ABSTRACT For Victoria Kahn, Hobbes' argument that fear of violent death is “the passion to be reckoned upon” in explaining what inclines men to peace must be interpreted as a mimetic argument. However, Kahn then notes a paradox that makes Hobbes' thinking problematic: whereas love and the desires are appetites that produce an imitative effect, fear is different. Though also a passion, fear lacks that capacity to produce a mimetic effect or, therefore, to generate a contract. My hypothesis is that (...) resolving the dilemma presented in Kahn's interpretation of Hobbes requires a shift in attention from mimesis to rhetoric and, more specifically, to biological rhetoric as defined by Nancy Struever. This approach to Hobbes makes it possible to understand the rhetorical role of fear in generating and maintaining the social contract, and how the problem that Kahn signals—the impotence of fear in relation to mimesis—can be resolved. Benjamin’s Critique of Violence (1921) has been a relevant source of legal and political philosophy about the nature of law, from Derrida to Menke. In this article, we rebuild the reading of Benjamin’s Critique proposed by Menke and consider the appropriateness of violence in the law not as a tragic tension, but as a condition for its reproduction. Finally, we will consider its paradoxical nature as a confirmation of the difference between the force of law and social-normative elements such as (...) recognition [ Anerkennung]. (shrink)

Philosophy & Social Criticism, Volume 48, Issue 6, Page 882-903, July 2022. Indigenous conservation through patrimonialization is the product of political and legal decisions made by a non-indigenous agent: the liberal state, using the law to retain a form of bios. We propose that patrimonialization is the device by which liberal states have processed and integrated indigenous claims into a form of bios ultimately designed to safeguard state legal structures. We argue that, to uphold the rule of law in contexts (...) of struggle and resistance that challenge the very understanding of the law, states respond by wielding the law in the form of the rule by law, that is, pushing the law to the limit to give normative content to the criteria by which the state conducts its affairs, without straying from the individual rights framework. We hold that the rule by law is an operation that defines the patrimonialization of indigenous peoples. It increases their visibility while imposing limits on political action to keep them from becoming sui juris subjects capable of breaching the distinction between zoe and bios. In this article, we try to understand the political–ideological intent of these decisions, the intentions beyond the letter of the law of patrimonialized peoples. (shrink)

El objetivo de la formación doctoral es la generación y difusión de nuevo conocimiento, sin embargo, no es claro cómo los programas de doctorado en Colombia se relacionan con este tipo de producción académica. A partir de ello, en el presente estudio se presenta el panorama general de la producción académica a través de las instituciones de educación superior colombianas que ofertan programas de formación doctoral en psicología. La producción académica se obtuvo de la base de datos Scopus en una (...) muestra de 13 universidades. Tras una búsqueda inicial, se encontraron 1345 documentos, con los cuales se realizó un análisis de los indicadores de productividad y de las redes de colaboración al interior de la disciplina en el país. Posteriormente, esta información se contrastó con la información nacional registrada en el sistema de Currículum Vitae Latinoamericano y del Caribe de 193 profesores asociados a las universidades que ofertan los programas de doctorado. Al comparar la producción académica nacional e internacional, se encontró una mayor correlación entre la dirección de tesis de posgrado y la publicación en revistas nacionales. Por lo tanto, se puede afirmar que el impacto de la formación doctoral en la generación de nuevo conocimiento es relativo y tiene un alcance limitado, siendo principalmente las revistas nacionales el medio de difusión de este conocimiento. Se recomienda evaluar el impacto de los productos asociados a la formación posgradual y la visibilidad internacional, con énfasis en las revistas indexadas en bases de datos internacionales. It looks at the exchange between Dworkin and Fish, initiated in the 1980s, and analyses the role the exchange has played in the development of contemporary theories of interpretation, legal reasoning, and the nature of law. This volume critically discusses the relationship between democracy and constitutionalism. It does so with a view to respond to objections raised by legal and political