A review of Eric Schwitzgebel's book "A Theory of Jerks and Other Philosophical Misadventures" (2020).

Dickert et al. (2020) effectively address how factors such as time limitations, stress, and illness severity in acute conditions warrant a deeper evaluation of how current consent processes serve patients. While data suggests that patients “prefer to be asked for permission upfront rather than waiving consent” (2), consent forms themselves “are frequently long and technical, follow rigid templates, and contain language that appears to prioritize institutional protection” (1). Such findings elucidate patients’ valuation of personal agency over settling for the “benefit (...) of the doubt” that physicians and the consent forms they provide are acting in the patients’ best interests. In response, the authors recommend revisions to consent forms in terms of content, structure, and tone to better facilitate patient understanding beyond the mere conveyance of information. We aim to build Dickert et al.’s discussion of how “consent processes serve functions beyond facilitating an informed, autonomous decision” (2), but with a broader focus on an underrecognized purpose of the consent process: namely, reaffirming a patient’s status as a capable, rational agent. Specifically, we argue that patients can exercise this agency when they thoroughly understand the consent process, per Grimm’s (2012) conception of understanding. (shrink)

Fabiano argues that virtue theory offers the best “safety framework” for mitigating the risks of moral enhancement (1). He advances five desiderata for an ideal safety framework and then explains how virtue theory satisfies each. Among these desiderata is the “preservation of identity” (1). Fabiano argues that moral enhancement can safely preserve personal identity when carried out within the framework of virtue theory. We suggest Fabiano's argument for this conclusion falls short, since contra Fabiano’s claim, enhancing virtues may not preserve—and (...) could even damage—personal identity. We draw on three sources of evidence: 1) virtue theory scholarship that argues for the importance of habituation for virtue formation, 2) Focquaert and Schermer’s (2015) distinction between active and passive enhancement and attendant endorsement of more active paths to virtue enhancement, and 3) empirical research suggesting that technologies which support moral enhancements may have damaging effects on personal identity. According to Macklin & Natanson (2019), one reason unusual practices can be misidentified as usual care is that “instead of using pertinent, accurate information describing usual care, investigators may rely on the opinion of ‘experts’ in the field, whose information may be out of date or otherwise inaccurate." We find Macklin & Natanson’s insights about misattributed expertise crucial, and suggest their discussion can be elucidated further by characterizing it in the context of Ballantyne (2018)’s recent exploration of what he calls (...) epistemic trespassing. What insights can be drawn from this characterization? In this commentary, we highlight two. First, the characterization elucidates the serious consequences that can result from epistemic trespassing. Second, the characterization of Macklin & Natanson’s cases as instances of epistemic trespassing offers us a potential roadmap for overcoming some of the problems the authors identify. (shrink)

