De ce a fost fondată Uniunea Europeană? Un prim răspuns ar fi dorinţa de pace după un război devastator şi umilitor. Un al doilea răspuns ar fi realizarea importanţei unităţii. O unitate care se va caracteriza printr-o diversitate a culturilor şi a limbilor. Statele europene nu au dorit să renunţe la suveranitatea lor, au vrut să devină un corp comun pentru a nu a mai putea fi călcate în picioare de iureşul istoriei. Ca orice unitate, UE avea nevoie de un (...) cadru de reglementare oferit de instituţii şi politici europene. De asemenea, pentru a armoniza ceva trebuie să poţi pune împreună anumite elemente separate. Armonizarea Uniunii a fost realizată prin fondarea instituţiilor şi a reglementărilor acestora (structura instituţională a UE este prezentată în Anexa nr. 1). Instituţionalizarea Uniunii Europene este cheia de boltă a construcţiei istorice europene. Început în anul 1957, acest proces a lăsat urme adânci în conştiinţa politică europeană. Dacă la început a fost privită cu reticenţă, acum Uniunea nu poate exista fără instituţii. (shrink)

După sfârşitul celei de a doua mari conflagraţii mondiale, Europa se afla în ruină şi dezastru economico-social. Ajutorul dat de Statele Unite ale Americii în reconstrucţia statelor europene a fost vital pentru supravieţuirea Occidentului european. În anul 1948, cinci state (Franţa, Marea Britanie, Belgia, Ţările de Jos şi Luxemburg) semnează Tratatul de Cooperare Culturală, Socială, Economică şi Apărare Colectivă, pe scurt Tratatul de la Bruxelles . După numirea generalului Dwight Eisenhower în funcţia de comandant suprem aliat în Europa, acest tratat (...) va deveni parte a documentelor NATO. Nevoia de apărare împotriva ameninţării sovietice se face şi mai vizibilă în propunerea ministrului de externe francez Réne Pléven. Planul Pléven, propus în anul 1952, viza constituirea unei Comunităţii Europene a Apărării, dar şi a unei Comunităţi Politice Europene. Planul nu a fost votat de către Adunare Franceză în anul 1954. Eşecul acestei comunităţi se datorează lipsei de viziune a liderilor europeni. O altă piedică în adoptarea acestui plan a fost teama statelor naţionale de posibila federalizare a Europei. (shrink)

Ca actor pe scena internațională, UE trebuie să facă fată noilor pericole, amenințări și provocări, cu atât mai mult cu cât urmărește să joace un rol în securitatea globală ceea ce implică asumarea de responsabilități sporite, așa cum sunt prezentate în anexă. Mediul global este caracterizat prin insecuritate, astfel Uniunea Europeană are nevoie de un mecanism complex de management al crizelor. Dezvoltarea unei astfel de capabilități atrage de la sine o altă problemă majoră, dezvoltarea unei capabilități a Uniunii. Există pericolul (...) ca această nouă capabilitate să dubleze NATO sau există pericolul ca Uniunea să își dezvolte o capacitate dar fără puterea de a o proiecta. Un conflict ce se întrevede în viitor este între președintele Consiliului European și Înaltul Reprezentant al UE pentru afaceri externe şi politică de securitate, în opinia unor eurosceptici. Dezvoltarea acestor capabilități este necesară Uniunii ce se dorește un important actor pe scena internațională. (shrink)

