BackgroundThe theory and practice of ethics consultations (ECs) in health care are still characterized by many controversies, including, for example, the practice of giving recommendations. These controversies are complicated by an astonishing lack of evidence in the whole field. It is not clear how often a recommendation is issued in ethics consultations and when and why this step is taken. Especially in a facilitation model in which giving recommendations is optional, more data would be helpful to evaluate daily practice, ensure (...) that this practice is in line with the overarching goals of this approach and support the development of standards.MethodsWe analyzed all consultations requested from an EC service working under a facilitation approach at a maximum-care university hospital in Germany over a period of more than 10 years. Our aim was to better understand why—and under what circumstances—some consultation requests result in a recommendation, whereas others can be sufficiently addressed solely by facilitated meetings. We especially wanted to know when and why clients felt the need for clear advice from the EC service while in other cases they did not. We compared ethics consultations in terms of the differences between cases with and without recommendations issued by the ethics consultants using χ2 difference tests and Welch’s t-test.ResultsA total of 243 ECs were carried out between September 2008 and December 2019. In approximately half of the cases, a recommendation was given. All recommendations were issued upon the request of clients. When physicians asked for an EC, the consultation was significantly more likely to result in a recommendation than when the EC was requested by any other party. ECs in cases on wards with ethics rounds resulted in comparably fewer recommendations than those in wards without ethics rounds. When interpersonal conflicts were part of the problem or relatives were present in the meeting, clients less frequently asked for a recommendation.ConclusionFrom the client’s point of view, there does not seem to be only one “right” way to provide ethics consultations, but rather several. While facilitated meetings are obviously appreciated by clients, there also seem to be situations in which a recommendation is desired (especially by physicians). Further empirical and theoretical research is needed to validate our single-center results and re-evaluate the role of recommendations in ethics consultations. (shrink)

BackgroundEthics consultation is recognized as an opportunity to share responsibility for difficult decisions in prenatal medicine, where moral intuitions are often unable to lead to a settled decision. It remains unclear, however, if the general standards of ethics consultation are applicable to the very particular setting of pregnancy.Main textWe sought to analyze the special nature of disagreements, conflicts and value uncertainties in prenatal medicine as well as the ways in which an ethics consultation service (ECS) could possibly respond to them (...) and illustrated our results with a case example. Ethics facilitation and conflict mediation, currently, have no broadly consented normative framework encompassing prenatal diagnosis and therapy as well as reproductive choice to draw on. Even so, they can still be helpful instruments for ethically challenging decision-making in prenatal medicine provided two additional rules are respected: For the time being, ECSs should (a) refrain from issuing content-heavy recommendations in prenatal medicine and (b) should not initiate conflict mediations that would involve the pregnant woman or couple as a conflict party.ConclusionIt seems to be vital that ethics consultants as well as health care professionals acknowledge the current limitations and pitfalls of ethics consultation in prenatal medicine and together engage in the advancement of standards for this particularly complex setting. Clinical ethics support services are experiencing a phase of flourishing and of growing recognition. At the same time, however, the expectations regarding the acceptance and the integration of traditional CES services into clinical processes are not met. Ethics rounds as an additional instrument or as an alternative to traditional clinical ethics support strategies might have the potential to address both deficits. By implementing ethics rounds, we were able to better address the needs of the clinical sections and to develop a (...) more comprehensive account of ethics quality in our hospital, which covers the level of decisions and actions, and also the level of systems and processes and aspects of ethical leadership. Bunnik and colleagues argued that financial barriers do not promote informed decision-making prior to prenatal screening and raise justice concerns. If public funding is provided, however, it would seem to be important to clarify its intentions and avoid any unwarranted appearance of a medical utility of the testing.

