En esta contribución intentaré mostrar que el criterio lex superior derogat legi inferiori conduce a una consecuencia que, al menos en lo que conozco, no ha sido todavía advertida. Si las normas de la máxima jerarquía de un sistema jurídico, verbigracia, normas constitucionales constituyen un conjunto consistente, entonces necesariamente el sistema jurídico es consistente. Dicho de otra manera, lex superior preserva necesariamente la consistencia. Si las normas del nivel más alto son miembros de un conjunto consistente, los niveles inferiores de (...) la jerarquía no podrían admitir normas contradictorias con las superiores. Más aún, habida cuenta que de una contradicción se sigue cualquier norma, en virtud del principio lógico ex falso quodlibet, de dos normas contradictorias que pertenecen a algún nivel inferior se derivan algunas normas en contradicción con normas del nivel superior; así normas contradictorias no podrían ser admitidas en los niveles inferiores. In this contribution, I shall intend to show that the criterion lex superior derogat legi inferiori has a consequence which, as far as I know, has not been noted yet: if the higherlevel norms in a legal system, i.e. constitutional norms, configure a consistent set, then necessarily the legal system is consistent. Lex superior preserves necessarily the consistency, as it were. If higher-level norms are members of a consistent set, then the lower-levels could admit no norm in contradiction with the higher-level norms. Moreover, given that from a contradiction follows anything, in virtue of the logical principle ex falso quodlibet, from two contradictory lower-level norms follow some norms in contradiction with norms of the higher-level, thus contradictory norms could never be admit in the lower-levels. This paper intends to show that it is possible to take convincingly into account the platitudes which underlie our moral practice. It deals with the articulation of an indirect strategy to answer the arguments of moral scepticism: if we can generate a conceptual space that takes such platitudes into account, perhaps we could ignore the sceptic doubts.Several metaethical conceptions can ecumenically carry out this task. Particularly, even if moral realism implies cognitivism and objectivism, moral objectivism –the plausibility of rational agreement (...) in morals- does presuppose necessarily neither realism nor cognitivism.An argument against moral relativism is also presented. It is argued that there are several ways of pluralism compatible with the very field of moral objectivity.The conclusion maintains that only an objectivist account of our moral practice is apt to make sense of our institutional designs that acknowledge universal human rights. Algunos de los más relevantes filósofos del derecho de los últimos años, como Carlos S. Nino y Ronald Dworkin, han defendido que hay una pluralidad de conceptos de Derecho. Scott Shapiro ha sostenido una posición especialmente relevante acerca de ello: la palabra ‘Derecho’ es sistemáticamente ambigua, pues a veces designa un conjunto de normas y otras veces una organización social. Esta es precisamente la tesis criticada en el trabajo. Se argumenta, basándose en determinada literatura filosófica acerca de los conceptos, que (...) los conceptos de objetos sociales de carácter intencional contienen una dimensión social y una dimensión significativa, normativa en el caso del derecho. El mismo concepto de Derecho expresa una dimensión social y una normativa imbricadas entre sí. Some of the most relevant legal philosophers in the last decades, as Carlos S. Nino and Ronald Dworkin, have defended the idea that there is a plurality of concepts of law. Scott Shapiro has sustained this account in a particularly relevant way: the word ‘law’ displays a ubiquitous ambiguity, sometimes designates a set of norms and other a social organization. This is precisely the thesis which is criticized in the paper. It is argued, from a certain philosophical literature about the concepts, that concepts of social objects of intentional character contain a social dimension and a meaning dimension, normative in the case of the law. That is to say, the concept of law expresses a social dimension and a normative dimension intertwined. (shrink)

