Hegel stresses in his “Philosophy of Right” that the intention of the text is to offer elemnts in order to reckon a State as such and not to say how it should be. One of these elements is that the State founds and sustains the moments that precede and constitute it. In this way the family as much as the bourgeois civil society have their basis in something that results from them, i.e., the State but according to Hegel this result (...) is already present at the very beginning of both family and the bourgeois civil society. The State promotes the overcoming of both of them. The aim of this essay is to consider the relationship between the State and the bourgeois civil society trying mainly to show how Hegel understands the bourgeois civil society and also identifying the perils for a State in the hands of the bourfeois civil society. For Hegel the greatest peril is the submission of the State to the interst as something of the common interest to the interest as common and to assume it as the rule for life within it. (shrink)

Is it possible to teach philosophy? The German philosopher G. W. F. Hegel not only answers positively to such question but also indicates what has to be taught in philosophy and how. Hegel's answer has as its source his activity in the High School of Nürnberg where he searches to establish the aims and the procedures so that philosophy may be taught to the young people. According to Hegel philosophy is always meaningful when it considers what is basic for men, (...) i.e., their life with all the questions related to it. In this way philosophy has to assume the man as its object. This ends up in the consideration of the human reality as it is so that it may be better and deeper understood through reflection and speculation. These abilities can only be obtained by the direct contact with philosophy itself in what is its specifications in its historical production or in other words, its texts. To know the history of philosophy is already to learn philosophy but such learning process needs the mediation of a teacher because one does not learn naturally nor spontaneously . The article argues that AI can enhance the measurement and implementation of democratic processes within political parties, known as Intra-Party Democracy (IPD). It identifies the limitations of traditional methods for measuring IPD, which often rely on formal parameters, self-reported data, and tools like surveys. Such limitations lead to the collection of partial data, rare updates, and significant demands on resources. To address these issues, the article suggests that specific data management and Machine Learning (ML) techniques, such as natural language processing (...) and sentiment analysis, can improve the measurement (ML about) and practice (ML for) of IPD. The article concludes by considering some of the principal risks of ML for IPD, including concerns over data privacy, the potential for manipulation, and the dangers of overreliance on technology. The advent of Generative AI, particularly through Large Language Models (LLMs) like ChatGPT and its successors, marks a paradigm shift in the AI landscape. Advanced LLMs exhibit multimodality, handling diverse data formats, thereby broadening their application scope. However, the complexity and emergent autonomy of these models introduce challenges in predictability and legal compliance. This paper analyses the legal and regulatory implications of Generative AI and LLMs in the European Union context, focusing on liability, privacy, intellectual property, and cybersecurity. It examines (...) the adequacy of the existing and proposed EU legislation, including the Artificial Intelligence Act (AIA), in addressing the challenges posed by Generative AI in general and LLMs in particular. Brian Cutter objected to the consequence argument due to its dependence on the principle that miracle workers are metaphysically impossible. A miracle worker is someone who has the ability to act in a way such that the laws of nature would be violated. While there is something to the thought that agents like us do not have this ability, Cutter claims that there is no compelling reason to regard miracle workers as metaphysically impossible. However, the paper contends that miracle workers (...) are indeed impossible according to well-known theories concerning the laws of nature. This result highlights the reliance of the consequence argument on a plausible premise, which is widely accepted by proponents of non-Humean views of laws. The paper also provides a way to explain away the intuition that miracle workers are possible, but this has the upshot that a recent, two-dimensional formulation of the consequence argument is unsound. Accountability is a cornerstone of the governance of artificial intelligence (AI). However, it is often defined too imprecisely because its multifaceted nature and the sociotechnical structure of AI systems imply a variety of values, practices, and measures to which accountability in AI can refer. We address this lack of clarity by defining accountability in terms of answerability, identifying three conditions of possibility (authority recognition, interrogation, and limitation of power), and an architecture of seven features (context, range, agent, forum, standards, process, (...) and implications). We analyse this architecture through four accountability goals (compliance, report, oversight, and enforcement). We argue that these goals are often complementary and that policy-makers emphasise or prioritise some over others depending on the proactive or reactive use of accountability and the missions of AI governance. The EU Artificial Intelligence Act (AIA) defines four risk categories for AI systems: unacceptable, high, limited, and minimal. However, it lacks a clear methodology for the assessment of these risks in concrete situations. Risks are broadly categorized based on the application areas of AI systems and ambiguous risk factors. This paper suggests a methodology for assessing AI risk magnitudes, focusing on the construction of real-world risk scenarios. To this scope, we propose to integrate the AIA with a framework developed by (...) the Intergovernmental Panel on Climate Change (IPCC) reports and related literature. This approach enables a nuanced analysis of AI risk by exploring the interplay between (a) risk determinants, (b) individual drivers of determinants, and (c) multiple risk types. We further refine the proposed methodology by applying a proportionality test to balance the competing values involved in AI risk assessment. Finally, we present three uses of this approach under the AIA: to implement the Regulation, to assess the significance of risks, and to develop internal risk management systems for AI deployers. We prove that every weakly square compact cardinal is a strong limit cardinal, and therefore weakly compact. We also study Aronszajn trees with no uncountable finitely splitting subtrees, characterizing them in terms of being Lindelöf with respect to a particular topology. We prove that the class of such trees is consistently non-empty and lies between the classes of Suslin and Aronszajn trees.