Das Gendiagnostikgesetz verbietet seit 2010 die pränatale Diagnostik spätmanifestierender Erkrankungen GenDG). In seiner Begründung bezog sich der Gesetzgeber in Analogie zu internationalen Empfehlungen für den pädiatrischen Bereich vor allem auf das Recht des heranwachsenden Kindes bzw. des späteren Erwachsenen auf Nichtwissen. Mit diesem gesetzlichen Verbot hat Deutschland einen viel diskutierten Sonderweg in der Regulierung genetischer Pränataldiagnostik eingeschlagen. Seither jedoch hat sich nicht nur die Perspektive auf prädiktive Testungen im Kindesalter verändert. In zunehmendem Maße generieren auf das gesamte Genom abzielende Diagnostikangebote (...) auch andere vorgeburtlich genetische Informationen, die – in ähnlicher Weise wie diejenigen zu spätmanifestierenden Erkrankungen eine potenzielle Gefahr für das Recht auf Nichtwissen der späteren Person darstellen. Es soll daher im Rahmen dieses Beitrages überprüft werden, inwiefern das deutsche Diagnostikverbot und dessen Bezug auf das Recht auf Nichtwissen des späteren Kindes eine tragfähige Basis zur Regulierung gendiagnostischer Untersuchungen in der Pränatalmedizin insgesamt darstellt bzw. zukünftig darstellen kann.Untersucht wird der Argumentationsgang des Diagnostikverbotes im Hinblick auf spätmanifestierende Erkrankungen vor dem Hintergrund der Entwicklungen in der prädiktiven Diagnostik. Eine Analyse des normativen Begründungsrahmens zeigt, dass nach wie vor deutlicher Klärungsbedarf hinsichtlich der philosophisch-ethischen Fundierung wie auch hinsichtlich der Interpretation eines Rechts auf Nichtwissen eines Kindes im Kontext von genetischer Diagnostik besteht. Darüber hinaus müssen auch Interessen des Kindes an eventuell möglich werdender pränataler Behandlung oder Prävention von Erkrankungen in die Abwägung miteinbezogen werden.Um zukünftigen Herausforderungen genomischer Pränataldiagnostik und -therapie begegnen zu können, müsste dringend geklärt werden, inwiefern Rechte zukünftiger Personen tatsächlich in der speziellen Situation der Schwangerschaft relevant sein können und mit welchen Pflichten diese für den Gesetzgeber, aber insbesondere auch für zukünftige Eltern und Ärzte einhergehen. Der Menschenrechtsdiskurs könnte hierfür eine tragfähige Basis und hilfreiche Strategien liefern. (shrink)

Due to new developments in prenatal testing and therapy the fetus is increasingly visible, examinable and treatable in prenatal care. Accordingly, physicians tend to perceive the fetus as a patient and understand themselves as having certain professional duties towards it. However, it is far from clear what it means to speak of a patient in this connection. This volume explores the usefulness and limitations of the concept of ¿fetal patient¿ against the background of the recent seminal developments in prenatal or (...) fetal medicine. It does so from an interdisciplinary and international perspective. Featuring internationally recognized experts in the field, the book discusses the normative implications of the concept of ¿fetal patient¿ from a philosophical-theoretical as well as from a legal perspective. This includes its implications for the autonomy of the pregnant woman as well as its consequences for physician-patient-interactions in prenatal medicine. (shrink)

Die in den vergangenen Monaten auf den Weg gebrachten Initiativen zur Änderung des Schwangerschaftskonfliktgesetzes in Deutschland betonen den grundsätzlichen Stellenwert der Schwangerenberatung vor und nach Pränataldiagnostik und damit auch die Bedeutung der Entscheidung der Schwangeren. Vorstellbar und zum Teil auch bereits eingerichtet sind darüber hinaus Beratungsstrukturen für die in einen Abbruch involvierten Ärzte. Die vorliegende Arbeit untersucht die Möglichkeiten und Grenzen von Beratung für die Schwangere wie auch für die beteiligten Ärzte bei (späten) Schwangerschaftsabbrüchen. Die umfassende Beratung der Schwangeren kann (...) sowohl der Sicherung selbstbestimmter Entscheidungen als auch dem Schutz des ungeborenen Lebens dienen. Die hypothetisch-stellvertretenden Entscheidungen der zur Arztberatung eingerichteten Kommissionen aber lassen nicht nur Zweifel an ihrer Legitimation, sondern ebenso an dem grundsätzlichen Umgang mit der medizinischen Indikation aufkommen. Gesetzesinitiativen in diesem Bereich müssen sich deshalb auch mit der medizinischen Indikation befassen, wenn eine umfassende und konsequente Regelung angestrebt wird. (shrink)

Background While most countries that allow abortion on women’s request also grant physicians a right to conscientious objection (CO), this has proven to constitute a potential barrier to abortion access. Conscientious objection is regarded as an understudied phenomenon the effects of which have not yet been examined in Germany. Based on expert interviews, this study aims to exemplarily reconstruct the processes of abortion in a mid-sized city in Germany, and to identify potential effects of conscientious objection. Methods Five semi-structured interviews (...) with experts from all instances involved have been conducted in April 2020. The experts gave an insight into the medical care structures with regard to abortion procedures, the application and manifestations of conscientious objection in medical practice, and its impact on the care of pregnant women. A content analysis of the transcribed interviews