The present essay examines the conflicting ontological assumptions that one can find behind the word dao in the texts of the Laozi and Zhuangzi and argues that the relative indifference to these texts toward whether or not dao has an ontic reality should not be considered a flaw of early Daoism. Rather, the historical process by which the term dao collects various possible ontological implications can be thought of as a philosophical stance in its own right. That is, if the (...) terms which one is obliged to use in discussing the immaterial necessarily hide, at least as much as they explain, the nature of Being, then it is a reasonable response to decline to ground one’s ethics in an ontology, and that while the resulting philosophy may not qualify as a fully-adumbrated system, this does not diminish its potential usefulness. The orthodoxy on the concept of ownership is given by Honoré's list of incidents. The idea this portrays is as ownership as a very flexible concept. The main purpose of this paper is to argue that the concept of property has much more integrity than the notion of a bundle of incidents may suggest. The Libertarian Challenge claims that redistributive theories of Justice, in so far as they impose involuntary taxes, are inconsistent with property rights, and are therefore unjustifiable. One (...) response to the libertarian challenge is to present alternative conceptions of ownership that are based on less than the complete list of incidents. These conceptions, we are told, avoid the inconsistency inherent in redistributive taxation by rejecting the incidents that are the source of the inconsistency, while retaining the moral appeal by leaving in place the core incidents and thus remaining faithful to what is primarily justifiable in property rights. Such an approach has been taken by several writers (notably, Waldron, Christman, and Fried). These different attempts to present a "truncated", "bifurcated", or "purist" concept of property invariably fail. Taxation must be an infringement of property. The upshot of this is that a justification of redistributive taxation requires a restriction of property or abandoning it altogether rather than redefining it. (shrink)

I den här uppsatsen argumenterar jag för att det krävs en kvantifierad deontisk logik för att förstå den logiska formen hos flera av de normer som uttrycks i denna förklaring. Jag kommer att gå igenom ett antal argument som intuitivt är giltiga, men som inte kan bevisas i klassisk logik. Observational and experimental discoveries of new factual entities such as objects, systems, or processes, are major contributors to some advances in the life sciences. Yet, whereas discovery of theories was extensively deliberated by philosophers of science, very little philosophical attention was paid to the discovery of factual entities. This paper examines historical and philosophical aspects of the experimental discovery by Carl Woese of archaea, prokaryotes that comprise one of the three principal domains of the phylogenetic tree. Borrowing Kuhn’s terminology, this (...) discovery of a major biological entity was made during a ‘normal science’ project of building molecular taxonomy for prokaryotes. Unexpectedly, however, an observed anomaly instigated the discovery of archaea. Substantiation of the existence of the new archaeal entity and consequent reconstruction of the phylogenetic tree prompted replacement of a long-held model of a prokarya and eukarya bipartite tree of life by a new model of a tripartite tree comprising of bacteria, archaea, and eukarya. This paper explores the history and philosophical implications of the progression of Woese’s project from normal science to anomaly-instigated model-changing discovery. It is also shown that the consequential discoveries of RNA splicing and of ribozymes were similarly prompted by unexpected irregularities during normal science activities. It is thus submitted that some discoveries of factual biological entities are triggered by unforeseen observational or experimental anomalies. (shrink)

