This article is about the information relevant to decision-making capacity in refusal of life-prolonging medical treatment cases. We examine the degree to which the phenomenology of the options available to the agent—what the relevant states of affairs will feel like for them—forms part of the capacity-relevant information in the law of England and Wales, and how this informational basis varies across adolescent and adult medical treatment cases. We identify an important doctrinal phenomenon. In the leading authorities, the courts appear to (...) count the first-personal phenomenology of the available options among the information that adolescents seeking to refuse life-prolonging treatment must understand and appreciate in order to possess capacity; adults are not held to this (higher) standard. We evaluate this differential treatment in light of philosophical work on transformative choice—decisions involving options whose sensory character, and effect on our values and preferences, are grasped only through experience itself. We explore the ethics of using motivational interviewing, an evidence-based, client-centred and directional counselling method, in conversations with next of kin about deceased solid organ donation. After briefly introducing MI and providing some context around organ transplantation and next of kin consent, we describe how MI might be implemented in this setting, with the hypothesis that MI has the potential to bring about a modest yet significant increase in next of kin consent rates. We subsequently consider the objection that using (...) MI in this context would be manipulative. Although we cannot guarantee that MI would never be used in a problematically manipulative fashion, we conclude that its use would, nevertheless, be permissible as a potential means to increase next of kin consent to deceased solid organ donation. We propose that MI be trialled in consent situations with next of kin in nations where there is widespread public support for organ donation. (shrink)

Adolescents are routinely treated differently to adults, even when they possess similar capacities. In this article, we explore the justification for one case of differential treatment of adolescents. We attempt to make philosophical sense of the concurrent consents doctrine in law: adolescents found to have decision-making capacity have the power to consent to—and thereby, all else being equal, permit—their own medical treatment, but they lack the power always to refuse treatment and so render it impermissible. Other parties, that is, individuals (...) who exercise parental responsibility or a court, retain the authority to consent on an adolescent’s behalf. We explore four defences of the doctrine. We reject two attempts to defend the asymmetry in the power to consent to and refuse medical treatment by reference to transitional paternalism. We then consider and reject a stage of life justification. Finally, we articulate a justification based on the distinctiveness of adolescent well-being. (shrink)

In order to be lawful in these jurisdictions, a valid request must precede the provision of assistance to die. Non-adherence to the criteria for valid requests for assisted dying may be a trigger for civil and/or criminal liability, as well as disciplinary sanctions where the assistor is a medical professional. In this article, we review the criteria and evidence in respect of (...) requests for assisted dying in the Netherlands, Belgium, Oregon, and Switzerland, with the aim of establishing whether individuals who receive assisted dying do so on the basis of valid requests. We conclude that the evidence suggests that individuals who receive assisted dying in the four jurisdictions examined do so on the basis of valid requests and third parties who assist death do not act unlawfully. However, further research on the elements that may undermine the validity of requests for assisted dying is warranted. One feature that classical apocalyptic writings commonly share is their eschatological dimension, their "sense of an ending"1—the end of the world, of time, of humanity. But whereas traditional apocalyptic texts were for the most part utopian, their tales of destruction followed by narratives of redemption, modern secular apocalyptic literature is largely dystopian, ending in pure devastation. This article examines the Depo-Provera Affair—where Israeli doctors administered the contraceptive Depo-Provera to newly immigrated Ethiopian Jewish women—to argue that the Israeli settler colonial project depends on these forms of gendered anti-Black violence, through the management of Black African bodies. In 2013, then Israeli Deputy Health Minister Yaakov Litzman admitted that they had administered Depo-Provera to Ethiopian immigrant women without their consent, after reproductive and civil rights activists in Israel called for an investigation after a drop in the (...) birthrate among Ethiopian women: close to 50 per cent within the previous decade. The demarcation of Blackness as a political tool necessary to advance Israeli modernity and the situating of Black bodies as antithetical to the state of Israel are not contradictory but rather illuminate Israel’s deployment of anti-Blackness through the racial and reproductive violence necessary to become part of the superior, European West. Sundquist terms the "black-Jewish question" (2). In doing so, the book serves as both culmination and corrective to an already-expansive (...) scholarly literature on blacks and Jews generated since the late 1960s. Much of this scholarship has operated within a U.S.