was performed. Results Both the procedural processes and the effects of conscientious objection are reported to differ significantly between early abortions performed before the 12th week of pregnancy and late abortions performed at the second and third trimester. Conscientious objection shows structural consequences as it is experienced to further reduce the number of possible providers, especially for early abortions. On the individual level of the doctor-patient relationship, the experts confirmed the neutrality and patient-orientation of the vast majority of doctors. Still, it is especially late abortions that seem to be vulnerable to barriers imposed by conscientious objection in individual medical encounters. Conclusion Our findings indicate that conscientious objection possibly imposes barriers to both early and late abortion provision and especially in the last procedural steps, which from an ethical point of view is especially problematic. To oblige hospitals to partake in abortion provision in Germany has the potential to prevent negative impacts of conscientious objection on women’s rights on an individual as well as on a structural level. Lebensjahres ausbrechen. In diesem Beitrag möchten wir Hinweise zur differenzierten Diskussion dieser in § 15 GenDG bestimmten Verbotsnorm liefern. (...) Obgleich Argumente, insbesondere das Recht auf Nichtwissen des geborenen Kindes, für ein solches Verbot sprechen, kommen wir aufgrund der medizinischen Sachlage und nach einer Analyse der Pro- und Kontraargumente aus ethischer und rechtlicher Sicht zu dem Schluss, dass ein generelles Verbot der pränatalen Diagnostik spätmanifestierender Erkrankungen im Sinne der Zielsetzung womöglich insuffizient ist sowie in der Begründung Inkonsistenzen zum bereits bestehenden Regelwerk aufweist, und lenken daher den Blick auf unter Umständen bessere Alternativen. Termination of pregnancy after a certain gestational age and following prenatal diagnosis, in many nations seem to be granted with a special status to the extent that they by law have to be discussed within a predominantly medical context and have physicians as third parties involved in the decision-making process (‘indication-based’ approach). The existing legal frameworks for indication-based approaches, however, do frequently fail to provide clear guidance for the involved physicians. Critics, therefore, asked for professional ethics and professional institutions in (...) order to provide normative guidance for the physicians in termination of pregnancy on medical grounds. After outlining the clinical pathway in an indication-based approach and the involved types of (clinical) judgements, this paper draws upon different understandings of professional ethics in order to explore their potential to provide normative guidance in termination of pregnancy on medical grounds. The analysis reveals that professional ethics will not suffice—neither as a set of established norms nor as internal morality—in order to determine the normative framework of indication-based approaches on termination of pregnancy. In addition, there seem to be considerable inconsistencies regarding the target and outcome between prenatal testing on the one hand and following termination of pregnancy on the other hand. A source of morality external to medicine has to be the basis of evaluation if a consistent and workable normative framework for termination of pregnancy and prenatal testing should be established. Prenatal care and the practice of prenatal genetic testing are about to be changed fundamentally. Due to several ground-breaking technological developments prenatal screening and diagnosis (PND) will soon be offered earlier in gestation, with less procedure-related risks and for a profoundly enlarged variety of targets. In this paper it is argued that the existing normative framework for prenatal screening and diagnosis cannot answer adequately to these new developments. In concentrating on issues of informed consent and the reproductive autonomy of the (...) pregnant women the ethical debate misses problems related to the clinical pathway as a whole and to implicit normative attributions to clinical actions or the function of health care professionals. If, however, ethical debate would focus on the clinical context and on the ends of PND to a larger extent, it would be able to provide a more comprehensive analysis of the ethical challenges especially of the new technologies in order to be more adequately prepared for their implementation. Obgleich Argumente, insbesondere das Recht auf Nichtwissen des geborenen Kindes, für ein solches Verbot sprechen, kommen wir aufgrund der medizinischen Sachlage und nach einer Analyse der Pro- und Kontraargumente aus ethischer und rechtlicher Sicht zu dem Schluss, dass ein generelles Verbot der pränatalen Diagnostik spätmanifestierender Erkrankungen im Sinne der Zielsetzung womöglich insuffizient ist sowie in der Begründung Inkonsistenzen zum bereits bestehenden Regelwerk aufweist, und lenken daher den Blick auf unter Umständen bessere Alternativen. Freiwilligkeit, personale Identität (im Sinne eines harmonisch verfassten und stabilen Selbst) und epistemische Gewissheit sind bei den meisten antiken Philosophieschulen untrennbar miteinander verbunden und garantieren im Rahmen einer als Lebenskunst verstandenen