Despite its authors’ intentions, the four principles approach to medical ethics can become crudely algorithmic in practice. The first section sets out the bare bones of the four principles approach drawing out those aspects of Beauchamp and Childress’s Principles of biomedical ethics that encourage this misreading. The second section argues that if the emphasis on the guidance of moral judgement is augmented by a particularist account of what disciplines it, then the danger can be reduced. The etymologizing which forms the torso of the Cratylus gives way, in the final pages, to an interesting, but brief, discussion of Heraclitean Flux. The transition is made on pages 437–8. Knowledge of reality through names has proved elusive because the names yield contradictory theses. This being so, it is argued that the truth is only to be obtained by a direct acquaintance with reality.

This study provides a moral justification of the family as a child-bearing and child-rearing institution by arguing that procreation may entitle parents to their children. It begins by observing that the belief that parents have such a right is deeply ingrained in the laws and customs of Western civilization but that at present we have no satisfactory theoretical explanation of this belief; and it further underscores the need for such an explanation by pointing to the conflict between a commitment to (...) equal opportunity and the family. ;Part I first considers the historical arguments philosophers have made on behalf of the family and shows why they fail. It argues that the traditional property argument fails because it interprets parental rights in terms of an absolute property right which is incompatible with the child's rights; that natural affection fails because some parents abuse their children and because adoptive parents may display "natural affection"; and that the best interest of the child fails because it cannot provide parents with a unique claim to their children. ;It then develops the property argument in a new and fruitful way. By replacing the traditional concept of an absolute property right with the modern "bundle of rights" analysis of property, it provides a means of analyzing parental rights in a way that prohibits abuse and is therefore compatible with the child's basic rights. Finally, it examines entitlement theory and argues that, since procreation satisfies its conditions, parents who adequately care for their children are entitled to them. ;Part II examines the nature of the parental entitlement claim. It argues for the rights necessary for paternalistic agency, interprets them according to a standard analysis of ownership, and concludes that a parental right to rear the child according to parental values is consistent with the child's rights. Next it argues that, in excluding others, parents incur a special obligation to do as much as they reasonably can for their child. And finally, it places things in a historical context, argues against an interpretation of parental obligation in terms of needs, and shows how the theory might work in practice. (shrink)

Aristotle’s notion of force seems to be the same as what we mean by “brute force,” or as an example of the Eudemian Ethics puts it, one is “forced” when one’s hand is literally seized by another and used to strike another person. But closer scrutiny suggests something else must be going on if for no other reason than that Aristotle, in his description of force, makes reference to a do-er (o( pra/ttwn [EN III.1.1110a2]). Based on such an insight, Flannery’s (...) “Force and Compulsion in Aristotle’s Ethics” subjects the account of forced actions, actions done under compulsion, and so called “mixed actions” in Aristotle’s ethical treatises to careful scrutiny. In my comments I focus upon two of his claims: First, that although Aristotle includes a notion of “brute force” in his account of force, he doesn’t limit his account just to that notion; and second, that Aristotle’s account of force presupposes or includes what he calls “a particular anthropology.”. Professor Garver’s “Living Well and Living Together” sheds light on one of the more confusing sections in Aristotle’s Politics, namely the discussion of the best way of life for individuals and city in Politics VII.1-3. At a distance, the conclusion of Aristotle’s remarks seem relatively clear: He endorses the claim that the most choice-worthy life and happiness of a city and an individual are the same. Further, the implications of such a claim for Aristotle’s political philosophy also seem clear: Aristotle’s (...) view of an “internally active” city amounts to a thorough critique of expansionist imperialism. But how these two surface level views—the best way of life for a city and the critique of imperialism—fit together is less than perspicuous. Garver’s paper goes after this text through the lens of two problems. First, Aristotle apparently argues from the nature of the best way of life or happiness for an individual to the best way of life for a city. But as Aristotle himself points out in his critique of the Republic, such an argument seems in danger of falling into a fallacy of composition. In response to such a perceived fallacy, Garver argues that Aristotle incorporates into his argument a third thing—what is the best life for a citizen or what Garver calls “common life” (p. 5, 6, of Garver’s text)—which mediates between the best life for a separate individual and for the city. As Garver puts it at one point “the best life for the citizen will be our means for discovering those [other] two” (p. 5, Garver’s text). The second problem which Garver raises concerns Aristotle’s apparent inference from energeiai to dunameis. Aristotle’s argument in Politics VII.1-3 begins from the claim that a city and individual have the same kind of happiness—namely, a sort of energeia—and extends to a claim about the structure which serves as the basis of that activity. The problem, according to Garver, is that “the virtues of the state cannot be energeiai of that part of its soul, because states don’t have souls” (p. 6, Garver’s text). The comparison between city and individual works—if it does work—only if “the psychological aspects of the virtue central to the Ethics become politically irrelevant” (p. 7, Garver’s text). Thus, Garver suggests that Aristotle’s comparison of city and individual comes at a cost, viz. that “Aristotle can talk about states being virtuous and happy only because of this psychological superficiality” (p. 9, Garver’s text). This paper defends a hylomorphic version of animalism according to which human persons survive as immaterial, bodiless animals after death. According to the hylomorphism under consideration, human persons have souls that survive death, and according to the animalism under consideration, human persons are necessarily animals. One might think this implies that human persons don't survive their deaths since if they were to survive their deaths, they would be immaterial animals after death, but necessarily animals are material. This paper shows that (...) the hylomorphic animalist can overcome this problem in a way that respects the intuition that animals are material. In addition, the paper defends the hylomorphic animalist survivalist from the objection that her view introduces an insoluble mereological puzzle. (shrink)

