilising Michel Foucault's theories of ethical self-formation and care of the self . By first explicating Foucault's ethics, the author reveals how the exercise, as practised in the post-secondary classroom, can be considered part of the "technologies of the self" advocated by Foucault that are integral to the process (...) of creating an ethical self. Moving beyond "knowledge of" oppression, in this instance "racial" inequality and degradation, to a more profound understanding of justice depends on our ability to sympathise with others. The author, in adopting Foucaut's model of moral development as ethical/liberatory/aesthetic practice, is claiming that self-construction, the constant critique and shaping of our persons as ethical beings, must be considered a central aim of moral pedagogy. Such an education involves more than the simple adoption of categorical truths. Creating an ethical self requires ongoing judgements about how one responds to the condition of others and who one would be in the world. It is these judgements that students need to recognise, examine, practise and critically reflect on, in order to grow as educated and compassionate people. (shrink)

When proponents of Intelligent Design theory deny that their theory is religious, the minimalistic theory they have in mind is the claim that the irreducibly complex adaptations found in nature were made by one or more intelligent designers. The denial that this theory is religious rests on the fact that it does not specify the identity of the designer—a supernatural God or a team of extra-terrestrials could have done the work. The present paper attempts to show that this reply underestimates (...) the commitments of the mini-ID Theory. The mini-ID theory, when supplemented with four independently plausible further assumptions, entails the existence of a supernatural intelligent designer. It is further argued that scientific theories, such as the Darwinian theory of evolution, are neutral on the question of whether supernatural designers exist. (shrink)

Indeed, Locke is not fully explicit about the relationship between pleasure and pain and the natural law in the Essay concerning Human Understanding. Perceptual experience is present-directed in the sense that what we perceptually experience seems to be temporally present, while what we remember or imagine does not. One way of explaining this contrast is to claim that perceptual experience uniquely involves awareness of the property of presence (either conceived as an observer-independent property of the present time or as a relation of simultaneity between an event and one’s experience of it). I argue against this explanation and in favour of one on which (...) perception’s feeling of present-orientation is explained in terms of the feeling of aptness for action guidance that characterizes perceptual experience. I argue that an advantage of this view is that, unlike its rivals, it can make perception’s present-directedness straightforwardly compatible with the specious present theory as an account of experiences of motion and change. Efficiency as quantified and promoted by cost-effectiveness analysis sometimes conflicts with equity and other ethical values, such as the “rule of rescue” or rights-based ethical values. We describe the utilitarian foundations of cost-effectiveness analysis and compare it with alternative ethical principles. We find that while fallible, utilitarianism is usually superior to the alternatives. This is primarily because efficiency – the maximization of health benefits under a budget constraint – is itself an important ethical value. Other ethical frames may be irrelevant, (...) incompatible with each other, or have unacceptable implications. When alternatives to efficiency are considered for precedence, we propose that it is critical to quantify the trade-offs, in particular, the lost health benefits associated with divergence from strict efficiency criteria. Using an example from HIV prevention in a high-prevalence African country, we show that favoring a rights-based decision could result in 92–118 added HIV infections per $100,000 of spending, compared to one based on cost-effectiveness. We present a criterion for the use of thought experiments as a guide to possibilia that bear on important arguments in philosophy of religion. We propose that the more successful thought experiments are closer to the world in terms of phenomenological realism and the values they are intended to track. This proposal is filled out by comparing thought experiments of life after death by Peter van Inwagen and Dean Zimmerman with an idealist thought experiment. Environmentalists express concern at the destruction/exploitation of areas of the natural environment because they believe that those areas are of intrinsic value. An emerging response is to argue that natural areas may have their value restored by means of the techniques of environmental engineering. It is then claimed that the concern of environmentalists is irrational, merely emotional or even straightforwardly selfish. This essay argues that there is a dimension of value attaching to the natural environment which cannot be restored no (...) matter how technologically proficient environmental engineers become. The argument involves highlighting and discussing analogies between faking art and faking nature. The pivot of the argument is the claim that genesis is a significant determinant of an area's value. By heeding the letters of _emet _we discern the truth of time manifestly concealed in the time of truth, the beginning that cannot begin if it is to be the beginning, the middle that re/marks the place of origin and destiny, and the end that is the figuration of the impossible disclosing the impossibility of figuration, the finitude of death that facilitates the possibility of rebirth. The time of death does not mark the death of time, but time immortal, the moment of truth that bestows on the truth of the moment an endless beginning of a beginningless end, the truth of death encountered incessantly in retracing steps of time yet to be taken—between, before, beyond. Through an extensive examination of the conceptions of social justice that may be ascribed validly to Karl Marx's political thougtht, Elliot R. Pruzan analyzes the apparent conflict between Marx as value-neutral social scientist and as revolutionary. He suggests a resolution to this conflict through a carefully constructed presentation of Marx's theory of human nature and the ethical presuppositions of that theory. Dreams have attracted the curiosity of humankind for millennia. In A Dream Interpreted Within a Dream, Elliot Wolfson guides the reader through contemporary philosophical and scientific models to the archaic wisdom that the dream state and waking reality are on an equal phenomenal footing--that the phenomenal world is the dream from which one must awaken by waking to the dream that one is merely dreaming that one is awake. By interpreting the dream within the dream, one ascertains the wakeful (...) character of the dream and the dreamful character of wakefulness. Assuming that the manner in which the act of dreaming is interpreted may illuminate the way the interpreter comprehends human nature more generally, Wolfson draws on psychoanalysis, phenomenology, and neuroscience to elucidate the phenomenon of dreaming in a vast array of biblical, rabbinic, philosophical, and kabbalistic texts. To understand the dream, Wolfson writes, it is necessary to embrace the paradox of the fictional truth--a truth whose authenticity can be gauged only from the standpoint of its artificiality. The dream, on this score, may be considered the semblance of the simulacrum, wherein truth is not opposed to deception because the appearance of truthfulness cannot be determined independently of the truthfulness of appearance. According to bridge-law non-naturalism, the laws are themselves partial grounds of the moral facts; whereas according to grounding-law non-naturalism, the laws explain the grounding connections that obtain between particular natural facts and particular moral facts. I pose and develop an objection to BLNN concerning moral worth: as compared to GLNN, BLNN has trouble accommodating the common (...) intuition that actions performed out of motivation for rightness de dicto are, at least in paradigm cases, deficient in their moral worth as compared to those performed out of motivation for rightness de re. After presenting the moral worth objection to BLNN, I respond to a possible defense of the view and explain why GLNN is not itself imperiled by an analogous objection. I finally argue that in light of the moral worth objection, a purported analogy between the law and morality fails to give us any reason to prefer BLNN to GLNN. I conclude that non-naturalists who accept the existence of general and explanatory moral principles should adopt GLNN rather than BLNN. (shrink)
