  1. Transformative Choice and Decision-Making Capacity.Isra Black, Lisa Forsberg & Anthony Skelton - 2023 - Law Quarterly Review 139 (4):654-680.
This article is about the information relevant to decision-making capacity in refusal of life-prolonging medical treatment cases. We examine the degree to which the phenomenology of the options available to the agent—what the relevant states of affairs will feel like for them—forms part of the capacity-relevant information in the law of England and Wales, and how this informational basis varies across adolescent and adult medical treatment cases. We identify an important doctrinal phenomenon. In the leading authorities, the courts appear to (...)

  2. Would it be ethical to use motivational interviewing to increase family consent to deceased solid organ donation?Isra Black & Lisa Forsberg - 2014 - Journal of Medical Ethics 40 (1):63-68.
We explore the ethics of using motivational interviewing, an evidence-based, client-centred and directional counselling method, in conversations with next of kin about deceased solid organ donation. After briefly introducing MI and providing some context around organ transplantation and next of kin consent, we describe how MI might be implemented in this setting, with the hypothesis that MI has the potential to bring about a modest yet significant increase in next of kin consent rates. We subsequently consider the objection that using (...)

  3. Overriding Adolescent Refusals of Treatment.Anthony Skelton, Lisa Forsberg & Isra Black - 2021 - Journal of Ethics and Social Philosophy 20 (3):221-247.
Adolescents are routinely treated differently to adults, even when they possess similar capacities. In this article, we explore the justification for one case of differential treatment of adolescents. We attempt to make philosophical sense of the concurrent consents doctrine in law: adolescents found to have decision-making capacity have the power to consent to—and thereby, all else being equal, permit—their own medical treatment, but they lack the power always to refuse treatment and so render it impermissible. Other parties, that is, individuals (...)

  4. Adherence to the Request Criterion in Jurisdictions Where Assisted Dying Is Lawful? A Review of the Criteria and Evidence in the Netherlands, Belgium, Oregon, and Switzerland.Penney Lewis & Isra Black - 2013 - Journal of Law, Medicine and Ethics 41 (4):885-898.
Some form of assisted dying (voluntary euthanasia and/or assisted suicide) is lawful in the Netherlands, Belgium, Oregon, and Switzerland. In order to be lawful in these jurisdictions, a valid request must precede the provision of assistance to die. Non-adherence to the criteria for valid requests for assisted dying may be a trigger for civil and/or criminal liability, as well as disciplinary sanctions where the assistor is a medical professional. In this article, we review the criteria and evidence in respect of (...)

Black Rain: The Apocalyptic Aesthetic and the Spectator's Ethical Challenge in (Israeli) Theater.Zahava Caspi - 2013 - Substance 42 (2):141-158.
One feature that classical apocalyptic writings commonly share is their eschatological dimension, their "sense of an ending"1—the end of the world, of time, of humanity. But whereas traditional apocalyptic texts were for the most part utopian, their tales of destruction followed by narratives of redemption, modern secular apocalyptic literature is largely dystopian, ending in pure devastation. According to some scholars, the very arrival of modernity, beginning with Cartesian philosophy and its inherent doubt, was apocalyptic in nature. In the twentieth century, (...)

    (Re)producing the Israeli (European) body: Zionism, Anti-Black Racism and the Depo-Provera Affair.Bayan Abusneineh - 2021 - Feminist Review 128 (1):96-113.
This article examines the Depo-Provera Affair—where Israeli doctors administered the contraceptive Depo-Provera to newly immigrated Ethiopian Jewish women—to argue that the Israeli settler colonial project depends on these forms of gendered anti-Black violence, through the management of Black African bodies. In 2013, then Israeli Deputy Health Minister Yaakov Litzman admitted that they had administered Depo-Provera to Ethiopian immigrant women without their consent, after reproductive and civil rights activists in Israel called for an investigation after a drop in the (...)

Patient Rights and Law: tobacco smoking in psychiatric wards and the Israeli Prevention of Smoking Act.Ilya Kagan, Ronit Kigli-Shemesh, Nili Tabak, Moshe Z. Abramowitz & Jacob Margolin - 2004 - Nursing Ethics 11 (5):472-478.
In August 2001, the Israeli Ministry of Health issued its Limitation of Smoking in Public Places Order, categorically forbidding smoking in hospitals. This forced the mental health system to cope with the issue of smoking inside psychiatric hospitals. The main problem was smoking by compulsorily hospitalized psychiatric patients in closed wards. An attempt by a psychiatric hospital to implement the tobacco smoking restraint instruction by banning the sale of cigarettes inside the hospital led to the development of a black (...)

Body, Gender, and Knowledge in Protest Movements: The Israeli Case.Tamar Rapoport & Orna Sasson-Levy - 2003 - Gender and Society 17 (3):379-403.
The authors suggest that social movements research should recognize more the potential of the protesting body as an agent of social and political change. This contention is based on studying the relations among the body, gender, and knowledge in social protest by comparing two Israeli-Jewish leftist protest movements, a woman-only movement and a mixed-gender one, which protested against the Israeli Occupation in the early 1990s. The comparison reveals reversed patterns of body/knowledge relations, each connoting a different meaning and outcome of (...)

International Relations Theory of War.Ofer Israeli - 2019 - Santa Barbara, CA: Praeger, an imprint of ABC-CLIO, LLC.
This book tries to answer two key questions. The first is why certain periods are more prone to war than others. The other is why certain wars that involve polar powers end with their territorial expansion whereas other wars end in their contraction or maintaining their territorial status. In conclusion, it is asked whether the polarity of the system affects these two outcomes, and if so, how.

Providing an accessible examination of ethics, Doing Ethics in Media, introduces students to ethical theory and provides a grounded discussion of ethics in the context of today's media outlets. Emphasizing the understanding of ethics, the text will help readers 'do ethics' expeditiously, honestly, and efficiently when they enter the workplace and need to make critical ethical decisions on deadline. The text is organized around six decision-making questions, and cases demonstrate the application of these questions to real-world scenarios. Each chapter focuses (...)

To be able to produce and understand metaphorical statements is nothing much to boast about: these familiar skills, which children seem to acquire as they learn to talk, are perhaps no more remarkable than our ability to tell and to understand jokes. How odd then that it remains difficult to explain what we do in grasping metaphorical statements. In a provocative paper, "What Metaphors Mean,"1 Donald Davidson has recently charged many students of metaphor, ancient and modern, with having committed a (...)

The Psychosis of Race offers a unique and detailed account of the psychoanalytic significance of race, and the ongoing impact of racism in contemporary society. Moving beyond the well-trodden assertion that race is a social construction, and working against demands that simply call for more representational equality, The Psychosis of Race explores how the delusions, anxieties, and paranoia that frame our race relations can afford new insights into how we see, think, and understand race's pervasive appeal. With examples drawn from (...)

In _Understanding the Qur’anic Miracle Stories in the Modern Age_, Isra Yazicioglu offers a glimpse of the ways in which meaningful implications have been drawn from these apparently strange narratives, both in the premodern and modern era. It fleshes out a fascinating medieval Muslim debate over miracles and connects its insights with early and late modern turning points in Western (...)
