In this paper, we consider how dignity is discursively constructed in the context of work dominated by physicality and dirt. Based on semi-structured interviews with garbage workers, our analysis considers how the deprivations they experience are cast through discourses intended to construct their individual and collective worth. We consider the manner in which dignity maybe denied to such workers through popular repudiations of individuality and status. We demonstrate how this positioning arises from contact with physical dirt, and associations with socially (...) dirty work based on ascriptions of servility, abuse and ambivalence. We go on to consider how garbage workers respond to this positioning through discourses of ‘everyday heroism’. Heroism is evoked through three inter-related narratives that speaks to a particular type of masculinity. The first takes the form of a classic process of reframing and recalibration through which workers not only renegotiate their public position and status, but also point to the inherent value to be had in working with dirt as part of that which we identify as a process of ‘affirmation’. The second narrative arises from the imposition of favourable social and occupational comparisons that effectively elevate garbage collectors’ social position. The third discourse—and previously unobserved in respect of garbage work—centres on paternalistic practices of care. Combined, these discourses disrupt the generally held view that dirty work is antithetical to heroism and wounds dignity. (shrink)

In previous research, we have argued that private companies should be more open with their scientific research findings. However, our research assumed, somewhat naively perhaps, that public institutions were quite open. Recent findings have suggested otherwise, and in this paper we explore the dilemma faced by industry, universities, and society in attempting to balance the needs of openness (to rapidly advance the body of knowledge), with secrecy (to protect the economic returns to a new innovation).

It is almost 30 years since the sociobiology controversy burst into full bloom. The modern theory of the evolution of animal behavior was born in the mid 1960’s with Bill Hamilton’s seminal papers on inclusive fitness and George William’s book Adaptation and Natural Selection. The following decade saw an avalanche of important ideas on the evolution of sex ratio, animal conflicts, parental investment, and reciprocity, setting off a revolution our understanding of animal societies, a revolution that is still going (...) on today. By the mid-1970’s, Richard Alexander, E. O. Wilson, Napoleon Chagnon, Bill Irons, and Don Symons among others began applying these ideas to understand human behavior. Humans are evolved creatures, and quite plausibly the same evolutionary forces that shaped the behavior of other animals also molded our behavior. Moreover, the new theory of animal behavior—especially, kin selection, parental investment, and optimal foraging theory—seemed fit the data on human societies fairly well. (shrink)

Medical accounts of the absence of conscience are intriguing for the way they seem disposed to drift away from the ideal of scientific objectivity and towards fictional representations of the subject. I examine here several contemporary accounts of psychopathy by Robert Hare and Paul Babiak. I first note how they locate the truth about their subject in fiction, then go on to contend that their accounts ought to be thought of as a “mythos,” for they betray a telling uncertainty (...) about where “fact” ends and “fantasy” begins, as well as the means of distinguishing mental health from mental illness in regard to some social roles. Robert Fogelin here collects fifteen of his essays, organized around the theme of interpreting philosophical texts. The essays place particular emphasis on understanding the argumentative or dialectical role that passages play in the specific context in which they occur. The somewhat surprising result of taking this principle seriously is that certain traditional, well-worked texts are given a radical re-interpretation. The United States Constitution was written for the purpose of establishing an effective but limited national government, a government that would be capable of dealing with national and international problems, but that would not be able to violate the traditional liberties of the people. Thus, the Constitution was, and is essentially a practical-juridical document. One should not expect to find there pronouncements about the nature of man, society, law, or the state, such as are often found in many other national (...) constitutions and international conventions. Nevertheless, several important characteristics of the Constitution—indeed its most important characteristics—are clear and admirable applications of the natural law. The principal drafters of the Constitution believed that God, in creating the universe, implanted in the nature of man a body of law to which all human beings are subject, which is superior to all manmade law, and which is knowable by human reason. Thus, the natural law of the American founders was traditional natural law as understood and expounded by classical and Medieval writers and carried forward in the English common law, and not the “Enlightenment” versions in vogue in eighteenth-century Europe. The classical-traditional natural law understanding of Madison, Hamilton, Wilson, and other leaders of the Philadelphia Convention are reflected in the three most important characteristics of the Constitution: the principle of limited government; the principle of subsidiarity (in both political and larger societal matters); and the practice of guaranteeing traditional rights, and only as against government. J. N. Crossley [1] raised the question of whether the implication 2 + A = A ⇒ 1 + A = A is true for constructive order types (C.O.T.'s). Using an earlier definition of constructive order type, A. G. Hamilton [2] presented a counterexample. Hamilton left open the general question, however, since he pointed out that Crossley considers only orderings which can be embedded in a standard dense r.e. ordering by a partial recursive function, and that his counterexample (...) fails to meet this requirement. We resolve the question by finding a C.O.T. A which meets Crossley's requirement and such that 2 + A = A but 1 + A ≠ A. At the suggestion of A. B. Manaster and A. G. Hamilton we easily extend this construction to show that for any n ≧ 2, there is a C.O.T. A such that n + A = A but m + A ≠ A for 0 < m < n. Hence, Theorem 3 of [2] and all of its corollaries hold with the new definition of C.O.T. The construction is not difficult and requires no priority argument. The techniques are similar to those developed in [3], but no outside results are needed here. (shrink)

