This article presents a normative‐theoretical account of democratic legitimacy that meets the challenge of moral and cultural pluralism in a way that takes the avoidance of oppression and violence to be a fundamental imperative. The discourse‐theoretical perspective of jürgen Habermas reveals that reasoned agreement among citizens is the only alternative to political oppression. Pace Habermas, however, the legitimacy of even basic constitutional principles does not require us to agree with one another for the same reasons. While we can affirm such (...) principles for a wide range of different reasons, the process of achieving reasoned agreements on contentious issues draws us together as citizens in loyalty to a particular, historical set of political institutions. The reasoned commitment to our constitution that we come to share in this ongoing process acts as an identity‐forming bond that allows us to live in peace with deep moral and cultural differences. This edited collection presents the case for a research program (in Lakatos's sense) in the social sciences based on the theory of recognition developed by Axel Honneth and others in recent years. The cumulative argument of the book is that recognition theory provides both a plausible framework for explaining social conflict and a normative compass for reaching just resolutions.

What is the fundamental purpose that justifies the existence of the modern university? The answer proposed in this essay is the promotion of social freedom. The essay begins by distinguishing social freedom from negative freedom and reflective freedom along the lines proposed by other theorists of social freedom, such as Frederick Neuhouser and Axel Honneth. After noting the need for a more developed account of the university than has so far been provided by these other theorists, the essay analyses the (...) various dimensions in which universities have, at their best, promoted social freedom. The essay then explains why it is through the promotion of social, as distinct from negative or reflective freedom, that universities fulfil their purpose. It concludes with some reflections on how this understanding of the purpose of the university fits an “immanent” model of social criticism. (shrink)

One way of providing a focus for critical theory today is to articulate those substantive and robust norms of egalitarian justice that would appear to be presupposed by the idea of a republican and democratic constitutional order. It is suggested here that democratic justice requires the equalisation of effective communicative freedom among all structurally constituted social groups (SCSGs) and that this will have far-reaching implications that entail the deconstruction of all social hierarchies in both domestic and global orders. This argument (...) is presented in three sections. The first defends the focus on groups rather than individuals in theorising democratic justice. The second intervenes critically in contemporary debates surrounding the theoretical relation between various aspects of justice including the demands of redistribution, recognition and political empowerment. The third turns to the challenges for critical theory presented by a complex and multifaceted process of globalisation and it defends a qualified form of cosmopolitanism and highlights the need for a radical democratisation of the international order. We consider here how cultural and socioeconomic dimensions of justice beyond the state are related. First we examine cosmopolitan theories that have drawn on John Rawls's egalitarian liberal framework to argue that a just global order requires substantive, transnational redistribution of material resources. We then assess the view, ironically put forward by Rawls himself, that this perspective is ethnocentric and insufficiently tolerant of non-liberal cultures. We argue that Rawls is right to be concerned about the danger of ethnocentrism, but wrong (...) to assume that this requires us to reject the case for substantive redistribution across state boundaries. A more compelling account of justice beyond the state will integrate effectively socioeconomic and cultural aspects of justice. We suggest that this approach is best grounded in a critical theory of recognition that responds to the damage caused to human relations by legacies of historical injustice. (shrink)

Jürgen Habermas takes the realization of rights through the democratic self-organization of legal communities to be the normative core of emancipatory politics. In this article I explore the implications of this claim in relation to the requirements of justice. I argue that Habermas's discourse theory of democratic legitimacy resupposes a substantive principle of justice that demands the equalization of effective communicative freedom for all structurally constituted social groups in any constitutional state. This involves the elimination of a range of structural (...) injustices rooted in the complex interrelationships between political, economic and cultural orders. In the final section I sketch briefly the implications of this analysis in the context of ongoing globalization processes. It is suggested that the most effective way to establish a just system of global governance is to equalize effective communicative freedom among nation-states. (shrink)

In the context of a new global order where the logic of the market reigns virtually unopposed, there is a need for thinking that might reinvigorate a progressive political project. This collection of essays brings together the work of a number of leading scholars who are concerned to construct a convincing basis for incisive criticism. These contributors represent such contemporary critical perspectives as egalitarian liberalism, socialism, poststructuralism, psychoanalysis, hermeneutics and critical theory.