This article analyzes the thesis of ethical relativism, as defended by Alchourrón and Bulygin. These authors offer, on the one hand, a suggestive conception according to which the question “what are our obligations?” is equivalent to thinking about what is to be done; on the other hand, they defend a relativist conception of ethics. They present three objections to constructivist accounts of ethics that are not relativist: a) the argument of the burden of the proof; b) a version of the (...) dilemma of Euthyphro, and c) the argument of particularism. This article presents counterarguments to these objections in the attempt to show that they are not conclusive and that a space therefore remains for objectivity in the normative sphere. The author discusses a question related to a certain aspect of justification of legal decisions, often so-called internal justification-a legal decision is internally justified if and only if it can be deduced from the norm(s) applicable to the case, and from the statement(s) describing the facts of the case. According to this notion, infinite irrelevant logical consequences are justified. To avoid this counterintuitive conclusion, the author analyzes three notions of relevance: Sperber-Wilson's notion, Anderson-Belnap's notion, and Schurz's notion. The author presents (...) a reconstruction of the notion of relevance very close to Schurz's notion, extended to make it suitable to the particular characteristics of deontic logic. Finally, this notion of relevance is used to discuss some aspects of the concept of normative system, conceived as a deductive system, that is, a system containing all its logical consequences. In this comment to the brilliant book on the Constitutionalism in Latin-America, Gargarella, it is accepted that perhaps is the equality the empty promise among the ideals of constitutionalism in this region of the world. It is also accepted that an important part of the reason for this absence of equality lies in the institutional design, in the engine room of the Constitution, concretely in an hypertrophy of presidentialism. A complementary suggestion is added: the ideal of a constitutional democracy presupposes (...) the existence of a State with an autonomous, efficient, professional and robust public Administration. Only with a well-designed tax system and an Administration apt to carry out the proper functions it is possible to build a well-ordered society in which the Rawlsian Difference Principle is respected and honoured. This handbook offers a deep analysis of the main forms of legal reasoning and argumentation from both a logical-philosophical and legal perspective. These forms are covered in an exhaustive and critical fashion, and the handbook accordingly divides in three parts: the first one introduces and discusses the basic concepts of practical reasoning. The second one discusses the main general forms of reasoning and argumentation relevant for legal discourse. The third one looks at their application in law as well as at (...) the different areas of legal reasoning. The handbook’s division in three parts reflects its conceptual architecture, since legal reasoning and argumentation are considered in relation to the more general types of reasoning. (shrink)

Transreligious theologians are posed with a number of difficult questions. First, how can I understand the beliefs and practices of a worldview I do not share? Then, once I begin to construct and synthesize truth claims, how normative are the source traditions? Finally, how do we transreligious theologians judge truth claims as better and worse? By offering answers to these questions using a model of critical interreligious appropriation, we may find a basis for a critical transreligious theology that avoids naïve (...) syncretisms and pernicious incommensurability. There is an extensive literature on time travel in both philosophy and physics. Part of the great interest of the topic stems from the fact that reasons have been given both for thinking that time travel is physically possible—and for thinking that it is logically impossible! This entry deals primarily with philosophical issues; issues related to the physics of time travel are covered in the separate entries on time travel and modern physics and time machines. We begin with the definitional (...) question: what is time travel? We then turn to the major objection to the possibility of backwards time travel: the Grandfather paradox. Next, issues concerning causation are discussed—and then, issues in the metaphysics of time and change. We end with a discussion of the question why, if backwards time travel will ever occur, we have not been visited by time travellers from the future. (shrink)

