It is widely apparent in our hyper-globalized world that the epistemologies, institutions, and practices underwriting it have reached a state of profound crisis. In the globalized world, everything is inevitably brought into proximity and correlation. Wars, natural disasters, climatic upheaval, nor political and economic turmoil, none of these can be effectively isolated, insulated, instituted, even immunized, as something apart, something that might be considered proper only to itself. This collected edition considers this crisis of the proper with a focus on (...) Italian political theorist Roberto Esposito’s work on community, immunity, and biopolitics. This collection introduces Esposito’s work to a wider English-speaking audience and provides many important contributions to the burgeoning scholarship on his political theory. Important international scholars working in this area examine and analyze his theory from a variety of perspectives, including those of biopolitics, feminism, political theory, the history of philosophy , property, community, and gift economies. The collection also includes previously untranslated essays by Esposito and Jean-Luc Nancy. The application of Artificial Intelligence (AI) in healthcare and epidemiology undoubtedly has many benefits for the population. However, due to its environmental impact, the use of AI can produce social inequalities and long-term environmental damages that may not be thoroughly contemplated. In this paper, we propose to consider the impacts of AI applications in medical care from the One Health paradigm and long-term global health. From health and environmental justice, rather than settling for a short and fleeting green honeymoon (...) between health and sustainability caused by AI, it should aim for a lasting marriage. To this end, we conclude by proposing that, in the upcoming years, it could be valuable and necessary to promote more interconnected health, call for environmental cost transparency, and increase green responsibility. The moral psychology of sympathy is the linchpin of the sentimentalist moral theories of both David Hume and Adam Smith. In this paper, I attempt to diagnose the critical differences between Hume's and Smith's respective accounts of sympathy in order to argue that Smithian sympathy is more properly suited to serve as a basis for impartial moral evaluations and judgments than is Humean sympathy. By way of arguing this claim, I take up the problem of overcoming sympathetic partiality in the (...) construction of a moral point of view, acknowledged by both writers, as my primary platform. My contention is that Humean sympathy is too mechanistic to actually deliver an impartial adjudicatory perspective, and that Smithian sympathy, with its evaluative, imaginative components, succeeds where Hume's account falls short. The paper is comprised of six sections: (i) introductory remarks, (ii) a discussion of Humean sympathy, (iii) a discussion of Smithian sympathy and its distinctness, (iv) a critical analysis of Hume's attempt to correct for sympathetic partiality in the construction of the judicial spectator's general point of view, (v) a critical discussion of sympathetic partiality in Smithian sympathy & (vi) a critical analysis of Smith's construction of the impartial spectator perspective as a moral point of view. Michael Polanyi articulates two arguments against the view that moral judgment has no proper place in the conduct of political science: Non-judgmental political science cannot understand what it studies; and non-judgmental political science cannot understand the political scientist himself. Evaluation of these arguments not only clarifies important dimensions of Polanyi’s conceptions of understanding and tacit inference, it prompts a reconsideration of the nature of both moral deliberation and moral truth. The COVID-19 pandemic has raised suspicions of ageism and gerontophobia in various health rationing practices. Age is a controversial triage criterion. This article clarifies the ethical relevance of age within triage systems, particularly its role within the principles of fairness and efficiency. Fairness requires giving more opportunities to those who have completed fewer life cycles. Efficiency takes age into account surreptitiously when trying to maximize short-term (saving lives) and long-term (saving years of life) benefits. Finally, age should not be the final rationale in triage decisions, although it is a variable to be taken into account because of its implicit presence in fundamental principles of prioritization. Sion in Mamluk Jerusalem1Jon Paul Heyne (bio)In the spring of 1353, roughly half a century after the Latin world's loss of Acre, the Florentine lady Sofia degli Arcangeli purchased lands in Mamluk Jerusalem for the establishment of a pilgrim hospital run by a group of select companions.2 Thus began the Latin (...) hospice of St. Mary's of Mt. Sion. For twenty years under Sofia's direction, the foundation obtained numerous privileges from the popes until suddenly, in 1375, Gregory XI denounced Sofia, forbidding her continued association with the hospital. Shortly thereafter, care of St. Mary's fell into the hands of a community of Franciscan friars living in Jerusalem—members of the recently formed Franciscan Custody of the Holy Land—who in turn established various regulations for the workers at the hospital, identified simply as women (mulieres) of the hospice.3 By the fifteenth century, the community at St. Mary's was transformed into a female house of Third Order Franciscans directly under the authority