The article presents a novel normative model of shared responsibility for remedying unjust labor conditions and protecting workers’ rights in global supply chains. While existing literature on labor governance in the globalized economy tends to focus on empirical and conceptual investigations, the article contributes to the emerging scholarship by proposing moral justifications for labor governance schemes that go beyond voluntary private regulations and include public enforcement mechanisms. Drawing on normative theories of justice and on empirical-legal research, our Labor Model of (...) Despite the growing global consensus regarding the need to ensure minimal labour standards such as adequate safety and health conditions, freedom of association, and the prohibition of child labour, millions of workers across the world continue to work in horrific conditions. Who should be held responsible, both morally and legally, for protecting workers' rights? What moral and legal obligations should individuals and institutions bear toward foreign workers in their countries? Is there any democratic way to generate, regulate, and enforce labour (...) standards in a global labour market? This book address these questions by taking a fresh look at the normative assumptions underlying existing and proposed international labour regulations. By focusing on international labour as a particular sphere of justice, it seeks to advance both the contemporary philosophical debate on global justice and the legal scholarship on international labour. Seyla Benhabib’s article, “Twilight of Sovereignty or the Emergence of Cosmopolitan Norms” offers a penetrating analysis of the contemporary global order and suggests a normative approach by which to mend its structural failures—viewed from the democratic ideal of popular sovereignty and guided by what she calls “cosmopolitan norms.” The authors take issue with Benhabib's position on both the descriptive and the normative grounds, and make three critical points in this matter: the first two points concern Benhabib's descriptive portrayal of the (...) global order. The third critical point concerns her normative position, i.e., her ideal of the good polity, displayed through her idea of “democratic iteration” operating through global civil society. The critical assessment of Benhabib's views ensues from the authors’ endorsement of the transformationalist position—the state, although somewhat undermined by global processes, still possesses considerable power and maintains a crucial role in determining the trajectory of these processes. In this paper, we explore a specific variant of multicultural education inIsrael that developed within the dominant Jewish cultural identity, that isthe claim of Jews from Islamic countries (Mizrahi Jews) for educational autonomy. This demand arose against the backdrop of an aggressive nationalist ideology – Zionism – that claimed torepresent all Jews, and yet was too ambivalent toward its non-European Jewish subjects. The Mizrahi Jews' dual identity, as Jews and as products of the Arab culture, conflated with the state's problematic (...) self-conception as both Jewish and democratic. This phenomenon, apparently, is evidenced by the two types of multicultural responses that developed within the Mizrahi sector: a critical multiculturalism with a social-democratic character on the one hand, and an autonomist multiculturalism with fundamentalist featureson the other. In this Article we propose an analytical framework for allocating responsibility for the protection of worker’s rights in the global labor market. Since production and services have expanded globally, and the state’s ability to protect worker’s rights on the national level has been undermined, the main challenge today is to find the appropriate institutional arrangements that allocate responsibility in a manner that realizes basic labor standards. The Article argues that in the context of a global labor market, responsibility should be (...) perceived in terms of "shared responsibility," whereby responsibility is shared by a complex network of agents and institutions that take part in global production and services. Within these global social networks and connections, labor relations generate a unique type of social connection which implies a special type of commitment and obligation towards workers. We propose four principles to guide the allocation of responsibility for remedying the unjust conditions of workers in the world, based on measures of connectedness, capacity, benefit, and contribution. According to the common view, conscientious objection is grounded in autonomy or in ‘freedom of conscience’ and is tolerated out of respect for the objector's autonomy. Emphasising freedom of conscience or autonomy as a central concept within the issue of conscientious objection implies that the conscientious objector should have an independent choice among alternative beliefs, positions or values. In this paper it is argued that: (a) it is not true that the typical conscientious objector has such a choice when they (...) decide to act upon their conscience and (b) it is not true that the typical conscientious objector exercises autonomy when developing or acquiring their conscience. Therefore, with regard to tolerating conscientious objection, we should apply the concept of autonomy with caution, as tolerating conscientious objection does not reflect respect for the conscientious objector’s right to choose but rather acknowledges their lack of real ability to choose their conscience and to refrain from acting upon their conscience. This has both normative and analytical implications for the treatment of conscientious objectors. (shrink)

