Topic modeling—a text‐mining technique often used to uncover thematic structures in large collections of texts—has been increasingly frequently used in the context of the analysis of scholarly output. In this study, we construct a corpus of 19,488 texts published since 1971 in seven leading journals in the field of bioethics and philosophy of medicine, and we use a machine learning algorithm to identify almost 100 topics representing distinct themes of interest in the field. On the basis of intertopic correlations, we (...) group the content‐based topics into eight clusters, thus providing a novel, fine‐grained intellectual map of bioethics and philosophy of medicine. Moreover, we conduct a number of diachronic analyses, examining how the “prominence” of different topics has changed across time. In this way, we are able to observe the distinct patterns in which bioethics and philosophy of medicine have evolved and changed their focus over the past half a century. (shrink)

The notion that a false positive (false conviction) is worse than a false negative (false acquittal) is a deep-seated commitment in the theory of criminal law. Its most illustrious formulation, the so-called Blackstone’s ratio, affirms that “it is better that ten guilty persons escape than that one innocent suffer”. Are people’s evaluations of criminal statutes consitent with this tenet of the Western legal tradition? To answer this question, we conducted three experiments (total _N_ = 2492) investigating how people reason about (...) a particular class of offenses—proxy crimes—known to vary in their specificity and sensitivity in predicting actual crime. By manipulating the extent to which proxy crimes convict the innocent and acquit those guilty of a target offense, we uncovered evidence that attitudes toward proxy criminalization depend primarily on its propensity toward false positives, with false negatives exerting a substantially weaker effect. This tendency arose across multiple experimental conditions—whether we matched the rates of false positives and false negatives or their frequencies, whether information was presented visually or numerically, and whether decisions were made under time pressure or after a forced delay—and was unrelated to participants’ probability literacy or their professed views on the purpose of criminal punishment. Despite the observed inattentiveness to false negatives, when asked to justify their decisions, participants retrospectively supported their judgments by highlighting the proxy crime’s efficacy (or inefficacy) in combating crime. These results reveal a striking inconsistency: people favor criminal policies that protect the rights of the innocent, but report comparable concern for their expediency in fighting crime. (shrink)

This paper discusses differences between two major schools in philosophy of criminal law, retributivism and consequentialism, with regard to the risk of punishing the innocent. As it is argued, the main point of departure between these two camps in this respect lies in their attitude towards the high evidentiary threshold in a criminal trial: while retributivism seems to strongly support setting this standard high, consequentialists may find it desirable to relax it in some cases. This discussion is set in the (...) context of proxy criminalization, i.e. a situation, in which some suspicious behaviour is criminalized. Since proxy criminalization may be understood as an effective lowering of the evidentiary threshold, its employment is justifiable from the consequentialist perspective, while being highly problematic for the retributivists. Blumenthal-Barby and her colleagues (2022) situate their discussion of philosophy and bioethics in the context of (reportedly) widely held assumption that, when compared to the early days of bioethics, the role of philosophy is now diminished across the field – the assumption we call the Disconnection Thesis. This assumption can be summarized, to use the authors’ own words, by the phrase “philosophy’s glory days in bioethics are over“. While in no place of the article they explicitly endorse the Disconnection Thesis, (...) at least some of the authors had previously endorsed it in print (Savulescu 2015). Such expressions of collective expert wisdom might be a valuable source of information on the discipline's history, but they should not be accepted uncritically. Given the explosion in the size and scope of bioethical research in recent decades, any scholar’s familiarity with the area is necessarily based on selective reading and might be biased. Hence, in this commentary, we examine what kind of more rigorous evidence could corroborate the Disconnection Thesis. In other words, if the role of philosophy in bioethics has been indeed diminishing, what kind of observable patterns should we expect to see? Drawing on our previous research (Bystranowski, Dranseika, Żuradzki 2022), here we focus on two useful perspectives: citation analysis and topic modeling. While the first approach allows us to indirectly measure the level of engagement of bioethicists with philosophical literature (by measuring the proportion of references from articles published in journals in bioethics that cite philosophy journals), the latter provides a window into the content and argumentative style of bioethical texts. Recent literature in experimental philosophy has postulated the existence of the abstract/concrete paradox : the tendency to activate inconsistent intuitions depending on whether a problem to be analyzed is framed in abstract terms or is described as a concrete case. One recent study supports the thesis that this effect influences judicial decision-making, including decision-making by professional judges, in areas such as interpretation of constitutional principles and application of clear-cut rules. Here, following the existing literature in legal theory, we argue that (...) the susceptibility to such an effect might depend on whether decision-makers operate in a legal system characterized by the formalist or particularist approach to legal interpretation, with formalist systems being less susceptible to the effect. To test this hypothesis, we compare the results of experimental studies on ACP run on samples from two countries differing in legal culture: Poland and Brazil. The lack of significant differences between those results suggests that ACP is a robust effect in the legal context. (shrink)