The 20th century was a bloody one, full of armed clashes which destroyed Europe, withered an entire generation’s hope of European-level peace. After the Versailles Treaty, the famous economist John Maynard Keynes uttered this prophecy: ”With such a peace treaty, you’ll be at war again within 20 years”. John Maxwell Coetzee, an important South-African novelist, called the 20th century “Satan’s century”. A tough statement yet extremely true unfortunately. Besides war, the past one hundred years also witnessed terrible totalitarian regimes occur, (...) such as the Nazi and fascism. The hardness of those regimes at least equaled the suffering caused by the world wars. One wouldn’t be wrong to call such regimes state terrorism: a leader suppressing his own citizens just to satisfy his own fantasy. The hugeness of their deeds goes beyond human imagination according to the number of victims. A classical word of wisdom describes terrorism as follows: ”It kills a few, but terrifies more”. In an increasingly urbanized world, construction industry is called upon to serve the needs of human society, such as environmental protection and safety in terms of infrastructure. In this context, a sustainable and ethical development means a close connection between buildings and environment. This connection can be achieved through, for example, the concept of ecological concrete or green concrete, as it is often called. The conventional process of obtaining cement and mineral aggregates from the concrete composition generates pollution, especially through (...) greenhouse gas emissions. Also, one should not ignore the fact that extraction of the raw materials affects the habitats of the sites and of the neighboring areas. When construction materials are questioned, the ethical issues lay not in the means of expression, but mainly in the means of production. More to the point, the present contribution aimed to find solutions for enhancing the adhesion of vegetal aggregates with the cement matrix, in order to obtain a material with optimal mechanical properties, which is valued as an ethical approach of building industry. Results showed that plant aggregates can be used to obtain a building material which can be improved by using partial substitution of cement by silica fume, fly ash, or by using additives and that green concrete as an environmentally friendly material offers the alternative for lower energy use and fewer CO2 emissions. Marketers must understand not only the advantages of these green materials, but also that they have an ethical commitment to provide consumers with environmentally friendly materials. (shrink)

The paper aims to clarify several key aspects of Alexandru Dragomir: his amazing “technique” of keeping his entire knowledge in perfect working condition, his exceptional precision of references and his continuous disregard concerning writing. The root of all these peculiarities is traced back to Plato’s cognitive and moral arguments against writing, as expressed in Phaedrus and Seventh Letter. Finally, the article brings to light what seems to be the lesson of Dragomir’s life as a thinker: to rely only on (...) the living thought, that which is written “inside the soul”. (shrink)

Migration generates well-being for individuals and communities, but the pursuit of well-being is not without risks. Tens of thousands of Romanian children are affected by the migration of their parents, others have to cope with the effects of their own migration. Should migrants have difficulties adjusting when returning “home”? Is readjustment even possible for all remigrants, without support? The article aims to present some issues that the remigrants are confronted with when trying to readjust to their communities of origin. The (...) article shows how readjustment is influenced by the social image, which in turn influences the social support for their adjustment and subsequent development. (shrink)

Currently, humanity is experiencing an explosive growth in technological objects designed to improve the body and mind. The main objective of this article is to review two recent classificatory and explanatory systems to cognitive enhancement cybernetic technologies, including both wearable and implantable artifacts that reorganize human embodiment or extend the mind. I argue that an outdated model of the cognitive sciences serves as the basis for these revised systems and taxonomies. Taking an embodied approach to the cognitive sciences, I propose (...) an alternative focus to classify cognitive enhancement cybernetic technologies. Specifically, by adopting a non-orthodox enactive approach to embodied cognition, I propose a new classificatory system that redefines the notion of the cybernetically enhanced human, restricting it to a purely cognitive context. As populations grow and arable land becomes increasingly scarce, large-scale long- term land leases are signed at a growing rate. Countries and investors with large amounts of financial resources and a strong agricultural industry seek long-term land leases for agricultural exploitation or investment purposes. Leaders of financially poorer countries often advertise such deals as a fast way to attract foreign capital. Much has been said about the short-term social costs these types of leases involve, however, less has been said about (...) the normative dimension of their long-term environmental impact. We therefore will focus on the likely impact such deals have for soil conservation, by (1) briefly introducing the basics of long-term leasing arrangements by comparing land leases to the renting of buildings, (2) explaining from a soil sciences perspective the difficulties in assessing the current value of an estate and in calculating the damages of soil erosion and degradation, and (3) show how difficult it is to incentivize the conservation of soil quality when one cannot sufficiently and cost-effectively valorize existing environmental capital and eventual future damages. Attempting to oblige tenants through contracts to invest in sustainable stewardship has limited potential when liability payments do not reflect true costs and are hard to enforce. (shrink)

In this annotated critical edition of Aristotle’s Metaphysics Lambda Stefan Alexandru draws upon many hitherto unexplored sources of the direct and indirect tradition, inter alia upon an independent Greek manuscript he has discovered in the Vatican Library.