When blame is understood to be emotion-based or affective, its emotional tone is standardly identified as one of anger. We argue that this conception of affective blame is overly restrictive. By attending to cases of blame that emerge against a background of a particular kind of hope invested in others, we identify a blaming response characterized not by anger but by sadness: reactive disappointment. We develop an account of reactive disappointment as affective blame, maintaining that while angry blame and disappointed (...) blame are both condemnatory responses, they have distinct evaluative foci and occupy different but complementary roles in our accountability practices. In a recent study half of the participants were informed of the occasional occurrence of location regularities in visual stimulus sets, while the other half was not. Evidence was presented to the effect that uninformed participants extracted the patterns from the displays better than the informed participants. The authors interpret their finding as demonstrating that working memory can operate non-consciously. However, inspection of the data suggests that rather than being more effective than the informed participants in extracting patterns, uninformed participants (...) were more strongly affected by the “Broken Patterns” that served as misleading cues. Thus whereas the findings may support the possibility of non-conscious operation of low level WM functions, they nevertheless underscore the importance of conscious awareness as far as higher level functions are concerned. Between States is the first book that assesses systematically the broad implications of interim governments in the establishment of democratic regimes and on the existence of states. Based on historical and contemporary democratisation experiences, the book presents four ideal types of interim government: opposition-led provisional governments, power-sharing interim governments, incumbent-led caretaker governments, and international interim government by the United Nations. The first part explores the theoretical problems of each of these models from a broad comparative perspective. Parce qu’elle est au confluent de plusieurs champs d’expérience et de réflexion, la question du temps offre une passerelle privilégiée pour croiser des approches rarement invitées à se rencontrer : celles des sciences d’un côté (physique, biologie, médecine, cosmologie), celles des arts (...) de l’autre (littérature, cinéma, arts plastiques, musique, théâtre). Au-delà des questions qui touchent à la réorganisation des partages cognitifs et disciplinaires (entre sciences et arts), l’objectif de cet ouvrage est de montrer la fécondité des transferts épistémologiques entre ces deux domaines. D’un côté, les sciences constituent un réservoir inépuisable pour les arts, auxquels elles proposent une multiplicité de modèles du temps opérant à différentes échelles : temporalités non linéaires, réversibles, cycliques ou emboîtées, qui peuvent être dynamisées par des bifurcations, des catastrophes ou des phénomènes d’émergence imprévisibles. De l’autre, les arts sont un lieu privilégié de modélisation, d’exposition et de mise à l’épreuve de modèles temporels, qui tantôt croisent la rationalité dominante (sciences, historiographie), tantôt en réactivent des dimensions occultées (mythe, rite, etc.). Following the outbreak of the COVID-19 pandemic, authorities have issued several guidelines to curb the pandemic's disastrous effects. However, measures' effectiveness is dependent upon people's adherence to them. Therefore, it is crucial to understand the potential factors that explain guideline adherence. In the present brief research report, we investigated need for structure and trait victimhood, i.e., the tendency to feel like a victim, and their effect on fear of the pandemic, which in turn, predicted guideline adherence. Furthermore, the association between (...) fear and guideline adherence was shaped by participants' global self-efficacy: higher levels of self-efficacy predicted more guideline adherence regardless of fear levels. The present findings may be relevant to health messaging endeavors aiming to improve compliance with guidelines. (shrink)

In this paper I explore the concept of tolerance and suggest a description of that concept that could be accepted regardless of the political theory one supports. Since a neutral perception of the limits of tolerance is impossible, this paper offers a guideline for a substantive-liberal or a perfectionist-liberal approach to it. The limits of tolerance are described through the principles of reciprocity and proportionality. The former explains why intolerance should not be tolerated whereas the latter prescribes how and to (...) what extent it should be tolerated. The cumulative effect of these principles is that apart from extremely rare occasions intolerance should not be tolerated at any time. (shrink)

We show the existence of Lorentz invariant Berry phases generated, in the Stueckelberg–Horwitz–Piron manifestly covariant quantum theory (SHP), by a perturbed four dimensional harmonic oscillator. These phases are associated with a fractional perturbation of the azimuthal symmetry of the oscillator. They are computed numerically by using time independent perturbation theory and the definition of the Berry phase generalized to the framework of SHP relativistic quantum theory.