-centered paradigm to chart interethnic relations, laboring as it does to unpack, complicate, theorize, and otherwise come to understand the changing texture of black-Jewish relations and, in Sundquist's wods, its "intermixture of empathy, anxiety, and Hostility' (3)." Strangers in the Land stretches this paradigm to its limit, even as the diasporic imaginaries treated therein persistently escape a U.S. national imaginary and signal other possibilities for conceptualizing this tense and tender history.In its five hundred–plus pages of text, one hundred–plus pages of endnotes, and countless detailed footnotes (that are themselves illustrative and evocative), Sundquist has assembled a voluminous archive of textual material to show how works of the imagination by blacks and Jews have been "produced in a dynamic, multilayered historical matrix" that reveals the paradoxes of American liberalism (9). In August 2001, the Israeli Ministry of Health issued its Limitation of Smoking in Public Places Order, categorically forbidding smoking in hospitals. This forced the mental health system to cope with the issue of smoking inside psychiatric hospitals. The main problem was smoking by compulsorily hospitalized psychiatric patients in closed wards. An attempt by a psychiatric hospital to implement the tobacco smoking restraint instruction by banning the sale of cigarettes inside the hospital led to the development of a black (...) market and cases of patient exploitation in return for cigarettes. This article surveys the literature dealing with smoking among psychiatric patients, the role of smoking in patients and the moral dilemmas of taking steps to prevent smoking in psychiatric hospitals. It addresses the need for public discussion on professional caregivers’ dilemmas between their commitment to uphold the law and their duty to act as advocates for their patients’ rights and welfare. The authors suggest that social movements research should recognize more the potential of the protesting body as an agent of social and political change. This contention is based on studying the relations among the body, gender, and knowledge in social protest by comparing two Israeli-Jewish leftist protest movements, a woman-only movement and a mixed-gender one, which protested against the Israeli Occupation in the early 1990s. The comparison reveals reversed patterns of body/knowledge relations, each connoting a different meaning and outcome of (...) the social protest. In the mixed movement, the body served as an instrument in carrying out the political knowledge and thus was left unmarked. To be able to produce and understand metaphorical statements is nothing much to boast about: these familiar skills, which children seem to acquire as they learn to talk, are perhaps no more remarkable than our ability to tell and to understand jokes. How odd then that it remains difficult to explain what we do in grasping metaphorical statements. In a provocative paper, "What Metaphors Mean,"1 Donald Davidson has recently charged many students of metaphor, ancient and modern, with having committed a (...) "central mistake." According to him, there is "error and confusion" in claiming "that a metaphor has, in addition to its literal sense or meaning, another sense or meaning." The guilty include "literary critics like Richards, Empson, and Winters; philosophers from Aristotle to Max Black; psychologists from Freud and earlier to Skinner and later; and linguists from Plato to Uriel Weinreich and George Lakoff." Good company, if somewhat mixed. The error to be extirpated is the "idea that a metaphor has a special meaning" . If Davidson is right, much that has been written about metaphor might well be consigned to the flames. If there is any social organization that has provided a powerful illustration of the permeable boundaries between social politics—defined by Stephen M. Buechler as “forms of collective action that challenge power relations without an explicit focus on the state”—and social movements , and the role of collective identity in transforming either, as defined for women by Betty Friedan—it would be the Israeli kibbutz movement. The research presented here on grassroots Israeli women activists, a significant proportion of whom had grown up (...) or had lived in a kibbutz, suggests that the social politics of everyday life on a kibbutz facilitated women's participation in larger social movements for peace, but also placed constraints on their activism. Many of these women had left or were in the process of leaving the kibbutz between 1989 and 1999, when this research was conducted. Those who had already left, and anchor women who organized urban demonstrations, saw the kibbutz as a conservative anti-woman force. Nonetheless, evidence gathered from qualitative interviewing with them suggests that the kibbutzim supported women who were politically active on national issues. Several women-led social protest movements illustrate how the kibbutz geared its members to think about the interplay of the moral and social orders in the small spaces of everyday life. (shrink)