I. Science, myth, magic: three components of knowledge, in other words three types of activity in man who, in interaction with his surrounding environment seeks to accomodate himself to the constraints which this environment imposes on him while at the same time seeing to his own immediate or far-reaching needs.

We study some aspects of the emergence of _lógos_ from _xáos_ on a basal model of the universe using methods and techniques from algorithmic information and Ramsey theories. Thereby an intrinsic and unusual mixture of meaningful and spurious, emerging laws surfaces. The spurious, emergent laws abound, they can be found almost everywhere. In accord with the ancient Greek theogony one could say that _lógos_, the Gods and the laws of the universe, originate from “the void,„ or from _xáos_, a picture (...) which supports the unresolvable/irreducible lawless hypothesis. The analysis presented in this paper suggests that the “laws„ discovered in science correspond merely to syntactical correlations, are local and not universal. (shrink)

The debate about how neurotechnologies impact authenticity has focused on two inter-related dimensions: self-discovery and self-creation. In this paper, we develop a broader framework that includes the experimental and relational dimensions of authenticity, both understood as decisive for shaping one’s narrative identity. In our view, neurointerventions that alter someone’s personality traits will also impact her very own self-understanding across time. We argue that experimental authenticity only needs a minimum conception of narrative coherence of the self and that reversibility should remain (...) a key feature in the ethical assessment of neurotechnologies. The relational dimension of authenticity derives from the fact that a process of self-constitution is never a solitary business. The significant others act not just as subsequent judges of one’s life decisions, but as real co-authors of one’s self. We discuss relevant cases in which others are actively contributing to the meaning-making process, as to the direction one’s life is taking. We also claim that the experimental and the relational dimensions of authenticity should aim to correct each other. The relational dimension introduces socially approved standards as well as limitations to the array of available possibilities of self-fashioning or human enhancement. The experimental side enables us to avoid confusing one’s personal identity with a social and narrative construct that only bears the mark of social pressure and conformism. (shrink)

The forfeiture thesis is posed as an independent thesis in moral philosophy according to which agents forfeit (or lose) rights if they perform certain act-types. According to many, this thesis plays a crucial role in the justification of (legal) punishment. In this paper, I argue that the forfeiture thesis is unnecessary – we can simply dismiss it without any substantive loss. Echoing an aspect of the specificationist approach to rights, the reason is that we may replace the forfeiture thesis with (...) an exception clause in the very content of the right not to be subjected to hard treatment: P has no right not to be subjected to hard treatment simpliciter, but a right not to be subjected to hard treatment unless P performs an act-type φ – e.g., murdering an innocent person. This alternative has substantive advantages over the forfeiture thesis, which, in turn, shows that the former cannot be reduced to the latter. (shrink)

In this paper we aim to examine a novel view on distributive justice, i.e. limitarianism, which claims that it is morally impermissible to be rich. Our main goal is to assess the two arguments provided by Ingrid Robeyns in favour of limitarianism, namely the democratic argument and the argument from unmet urgent needs and the two distinct limitarian views which these arguments give rise to. We claim that strong limitarianism, which is supported by the democratic argument, should be rejected as (...) it fails to fully instantiate the value of political equality, while having some other unattractive implications as well. By contrast, we argue that weak limitarianism, which is supported by the argument from unmet urgent needs, should be endorsed, albeit in a qualified version which also takes responsibility constraints into consideration. Um marco sobre a questão do tempo na História da Filosofia, o livro XI das Confissões de Agostinho de Hipona (354–430) ainda hoje recebe interpretações. O presente artigo menciona pontos que já apresentei noutro texto sobre o tempo como espelho da alma, no entanto ele recebe o acréscimo de dois pontos que mudam a ênfase de minha interpretação prévia: (1) a citação a Josué e (2) a escolha de Deus creator ominum para exemplificar a relação, via tempo, entre ser humano, (...) Deus e o mundo. Mediante a análise textual do livro XI, a seguinte conclusão será encaminhada: embora Agostinho não recuse a existência do tempo como uma realidade independente das vivências humanas, ele privilegia outro aspecto do tempo, medular nas Confissões, a saber, a relação humana com o tempo em correspondência com a intenção da vontade pela qual a vida humana é governada. Em Agostinho, o tempo da vida se compromete com a ética, e reflete o modo como a vontade habita a vida. Tempo e alma, nas Confissões, são interdependentes a ponto de a experiência humana do tempo ser um espelhamento da vontade. (shrink)