Beilin was a former chief negotiator for the Israeli government in the Oslo process at Camp David and Taba. He brings a valuable contribution to this volume as a practitioner and political scientist involved directly in conflict negotiations. After fulfilling his post as the Minister of Justice for the Israeli government, he became one of the lead Israeli representatives in the Geneva Accord negotiations. In this sceptical work, Beilin points to the possible dangers of speaking about the combined concepts of (...) justice and peace, believing that there cannot be one without the other. Peace treaties have often been signed and implemented by the victors of conflict, but have left the population on either side out of the determinations of justice. Beilin presents a history filled with examples in which political leaders have bypassed opportunities for peace because they did not deem the conditions just, and thus perpetuated conflict with untold costs. The use of artificial intelligence (AI) to aid legal decision making has become prominent. This paper investigates the use of AI in a critical issue in employment law, the determination of a worker’s status—employee vs. independent contractor—in two common law countries (the U.S. and Canada). This legal question has been a contentious labor issue insofar as independent contractors are not eligible for the same benefits as employees. It has become an important societal issue due to the ubiquity of the gig (...) economy and the recent disruptions in employment arrangements. To address this problem, we collected, annotated, and structured the data for all Canadian and Californian court cases related to this legal question between 2002 and 2021, resulting in 538 Canadian cases and 217 U.S. cases. In contrast to legal literature focusing on complex and correlated characteristics of the employment relationship, our statistical analyses of the data show very strong correlations between the worker’s status and a small subset of quantifiable characteristics of the employment relationship. In fact, despite the variety of situations in the case law, we show that simple, off-the-shelf AI models classify the cases with an out-of-sample accuracy of more than 90%. Interestingly, the analysis of misclassified cases reveals consistent misclassification patterns by most algorithms. Legal analyses of these cases led us to identify how equity is ensured by judges in ambiguous situations. Finally, our findings have practical implications for access to legal advice and justice. We deployed our AI model via the open-access platform, https://MyOpenCourt.org/, to help users answer employment legal questions. This platform has already assisted many Canadian users, and we hope it will help democratize access to legal advice to large crowds. (shrink)

The behavioral decision-making and negotiations literature usually advocates a first-mover advantage, explained the anchoring and adjustment heuristic. Thus, buyers, who according to the social norm, tend to move second, strive to make the first offer to take advantage of this effect. On the other hand, negotiation practitioners and experts often advise the opposite, i.e., moving second. These opposite recommendations regarding first offers are termed thePractitioner-Researcher paradox. In the current article, we investigate the circumstances under which buyers would make less favorable (...) first offers than they would receive were they to move second, focusing on low power and anxiety during negotiations. Across two studies, we manipulated negotiators' best alternative to the negotiated agreement (BATNA) and measured their anxiety. Our results show that, when facing neutral-power sellers, weak buyers who feel anxious would make inferior first offers (Studies 1 and 2). When facing low-power sellers, weak buyers would make inferior first offers across all anxiety levels (Study 2). Our findings shed light on two critical factors leading to the Practitioner-Researcher paradox: power and anxiety, and offer concrete guidelines to buyers who find themselves at low power and highly anxious during negotiations. There is a growing scientific interest around entrepreneurship. One central line of research examines how different personality traits and characteristics such as creativity or resilience relate to entrepreneurial intentions and behavior. In the current research, we add to this literature by focusing on trait victimhood, a trait that entrepreneurship research has overlooked and may be relevant to understanding entrepreneurial tendencies. In two studies in Israel among a sample of entrepreneurship students and a sample representing the general public, we show that (...) trait victimhood is negatively related to entrepreneurial personality and behavior. Moreover, Study 2 suggests that a strong sense of self-efficacy may buffer against trait victimhood’s adverse effects on behavioral entrepreneurship. (shrink)