of the Custody, which, [End Page 33] for its own part, had adopted the regular Observance sub vicariis of the Franciscan order.The story of Sofia's hospital and its associated house of workers raises important questions regarding the relationship of penitential lay communities to the papacy and to the mendicant orders in the late medieval period. At first glance, St. Mary's appears simply to have encountered the same fate of many quasi-religious groups in the fourteenth and fifteenth centuries; driven by papal, clerical, and Observant efforts to establish uniformity and avoid heresy among lay penitents, the hospice fell under the supervision of the Franciscans, and the women living and working there were made tertiary members of the friars' order. Was, however, this clerical interest in regulating penitential groups the primary driving force in the development and transformation of Sofia's hospital? How did the hospital's location in Jerusalem, a city under Islamic rule, influence the dynamics that formed between Sofia and the popes and between the community at St. Mary's and the nearby Franciscan monastery? I argue that both the popes' changing relationship with Sofia and the formation of closer ties between the hospice community in Jerusalem and the Franciscan Custody had as much or more to do with the opportunities and challenges presented by the hospital's position as a Latin establishment in the Mamluk Empire as it did with clerical preoccupations to promote uniformity in the late medieval Church. Thus, the history of St. Mary's expands upon recent scholarly understandings of the creation of the third orders, offering a view of these tertiary communities within the wider scope of Muslim-Christian relations in the Mediterranean.Before examining the history of St. Mary's, I offer a brief overview of recent scholarship on female tertiary communities.4 Traditional narratives on the Franciscan Third Order assert that the tertiaries officially began with St. Francis or at the very least with the creation of an "order of penitents" through the 1289 bull Supra montem.5 Several studies have challenged this older interpretation, describing the formation of the Third [End Page 34] Order Franciscans as a much messier and less coherent process spanning the thirteenth through sixteenth centuries.6 According to some of the most recent revisionist approaches, female penitential establishments first fell under increased clerical scrutiny and canonical regulation in the late thirteenth century and early fourteenth centuries.7 Nonetheless, despite such ecclesiastical efforts to conform penitential groups to more traditional forms of religious life—by requiring enclosure, a rule, and the direct association with an existing order—many lay communities remained merely quasi-religious and even those that adopted Supra montem as a "rule" were only superficially connected to the Franciscan friars. In this short article, my aim is to introduce readers to some debates about religious freedom and constitutional law in the United States. I highlight a few of the enduring questions debated by political philosophers and legal scholars. For example, does the Constitution require special religious exemptions for citizens whose religious convictions put them at odds with otherwise neutral and legitimate state pol- icy? Should the Constitution be interpreted as supporting a strict secularism or a multicultural egalitarian liberal position? (...) What are the limits to religious freedom? I suspect that the concept of explanation I operate with is not especially idiosyncratic, is not fully captured in the existing philosophical literature, and that it may be the more appropriate concept if we are to consider explanation as the goal of physics. This paper explores what happens to the identity of self when entering a place of protest, and what happens to it on leaving. In short, it explores the relations between identities of self and place. Acknowledging the presence of a multiplicity of identities in relation to both notions, it examines the ways in which aspects of the self influence place, and conversely, how aspects of place influence the self. By using empirical examples from Environmental Direct Action, the paper follows (...) Casey in arguing for the co-constitution of self- and place-identities. This article considers what it means to give plants a voice as witnesses to nuclear events. It examines two texts that attempt to represent the nonverbal testimony of irradiated plants through a hybrid approach of text and image: Sugihara Rieko’s Pilgrimage to the A-Bombed Trees (Hibakuju junrei, 2015) and Michael Marder and Anaïs Tondeur’s The Chernobyl Herbarium: Fragments of an Exploded Consciousness (2016). Published a year apart, both texts focus on the afterlife of nuclear catastrophes: the atomic bombing of Hiroshima (...) in 1945 and the Chernobyl nuclear disaster in 1986. Sugihara’s book is an account of the hibakujumoku – trees that survived the atomic bombing of Hiroshima and continue to produce new growth to this day. Combining maps, photographs, interviews, and short essays, Pilgrimage to the A-Bombed Trees is intended as an immersive guidebook to the nearly 170 irradiated trees located within a two-kilometer radius around Hiroshima’s ground zero. It presents these trees as “living witnesses” whose subsequent flourishing has provided human survivors with a conceptual figuration of destructive plasticity. Marder and Tondeur’s The Chernobyl Herbarium formally resembles Sugihara’s Pilgrimage to the A-Bombed Trees, and likewise combines text (a