philosophers who are sceptical of judicial review based on the assumption that judicial review is an undemocratic institution. The book builds on earlier literature on the moral justification of the authority of constitutional courts, and on the current attempts to develop a system on "weak judicial review". Although different in their approach, the chapters all focus (...) on devising institutions, procedures and, in a more abstract way, normative conceptions to democratize constitutional law. These democratizing strategies may vary from a radical objection to the institution of judicial review, to a more modest proposal to justify the authority of constitutional courts in their "deliberative performance" or to create constitutional juries that may be more aware of a community's constitutional morality than constitutional courts are. The book connects abstract theoretical discussions about the moral justification of constitutionalism with concrete problems, such as the relation between constitutional adjudication and deliberative democracy, the legitimacy of judicial review in international institutions, the need to create new institutions to democratize constitutionalism, the connections between philosophical conceptions and constitutional practices, the judicial review of constitutional amendments, and the criticism on strong judicial review. IntroductionCardiology is characterized by its state-of-the-art biomedical technology and the predominance of Evidence-Based Medicine. This predominance makes it difficult for healthcare professionals to deal with the ethical dilemmas that emerge in this subspecialty. This paper is a first endeavor to empirically investigate the axiological foundations of the healthcare professionals in a cardiology hospital. Our pilot study selected, as the target population, cardiology personnel not only because of their difficult ethical deliberations but also because of the stringent conditions in which they (...) have to make them. Therefore, there is an urgent need to reconsider clinical ethics and Value-Based Medicine. This study proposes a qualitative analysis of the values and the virtues of healthcare professionals in a cardiology hospital in order to establish how the former impact upon the medical and ethical decisions made by the latter.ResultsWe point out the need for strengthening the roles of healthcare personnel as educators and guidance counselors in order to meet the ends of medicine, as well as the need for an ethical discernment that is compatible with our results, namely, that the ethical values developed by healthcare professionals stem from their life history as well as their professional education.ConclusionWe establish the kind of actions, communication skills and empathy that are required to build a stronger patient-healthcare professional relationship, which at the same time improves prognosis, treatment efficiency and therapeutic adhesion. Considerando traços da conceptualização das noções de “repetição” e “hábito”, presentes em Empirisme et subjectivité (DELEUZE, 1953, em diante ES), esperamos fazer algumas anotações acerca do percurso que leva até Différence et répétition, tese que Deleuze apresenta em 1968 (doravante DR), cujo capítulo II se debruça na constituição da síntese do presente. Para tanto, será necessário estabelecermos duas etapas na determinação desse percurso. Na primeira etapa, abordaremos a forma em que Deleuze descreve o hábito como princípio complementar ao princípio de (...) experiência na construção do conhecimento. En los procesos de identificación social muchas veces la valoración del pasado resulta fundamental. La existencia objetiva de esa valoración ha propiciado que distintos actores sociales, en diferentes momentos históricos, hayan hecho uso del pasado en la estructuración de las ideologías que sustentan los procesos de identificación y, en consecuencia, sus propios proyectos políticos. Es decir, los mitos políticos están compuestos manifiestamente de dos componentes básicos. Por un lado, consisten en la así llamada política simbólica y por el otro lado, (...) son parte de la memoria colectiva. Es por esto que los mitos se enfrentan con las bases mismas del proyecto de modernidad, quizás la razón por la cual sea la politología la disciplina de las ciencias sociales que menos los ha estudiado. La utopía andina, el mahdi o el doceavo imán, el emperador alemán oculto y dormido y el bolivarianismo, constituyen algunos estos mitos políticos. (shrink)