This work offers a systematic interpretation of the problematics of disinterest in the Critique of Aesthetic Judgment. It examines Kant's thesis that the judgement of taste is free of considerations of morality or utility. Dahan Fan carefully traces Kant's differentiation between the agreeable, the good, and the beautiful, thus casting the relationship between the interests of reason and aesthetic disinterest in a new light.

Most democratic states tolerate, to various extents, conscientious objection. The same states tend not to tolerate acts of civil disobedience and what they perceive as selective conscientious objection. In this paper it is claimed that the dichotomy between civil disobedience and conscientious objection is often misguided; that the existence of a “civic conscience” makes it impossible to differentiate between conscientious objection and civil disobedience; and that there is no such thing as “selective” conscientious objection—or that classifying an objection as “selective” (...) has no significant moral or practical implications. These claims are supported by a preliminary, more general argument according to which conscientious objection is and should be tolerated because the objector lacks the ability to choose his conscience and to decide whether to act upon it. The lack-of-choice argument, it is claimed, applies equally to all types of conscientious objection, including those that are mistakenly called “selective” objection. It also applies to one type of civil disobedience. As a result, if a state is willing to tolerate non-selective conscientious objection, it may and at times must also tolerate selective conscientious objection and civil disobedience and to a similar degree. By enacting equality laws the liberal state decides the limits of liberal tolerance by relying on content-based rather than content-neutral considerations. Equality laws are not and cannot be neutral. They reflect a content-based moral decision about the importance and weight of the principle of equality vis-à-vis other rights or interests. This leads to the following conclusions: First, since equality laws in liberal democracies reflect moral-liberal values, conscientious objections to equality laws rely, almost by definition, on unjustly intolerant, anti-liberal and morally (...) repugnant values. Secondly, we should not shy away from explicitly relying on moral-liberal views when deciding whether it is justified to grant exemptions from equality laws. Thirdly, conscientious objections to equality laws should normally not be tolerated or accommodated by the state, because conscientious objections that rely on what is rightly perceived as unjustly intolerant, anti-liberal and morally repugnant values should not be tolerated in a tolerant-liberal democracy. Several possible approaches can be applied by the state when it responds to religious conscientious objections. These approaches compare the response to religious-conscientious objections with that to non-religious objections. If the content of the objector’s conscience is significant when deciding to grant conscientious exemptions, three approaches to the practice of granting conscientious exemptions are possible: First, a non-neutral liberal approach that takes into consideration the content of the conscience but not its religiosity as such; second, a pro-religious approach; and third, (...) an anti-religious approach. This paper contends that the non-neutral liberal approach and the pro-religious approach should be rejected in favor of an anti-religious approach to granting conscientious exemptions. The proposed anti-religious approach is as follows: (1) unjustified intolerance should not be tolerated; (2) empirical evidence links religion and intolerance – that is, people’s responses to measures of religion and intolerance are closely related; (3) theoretical evidence links (some) religions and intolerance; and (4) the religiosity of conscience gives the state a reason to refuse to grant conscientious exemptions. This paper explores two main arguments. The first argument is that religious persons—because they are religious persons—are likely to be more intolerant than non-religious persons. This argument is supported by decisive empirical evidence. The second argument is that there are meaningful, clear and unique theoretical links between religion, or, more precisely, certain types of religion, and intolerance. It is submitted that the special links between religion and intolerance are the result of seven characteristics of religion which are specified in the (...) paper. There is a common refrain in the literature on punishment that presumes the mutual exclusivity of defending retribution and adopting a humanistic or welfare-oriented outlook. The refrain, that if we want to be humane, or care about human welfare, we must abandon retributive punishment, anger, and resentment is readily repeated, endorsed, and relied upon. This article suggests that this opposition is false: retribution and welfare-orientation can not only be endorsed concomitantly, but are complimentary projects, and may even be grounded in (...) the same normative basis, such that if we endorse one we are already committed to ideas that ground reason to care about the other.My primary target will be claims that aim to undermine retributivism by demonstrating the desirability of welfare-orientation. If both can live together, demonstrating the attractiveness of one goes nowhere toward displacing the other. Further, establishing this claim invites further inquiry into classic questions about the “barbaric,” or “morally repugnant” credentials of retributivism. Confronting these claims will elucidate the consistency of adopting both retributive and welfare-oriented views, which, I suggest, can be jointly adopted and pursued. (shrink)