How should medical services be distributed within society? Who should pay for them? Is it right that large amounts should be spent on sophisticated technology and expensive operations, or would the resources be better employed in, for instance, less costly preventive measures? These and others are the questions addreses in this book. Norman Daniels examines some of the dilemmas thrown up by conflicting demands for medical attention, and goes on to advance a theory of justice in the distribution of health (...) care. The central argument is that health care, both preventive and acute, has a crucial effect on equality of opportunity, and that a principle guaranteeing equality of opportunity must underly the distribution of health-care services. Access to care, preventive measures, treatment of the elderly, and the obligations of doctors and medical administrations are fully discussed, and the theory is shown to underwrite various practical policies in the area. Reasoning about situations we take to be impossible is useful for a variety of theoretical purposes. Furthermore, using a device of impossible worlds when reasoning about the impossible is useful in the same sorts of ways that the device of possible worlds is useful when reasoning about the possible. This paper discusses some of the uses of impossible worlds and argues that commitment to them can and should be had without great metaphysical or logical cost. The paper then provides an (...) account of reasoning with impossible worlds, by treating such reasoning as reasoning employing counterpossible conditionals, and provides a semantics for the proposed treatment. Many people who were Saturday Night Live fans in the 1990s recall the firing of Norm Macdonald as a watershed moment. In exploring theories about why people employ humor, they just might be able to discover the motivations behind Macdonald's firing. Macdonald offered a different assessment of his firing in an oral history of Saturday Night Live, saying that it came down to a philosophical disagreement between NBC management and himself about the goal of “Weekend Update.” Macdonald's requirement that laughter (...) be involuntary tracks well with Max Eastman's philosophical theory of humor known as play theory. Sigmund Freud's Relief Theory suggests that the main goal of humor and laughter is to relieve pent up stresses and mental strain that people carry around with them. The most important difference between humor‐as‐relief and play theory is that in play theory the release is a positive consequence, but not the intended goal. (shrink)

This paper reflects on a simple, ingenious and celebrated result by Amartya Sen, ‘The Impossibility of a Paretian Liberal’ (1970). Sen’s result, sometimes called the 'Liberal Paradox', has attracted — particularly in the years soon after its publication — a vast literature, including responses and reflections from Sen himself. Much of the literature involves attempts to ‘escape’ the Liberal Paradox by proposing ways to avoid or resolve the problem it seems to identify. But despite the extensive attention, and perhaps a (...) sense among philosophers in related areas that the result is somehow relevant to liberalism or to political philosophy in general, it is still not clear why the result matters philosophically. I am sceptical about the significance of the Liberal Paradox: in this paper, I articulate various ways in which political philosophers might be urged to care about the Paradox, and argue that each of them is either implausible or of only moderate interest. Objective: To examine current research payment practices and to inform development of clearer guidelines for researchers and ethics committees.Design: Exploratory email based questionnaire study of current research participant reimbursement practices. A diverse sample of organisations and individuals were targeted.Setting: Australia.Participants: Contacts in 84 key research organisations and select electronic listservers across Australia. A total of 100 completed questionnaires were received with representations from a variety of research areas .Main measurements: Open-ended and fixed alternative questions about type of research agency; type (...) of research; type of population under study; whether payment is standard; amounts and mechanisms of payment; factors taken into account when deciding on payment practices; and whether payment policies exist.Results: Reimbursement practice is highly variable. Where it occurs it is largely monetary and is for time and out-of-pocket expenses. Ethics committees were reported to be often involved in decision making around reimbursement.Conclusions: Research subject payment practices vary in Australia. Researchers who do provide payments to research participants generally do so without written policy and procedures. Ethics committees have an important role in developing guidelines in this area. Specific guidelines are needed considering existing local policies and procedures; payment models and their application in diverse settings; case study examples of types and levels of reimbursement; applied definitions of incentive and inducement; and the rationale for diverse payment practices in different settings. Our ability to locate moral responsibility is often thought to be a necessary condition for conducting morally permissible medical practice, engaging in a just war, and other high-stakes endeavors. Yet, with increasing reliance upon artificially intelligent systems, we may be facing a wideningresponsibility gap, which, some argue, cannot be bridged by traditional concepts of responsibility. How then, if at all, can we make use of crucial emerging technologies? According to Colin Allen and Wendell Wallach, the advent of so-called ‘artificial moral (...) agents’ (AMAs) is inevitable. Still, this notion may seem to push back the problem, leaving those who have an interest in developing autonomous technology with a dilemma. We may need to scale-back our efforts at deploying AMAs (or at least maintain human oversight); otherwise, we must rapidly and drastically update our moral and legal norms in a way that ensures responsibility for potentially avoidable harms. This paper invokes contemporary accounts of responsibility in order to show how artificially intelligent systems might be held responsible. Although many theorists are concerned enough to develop artificial conceptions ofagencyor to exploit our present inability to regulate valuable innovations, the proposal here highlights the importance of—and outlines a plausible foundation for—a workable notion ofartificial moral responsibility. At 30 years' distance, it is safe to say that Nozick's Anarchy, State and Utopia has achieved the status of a classic. It is not only the central text for all contemporary academic discussions of libertarianism; with Rawls's A Theory of Justice, it arguably frames the landscape of academic political philosophy in second half of 20th century. Many factors, obviously account for the prominence of the book. This paper considers one: the book's use of rhetoric to charm and disarm its (...) readers, simultaneously establishing Nozick's credibility with readers, turning them on his ideological opponents, and helping his argument over some of its more serious substantive difficulties. The book presents the case for the making of a new political imagination by offering a critique of existing political institutions, philosophy and practices that are unable to provide the thinking, means and leadership to deal with the complexity and crises of specific locales and the world at large. The authors make clear that there is a fundamental disjuncture between the complexity of the combined critical conditions that are now putting life on Earth at risk, and the divisions and theories (...) of knowledge that are dominantly and instrumentally trying to understand the situation. In response this work makes the case for the need for a new political imagination that rejects the sufficiency of existing political ideologies (including democracy) being the end point of politics. The book tackles the political underpinnings of social and economic life in a world still embedded in the inequities of the afterlife of colonialism and state socialism. Thereafter it engages narratives of change, rethinks imagination and critical practices, to finally present a relationally connected way to move forward. (shrink)