En el contexto del sistema presidencial chileno, el artículo analiza el rol del Congreso en la elaboración de la política exterior, desde la perspectiva del enfoque transaccional desarrollado por Pablo Spiller y Mariano Tommasi (2000). De este modo, se plantea que el trabajo del Congreso en general, y de las comisiones de Relaciones Exteriores del Senado y de la Cámara de Diputados en particular, se caracteriza por la permanencia y continuidad de los miembros y, en consecuencia, por un trabajo especializado (...) y de alta calidad profesional, lo que favorece la cooperación entre los actores y los intercambios intertemporales entre éstos. Wind turbines have been used by many groups of humans for many centuries. Wind turbines have allowed groups of humans to perform many different tasks in the past. However, only a century and a half ago, they began to be used to convert the energy captured from wind into electric energy. Moreover, only approximately twenty-five years ago, we started to introduce on a massive scale the energy generated from wind turbines into the electric networks of most developed countries in the (...) world for regular consumption. According to 2017 statistics, approximately 12 percent of the electric energy consumed in the EU is produced by wind turbines. Despite the fact that wind turbines generally appear quite similar externally—i.e., a three-blade structure, a nacelle, a tower, etc.—if we carefully examine the electric technology used within them, we find quite a wide range of technologies for energy conversion, which is a key issue in wind turbine technology. Hence, this paper adopts a dialectic perspective towards analyzing and understanding why several electric technologies coexist in wind turbine technology. We explain the specific factors that have influenced different wind turbine manufacturers to adopt different electric technologies across the last twenty-five years. We show how their actions and the technological directions that have followed have been mutually codetermined, resulting in a technological evolution that has produced today’s wind turbine variety. Se examina la noción de espectro, propuesta en Espectros de Marx, para evidenciar la problematización que Jacques Derrida hace a la oposición, que se supone tajante, entre las nociones de vida y muerte. Se evidencia que Derrida no traza tal problematización exclusivamente a partir de Espectros de Marx, sino también desde diversos textos que dan cuenta de un constante asedio que ronda su pensamiento: la sobrevida. A su vez, se analiza la discusión que Derrida sostuvo con el espectro de Marx (...) para evidenciar: (1) de qué modo la herencia fiel-infiel de Marx contribuye al pensamiento de la sobrevida; (2) cómo en tal pensamiento de la sobrevida se inscribe necesariamente el problema de la justicia y la alteridad. En el presente trabajo se pretende llevar a cabo una aproximación al fenómeno del colapso ecológico y su relación con la filosofía de la historia a través de las aportaciones de Walter Benjamin y Theodor Adorno. En este sentido, el fenómeno del colapso ecológico será abordado como la barbarie de nuestro tiempo, introduciéndonos en uno de los conceptos con mayor recorrido en la teoría crítica, para acto seguido explorar diversas vías filosóficas abiertas para hacerle frente en la actualidad.

This article analyzes the evolution of Philosophy of Educationin Spain and its situation at the dawn of the 21st century. Spain'speculiar socio-historical circumstances have largely conditioned thedirection this discipline has taken over the last several decades. So,although during a period there was some approximation towards themethods of analytic philosophy, Philosophy of Education has never fullyrelinquished its normative vocation. To do so would have meant spurningthe hopes and fears that had filled Spanish society by the mid 1970supon the reinstatement of civil (...) liberties and democracy. Indeed,attention to the circumstances and that normative orientation have foundtheir best fit in a practical Aristotelian-based philosophy meant toendow Philosophy of Education with a normative character that do notshun the educator's need for reflection, practical decision-making, andresponsibility. Since the 1990s, new directions have been marked by thechallenge of postmodernism, inasmuch as it affects not only thetechnological positivist model but also the reflective educator's modelof a practical Philosophy of Education. The new directions spread out invarious ways, yet they all fall into a common denominator of narrativetrends. The problem posed by these new languages lies in the extent towhich they are consistent with pedagogic intent. In turn, the answerstake on different profiles depending on whether the stance leans moretowards the philosophical or the pedagogical point of view withinPhilosophy of Education. The complementary nature of both perspectivescharacterizes the current state of the field in Spain. (shrink)