Many intergovernmental organizations have recently established offices of internal oversight. Yet scandals have revealed serious flaws in the design of these institutions. This study argues that this is due, in great part, to the initial use of an imperfect domestic model.

Built in between the end of the nineteenth century and the beginning of the twentieth century in a mountainous region in Romania, the Peleş Castle and its gardens were conceived according to the mid sixteenth and early seventeenth centuries landscape design principles. Thus, the surrounding landscape, the park and gardens at the royal residence in Sinaia make up an overall image of a Mannerist landscape in which the Villa or, in this case, the castle, is integrated in a complex allegorical, (...) alchemical and political programme. To explore this chronologically incongruent design and to explore gardening principles perhaps invisible in plain sight for modern eyes, the following study aims to emphasize the presence of early modern Western European gardens in the design of the park and gardens at Peleş. This analysis will also reveal the various ways in which, by manipulating nature according to Late Renaissance and Mannerism principles, nature was staged to achieve political goals. (shrink)

Kitcher has proposed an ideal-theory account—well-ordered science (WOS)— of the collective good that science’s research agenda should promote. Against criticism regarding WOS’s action-guidance, Kitcher has advised critics not to confuse substantive ideals and the ways to arrive at them, and he has defended WOS as a necessary and useful ideal for science policy. I provide a distinction between two types of ideal-theories that helps clarifying WOS’s elusive nature. I use this distinction to argue that the action-guidance problem that WOS faces (...) remains even under the aims/means distinction, because the WOS’s failure is more basic than critics have suggested. In this paper, we raise two points. First, any rights‐based theory should provide a method by which to guide reasoning in addressing conflicts of rights. The reason, we argue, is that these theories must provide guidance on what should be done. Second, this method must contain two key recommendations: (1) We should try to find a deliberative mechanism through which none of the rights is simply eliminated from the scene; (2) these rights may be balanced against each other to define (...) which right should prevail, but without considering non‐rights‐interests as if they were rights in the process. These recommendations instantiate two crucial principles that underlie our common intuitions on rights, namely, the principle that rights deserve equal respect and the principle that rights should be taken seriously. Is it justified to hold that an agent S has a (moral) right to P if the duty-bearer is not specified? There is an intense ongoing debate on this question. There are two positions in the literature. On the one hand, O´Neill´s much-discussed account of rights holds that it is justified to say that an agent S has a right to P if and only if the duty-bearer is sufficiently determined – i.e. if and only if it is clear against (...) whom S may claim her right to P (O’Neill 1986, 1988, 1996, 2000, 2005, 2016). Call this, the ‘claimability condition’. On the other hand, interest-based theorists argue that it can be justified to say that an agent S has a right to P even if the duty-bearer is not sufficiently determined (Caney 2007; Griffin, 2008; Raz 1988; Tasioulas 2007; see also: Etinson, 2013; Ypi 2010). Who (if anyone) is correct in this fundamental discussion about the very nature of rights? In this paper, I provide an answer to this crucial question. Neither O´Neill nor interest-based theorists provide good reasons to justify their positions. However, I argue, the claimability condition is an existence condition of rights justified on the basis of their action-guiding character. The reason is that if the duty-bearer is not specified, the content of the right (its correlative obligation) does not sufficiently guide what the agent should do because it is indeterminate who is required to act (or refrain from acting). Dans cet article, je propose une exploration du phénomène du témoignage. Mon but est de montrer que la perspective phénoménologique rend possible une approche intégrative du témoignage, compris comme un phénomène qui engage la structure existentielle du sujet, articulant les relations entre langage, présence, mémoire, vérité et temporalité. Le témoin n’est pas seulement celui qui témoigne, mais d’abord celui qui affronte, dans sa présence expérientielle, un événement dont le sens est bouleversant et institue ainsi le sujet comme témoin : soit (...) comme « témoin endurant » si l’enjeu est d’abord le soi le plus propre du témoin, ou comme « témoin oculaire»s’il s’agit principalement de l’autre. Le témoignage trouve sa signification particulière dans la tension qui se creuse entre le pôle ontologique, où le témoin est compris comme « être là » en présence de l’événement sur le plan expérientiel, et le pôle herméneutique, où le témoin est convoqué devant les autres au niveau du langage. Une autre différence doit être tracée entre le « témoin-confessant », lorsque le témoignage porte précisément sur ce que le témoin a enduré soi-même, et le « témoin-tiers », dont le témoignage porte sur ce que l’on a principalement observé sans le subir soi-même. This paper raises some concerns about Paul Humphreys’ fusion emergence in general and about his core example of fusion emergence (i.e., covalent bonding) in particular. It argues that the extent to which covalent bonding undermines the idea that our world’s ontology is wholly compositional has been overstated.