This is a big book. Literally. Each of its almost 800 pages is 6.75” x 9.75” (rather than the somewhat more usual 5.75” x 8.75” sized page of an academic hardcover book), with words in a small font and short margins all-around. It would appear that the publisher used a number of production tricks to squeeze in as many words as possible. Which is understandable because Politics & Philosophy at Rome contains the collected papers (mostly published, but several unpublished) of (...) Miriam T. Griffin, one of the biggest and most important Anglophone scholars of Roman philosophy, who passed away shortly before the book was completed in 2018. Students of Cicero, Tacitus, and Seneca are especially in debt to her for the rigorous and richly contextualized studies she has produced of their ethical, historical, and political works. And all students of ancient Rome are in debt for the republication of fifty of her papers, which range over three areas (and are organized into three subsections in the book). The first part of the book includes ten papers on Roman history (in both the republican and imperial periods). The second part of the book includes seven published papers, five unpublished lectures, and three “occasional pieces” on Roman historiography (especially in the case of Tacitus). A third and final section of the book includes 25 papers on Roman politics and philosophy (which includes almost 400 pages of material). (shrink)

Aristotle’s discussions of natural slavery, ‘barbarian kingship’, and the natural characteristics of barbarians or non-Greeks are usually read as calling into question the intellectual, ethical, and political accomplishments of non-Greeks. Such accounts of non-Greek inferiority or inability to self-govern also appear to presuppose a climatic or environmental account that on the whole would imply severe limitations on the possibility of political flourishing for peoples living outside the Greek Mediterranean basin. In light of such accounts, it is somewhat astounding to find (...) Aristotle praising the social and political institutions of Carthage within his discussion of the best constitution in the second book of the Politics. In the 4th century BCE, Carthage (modern day Tunis) was a Phoenician commercial empire that culturally and linguistically was Semitic and clearly non-Greek. That Aristotle contrasts Carthage, a non-Greek polis, favorably with both Sparta and Crete undermines both the claim that Aristotle embraced a categorical opposition between Greeks and non-Greeks and the claim that he was dismissive of the achievements of non-Greeks. In his account of the Persian Wars, the 5th century historian Herodotus reports an exchange between the Persian monarch Xerxes and a deposed Spartan king, Demaratus, who became what Lattimore later classified as a “tragic warner” to Xerxes. On the eve of the battle of Thermopylae, Xerxes asks how a small number of free Spartiates can stand up against the massive ranks of soldiers that Xerxes has assembled. Herodotus has Demaratus reply: So is it with the Lacedaemonians; fighting singly they (...) are as brave as any man living, and together they are the best warriors on earth. Free they are, yet not wholly free; for law is their master (ἐλεύθεροι γὰρ ἐόντες οὐ πάντα ἐλεύθεροι εἰσί· ἔπεστι γάρ σφι δεσπότης νόμος), whom they fear much more than your men fear you. This is my proof—what their law bids them, that they do; and its bidding is ever the same, that they must never flee from the battle before whatsoever odds, but abide at their post and there conquer or die. (Hdt. 7.104) As the outcome of Thermopylae makes clear, Demaratus is hardly guilty of boasting. But Greek political theorists were not only fascinated by the Spartans who fought at the battle of Thermopylae in 480; they also wondered how slightly more than a century later Sparta was ignobly defeated by Thebes at the battle of Leuctra in 371, after which Spartan hegemony collapsed. How did Sparta field citizen-soldiers in the 5th century who were without parallel in their bravery and military prowess? And why did Sparta, predominantly under the same political organization, collapse just over a century later? Such are the main questions that Xenophon, Plato, Aristotle, and Plutarch—what Cartledge (1999, 313–14) has characterized as “political-theoretical” laconophiles—seek to answer in their writings about Sparta. John McDowell's contribution