This book focuses on Andrew Arato’s democratic theory and its relevance to contemporary issues such as processes of democratization, civil society, constitution-making, and the modern Executive. Andrew Arato is -both globally and disciplinarily- a prominent thinker in the fields of democratic theory, constitutional law, and comparative politics, influencing several generations of scholars. This is the first volume to systematically address his democratic theory. Including contributions from leading scholars such as Dick Howard, Ulrich Preuss, Hubertus Buchstein, Janos Kis, Uri Ram, Leonardo (...) Avritzer, Carlos de la Torre, and Nicolás Lynch, this book is organized around three major areas of Arato´s influence on contemporary political and social thought. The first section offers a comprehensive view of Arato’s scholarship from his early work on critical theory and Western Marxism to his current research on constitution-making and its application. The second section shifts its focus from the previous, comprehensive approach, to a much more specific one: Arato´s widespread influence on the study of civil society in democratization processes in Latin America. The third section includes a previously unpublished work, ‘A conceptual history of dictatorship (and its rivals,)’ one of the few systematic interrogations on the meaning of a political form of fundamental relevance in the contemporary world. While constitutionalism is generally reduced to the idea of limited government, little has been said to its contribution to the juridification of the social sphere. The article shows the significance of constitutionalism for the institutionalization of modern civil societies. Modern civil societies, it is argued, can only flourish in a form of modern state that has undergone a process of internal differentiation in the direction of a separation of powers. Through the analysis of the process of self‐constitution of Argentine civil (...) society, I show how the erosion of the constitutional components of the state by populist democratizing movements resulted in the disintegration of civil society. What is the distinctive trait of the Latin American pattern of modernization? In contrast to western societies, where the debate on modernization has been dominated by the Weberian thematic of bureaucratiz-ation, the most salient feature of the Latin American developmental path is the chronic frailty of legal-constitutional arrangements. In Latin America, the process of modernization and social differentiation has not been followed by the legal stabilization of social complexity but is characterized by a low degree of juridification and institutional precariousness. (...) Drawing on insights from both Luhmann's and Habermas' theories, the article provides a critical theoretical framework for the study of the peculiarities of the Latin American modernizing path. Esta obra se abre con una introducción histórica, no heleno ni eurocéntrica, en la que se reinterpretan los sistemas éticos en la historia mundial, hasta situar la problemática en la Modernidad dentro del sistema-mundo como proceso de globalización que simultáneamente excluye a la mayoría de la humanidad. En la primera parte se aborda una crítica a las morales formales (Kant, Rawls, Apel, Habermas) desde un principio material o de contenido con pretensión de universalidad; el deber de producir, reproducir y desarrollar (...) la vida humana en comunidad. El principio de factibilidad ética, por su parte, permite que el cumplimiento del acto, institución o sistema de eticidad pueda tener la pretensión de bondad. En la segunda parte, desde la imposibilidad de que dicho acto, institución o sistema de eticidad «buenos» pueda tener pretensión de perfección acabada, se descubren los que «sufren» en su corporalidad vulnerable la imposibilidad de vivir, el hecho de ser excluidos. Se trata de las víctimas, al decir de Marx, Horkheimer, Benjamin, Nietzsche, Freud o Lévinas. Desde las víctimas comienza propiamente el discurso de la Ética de la Liberación, en su nivel negativo material (deben poder vivir), en el principio discursivo crítico (deben poder participar en la argumentación), todo lo cual culmina en el principio crítico negativo de la factibilidad: el principio-liberación que inspira las transformaciones con pretensión de justicia. The aim of this paper is to explore the peculiar case of infectious logics, a group of systems obtained generalizing the semantic behavior characteristic of the -fragment of the logics of nonsense, such as the ones due to Bochvar and Halldén, among others. Here, we extend these logics with classical negations, and we furthermore show that some of these extended systems can be properly regarded as logics of formal inconsistency and logics of formal undeterminedness.