The BRAIN 2.0 Neuroethics Report reflects on the ways in which neuroscientific research may inform our understanding of concepts such as consciousness and empathy, and how advances in this understanding might in turn affect practices such as research on non-human animal primates. Generally, the Report calls for “the integration of neuroscience and neuroethics during the remaining years of the BRAIN initiative and beyond” (NIH 2019). In responding to the Report, the articles in this issue grapple with theoretical questions about what (...) the integration of neuroscience and neuroethics might look like, as well as how specific practices might be affected. In this commentary, we don’t grapple with these questions ourselves. Instead, we propose a framework for debates about them. Specifically, we introduce the idea of ‘morally-salient features,’ suggesting that the concept may be helpful in providing a framework for the kinds of questions addressed by the BRAIN 2.0 Neuroethics Report as well as those tackled by the authors of this issue. A detailed theoretical analysis is presented of what five utility representations – subjective expected utility (SEU), rank-dependent (cumulative or Choquet) utility (RDU), gains decomposition utility (GDU), rank weighted utility (RWU), and a configural-weight model (TAX) that we show to be equivalent to RWU – say about a series of independence properties, many of which were suggested by M. H. Birnbaum and his coauthors. The goal is to clarify what implications to draw about the descriptive aspects of the representations from data (...) concerning these properties. The upshot is a sharp rejection of SEU and RDU and no clear choice between GDU and TAX, but a list of 8 properties is given that should receive more attention to discriminate between the latter two models. Discrete choice experiments—selecting the best and/or worst from a set of options—are increasingly used to provide more efficient and valid measurement of attitudes or preferences than conventional methods such as Likert scales. Discrete choice data have traditionally been analyzed with random utility models that have good measurement properties but provide limited insight into cognitive processes. We extend a well-established cognitive model, which has successfully explained both choices and response times for simple decision tasks, to complex, multi-attribute discrete choice data. The (...) fits, and parameters, of the extended model for two sets of choice data (involving patient preferences for dermatology appointments, and consumer attitudes toward mobile phones) agree with those of standard choice models. The extended model also accounts for choice and response time data in a perceptual judgment task designed in a manner analogous to best–worst discrete choice experiments. We conclude that several research fields might benefit from discrete choice experiments, and that the particular accumulator-based models of decision making used in response time research can also provide process-level instantiations for random utility models. Generalizing, any gamble is indifferent to the (...) joint receipt of its element of chance and a certain consequence, which is called the `kernel equivalent' of the gamble. Under idempotence, the kernel equivalent equals the certainty equivalent. Conditions are reported (Theorem 4) that are sufficient for the kernel equivalents to have the kind of utility representation first discussed by Luce and Fishburn (1991), including being idempotent. This utility representation of the kernel equivalents together with the derived form of utility over joint receipts yields a utility representation of the original structure. Many liberal philosophers view elite education as a virtue of political leaders and, in addition, hold that an important role of a just education system is to create better elites. A compelling and influential articulation of this view has been offered by Elizabeth Anderson. However, this view is in conflict with a commitment to substantive democracy, given the background conditions of the United States today. This article will argue, contra Anderson, that having the highly educated disproportionately represented in political leadership (...) is incompatible with egalitarian principles of democracy. The key reason for this is that it systematically shuts out the working class from full political participation. Therefore, in order to satisfy the constraints of democracy, we must sever the connection between elite education and political office. (shrink)

Suppose that the axioms of conjoint measurement hold for quantities having two independent components and that the axioms of extensive measurement hold for each of these components separately. In a recent paper, Luce shows that if a certain axiom relates the two measurement systems, then the conjoint measure on each component is a power function of the extensive measure on that component. Luce supposes that each component set contains all "rational fractions" of each element in that set; in this note (...) we present an alternative form of the axiom relating the measurement systems that enables us to prove Luce's result without requiring that such "rational fractions" exist. Suppose that entities composed of two distinct components can be qualitatively ordered in two ways, such that each ordering relation satisfies the axioms of conjoint measurement. Without further assumptions nothing can be said about the relation between the pair of numerical scales constructed for each component. Axioms are stated that relate the two measurement theories, and that are sufficient to establish that the two conjoint scales on each component are linearly related.

At the centre of the genre of dating advertisements is a tension between speech and writing, process and product, interaction and transaction. In this article I investigate some of the interpersonal resources available to writers of advertisements to achieve the goal of interacting in writing with a potential partner. I first consider the ways in which advertisers use questions and answers to enact and project speech-like interactional roles for themselves and their readers, in order to encourage an overt response to (...) their textual initiations and open a conversation with a suitable partner. I then consider their use of modality to engage potential partners and negotiate mutual suitability. I conclude by comparing the generic function of these two areas of interpersonal resource and suggest a relationship of agnation between them. (shrink)

COVID-19 is compromising all aspects of society, with devastating impacts on health, political, social, economic and educational spheres. A premium is being placed on scientific research as the source of possible solutions, with a situational imperative to carry out investigations at an accelerated rate. There is a major challenge not to neglect ethical standards, in a context where doing so may mean the difference between life and death. In this paper we offer a rubric for considering the ethical challenges in (...) COVID-19 related research, in the form of an ethics toolkit for global research developed at the University of Edinburgh in collaboration with more than 200 global researchers from around the world. This toolkit provides a framework to support confrontation of ethical conflicts through the integrated and iterative analysis of Place, People, Principles and Precedents, throughout the research journey. Two case analyses are offered to exemplify the utility of the toolkit as a flexible and dynamic tool to promote ethical research in the context of COVID-19. (shrink)