to philosophy has ranged across Greek philosophy, philosophy of language, philosophy of mind, metaphysics and ethics. His writings have drawn on the works of, amongst others, Aristotle, Kant, Hegel, Frege, Russell, Wittgenstein, Sellars, and Davidson. His contributions have made him one of the most widely read, discussed and challenging philosophers writing today. This book provides a careful account of the main claims that McDowell advances in a number of different areas of philosophy. The interconnections between the different (...) arguments are highlighted and Tim Thornton shows how these individual projects are unified in a post-Kantian framework that articulates the preconditions of thought and language. Aristotle’s claim that poetry is ‘a more philosophic and better thing’ than history (Poet 9.1451b5-6) and his description of the ‘poetic universal’ have been the source of much scholarly discussion. Although many scholars have mined Poetics 9 as a source for Aristotle’s views towards history, in my contribution I caution against doing so. Critics of Aristotle’s remarks have often failed to appreciate the expository principle which governs Poetics 6-12, which begins with a definition of tragedy and then elucidates the terms (...) of that definition by means of a series of juxtapositions. The juxtaposition between poetry and history is one such instance which seeks to elucidate what sort of plot exemplifies a causal unity such that the events of a play unfold with likelihood or necessity. Within that context, Aristotle compares history and poetry in order to elucidate the object of poetic mimesis rather than criticize history as a discipline. Viewing Aristotle as antagonistic towards history fails to appreciate the expository structure of the Poetics and obscures the resource which history provides to the poet, a point which I explore by considering what Aristotle would have thought of an ‘historical’ tragedy like Aeschylus’ Persians. In the autumn of 430 BCE, the city of Athens was devastated by a plague, one chronicled by both the Athenian historian Thucydides and the Roman poet Lucretius. Albert Camus’ notebooks and novel The Plague (La peste) clearly show his interest in the plague of Athens and several scholars have detected comparisons between its narrator, Dr. Rieux, and the historian Thucydides. But a careful examination of what Rieux actually says about the plague of Athens complicates matters and suggests that Camus (...) in some sense rejects accounts of the plague of Athens as a model for his novel. Such a rejection seems confirmed by the novel’s identification of Joseph Grand as its hero, an example of decidedly non-Periclean virtue. I argue that although one can find comparisons within the Plague between Athens and Oran, more pronounced are their contrasts. (shrink)

Psychiatry’s inchoate wish for a paradigm shift and the biopsychosocial model of mental illness’ critically examines the much discussed goal of a paradigm shift in psychiatric taxonomy. The chapter first highlights some illustrative calls for such a change and then sets these against the Kuhnian account of science from which the idea is taken, highlighting the connection to incommensurability. Relative to a distinction drawn from Winch, between putative sciences where the self-understanding of subjects plays no role and those where it (...) is fundamental, psychiatry falls into the latter kind. This suggests that the wish for a paradigm shift in psychiatry is either incoherent or a wish for a radical but unpredictable overhaul of a significant aspect of our self-understanding as subjects and agents. The biopsychosocial model of mental illness is thus a helpful reminder of the cost of a paradigm shift in psychiatry. (shrink)

Is it possible to invoke the use of moral responsibility as part of the selection criteria in the allocation of livers for transplant? Criticism has been applied to the difficulties inherent in including such a criterion and also the effect that employing such a judgement might have upon the relationship between the physician and patient. However, these criticisms rely on speculation and conjecture and do not relate to all the arguments put forward in favour of applying moral responsibility. None of (...) the present arguments against using moral responsibility in the allocation of livers for transplant are good enough to warrant its dismissal. (shrink)