Despite pervasive variation in the content of laws, legal theorists and anthropologists have argued that laws share certain abstract features and even speculated that law may be a human universal. In the present report, we evaluate this thesis through an experiment administered in 11 different countries. Are there cross‐cultural principles of law? In a between‐subjects design, participants (N = 3,054) were asked whether there could be laws that violate certain procedural principles (e.g., laws applied retrospectively or unintelligible laws), and also (...) whether there are any such laws. Confirming our preregistered prediction, people reported that such laws cannot exist, but also (paradoxically) that there are such laws. These results document cross‐culturally and –linguistically robust beliefs about the concept of law which defy people's grasp of how legal systems function in practice. (shrink)

A cross-cultural survey experiment revealed a widespread tendency to rely on a rule’s letter over its spirit when deciding which acts violate the rule. This tendency’s strength varied markedly across (k = 15) field sites, owing to cultural variation in the impact of moral appraisals on judgments of rule violation. Compared to laypeople, legal experts were more inclined to disregard their moral evaluations of the acts altogether, and consequently exhibited more pronounced textualist tendencies. Finally, we evaluated a plausible mechanism for (...) the emergence of textualism: In a two-player coordination game, incentives to coordinate in the absence of communication reinforced participants’ adherence to rules’ literal meaning. Together, these studies (Ntotal = 5495) help clarify the origins and allure of textualism, especially in the law. Within heterogeneous communities in which members diverge in their moral appraisals involving a rule’s purpose, the rule’s literal meaning provides a clear focal point—an easily identifiable point of agreement enabling coordinated interpretation among citizens, lawmakers and judges. This article focuses on Bob Zajonc’s views on unconscious emotion, especially in the context of the debates about the independence of affect and cognition. Historically, Bob was always interested in the “mere”—basic, fundamental processes. His empirical demonstrations of precognitive and preconscious emotional processes, combined with his elegant expositions of them, sharply contrasted with cold and complex cognitive models. Interestingly, Bob tended to believe that whereas the causes of emotion can be unconscious, the emotional state itself tends to be conscious. However, (...) he reconsidered this assumption and in his later work showed that subjects in affective priming experiments do not experience conscious affect, but instead act on basic preferences. Today, Bob’s insights continue to inspire research on “unconscious emotion.”. (shrink)

Predictive processing (PP) has been repeatedly presented as a unificatory account of perception, action, and cognition. In this paper, we argue that this is premature: As a unifying theory, PP fails to deliver general, simple, homogeneous, and systematic explanations. By examining its current trajectory of development, we conclude that PP remains only loosely connected both to its computational framework and to its hypothetical biological underpinnings, which makes its fundamentals unclear. Instead of offering explanations that refer to the same set of (...) principles, we observe systematic equivocations in PP‐based models, or outright contradictions with its avowed principles. To make matters worse, PP‐based models are seldom empirically validated, and they are frequently offered as mere just‐so stories. The large number of PP‐based models is thus not evidence of theoretical progress in unifying perception, action, and cognition. On the contrary, we maintain that the gap between theory and its biological and computational bases contributes to the arrested development of PP as a unificatory theory. Thus, we urge the defenders of PP to focus on its critical problems instead of offering mere re‐descriptions of known phenomena, and to validate their models against possible alternative explanations that stem from different theoretical assumptions. Otherwise, PP will ultimately fail as a unified theory of cognition. (shrink)