combination of short theoretical essays and personal remembrances of the Chernobyl meltdown) and images (Tondeur’s photograms of plants grown in the exclusion zone) into a slim volume that calls for a rejection of language as the sole means of bearing witness. According to Marder, Tondeur’s photograms “bring out the testimony of the plant,” and yet the same procedure renders these plant witnesses “specimens,” full of radioactivity but devoid of life (something Sugihara’s book avoids through the medium of photography). The Chernobyl Herbarium is an attempt to capture, in fragmentary form, the limits of language in the conceptualization of plant life and in the proper conceptualization of the Chernobyl disaster. Ultimately, both texts are experiments to “think the unthinkable and represent the unrepresentable,” to borrow Marder’s words, through a deep, speculative engagement with the botanical realm. As wordless testimony is given voice through human–botanical intra-action, the plasticity of plant life (its capacity to adapt and change) is highlighted, and this allows us to locate moments of phytomorphism – the attribution of vegetal qualities to the human – in these two self-proclaimed “guidebooks.”. The aim of this article is to consider the prospects of a liberal conception of religious freedom in some Muslim-majority states. Part I offers a brief sketch of three approaches to religious freedom that inform my view. Part II then presents a liberal framework for religious toleration that draws ideas from Rainer Forst’s Toleration in Conflict, as well as some perennial themes in classical liberal thought. I briefly examine three case studies in Part III: the Turkish Republic; the Arab Spring (...) states; and the post-Soviet republics of Central Asia. This is followed by a short conclusion. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:Borges on Language and TranslationJon StewartAlthough Jorge Luis Borges had years of philosophical training and expressed a number of philosophical theories in his literary works, he never published a philosophy treatise. The result is that his oeuvre has often been viewed as purely literary and been largely neglected by trained philosophers. However, by ignoring the philosophical aspects of Borges’s thought, criticism has neglected a vast dimension of his work (...) and has thus frequently misunderstood and misinterpreted many aspects of it. As I have tried to demonstrate in an earlier article, 1 there are important philosophical themes in the short stories of Borges, which have yet to be considered. In the present essay, I take up one of these heretofore neglected themes.We can find perhaps no better example of the literary exposition of Borges’s philosophical ideas than in his short story or cuento, “Averroes’ Search.” 2 There Borges reconstructs for us a culture and an age radically different and temporally distant from our own. He recounts the story of Averroes, the Arab philosopher living in Spain in the second half of the twelfth century. The history of philosophy knows Averroes as one of the great medieval commentators on the works of Aristotle. Borges recreates the historical moment and the passion of Averroes in his task of translating and providing a commentary for the texts of the great Greek philosopher who remains forever distant from him. The story takes as its point of departure Renan’s observation about a curious misinterpretation of Aristotle found in Averroes: “S’imaginant que la tragédie n’est autre chose que l’art de louer...”(p. 180). Borges poses [End Page 320] the question of why Averroes, who had dedicated his life to understanding the work of Aristotle, had so badly misunderstood the concept of tragedy treated by the Greek philosopher. To answer this question, Borges brilliantly employs the faculty of historical imagination in order to think himself back into Averroes’s particular time period and cultural context. The short story presents us with a thesis about the intimate connection between culture and language and the ultimate futility of translation and crosscultural knowledge and comprehension. In the present essay, I wish to argue that the point of Borges’s story about the fate of Averroes is (1) to refute the common view which sees language as an entity neutral with respect to culture and history, and (2) to bring to light the comprehensive nature and scope of particular culturally and historically determined ways of thinking and perceiving the world. These philosophical elements have been neglected by the various literary scholars who have treated the works of Borges. 3 Moreover, Borges anticipates many of the most celebrated epistemological and hermeneutical theories of our day from philosophers such as Gadamer, Davidson and Quine, and presents them in literary form.IThere is a common view according to which the manifold languages of the various peoples and cultures of the world are more or less interchangeable. According to this linguistics of common sense, language is something secondary and accidental which is only an inessential corollary to our basic understanding and perception of the world. Human perception and cognition are thought of as constants for all humans everywhere. A dog will be perceived as a dog regardless of time period, place or culture, and the words we create to represent “dog” in the medium of language are secondary and even arbitrary. As a result, individual words in one language correspond to individual words in another. Dog in English corresponds straightforwardly to Hund in German or perro in Spanish, and nothing could be