All rights reserved.We present new observations of the low-mass companion to HD 984 taken with the Gemini Planet Imager as a part of the GPI Exoplanet Survey campaign. Images of HD 984 B were obtained in the J and H bands. Combined with archival epochs from 2012 and 2014, we fit the first orbit to the companion to find an 18 au orbit with a 68% confidence interval between 14 and 28 au, an eccentricity (...) of 0.18 with a 68% confidence interval between 0.05 and 0.47, and an inclination of 119°with a 68% confidence interval between 114°and 125°. To address the considerable spectral covariance in both spectra, we present a method of splitting the spectra into low and high frequencies to analyze the spectral structure at different spatial frequencies with the proper spectral noise correlation. Using the split spectra, we compare them to known spectral types using field brown dwarf and low-mass star spectra and find a best-fit match of a field gravity M6.5 ±1.5 spectral type with a corresponding temperature of K. Photometry of the companion yields a luminosity of log=2.88 ± 0.07 dex with DUSTY models. Mass estimates, again from DUSTY models, find an age-dependent mass of 34 ±1 to 95 ±4 M Jup. These results are consistent with previous measurements of the object. (shrink)

The present theory leads to a set of subjective weights such that the utility of an uncertain alternative (gamble) is partitioned into three terms involving those weights—a conventional subjectively weighted utility function over pure consequences, a subjectively weighted value function over events, and a subjectively weighted function of the subjective weights. Under several assumptions, this becomes one of several standard utility representations, plus a weighted value function over events, plus an entropy term of the weights. As individuals and social activists, Bob Marley and Frantz Fanon appear to stand in paradoxical relations with one another. In some ways, they were kindred, coming from the same physical and social spaces—Marley from Jamaica and Fanon from Martinique. As social activists, they spoke the same language of liberation that transcends their local and regional realities—specifically; both were globalists as the theory of liberation is concerned. However, Marley and Fanon, to certain extents, differed in relation to the (...) means of liberation. While Marley sometimes vacillated on the use of violence for liberation, Fanon was emphatic that violence is a veritable means of liberation. While Marley looked back for the ingredients of the liberation process, Fanon believed that moving forward to the future is the tool kit of liberation. The paper places Marley’s and Fanon’s notions of liberation within the context of the existential issues raised by the twin phenomena of slavery and colonialism. The paper situates Marley and Fanon along the poeticist and historicist analytical framework enunciated by Paget Henry (2000). While Marley could be identified with the poeticist school which advocates for a reconstruction of the past as a means of liberation, Fanon’s historicism projects an alternative reality to replace the past in order to liberate the oppressed. The paper argues that both positions can be reconciled to achieve a coherent theory of liberation, which is the mitigation of the situation of the oppressed and the powerless in Caribbean society and the world in general. This article presents Paul Ricœur’s hermeneutic of the productive imagination as a methodological tool for understanding the innovative social function of texts that in exceeding their semantic meaning, iconically augment reality. Through the reasoning of Rastafari elder Mortimo Planno’s unpublished text, Rastafarian: The Earth’s Most Strangest Man, and the religious and biblical signification from the music of his most famous postulate, Bob Marley, this article applies Paul Ricœur’s schema of the religious productive imagination to conceptualize the metaphoric transfer from (...) text to life of verbal and iconic images of Rastafari’s hermeneutic of word, sound and power. This transformation is accomplished through what Ricœur terms the phenomenology of the iconic augmentation of reality. Understanding this semantic innovation is critical to understanding the capacity of the religious imagination to transform reality as a proclamation of hope in the midst of despair. (shrink)

In his article ‘An Ameliorative Analysis of the Concept of Education’, Jack Marley-Payne sets out to provide an ameliorative analysis of the concept ‘education’. Marley-Payne draws an important distinction between what he labels the ‘Broad’ and the ‘Narrow’ account of education. His conclusion is that an ameliorative conceptual analysis of education favours the narrow account. The main argument is that a narrow approach, tightly connected to formal schooling, provides a better basis for pursuing an egalitarian agenda. Contrary to (...) Marley-Payne, I will argue that an amelioration of the concept education need not favour either a wide notion or a narrow notion. I believe that there are other alternatives to choose from, that in fact leads to an amelioration of what education can and ought to mean. The problem with Marley-Payne’s conclusion is thus, not only that it builds upon a false dichotomy but also that it is not emancipatory enough. We need an amelioration that is inclusive rather than exclusive. (shrink)