This article analyzes the question of how the size of bribes should impact criminal sanctions. In contrast to the commonly held view that punishment should increase with the size of the bribe, we argue to the contrary: that the punishment of the bribee should decrease with the size of the bribe. Our conclusion is based both on a philosophical argument and an economic argument. We argue that all else being equal, as an agent’s reservation price for selling public interests decreases, (...) the culpability of the agent willing to receive a bribe increases. In addition, from an economic perspective, the expected social harm of an official acting with a low reservation price for bribes is much greater than one acting with a high reservation price: both the susceptibility of being bribed as well as the potential for social harm is much greater when the reservation price is low. Imbalanced plasticity of neural networks in the brain is proposed to underlie deficits in the integration of efferent and afferent processes in schizophrenia. These deficits affect the priming of the behavior implementing systems by prior knowledge, and thus impair both controlled regulation and automatic activation of mental and motor processes. The sense of self as a distinct entity can consequently be undermined. In predominantly reality-distorting patients, hypo-plasticity of neural connectivity may cause the emergence of highly focused but inflexible patterns of (...) activation in their representation and response systems. This may lead to dominance of prepotent patterns of activity in these systems and a relative inability of higher control systems to bias lower level activity towards congruence with the ongoing cognitive and motor context. By contrast, predominantly disorganized patients are characterized by hyper-plastic connectivity. This leads to a weakening of prepotent response tendencies but also, as in reality-distorting patients, to less effective top-down contextual constraining. (shrink)

In the early 1990s Israel underwent a so-called constitutional revolution. According to the champions of this revolution, Israel has essentially become, as a result of this momentous event, a constitutional democracy, upholding individual freedom and liberties and allowing for judicial review of parliamentary legislation. Despite the congratulatory rhetoric, it is generally agreed upon that the constitution is still in need of some essential supplements before Israel can qualify as a fully constitutional democracy. The main question addressed in this paper is (...) the following: is it ‘reasonable’ that Israel take the further necessary steps that qualify it as a fully constitutional democracy? The doubts raised in this regard stem from the very concerns that lead political philosophers (mainly Rawls) to stress the unique value of liberal democracy. As they argue, liberal democracy provides deeply divided societies with the best means to secure their legitimacy and political stability. Israel's political realities, I argue, defy this claim. Moreover, Israel's political realities may also carry a valuable lesson to other states, even to seemingly robust liberal democracies. It is not the purpose of the paper, of course, to argue that Israel's existing rule of government should be embraced by other states – far from that. Israel should undergo some radical changes so that it can protect the rights and interests of all its citizens. Yet, to achieve this purpose, it should transcend, I will argue, liberal democracy. As matters stand, simply strengthening its liberal character, Israel's political system may be exposed to a growing challenge to its legitimacy and stability. It should, therefore, reject liberal democracy and especially the principle of neutrality that is intimately connected with a liberal rule of government and embrace, instead, the ideal of multicultural democracy. This ideal, I argue, is better equipped to answer the need of deeply divided societies to secure their legitimacy and stability. (shrink)