In The Theological Metaphors of Marx, Enrique Dussel provides a groundbreaking combination of Marxology, theology, and ethical theory. Dussel shows that Marx unveils the theology of capitalism in his critique of commodity fetishization. Capitalism constitutes an idolatry of the commodity that undergirds the capitalist expropriation of labor. Dussel examines Marx's early writings on religion and fetishism and proceeds through what Dussel refers to as the four major drafts of Capital, ultimately situating Marx's philosophical, economic, ethical, and historical insights in (...) relation to the theological problems of his time. Dussel notes a shift in Marx's underlying theological schema from a political critique of the state to an economic critique of the commodity fetish as the Devil, or anti-God, of modernity. Marx's thought, impact, and influence cannot be fully understood without Dussel's historic reinterpretation of the theological origins and implications of Marx's critiques of political economy and politics. Witnessing is an increasingly important theme in the work of Jean-Luc Marion. According to Marion, the witness can be considered an appropriate figure to define the first person, the “I,” without reducing it to subjectivism and without envisaging the intersubjective tie as binary, inasmuch as the testimony refers instead to a ternary relation. The present analysis investigates the difference Marion identifies between the religious witness and what seems to be, according to common sense, the regular witness. While in the latter (...) case, the subject is completely foreign to the event to which s/he testifies, in the case of the religious witness, the commitment is total. We will tackle this difference by showing that the fact of testifying always implies a connection with effectivity, which reveals itself through the profound commitment characterizing the witness’s life, up to the point of death. This becomes obvious when considering the role played by the witness’s confessing speech, which establishes an unsurpassable ternary relationship between the witness, the object of the testimony, and the one to whom it is addressed, by deploying an absolute form of the social bond. Attempts to lay a foundation for the sciences based on modern mathematics are questioned. In particular, it is not clear that computer science should be based on set-theoretic mathematics. Set-theoretic mathematics has difficulties with its own foundations, making it reasonable to explore alternative foundations for the sciences. The role of computation within an alternative framework may prove to be of great potential in establishing a direction for the new field of computer science.Whitehead''s theory of reality is re-examined as a foundation (...) for the sciences. His theory does not simply attempt to add formal rigor to the sciences, but instead relies on the methods of the biological and social sciences to construct his world-view. Whitehead''s theory is a rich source of notions that are intended to explain every element of experience. It is a product of Whitehead''s earlier attempt to provide a mathematical foundation for the physical sciences and is still consistent with modern physics. (shrink)

The aim of this paper is to offer a broad characterization of the kind of account that I believe cannot plausibly face conclusively the problem of the ethics of immigration restrictions in a non-ideal world at the level of the constitutional essentials. I argue that justice-based accounts of immigration controls fail to normatively evaluate what immigration controls do to outsiders subjected to them in non-ideal conditions, so judgments of justice by themselves tend to be overall bad for the interest of (...) immigrants. I explain this by insisting that a prior question about the legitimacy of immigration controls have been overlooked by familiar accounts. A full account of the ethics of immigration suitable for guiding constitutional essentials should be able to connect distinct kinds of justice-based evaluations in order to ask both, what legitimacy requires from territorial institutional control as well as what justice requires from immigration policy. En este artículo abordaremos el conocimiento divino de las posibles creaturas, preguntándonos si el Doctor Sutil le atribuye a su ser inteligible, esse intelligibile, algún tipo de realidad ontológica. En discusión con la interpretación de quien fue su secretario, Guillermo de Alnwick, argumentaremos (...) que Escoto se refiere, con aquella expresión, al contenido semántico de la intelección sin ningún compromiso ontológico. La inestable relación entre el papado romano y la monarquía francesa desde finales del siglo XIII continuando las primeras décadas del siglo XIV ha sido ocasión propicia para el desarrollo de teorías políticas y la profundización en el estudio de las relaciones entre poder temporal y espiritual. Esta investigación tiene como objetivos principales determinar la posición de Duns Escoto sobre algunos elementos clave de teoría política, como lo son el origen de la sociedad y la autoridad, así como el papel (...) que desempeña la propiedad privada alrededor de estas cuestiones. Nos interesa enmarcar las ideas políticas en conexión con las grandes doctrinas de su filosofía y el debate histórico que vivió él mismo, para poder indagar acerca de su posición en este. De este análisis surgirá que la propiedad privada no es absoluta, la potestad de la autoridad civil es otorgada por la comunidad, puesto que la sociabilidad es anterior a la politicidad y su inclinación contraria a las ideas teocráticas a favor de la separación de los poderes espiritual y temporal. The subject of causality appears in many of the solutions proposed by Duns Scotus on various philosophical problems, such as voluntary act, and theological problems, as the divine dispensation of grace in the sacraments. This paper shows the kinds of causes and causality which are involved in the actual act of intellection. It focuses on the concept of essential order as the source of the different kinds of causal concurrence, and applies this concept to the act of actual intellection, interpreting (...) it according to the idea of unitas ordinis. Los objetivos de este trabajo son dos: determinar el alcance y la modalidad en que la potentia Dei actúa sobre el mundo natural según el Doctor Sutil y resolver una posible inconsistencia cuando este (...) pensador analiza la capacidad del homo viator para alcanzar certeza en el conocimiento experiencial.John Duns Scotus molds his philosophical thought from a Christian perspective, in which an omnipotent divine action creates and preserves creatures. All what the creator produces ad extra is contingent, so whatever is added to physical reality belongs to an ontological and operational level. This paper aims to determine the extent and manner in which, according to the Doctor Subtilis, the potentia Dei operates on the natural world and to resolve a possible inconsistency when Scotus analyzes the ability of the homo viator to achieve certainty in the experiential knowledge.