Some Saturday Night Live (SNL) religion sketches are relatively harmless. Sears pulled their advertising from NBC's online posting of the sketch and Jim Baker argued that it was the “most blasphemous skit in SNL history.” Actor Pat Boone, who starred in the film, objected to the SNL parody, equating it to an attack on God and suggesting that the writers had earned themselves a place in hell. SNL was birthed into existence in conflict with religion. That conflict came to a (...) head on October 3, 1992 when Sinead O'Connor – after singing an acapella version of Bob Marley's “War” – held up a picture of Pope John Paul II, sang the word “evil,” tore the picture to shreds, and shouted “Fight the real enemy!”. The Republic is essentially one long argument that it's better to be like O'Connor because being virtuous comes with its own internal reward that far outweighs the reward of public recognition. Christmas, and there was always a thrilling magic to rehearing the story of Scrooge's moving spiritual transformation. Yet, the story raises an important spiritual question: Scrooge is a new man on Christmas day, but what about after that? We often vow to be better people and fail. Why is this? A Christmas Carol is, of course, pure fantasy—a deeply heartwarming fantasy that bears repeated hearings—but it nonetheless does raise a real question about how spiritual enlightenment is actually achieved.I still appreciate A Christmas Carol as much as I did when I was a child, but as I have grown older, and after having encountered Buddhist philosophy, I have also begun to contemplate the story of Scrooge's spiritual transformation in a new light. The Buddhist notion of karma entails that, even if we are deeply moved now to change our ways for the better, the unexamined patterns of thought that underpinned our past actions retain a latent force in our mind stream that can influence us unexpectedly. If we are not observant of these patterns of thought, we are likely to repeat the kinds of actions we have performed in the past. Because the force of karma can be very strong, "overnight" spiritual and moral transformations are comparatively rare. On a Buddhist reading, the end of A Christmas Carol is where the spiritual journey for Scrooge actually begins.This underestimation of the force of karma on Dickens's part was, of course, a necessary case of artistic license, but is somewhat conspicuous given that a realization of the law of karma plays a critical (albeit unnamed) role in the story of Scrooge's putative enlightenment. Scrooge's transformation begins with a visit from the ghost [End Page 25] of his deceased business partner, Jacob Marley, a man who was as miserly and selfish as Scrooge himself. Marley's ghost is weighed down by a heavy chain, which represents his regret for having lived such a greedy and shortsighted life. "I wear the chain I forged in life. I made it link by link, yard by yard: I girded it on my own free will, and of my own free will I wore it."1 He warns that Scrooge will be visited by three spirits whose lessons he must heed in order to redeem himself. "Without their visits," Marley declares, "you cannot hope to shun the path I tread."2 Upon Marley's departure we are then treated to a Dickensian image of the Buddhist "lower realms." Scrooge looks out the window into the cold night air and sees a swarm of unfortunate ghostly forms, suffering and encumbered by heavy chains of remorse: "The air was filled with phantoms, wandering hither and thither in restless haste, and moaning as they went.... The misery with them all was, clearly, that they sought to interfere, for good, in human matters, and had lost this power for ever."3 Later, Scrooge's nephew Fred makes this pithy karmic observation: "Scrooge's offences carry their own punishment.... Who suffers by his ill whims? Himself, always."4Throughout the remainder of the night Scrooge is visited sequentially by the three spirits representing the Christmases past, present, and future, who, like helpful bodhisattvas, show him scenes from his life in order to awaken him to a realization of the law of karma. By the Ghost of Christmas Past Scrooge is presented with painful images of his childhood suffering as well as the kindness shown to him by others in the past, and learns how the present direction of his life has been shaped by these experiences. This paper is a historical analysis of the contributions of music artistes to the idea of development in Africa in the period between 1974 and 1987. Itseeks to show that concern for the development of the continent was not confined to the intellectual community. Music artistes were not merely interested in entertainment; they also paid attention to the real problems that confronted the society of their time, thereby sharing in the concern of political thinkers of all ages. The works of (...) three artistes - Sonny Okosun, Fela Anikulapo-Kuti and Bob Marley - are selected for detailed examination, although references are made to other artistes. The study depended on primary and secondary source material. The paper is a contribution to knowledge in the field of African Political Thought. (shrink)