In this paper, I argue that specificationism deprives rights of any significant role in practical reasoning before it arrives at a conclusion, while the generalist conception preserves the practical role we intuitively assign to rights in reasoning directed to action. Assuming that a conception of rights faithful to ordinary practical reasoning is preferable, this fact gives a strong reason to prefer generalism over specificationism, although not without qualification. To be satisfactory from the practical standpoint, any account of rights that adopts (...) the generalist view must include second-order principles to orientate agents with regards to addressing rights conflicts. I show that my practical analysis is substantially different from others available in the literature. (shrink)

The organizational account of biological functions interprets functions as contributions of a trait to the maintenance of the organization that, in turn, maintains the trait. As has been recently argued, however, the account seems unable to provide a unified grounding for both intra- and cross-generation functions, since the latter do not contribute to the maintenance of the same organization which produces them. To face this ‘ontological problem’, a splitting account has been proposed, according to which the two kinds of functions (...) require distinct organizational definitions. In this article, we propose a solution for the ontological problem, by arguing that intra- and cross-generation functions can be said to contribute in the same way to the maintenance of the biological organization, characterized in terms of organizational self-maintenance. As a consequence, we suggest maintaining a unified organizational account of biological functions. (shrink)

In this paper I aim to provide a novel account of the Democratic Argument for limitarianism. I first claim that the standard version of this argument is questionable due to its reliance on a problematic central premise, namely that excessive wealth damages democracy because of its detrimental impact on political equality. Subsequently, I relocate the fundamental democratic worry in regard to excessive wealth in the process of backsliding, and more specifically in the relation between excessive wealth and political polarization. I (...) then offer a new account of the Democratic Argument for limitarianism which envisages wealth capping as instrumental for democratic resilience, but I maintain that the argument is not unambiguously successful. RESUMO Em geral, podemos encontrar na literatura (tanto na popular quanto na acadêmica) atribuições de deveres coletivos complexos a coletivos não estruturados extensos de indivíduos. Por “deveres coletivos complexos”, quero dizer deveres coletivos que, de maneira plausível, exigem que os membros individuais de um coletivo não estruturado extenso empreguem tipos diferentes de ações contributivas para alcançarem um objetivo coletivo - por exemplo, o suposto dever coletivo universal de acabar com a pobreza mundial. Neste artigo, defendo que esses deveres não orientam (...) a ação. O motivo é por que eles não passam no que chamo de “teste de orientação de ação”. Esse teste pressupõe a crença intuitiva de que um dever moral orienta a ação apenas se, para o portador do dever, estiver claro o tipo de ação que ele deve praticar após a atribuição do dever. Deveres coletivos complexos atribuídos a coletivos não estruturados extensos não passam nesse teste porque, embora cada portador do dever (ou seja, cada membro do coletivo) receba orientação sobre o fim que se deve atingir em conjunto, não está claro para esses agentes o tipo de ação que cada um deles deve por em prática. Since Kaplan : 81–98, 1979) first provided a logic for context-sensitive expressions, it has been thought that the only way to construct a logic for indexicals is to restrict it to arguments which take place in a single context— that is, instantaneous arguments, uttered by a single speaker, in a single place, etc. In this paper, I propose a logic which does away with these restrictions, and thus places arguments where they belong, in real world conversations. The central innovation is (...) that validity depends not just on the sentences in the argument, but also on certain abstract relations between contexts. This enrichment of the notion of logical form leads to some seemingly counter-intuitive