Teologia już niejednokrotnie składała współczesnej myśli filozoficznej obietnicę poszerzenia horyzontów czy też otwarcia jej na transcendencję. Jednak obietnica ta nie spotkała się – jak dotąd – z przychylnym przyjęciem, gdyż teologia sama nie zdołała przekonać filozofii o swojej racjonalności. Filozofia przestała być bowiem, z jednej strony, wrażliwa na argumentację natury metafizycznej, z drugiej zaś, teologia jest skłonna poddawać się metodologiom nauk szczegółowych, rezygnując przy tym z własnej odrębności. Zarysowana tu hermeneutyka teologii jest w pierwszym rzędzie badaniem teologii jako nauki, próbą (...) uprawomocnienia jej na gruncie jednego z najważniejszych kierunków filozofii współczesnej, mianowicie hermeneutyki filozoficznej. Teologia zostaje tu ujęta w aspekcie immanencji, choć bynajmniej nie zamyka się w jej horyzoncie. Dziejący się świat teologii rozpada się na „kawałki” – miejsca teologiczne – które jednak wchodząc ze sobą w interakcje, uczestniczą w grze teologicznej. Jako pole owej gry zostaje wskazana liturgia, miejsce metodologicznie wyróżnione ze względu na naoczność dokonujących się konsekwencji gry teologicznej. Analiza czerpie z takich źródeł jak teoria miejsc teologicznych Melchiora Cano OP, koncepcja kręgu hermeneutycznego Martina Heideggera oraz projekt hermeneutyki filozoficznej Hansa-Georga Gadamera, ze szczególnym uwzględnieniem roli prze(d)sądów, utożsamianych tutaj z miejscami teologicznymi. Nowość spojrzenia na tradycję katolicką kontekście myśli hermeneutycznej sprawia, że prezentowana książka może trafić nie tylko do teologów i filozofów, ale także do badaczy szeroko rozumianej kultury. This book is a manifesto of reformed Stoicism. It proposes a system of life which is bullet-proof, universal, viable and effective in every cosmic setting. It holds in every possible universe, under any government and within any economic system. We can be reformed Stoics no matter what we believe in. Reformed Stoicism is about enjoying and exercising our agency. In other words, it's about the flow of making autonomous and right decisions, and about celebrating our ability to make them. With (...) no reliance on nature, with the recalibration of metaphysical positions, with skepticism towards grand discourses and universal answers, with an emphasis on the usefulness instead of truthfulness of narratives, with no reference to the vanity argument, with criticism of both conservative and ascetic misinterpretations of Stoicism, with an overall softer and more empathic approach, we can no longer be defined by the generic term "Stoicism". Our time, in short, calls for a fresh interpretation of Stoicism. It is time for a new generation of Stoics. Thus: reformed Stoicism. (shrink)

Spanning the period between Wittgenstein's return to Cambridge in 1929 and the first version of Philosophical Investigations in 1936, Piotr Dehnel explores the middle stage in Ludwig Wittgenstein's philosophical development and identifies the major issues which engrossed him, including phenomenology, philosophy of mathematics and philosophy of language. Contrary to the dominant perspective, Dehnel argues that this period was intrinsically different from the early and late stages and should not be viewed as a mere transitional phase. The distinctiveness of Wittgenstein's (...) middle work can be seen in his philosophical thinking as it unfolds in a non-linear trajectory: thoughts do not follow upon each other, ideas do not appear sequentially one by one, and insights do not form a straight chain. Dehnel portrays the diffused and multifarious quality of Wittgenstein's middle thinking, enabling readers to form a more comprehensive view of his entire philosophy and acquire a better grasp of his conceptual trajectory, complete with the intricacies and challenges that it poses. In 2017, Michael Nair-Collins formulated his Transitivity Argument which claimed that brain-dead patients are alive according to a concept that defines death in terms of the loss of moral status. This article challenges Nair-Collins’ view in three steps. First, I elaborate on the concept of moral status, claiming that to understand this notion appropriately, one must grasp the distinction between direct and indirect duties. Second, I argue that his understanding of moral status implicit in the Transitivity Argument is faulty since (...) it is not based on a distinction between direct and indirect duties. Third, I show how this flaw in Nair-Collins’ argument is grounded in the more general problems between preference utilitarianism and desire fulfillment theory. Finally, I present the constructivist theory of moral status and the associated moral concept of death and explain how this concept challenges the Transitivity Argument. According to my view, brain death constitutes a valid criterion of death since brain death is incompatible with the preserved capacity to have affective attitudes and to value anything. (shrink)