more simple. The gifted translator is merely someone with a great capacity to memorize words and to effect rapid replacement changes, and translation is regarded as a more or less mechanical process with little room for creativity. The diversity of languages is neither epistemologically necessary nor important, but rather explained as an historical accident as in the etiological tale of the Tower of Babel. This article provides an English translation of Johan Ludvig Heiberg’s “Literary Winter Crops” from 1843. The young Kierkegaard cultivated a positive relationship with Heiberg, who was the most powerful cultural figure in Denmark at the time. Heiberg published Kierkegaard’s first articles in his literary journal Kjøbenhavns flyvende Post, and in Kierkegaard’s early works such as From the Papers of One Still Living and The Concept of Irony, there are clear signs that he continued to court Heiberg’s favor. Heiberg’s dismissive book (...) review of Either/or in “Literary Winter Crops” definitively ended the relationship. Deeply offended, Kierkegaard from this point on waged a polemical war with Heiberg. Heiberg’s short review played a large and negative role not just in their personal relationship but also in Kierkegaard’s development generally. In a widely read essay, “For the Law, Neuroscience Changes Nothing and Everything,” Joshua Greene and Jonathan Cohen argue that the advance of neuroscience will result in the widespread rejection of free will, and with it – of retributivism. They go on to propose that consequentialist reforms are in order, and they predict such reforms will take place. We agree that retributivism should be rejected, and we too are optimistic that rejected it will be. But we don’t think that such (...) a development will have much to do with neuroscience – it won’t, because neuroscience is unlikely to show that we have no free will. We have two main aims in this paper. The first is to rebut various aspects of the case against free will. The second is to examine the case for consequentialist reforms. We take Greene and Cohen’s essay as a hobbyhorse, but our criticisms are applicable to neurodeterministic anti-free-willism in general. We first suggest that Greene and Cohen take proponents of free will to be committed to an untenable homuncular account of agency. But proponents of free will can dispense with such a commitment. In fact, we argue, it is Greene and Cohen who work with an overly simple account of free will. We sketch a more nuanced conception. We then turn to the proposal for consequentialist reforms. We argue that retributivism will fall out of favor not as a consequence of neuroscience-driven rejection of free will, but rather, as a result of a familiar feature of moral progress – the expanding circle of concern. In short, retributivism can and must die, but neuroscience will not kill it – humanity will. (shrink)

The goal of this paper is to expose the research misconduct of pharmaceutical industry-sponsored clinical trials via three short case studies of corrupted psychiatric trials that were conducted in the United States. We discuss the common elements that enable the misrepresentation of clinical trial results including ghostwriting for medical journals, the role of key opinion leaders as co-conspirators with the pharmaceutical industry and the complicity of top medical journals in failing to uphold standards of science and peer review. An important concern sometimes voiced in the neuroethical literature is that swift and radical changes to the parts of a person’s mental life essential for sustaining his/her numerical identity can result in the person ceasing to exist—in other words, that these changes may disrupt psychological continuity. Taking neurointerventions used for rehabilitative purposes as a point of departure, this short paper argues that the same radical alterations of criminal offenders’ psychological features which under certain conditions would result in a disruption (...) of numerical identity can be achieved without these having any effect on numerical identity. Thus, someone interested in making radical alterations to offenders’ psychology can avoid the charge that this would kill the offenders, while still achieving a radical transformation of them. The paper suggests that this possibility makes the question of what kinds of qualitive alterations to offenders’ identity are morally permissible pressing, but then briefly highlights some challenges for arguments against making radical qualitative identity alterations to offenders. There is little debate regarding the acceptability of providing medical care to restore physical or mental health that has deteriorated below what is considered typical due to disease or disorder (i.e., providing “treatment”—for example, administering psychostimulant medication to sustain attention in the case of attention deficit disorder). When asked whether a healthy individual may undergo the same intervention for the purpose of enhancing their capacities (i.e., “enhancement”—for example, use of a psychostimulant as a “study drug”), people often express greater hesitation. (...) Building on prior research in moral philosophy and cognitive science, in this work, we ask why people draw a moral distinction between treatment and enhancement. In two experiments, we provide evidence that the accessibility of health-related interventions determines their perceived descriptive or statistical normality (Experiment 1), and that gains in descriptive normality for such interventions weaken the moral distinction between treatment and enhancement (Experiment 2). In short, our findings suggest that the tendency to draw a moral distinction between treatment and enhancement is driven, in part, by assumptions about descriptive abnormality; and raise the possibility that normalizing novel biomedical interventions by promoting access could undermine people’s selective opposition toward enhancement, rendering it morally comparable to treatment. Disasters may disproportionately impact older adults due to sensory deficits, diminished social support networks, financial limitations, and displacement from familiar environments. During and shortly after a disaster, older adults' mental health needs may be overlooked for varied reasons, including concerns about stigma and lack of information about available services. Law can protect the mental health of older adults in disaster and non-disaster circumstances, but it sometimes may frustrate efforts to address older adults' mental health concerns. There is limited knowledge about sleep in adolescents with elevated levels of anxiety treated within primary health care settings, potentially resulting in sleep problems not being sufficiently addressed by primary health care workers. In the current study self-reported anxiety, insomnia, sleep onset latency, sleep duration, and depressive symptoms were assessed in 313 adolescents referred to treatment for anxiety within primary health care. Results showed that 38.1% of the adolescents met criteria for insomnia, 34.8% reported short sleep duration, and 83.1% (...) reported long sleep onset latency. Total anxiety symptoms were related to all sleep variables after controlling for age and sex. Furthermore, all anxiety symptom sub-types were associated with insomnia and sleep onset latency, whereas most anxiety subtypes were associated with sleep duration. Adolescents’ depressive symptoms accounted for most of the anxiety-sleep associations, emphasizing the importance of depressive symptoms for sleep. However, anxiety was associated with insomnia and sleep onset latency also among youth with low levels of depressive symptoms. The findings suggests that primary health care workers should assess sleep duration, sleep onset latency, and insomnia in help-seeking adolescents with anxiety. (shrink)

In his Lectures on the Philosophy of Religion, Hegel treats the religions of the world under the rubric "the determinate religion." This is a part of his corpus that has traditionally been neglected since scholars have struggled to understand what philosophical work it is supposed to do. In Hegel's Interpretation of the Religions of the World, Jon Stewart argues that Hegel's rich analyses of Buddhism, Hinduism, Zoroastrianism, Judaism, Egyptian and Greek polytheism, and the Roman religion are not simply irrelevant historical (...) material, as is often thought. Instead, they play a central role in Hegel's argument for what he regards as the truth of Christianity. Hegel believes that the different conceptions of the gods in the world religions are reflections of individual peoples at specific periods in history. These conceptions might at first glance appear random and chaotic, but there is, Hegel claims, a discernible logic in them. In recent years interest in the thought of Kierkegaard has grown dramatically, and with it the body of secondary literature has expanded so quickly that it has become impossible for even the most conscientious scholar to keep pace. The problem of the explosion of secondary literature is made more acute by the fact that much of what is written about Kierkegaard appears in languages that most Kierkegaard scholars do not know. Kierkegaard has become a global phenomenon, and new research traditions (...) have emerged in different languages, countries, and regions. The present volume is dedicated to trying to help to resolve these two problems in Kierkegaard studies. Its purpose is, first, to provide book reviews of some of the leading monographic studies in the Kierkegaard secondary literature so as to assist the community of scholars to become familiar with the works that they have not read for themselves. The aim is thus to offer students and scholars of Kierkegaard a comprehensive survey of works that have played a more or less significant role in the research. Second, the present volume also tries to make accessible many works in the Kierkegaard secondary literature that are written in different languages and thus to give a glimpse into various and lesser-known research traditions. I then discuss whether punishment can be appropriate for animals of each category, and if so what form punishment may appropriately take for animals of each category. The aim is to illuminate each type of punishment through comparison and contrast with the others. This both forestalls the overintellectualization of punishment which arises from viewing humans as the only paradigm case and forestalls the underintellectualization of human punishment which results (...) from making no essential reference, in an account of human punishment, to the human capacity for specifically critical reasoning. A classicist, philosopher, and poet, Poul Martin Møller was an important figure in the Danish Golden Age. The traumatic event of the death of his wife led him to think more profoundly about the question of the immortality of the soul. In 1837 he published his most important philosophical treatise, "Thoughts on the Possibility of Proofs of Human Immortality," presented here in English for the first time. It was read and commented upon by the leading figures of the Golden Age, (...) such as Søren Kierkegaard.