Philosophie das Glück. Im Anlehnung an Überlegungen bei Aristoteles und dem zeitgenössischen Philosophen Peter Bieri analysieren wir, wie Entscheidungen, die zum Zeitpunkt ihres Treffens als bedingt frei und selbstbestimmt wahrgenommen wurden, im Nachhinein vom Han-delnden aufgrund des damals fehlenden Wissens über die Handlungsumstände als unfrei wahrgenommen werden und zu Erfahrungen (...) der Selbstentfremdung führen können. Anknüpfend an Pamela Hieronymis Unterscheidung zwischen zwei Formen der Ausübung mentaler Freiheit zeigen wir anhand von fiktiven Fallbeispielen, wie die Protagonisten trotz epistemischer Ungewissheit zur Autorität über ihren Geist sowie zu einer funktionalen Selbstbeziehung zurückfinden können, und stellen dies in den Kontext einer zeitgenössischen Philosophie als Lebenskunst. Dissident circles during the Czechoslovak communist regime were organized in semi-private islands of resistance. They saw themselves as a parallel polis in line with Arendt’s notion of political action by pursuing “life in truth,” authentic experience, and ultimately freedom. The heroes of these circles were that society’s pariahs. In their quest for authenticity, they turned to the past to find meaning, to understand the nature of their communities and the needs for political action towards the future. As such, they sought (...) what Heidegger would label authentic public interpretations. After 1989, these heroes shaped and adapted to the constitutional design of the new polis and often experienced a transformation from pariah to inauthentic hero to at least the potential to become strong man, maintaining varying degrees of authenticity. A perceptual realism that is naive in a good way must be naively realistic about world and mind. But contemporary self-described naive realists often have trouble acknowledging that both the good cases of successful perception and the bad cases of illusion and hallucination involve internal experiential states with intentional contents that present the world as being a certain way. They prefer to think about experience solely in relational terms because they worry that otherwise we won’t be able to escape from (...) radical skepticism. I argue that experiential relations to objects require that their subjects be in internal experiential states. But this does not mean that these states are our epistemological starting point which can be known independently of any knowledge of the external world. We do escape the epistemological predicament of radical skepticism because the good cases are primary over the bad ones. But this is not because the good cases alone provide reasons for belief, but because we do not need a reason to think we are in a good case, but do need a reason to think we are not, and such a reason must come from a good case. So bad cases can only be thought of as deviations from good cases. And we can only understand experiences as states with contents distinct from their objects and present in good and bad cases once we understand misrepresentation, that is, bad cases, and therefore only as we ascribe knowledge of the external world to ourselves. Although big-data research has met with multiple controversies in diverse fields, political and security implications of big data in life sciences have received less attention. This paper explores how threats and risks are anticipated and acted on in biobanking, which builds research repositories for biomedical samples and data. Focusing on the biggest harmonisation cluster of biomedical research in Europe, BBMRI-ERIC, the paper analyses different logics of risk in the anticipatory discourse on biobanking. Based on document analysis, interviews with ELSI experts, (...) and field research, three types of framing of risk are reconstructed: data security, privacy, and data misuse. The paper finds that these logics downplay the broader social and political context and reflects on the limits of the practices of anticipatory governance in biobanking. It argues that this regime of governance can make it difficult for biobanks to address possible future challenges, such as access to biomedical data by authorities, pressures for integrating biobank data with other type of personal data, or their use for profiling beyond medical purposes. To address potential controversies and societal implications related to the use of big data in health research and medicine, the paper suggests to expand the vocabulary and practices of anticipatory governance, in the biobanking community and beyond. Dazu bedarf es der Besinnung des Menschen auf sein Sichfinden in seiner Umgebung. Das ist Philosophie. Sie wird aber kompliziert durch zwei Wege der Bekanntschaft des Menschen mit sich selbst. Einerseits ist es die Bekanntschaft mit den objektiven Tatsachen, deren Zuschreibung an den Menschen unsicher und zufallig ist. Unzweifelhaft und notwendig ist dagegen die Begegnung des Menschen mit sich selbst auf dem anderen Weg, im affektiven Betroffensein, denn er wird gleichsam auf sich gestossen, wenn ihm etwas nahe geht. Es sind diese subjektiven Tatsachen, die Hermann Schmitz von den objektiven abhebt und philosophisch entfaltet, wobei er zeigt, warum Idealismus - einschliesslich existentialistischer Ansatze - und Realismus - mit seinen Fortsetzungen Nominalismus, Positivismus, Konstruktivismus - ihre Ziele verfehlen.