Stoicism is coming back in a big way. Seen as a remedy for the craziness of the times we live in, it is experiencing a great surge in academic and cultural interest. Yet, can one live stoically and be a creative artist at the same time? Delving into its underlying tenets, obscure restrictions and limits of applicability, Stankiewicz critically explores Stoicism and its complex association with artistic creativity. The scientific papers published in a special edition of the journal “Scientia et Fides” are the result of an international scientific project titled “The Dynamic Theodicy Model: Understanding God, Evil, and Evolution.” The project leaders are Prof. Piotr Roszak (Nicolaus Copernicus University) and Prof. Saša Horvat (University of Rijeka), under the auspices of the University of Oxford and the John Templeton Foundation. Other members of the project team include Grzegorz Karwasz, Michał Oleksowicz, Tomasz Huzarek, and Jan Wółkowski.

The article presents a thought experiment aimed at indicating a possibility for thinking education beyond the logic of progress. In its first part, the argument reconstructs the entanglement of the modern idea of progress (as found in Francis Bacon and Comenius) and education, while tracking down the specific coupling of obedience and conquest at work. Through such an analysis a link between the ideas of progress and of emancipation is determined, which leads to the acknowledgement of the difficulty of the (...) task of imagining education outside of the logic of progress. In the second part an attempt is made to match this task by suggesting that when studying with a teacher, the logic of progress is deactivated. A phenomenological analysis of the practices involved in studying with a teacher points to a specific way of living together that such a collective study involves. This way of living together is formed by continual exercises in the humble equality realized through shared attention to something worthy of study: this stems from attentiveness to what exists, and it develops an attitude of care and respect for being as such. This interdisciplinary study introduces readers to Friedrich Schleiermacher's diverse pathways of reflection and creative practice that are related to the field of translation. By drawing attention to Schleiermacher's various writings on a range of subjects (including philology, criticism, hermeneutics, dialectics, rhetoric and religion), the author makes it clear that the frequently cited lecture Über die verschiedenen Methoden des Übersetzens (On the Different Methods of Translating) represents but a fraction of Schleiermacher's contributions to modern-day insights into translation. The analysis of Schleiermacher's (...) various pathways of reflection on translation presented in this book leads to the conclusion that translation is part of the essence of the world, as it is a fundamental tool of our cognition and a foundation of our existence. In Schleiermacher's works, transfer, translation, mediation, and communication underpin our very existence in the world and our self-awareness. At the same time, they represent fundamental categories for a project that focuses on the consolidation and assimilation - through translation - of that which is foreign, different, diverse. The predictive processing account of action, cognition, and perception is one of the most influential approaches to unifying research in cognitive science. However, its promises of grand unification will remain unfulfilled unless the account becomes theoretically robust. In this paper, we focus on empirical commitments of PP, since they are necessary both for its theoretical status to be established and for explanations of individual phenomena to be falsifiable. First, we argue that PP is a varied research tradition, which may employ (...) various kinds of scientific representations, differing in the scope of empirical commitments they entail. Two major perspectives on PP qua cognitive theory may then be distinguished: generalized vs. hierarchical. The first one fails to provide empirical detail, and the latter constrains possible physical implementations. However, we show that even hierarchical PP is insufficiently restrictive to disallow incorrect models and may be adjusted to explain any neurocognitive phenomenon–including non-existent or impossible ones–through flexible adjustments. This renders PP a universal modeling tool with an unrestricted number of degrees of freedom. Therefore, in contrast with declarations of its proponents, it should not be understood as a unifying theoretical perspective, but as a computational framework, possibly informing further theory development in cognitive science.