Robert Yerkes is a pivotal figure in American psychology and primatology in the first half of the twentieth century. As is well known, Yerkes first studied ape intelligence in 1915, on a visit to the private California laboratory of the psychiatrist Gilbert Hamilton, a former student. Less widely appreciated is how far the work done at the Hamilton lab, in its aims and ambitions as well as its techniques, served as a template for much of Yerkes’s research (...) thereafter. This paper uses the Hamilton–Yerkes relationship to re-examine Yerkes’s career and, more generally, that of American psychology in the early twentieth century. Three points especially are emphasized: first, the role of Freudian psychoanalysis as a spur to Hamilton’s experimental studies of ape intelligence; second, the importance of Hamilton’s laboratory, with its semi-wild population of monkeys and ape, as a model for Yerkes’s efforts to create a laboratory of his own; and third, the influence on Yerkes of Hamilton’s optimism about experimental psychological studies of nonhuman primates as a source of lessons beneficial to a troubled human world. The article “The EU Top Court Rules that Married Same-Sex Couples Can Move Freely Between EU Member States as “Spouses”: Case C-673/16, Relu Adrian Coman, Robert Clabourn Hamilton, Asociaţia Accept v Inspectoratul General pentru Imigrări, Ministerul Afacerilor Interne”, written by “Alina Tryfonidou” was originally published electronically on the publisher’s internet portal on 23 April 2019 without open access.

In the Coman case, the European Court of Justice was asked whether the term “spouse”—for the purposes of EU law—includes the same-sex spouse of an EU citizen who has moved between EU Member States. The ECJ answered this question affirmatively, holding that a refusal to recognise a same-sex marriage and the resultant refusal to grant family reunification rights to a Union citizen who moves to another Member State, would constitute an unjustified restriction on the right to free movement that Union (...) citizens enjoy under EU law. This case comment analyses the judgment, arguing that the Court’s pronouncement is a very welcome first step towards marriage equality at a cross-border level in the EU. At the same time, following the delivery of this ruling, a lot of questions have arisen and gaps in the protection of same-sex couples persist, and these are also analysed in this piece. (shrink)

Reverend H.F.C. Logan is put forward as the formerly unidentified figure to which Robert Leslie Ellis referred in a journal entry of 1840 in which he wrote that it was due to his influence that William Whewell came to uphold particular Kantian views on time and space. The historical evidence of Ellis’s early familiarity with, and later commitment to Kant is noteworthy for at least two reasons. Firstly, it puts into doubt the accepted view of the second generation of (...) reformers of British algebra as non-philosophical, practice-oriented mathematicians. Secondly, in so far as Logan was the correspondent of William Rowan Hamilton, it re-emphasizes that the role of Kantianism in the transition from ‘symbolical’ to ‘abstract’ algebra in nineteenth-century British algebra requires closer scrutiny. Anyone interested in the philosophy of theater will need to address Professor Hamilton’s accomplishment.The (...) leading idea in The Art of Theater is that theatrical performance is an independent art form. That is, theatrical performance, as such, is not, as Aristotle suggested by his demotion of spectacle, a mere adjunct to literature, or essentially a medium for illustrating dramatic and comedic texts. Theatrical performance itself is an art in its own right. This view of theater art has been increasingly apparent in the practices of modern theater in the West, but these practices—as exemplified by Gordon Craig, Vsevolod Meyerhold, Jacques Copeau, Bertolt Brecht, Antonin Artaud, Jerzy Grotowski, and, more recently, Robert Wilson—merely revealed what has always been the case: that theater is at root a performing art.Although for centuries theater in the West had been conceptualized as a text-based art, Hamilton maintains that this tradition is local. Theatrical performances in other cultures need not be the enactment of antecedently written-out texts. Furthermore, even within Western culture, most of us see and discuss plays without ever reading the texts upon which they are based. Hamilton takes these facts to support his view that theatrical performance is an autonomous art form. Among other things, this means that the critical model that presumes that the success of a theatrical performance must be assessed against the effectiveness of its implementation of the pertinent preexisting literary text is a misguided one. Kenneth Branagh’s Hamlet, which omitted no word from the accepted version of the text, was the exception to the rule. Thus, what Hamilton calls the ingredients model of the relation of texts to theatrical performances has the advantage on its side of better corresponding to actual practices, as compared to the notion that a theatrical performance is to be understood as a matter of bringing a literary text to life.Of course, one apparent advantage that the text-implementation model of theatrical performance might seem to possess is that it appears to have a way ready-to-hand for identifying theatrical performances. Gielgud’s performance, Olivier’s performance, and Burton’s performance are, ex hypothesi, all performances of Hamlet because they are all performances of Shakespeare’s text to which they all roughly comply. If, following Hamilton, we sever the relationship to the play-text, how can we account for the way in which we identify theatrical performances?2 That is, independently of reference to texts, how do we identify a theatrical performance as another instance of Hamlet?In order to solve this problem, Hamilton introduces the idea of “a basic understanding” of a theatrical performance. The basic understanding of a theatrical performance is, on Hamilton’s account, said to involve no more than comprehending on a moment-to-moment basis the ongoing bits of dialogue and stage action as they evolve, as well as understanding the transitions from one scene to another while also responding physically in a suitable manner to the evolving story (for example, laughing where laughter is appropriate) or emoting responsively to what is happening onstage.