In this paper I will present a puzzle about epistemic akrasia, and I will use that puzzle to motivate accepting some non-standard views about the nature of epistemological judgment. The puzzle is that while it seems obvious that epistemic akrasia must be irrational, the claim that epistemic akrasia is always irrational amounts to the claim that a certain sort of justified false belief—a justified false belief about what one ought to believe—is impossible. But justified false beliefs seem to be possible (...) in any domain, and it’s hard to see why beliefs about what one ought to believe should be an exception. I will argue that when we get clearer about what sort of psychological state epistemic akrasia is, we can resolve the puzzle in favor of the intuitive view that epistemic akrasia is always irrational. The potential to collect brain data more directly, with higher resolution, and in greater amounts has heightened worries about mental and brain privacy. In order to manage the risks to individuals posed by these privacy challenges, some have suggested codifying new privacy rights, including a right to “mental privacy.” In this paper, we consider these arguments and conclude that while neurotechnologies do raise significant privacy concerns, such concerns are—at least for now—no different from those raised by other well-understood data collection (...) technologies, such as gene sequencing tools and online surveillance. To better understand the privacy stakes of brain data, we suggest the use of a conceptual framework from information ethics, Helen Nissenbaum’s “contextual integrity” theory. To illustrate the importance of context, we examine neurotechnologies and the information flows they produce in three familiar contexts—healthcare and medical research, criminal justice, and consumer marketing. We argue that by emphasizing what is distinct about brain privacy issues, rather than what they share with other data privacy concerns, risks weakening broader efforts to enact more robust privacy law and policy. This paper proposes a new account of bounded or minimal doxastic rationality (in the sense of Cherniak 1986), based on the notion that beliefs are answers to questions (à la Yalcin 2018). The core idea is that minimally rational beliefs are linked through thematic connections, rather than entailment relations. Consequently, such beliefs are not deductively closed, but they are closed under parthood (where a part is an entailment that answers a smaller question). And instead of avoiding all inconsistency, minimally rational (...) believers only avoid blatant inconsistencies (where some beliefs are blatantly inconsistent when they contradict one another on a particular question). Rather than cohering into a single overall world view, beliefs are more loosely connected in what is best described as a web of questions. This view of minimally rational belief naturally gives rise to an account of deductive inquiry on which deductive reasoning is a matter of posing new questions. (shrink)

There is no topic that attracts more attention, more energy and time and devotion, than love. As long as there's been recorded history, love has taken center seat as the inspiration for countless paintings, instigator of wars, muse of untold poets and musicians. And just as poetry, art and music have the ability to communicate something about love that is difficult to articulate with words, the same is true of mathematics.