The EU proposal for the Artificial Intelligence Act (AIA) defines four risk categories: unacceptable, high, limited, and minimal. Regulation by design (RBD) is a growing research field that explores, develops, and criticises the regulative function of design. In this article, we provide a qualitative thematic synthesis of the existing literature. The aim is to explore and analyse RBD's core features, practices, limitations, and related governance implications. To fulfil this aim, we examine the extant literature on RBD in the context of digital technologies. We start by identifying and structuring the core features of RBD, namely the goals, regulators, regulatees, (...) methods, and technologies. Building on that structure, we distinguish between three types of RBD practices: compliance by design, value creation by design, and optimisation by design. We then explore the challenges and limitations of RBD practices, which stem from risks associated with compliance by design, contextual limitations, or methodological uncertainty. Finally, we examine the governance implications of RBD and outline possible future directions of the research field and its practices. (shrink)

International regulation of autonomous weapon systems (AWS) is increasingly conceived as an exercise in risk management. This requires a shared approach for assessing the risks of AWS. This paper presents a structured approach to risk assessment and regulation for AWS, adapting a qualitative framework inspired by the Intergovernmental Panel on Climate Change (IPCC). It examines the interactions among key risk factors—determinants, drivers, and types—to evaluate the risk magnitude of AWS and establish risk tolerance thresholds through a risk matrix informed by (...) background knowledge of event likelihood and severity. Further, it proposes a methodology to assess community risk appetite, emphasizing that such assessments and resulting tolerance levels should be determined through deliberation in a multistakeholder forum. The paper highlights the complexities of applying risk-based regulations to AWS internationally, particularly the challenge of defining a global community for risk assessment and regulatory legitimization. We offer a review of some of the most influential views on the status of Reichenbach’s Principle of the Common Cause (RPCC) for genuinely indeterministic systems. We first argue that the RPCC is properly a conjunction of two distinct claims, one metaphysical and another methodological. Both claims can and have been contested in the literature, but here we simply assume that the metaphysical claim is correct, in order to focus our analysis on the status of the methodological claim. We briefly (...) review the most entrenched or classical positions, including Salmon’s ‘interactive forks’, van Fraassen’s scepticism, and Cartwright’s generalisation of the fork criterion. We then go on to review the results of the ‘Budapest school’ on the existence of formally defined screening­ off events for any correlation —by means of the ideas of probability space extensibility and (Reichenbachian common cause) completability. We distinguish the Budapest doctrine clearly from any of the classical conceptions, and thus present an overall framework for discussions of causal inference in quantum mechanics. We argue that this review is preliminary essential work for a thorough assessment of the conditions under which RCCP may be a reliable tool for causal inference in a genuinely probabilistic (indeterministic) context. In zweierlei Hinsicht trägt die vorliegende Arbeit dazu bei, dieses Desiderat zu beseitigen: Im ersten Teil wird dafür argumentiert, daß Ansätze, die glaubhaft machen wollen, daß bei der Erklärung von Intentionalität auf Rationalitätsannahmen zu verzichten sei, schon deshalb fehlerhaft sind, weil es bei Einstellungs-Zuschreibungen nicht auf die Individuierung geistiger Zustände ankommt. Vielmehr besagt die zentrale Überlegung des zweiten Teils, (...) daß dasjenige, was gemeinhin als die kognitive Signifikanz von Einstellungs-Äußerungen bezeichnet wird, am einfachsten durch eine ergänzende Theorie der pragmatischen Kontext-Bedingungen zu erfassen ist. This collection explores the controversial and perhaps even abject idea that evils, large and small, human and natural, may have a central positive function to play in our lives. For centuries a concern of religious thinkers from the Christian tradition, very little systematic work has been done to explore this idea from the secular point of view.

In this paper, I shall set out the pros and cons of assigning legal personhood on artificial intelligence systems under civil law. More specifically, I will provide arguments supporting a functionalist justification for conferring personhood on AIs, and I will try to identify what content this legal status might have from a regulatory perspective. Being a person in law implies the entitlement to one or more legal positions. I will mainly focus on liability as it is one of the main (...) grounds for the attribution of legal personhood, like for collective legal entities. A better distribution of responsibilities resulting from unpredictably illegal and/or harmful behaviour may be one of the main reasons to justify the attribution of personhood also for AI systems. This means an efficient allocation of the risks and social costs associated with the use of AIs, ensuring the protection of victims, incentives for production, and technological innovation. However, the paper also considers other legal positions triggered by personhood in addition to responsibility: specific competencies and powers such as, for example, financial autonomy, the ability to hold property, make contracts, sue. This is the first book to offer a systematic comparison of the philosophies of Albert Camus and Frantz Fanon. It shows how the ethical, political, and psychological outlooks of these two influential thinkers can further our understandings of how to bring about justice in the face of deep power imbalances. The author foregrounds the bloody Algerian War of Independence in his analysis of the philosophies of Camus and Fanon. Although neither supported French colonial occupation of Algeria, they held radically different (...) views of the conflict. Fanon supported emancipation through violence, which the author argues has been uncritically romanticized. Camus, on the other hand, supported an ethics of moderation that shunned indiscriminate violence. The author argues that Camus has been unfairly accused of being an apologist for colonialism. Finally, the author draws out the common endorsement of humanist values that drive both Camus' and Fanon's thought. Camus and Fanon on the Algerian Question will appeal to scholars and advanced students interested in twentieth-century Continental philosophy, postcolonialism, existentialism, and African philosophy.