This book provides a philosophical analysis of the notion of selfhood that underlies identity politics. It offers a unique theory of the self that combines previous scholarly work on recognition and the phenomenology of space. The politics of identity occupy the centre of a contested terrain. Marginalised and oppressed peoples continue to seek the transformation of our shared social world and our political institutions required for their lives to be liveable. Public criticism and academic treatments of identity politics often take (...) a disparaging view that treats it as subordinate to more general political questions about justice and the organisation of society and its institutions. This book argues that these polemics ignore the numerous ways in which all politics is concerned with matters of selfhood and identity. Through a rereading of Hegel's account of recognition as an ongoing and dynamic process that constitutes the self, it presents selves-and the categories of identity that qualify these selves-as fundamentally conditioned by the environments in which they appear before themselves and others. It also argues that we do the work of identity in public spaces-particularly digital spaces-and that these spaces shape what identities we can assume and what those identities mean. Contemporary social media technologies facilitate the production of particular forms of selfhood through the combined logics of the interface, the profile, and the post. The Politics of Recognition in the Age of Digital Spaces will be of interest to scholars and advanced students working in a wide range of disciplines including political philosophy, phenomenology, philosophy of technology, sociology, political theory, and critical theory. Het Leids-Haags Allegorieënlexicon toont nieuwe perspectieven op de maatschappelijke werkelijkheid met een actuele duiding van vijftig kernthema’s uit de wetenschap. De auteurs zijn de duale promovendi en hun promotores van Leiden University Dual PhD Centre The Hague. Ze worden daarbij geïnspireerd door de metafoor van de grot van Plato: Waar ben ik? Waar sta ik? Welk beeld zie ik? Hoe kan ik dat begrijpen? Two essays on utilitarianism, written from opposite points of view, by J. J. C. Smart and Bernard Williams. In the first part of the book Professor Smart advocates a modern and sophisticated version of classical utilitarianism; he tries to formulate a consistent and persuasive elaboration of the doctrine that the rightness and wrongness of actions is determined solely by their consequences, and in particular their consequences for the sum total of human happiness. In Part II Bernard Williams offers a sustained (...) and vigorous critique of utilitarian assumptions, arguments and ideals. He finds inadequate the theory of action implied by utilitarianism, and he argues that utilitarianism fails to engage at a serious level with the real problems of moral and political philosophy, and fails to make sense of notions such as integrity, or even human happiness itself. This book should be of interest to welfare economists, political scientists and decision-theorists. (shrink)

The major reason given in the philosophical literature for dissatisfaction with theories of vagueness based on fuzzy logic is that such theories give rise to a problem of higherorder vagueness or artificial precision. In this paper I first outline the problem and survey suggested solutions: fuzzy epistemicism; measuring truth on an ordinal scale; logic as modelling; fuzzy metalanguages; blurry sets; and fuzzy plurivaluationism. I then argue that in order to decide upon a solution, we need to understand the true nature (...) and source of the problem. Two possible sources are discussed: the problem stems from the very nature of vagueness—from the defining features of vague predicates; or the problem stems from the way in which the meanings of predicates are determined—by the usage of speakers together with facts about their environment and so on. I argue that the latter is the true source of the problem, and on this basis that fuzzy plurivaluationism is the correct solution. (shrink)

In 1484, humanist philosopher and theologian Marsilio Ficino published the first complete Latin translation of Plato's extant works. Students of Plato now had access to the entire range of the dialogues, which revealed to Renaissance audiences the rich ancient landscape of myths, allegories, philosophical arguments, etymologies, fragments of poetry, other works of philosophy, aspects of ancient pagan religious practices, concepts of mathematics and natural philosophy, and the dialogic nature of the Platonic corpus's interlocutors. By and large, Renaissance readers in the (...) Latin West encountered Plato's text through Ficino's translations and interpretation. -/- In Plato's Persona, Denis J.-J. Robichaud provides the first synthetic study of Ficino's interpretation of the Platonic corpus. Robichaud analyzes Plato's works in their original Greek and in Ficino's Latin translations, as well as Ficino's non-Platonic writings and correspondence, in the process uncovering new aspects of Ficino's intellectual work habits. In his letters and works, Ficino self-consciously imitated a Platonic style of prose, in effect devising a persona for himself as a Platonic philosopher. Plato's dialogues are populated with a wealth of literary characters with whom Plato interacts and against whom Plato refines his own philosophies. Reading through Ficino's translations, Robichaud finds that the Renaissance philosopher seeks an understanding of Plato's persona(e) among all the dialogues' interlocutors. In effect, Ficino assumed the role of Plato's Latin spokesperson in the Renaissance. -/- Plato's Persona is grounded in an extensive study of scholarship in Renaissance humanism, classics, philosophy, and intellectual history, and contextualizes Ficino's intellectual achievements within the contemporary Christian orthodox view of Platonism. Ficino was an influential figure in the early Italian Renaissance: the key intermediary between Greek and Latin, and between manuscript and print, giving voice to Plato and access to the ancient frameworks needed to interpret his dialogues.