El uso de sistemas de machine learning en los procesos de selección laboral ha sido de gran utilidad para agilizarlos y volverlos más eficientes, pero al mismo tiempo ha generado problemas en términos de equidad, confiabilidad y transparencia. En este artículo comenzamos explicando los diferentes usos de la Inteligencia Artificial en los procesos de selección laboral en Estados Unidos. Presentamos los sesgos sexuales y raciales que han sido detectados en algunos de ellos y explicamos los obstáculos jurídicos y prácticos para (...) su detección y análisis. Un posible remedio jurídico a la discriminación algorítmica es el régimen de impacto diferencial sistémico utilizado en Estados Unidos. Usamos algunas características de este régimen para señalar los vacíos jurídicos frente a la discriminación en el acceso al empleo en el ámbito del derecho laboral colombiano, y ofrecemos algunas características generales que podría tener un régimen de esa naturaleza. BackgroundThe COVID-19 pandemic has hit almost all countries around the globe, seriously affecting the welfare of populations. Spain is especially hard-hit. In this context, the purpose of the present study is to analyze social, demographic, and economic correlates of mental health during the COVID-19 pandemic in the population residing in Spain.MethodThe sample of this cross-sectional study was comprised of 801 participants aged 18 or older and residing in Spain. Data collection was carried out during March and April 2020. Data of (...) mental health and well-being indicators, and those of a wide number of social, demographic, and economic variables were recorded. Linear regression models were built to value associations between mental health and social, demographic, and economic indicators.ResultsMental health morbidity was higher in women, younger people, individuals with medium studies, people with fewer children, singles, students, and unemployed individuals. Positive affect was higher among women, people with a high level of studies, those not co-living with dependent seniors, the self-employed, the employed, and those working outside home. Negative affect was negatively associated with age and number of children and was higher among women, people with basic studies, singles, individuals co-living with dependent seniors, homemakers, and students.ConclusionThe most vulnerable populations were found to be women, younger people, people with basic or medium studies, students and individuals with no remunerated activities, single populations, and those co-living with dependent seniors as well as those with a reduced number of children. Published in 1998, the main aim of this book is to use a naturalistic, evolutionary approach to solve some of the most important problems in philosophy. The first two problems come from the philosophy of science: the problem of rationality of science and the problem of truth in science. In presenting the first problem, the author argues that the views of Kuhn and Feyerabend do create a very serious challenge to traditional epistemology, however, if the assumption of individual rationality is (...) abandoned in favour of the author's social concept of rationality, a committed naturalism can account for science as a rational activity. In tackling the second problem of truth, the author shows that a committed evolutionary philosophy does not support realism but leads instead to a thorough evolutionary relativism of scientific knowledge. It is nevertheless possible to use this evolutionary relativism to construct a theory of relative truth. The issue of whether science discovers truth has also been tied to absolutism, that a well formulated theory of relative truth is likely to bring about a profound transformation of the way we think about the field. The author explores the notion of relative truth in the philosophy of science, ethics and aesthetics. (shrink)

Todo el curso gravita sobre la función reproductiva de la trompa. La trompa, en fin de cuentas, es un oviducto. Ya bastante habrán dicho de todo ello Michel Idoate y Fernando de la Fuente. Yo lo que quiero hacer en mi charla es llamar la atención sobre los aspectos éticos de unos pocos hechos básicos: que, de ordinario, la fecundación tiene lugar en la ampolla tubárica y que aquí y en el istmo transcurren las primeras horas y los primeros días (...) del desarrollo embrionario. Estos hechos, tan conocidos, tienen implicaciones ético-médicas muy importantes. La principal de ellas, se refiere a quien sea el embrión humano que se engendra en la trompa y en ella habita cuatro o cinco días. Pero, no menos importante, es la que se refiere a cuáles son las relaciones éticas que han de establecerse entre el médico y la mujer en cuya trompa flota un embrión. (shrink)