This volume brings together a range of theoretical responses to issues in Irish politics. Its organising ideas: recognition, equality, and democracy set the terms of political debate within both jurisdictions. For some, there are significant tensions between the grammar of recognition, concerned with esteem, respect and the symbolic aspects of social life, and the logic of equality, which is primarily concerned with the distribution of material resources and formal opportunities, while for others, tensions are produced rather by certain interpretations of (...) these ideas while alternative readings may, by contrast, serve as the basis for a systematic account of social and political inequality. The essays in this collection will explore these interconnections with reference to the politics of Northern Ireland and the Republic. The Republic has gone through a period in which its constitution was the focus for a liberal politics aimed at securing personal autonomy, while Northern Ireland’s political landscape has been shaped by the problem of securing political autonomy and democratic legitimacy. The author examines the fundamental tenets of the classical Thomistic account, and on this basis critiques the 20th century revisionist theories of Domingo Banez, Reginald Garrigou-Lagrange, Francisco Marin-Sola, Jacques Maritain, Bernard Lonergan, and Jean-Herve Nicolas. In conclusion, the implications of the traditional view are considered in light of the spiritual life.

Is logical empiricism incompatible with a critical social science? The longstanding assumption that it is incompatible has been prominent in recent debates about welfare economics. Sen’s development of a critical and descriptively rich welfare economics is taken by writers such as Putnam, Walsh and Sen to involve the excising of the influence of logical empiricism on neo-classical economics. However, this view stands in contrast to the descriptively rich contributions to political economy of members of the left Vienna Circle, such as (...) Otto Neurath. This paper considers the compatibility of the meta-theoretical commitments of Neurath and others in the logical empiricist tradition with this first-order critical political economy. (shrink)

The paper addresses two questions central to recent environmental political thought: Can a reduction in consumption be rendered compatible with a maintenance or improvement of well-being? What are the conditions for a sense of citizenship that crosses different generations? The two questions have elicited two conflicting responses. The first has been answered in broadly Epicurean terms: in recent environmental thought appeal has been made to recent hedonic research which appears to show that improvements in subjective well-being can be decoupled from (...) increased material consumption. The second has usually been answered in broadly Aristotelian terms: republicans have suggested that a public world and projects that are shared over generations are a condition of human well-being. These Epicurean and Aristotelian responses appear to look in opposite directions. They start from different accounts of well-being and appear to look in different places for human flourishing. This paper suggests that the broadly Aristotelian response is in fact owed to both problems. It shows that recent empirical research in the hedonic tradition can be rendered consistent with that Aristotelian response. (shrink)

Public choice theory presents itself as a new institutional economics that rectifies the failure of the neo-classical tradition to treat the institutional dimension of economics. It offers criticism of both neo-classical defenders of cost-benefit analysis and their environmental critics. Both assume the existence of benign political actors. While sharing some of its scepticism about this assumption, this paper argues that the public choice perspective is flawed. The old institutionalism of classical economics provides a better perspective to examine both explanatory and (...) nonnative problems occasioned by environmental problems than does the new institutionalism, raising significant questions about the relationship between environmental goods, virtues and institutions which have been lost to recent discussion. A collection of original essays that represent the first extended treatment of political philosopher John Rawls' idea of a property-owning democracy.

Hume has a special place in justifications of claims made for rational choice theory to offer a unified language and explanatory framework for the social sciences. He is invoked in support of the assumptions characterising the instrumental rationality of agents and the constancy of their motivations across different institutional settings. This paper explores the problems with the expansionary aims of rational choice theory through criticism of these appeals to Hume. First, Hume does not assume constancy. Moreover, Hume’s sensitivity to the (...) relationships between institutional setting and individual motivation owes something to the relative transparency of the plural language of vices and virtues that he employs. Second, rational choice theory’s minimal modification of Hume’s account of the relation of reason and the passions through the introduction of constraints of consistency on preferences is unstable. The cinematography and set design of The Expanse make extensive use of chiaroscuro—a famous artistic technique in the history of painting. For some reason, the infinity of The Expanse attracts us. The look and design of the show indulges us in an experience of the sublime. The dynamically sublime is an experience of infinite power, but not where (...) our survival is threatened by it. The experience of the sublime is one proof of freedom. The absence of the ability to know the significance of what one does in the context of the infinite does not diminish the significance of what they do. The characters of The Expanse know this. This article addresses two areas of continuing controversy about consent in clinical research: the question of when consent to low risk research is necessary, and the question of when consent to research is valid. The article identifies a number of considerations relevant to determining whether consent is necessary, chief of which is whether the study would involve subjects in ways that would (otherwise) infringe their rights. When consent is necessary, there is a further question of under what conditions consent is (...) valid or successful in waiving a right. The most influential account of validity conditions is non-moralized, in the sense that the conditions make no essential reference to whether the researcher soliciting consent has obtained it in a way that wrongs the subject. The article examines the implications of this account, and compares it with recent accounts that moralize some of the validity conditions. -/- . (shrink)