My dissertation is about the scope and limits of practical rationality. Specifically, it is intended as a critical essay on instrumental rationality; it will also include some suggestions on how to go beyond instrumental rationality. ;The instrumental conception of rationality expresses a recurrent theme in modern contemporary philosophy. This theme made its first formidable appearance in the work of Hobbes, and since then it has dominated most of the debates about the objectivity of moral values, personal values, and ideals. Depending (...) on their aspirations, the participants of these debates have either accepted the instrumental theme or wanted to expose its shortcomings. ;The instrumental theme is identified with two complementary theses. According to the first thesis, humans are identified as desire-maximizers who are motivated to act only by their actual desires, inclinations, and dispositions. Under this conception, even morality is perceived as being a set of prudential precepts reducible to the agent's concern with the satisfaction of his desires . ;According to the second thesis, rational deliberation has only the limited function of selecting effective means to satisfying one's desires. That is, rational deliberation does not involve the furnishing of the practical agent with new desires and goals, nor are his desires and goals susceptible to rational appraisal. The rationality of a person is a direct function of his capacity to select proper means for satisfying his desires: the more efficient the means, the more rational the person's conduct. The skeptical thrust of the second thesis amounts to the denial of intrinsic value to any desire or goal. ;My critical discussion of the instrumental conception is intended to show two things. First, the ultimate goal of humans cannot be identified solely with the satisfaction of desires; and second, reason is capable of doing more than just selecting efficient means for satisfying one's desires. The idea guiding my critical discussion of the instrumental conception is that personal values and ideals are susceptible to rational appraisal--an appraisal that contributes essentially to the conception of what it means to be rational. Indeed, this kind of appraisal is what carries us beyond instrumentalism. (shrink)

Rousseau's Emile has attracted an avalanche of critical responses. His theme of negative education, or as he defines it, “well-regulated freedom”, has been denounced as outright manipulation in disguise, which instead of respecting the child's autonomy and dignity, places him at the whim of the teacher's machinations and stratagems. His recommendation that the child's imagination be curtailed (that he may not acquire desires which cannot be satisfied) is widely held to militate against one of the most cherished goals of education: (...) the fostering of the natural curiosity of the child. Rousseau is also accused of professing an “ideology of childhood” which ignores the real needs of children. In the sterilized environment which Rousseau proposes for the growing child, affection, praise and approval, are some of the sacrifices made to this ideology. Furthermore, his views on women are considered degrading, outrageous and blatantly sexist. Yet despite the myriad criticisms leveled against his work, Rousseau's Emile highlights one of the most exacting challenges for education — how to educate the child without alienating him. Rousseau connects this issue with the larger problem of alienation: namely, that experienced by man within the modern social order. Rousseau's views anticipate the contemporary debate between virtue-based and deontological ethics. The purpose of this paper is (i) to describe Rousseau's diagnosis of the problem of alienation as it arises in the various spheres of human life, paying special attention to the moral domain, and (ii) to assess the solutions he offers to the problem of alienation. These solutions are based on a conception of the good life which, I argue, is unacceptable. I also argue that this conception dissipates one form of alienation only at the expense of creating another. The paper begins by tracing the changes which the concept of alienation has undergone, and consequently I draw a distinction between two kinds of alienation — conscious and unconscious. I demonstrate that even if Rousseau is successful in offering a remedy for conscious alienation, this very remedy itself gives rise to unconscious alienation. (shrink)

ABSTRACT“How should a person lead her life?” The purpose of this paper is to suggest some principles (not a complete list) which will serve us ‘intellectual instruments’ for assessing forms of life. These principles are utilitarian in nature, and, as I will argue, essential to a reasonably rich account of personal well-being. The principles suggested are not instrumental, that is, they determine the worthiness of a form of life led by an agent irrespective of whether it satisfies her existing desires (...) and meet her actual preferences. Hence, I will argue that a person can be deprived, that is, categorically deprived, even when most of her desires are satisfied. In the last section of the paper I will argue for the role of education in ‘initiating’ the agent into worthy forms of life, and hence evading the charge of categorical deprivation and that of irrationality.