results: a sequence of sentences may make up a valid argument in one sequence of contexts, and an invalid one in another such sequence. I argue that this is an unavoidable result of context sensitivity in general, and of the nature of indexicals in particular, and that reflection on such examples will lead us to a better understanding of the idea of applying logic to context sensitive expressions, and thus to natural language in general. This paper argues for a revised concept of authenticity entailing two demands that must be balanced. The first demand moves authenticity from the position of a strictly self-regarding virtue towards the position of a fully social virtue, acknowledging the crucial feature of steadiness, i.e. self-consistency, as being precisely what we ‘naturally’ lack. Nevertheless, the value of personal authenticity in a modern, open society comes from the fact that it brings about not only steadiness, but also the public development of a (...) variety of existential options that can be understood as Millian ‘original experiments in living’. Thus the second demand of authenticity is a demand for ‘experimental’ authenticity which covers the whole spectrum of technologies of the self, from Nietzschean ‘brief habits’, to the use of enhancement technologies. El presente texto tiene como propósito analizar teórico-conceptualmente las prácticas pedagógicas de la ética implementadas por los docentes en la universidad tradicional y la universidad popular en los años 2010 – 2020. Teniendo en cuenta, primero, las características inherentes de la universidad tradicional tanto en sus orígenes y principios fundamentales; segundo, las practicas pedagógicas de la ética en el rol docente; y tercero, el advenimiento, desarrollo y propuesta de la Universidad popular. Mediante este análisis fue posible develar los paralelismos entre (...) sus divergencias y puntos de encuentro con base en la ética-práctica del rol docente, para el mejoramiento continuo tanto de esta área del conocimiento como de los demás saberes en general. The much-discussed “claimability objection” holds that it is unjustified to believe that all individuals have a human right to subsistence because the bearers of the correlative duties are not sufficiently determined. This argument is based on the so-called “claimability-condition”: S has a right to P if and only if the duty-bearer is sufficiently determined. Practice-based theorists defend the human right to subsistence by arguing that if we take the existing human rights practice seriously, there is no indeterminacy about the allocation (...) of duties. In this paper, I challenge this (apparently compelling) defense of the human right to subsistence with a dilemma. If the claimability condition is true, the practice-based defense fails to undermine the claimability objection because the duty-bearer is determined in some, but not all, cases. If practice-based theorists reject the claimability condition, they generate an account of human rights that is problematic from the practical perspective because it may contain duties that are unable to guide action. Barnes (2014) has argued in this journal for the following conditional: If there is any metaphysical indeterminacy, this must be at the most fundamental level of reality. To argue for this claim, Barnes relies on two principles that I shall call bivalent completeness and determinate link. According to the former, a complete description is a bivalent assignment of truth values to every sentence. The determinate link, instead, establishes that the determination relation between levels of reality preserves determinacy from one level (...) to another. In response to Barnes’ conclusion, Eva (2018) has recently pointed out that bivalent completeness is question begging. In this paper, I will first show why Eva's line of reasoning can be resisted. My aim will then be to present a stronger case against Barnes’ argument by challenging the determinate link. In the presence of metaphysical indeterminacy, the link between fundamental and derivative facts might itself be the locus of indeterminacy. I will conclude by showing that Barnes and Eva make many unwarranted assumptions regarding both indeterminacy and fundamentality. The logical space around the connection between these two notions appears to be much wider than what they seem to be aware of, or so I will argue. (shrink)
