Item context effects refer to the impact of features of a test on an examinee’s item responses. These effects cannot be explained by the abilities measured by the test. Investigations typically focus on only a single type of item context effects, such as item position effects, or mode effects, thereby ignoring the fact that different item context effects might operate simultaneously. In this study, two different types of context effects were modeled simultaneously drawing on data from an item calibration study (...) of a multidimensional computerized test (N = 1,632) assessing student competencies in mathematics, science, and reading. We present a generalized linear mixed model (GLMM) parameterization of the multidimensional Rasch model including item position effects (distinguishing between within-block position effects and block position effects), domain order effects, and the interactions between them. Results show that both types of context effects played a role, and that the moderating effect of domain orders was very strong. The findings have direct consequences for planning and applying mixed domain assessment designs. (shrink)

This paper reconstructs Oskar Becker’s phenomenology of race, a project he called “paraontology.” For Becker, a fervent National So-cialist, paraontology provided a phenomenological account of “na-ture”—a realm of ahistorical essences encompassing both the “super-historical” truths of mathematics and metaphysics and the “sub-historical” forces of “blood and soil.” The impetus for this reconstruc-tion is the re-emergence of this term in contemporary Black studies, where it is used to problematize ontology’s usefulness for thinking black life. This paper asks what the (...) possibility of such an iteration shows about Becker’s project and its investment in non-historical repetition, arguing it reveals a profound disavowal of the historical at the heart of Becker’s project rather than a phenomenological disclosure of the natural. This essay reconstructs Oskar Becker’s idiosyncratic conception of aesthetics and its importance for phenomenology. For Becker, the aesthetic is not simply one type of phenomenon among others; rather, it occupies a privileged position as, first, that phenomenon which is itself “wholly phenomenal,” and, second, that phenomenon which discloses the ontological structure of phenomenality itself (and is thus what he calls “hyperontological”). The paper first reconstructs Becker’s descriptive phenomenology of the aesthetic (which he restricts to the realm of (...) masterpieces of fine art). For Becker, the key characteristic for understanding the givenness of beauty is its sense of fragility, which he uses to reveal a complicated interweaving of temporality and modality at the heart of the aesthetic. This essay then shows how this is rooted in Becker’s larger ontological project of developing a phenomenology of the non-historical in dialogue with Heidegger’s early work, a project which began in 1927 with the publication of his magnum opus Mathematical Existence. Hardly anyone disputes that discrimination can be a grave moral wrong. Yet this consensus masks fundamental disagreements about what makes something discrimination, as well as precisely why acts of discrimination are wrong. Benjamin Eidelson develops systematic answers to those two questions. He claims that discrimination is a form of differential treatment distinguished by its special connection to the differential ascription of some property to different people, and goes on to argue that what makes some cases of discrimination intrinsically wrongful (...) is that they manifest an attitude of disrespect for the personhood of those who are disfavored. He endeavors to specify what this attitude consists in, and to demonstrate how attending to its character can help us to better understand the moral dimensions of different forms of wrongful discrimination. The debate on empirical tests of social mechanisms suffers from a fragmented view on the relative benefit of the empirical method a researcher considers to be superior, compared to the flaws of all other methods. In this outlook. I argue that disciplinary barriers might be surmounted by a common methodological perspective on the analysis of social mechanisms. First, experimental, quantitative, qualitative, and simulation methods (agent-based modeling) are all required, but also capable to deal with the issue of causal identification, respectively. (...) The dissonance between these aspects is of growing concern for most human rights educators in various social contexts. The first part of the book opens up new discourses and presents new ontologies and epistemologies from scholars in human rights, human rights education and human rights literacies to critique and/or justify the understandings of human rights' complex applications. Today's rapidly changing social contexts and new languages (...) attempting to understand ongoing dehumanization and violations, put enormous pressure on higher education, educators, individuals working in social sciences, policy makers and scholars engaged in curricula making. The second part demonstrates how global interactions between citizens from different countries with diverse understandings of human rights (from developed and developing democracies) question the link between human rights and it's in(ex)clusive Western philosophies. Continuing inhumane actions around the globe reflect the failure of human rights law and human rights education in schools, higher education and society at large. The book shows that human rights education is no longer a blueprint for understanding human rights and its universal or contextual values presented for multicomplexial societies. The final chapters argue for new ontologies and epistemologies of human rights, human rights education and human rights literacies to open-up difficult conversations and to give space to dissonant and disruptive discourses. An increasing number of regulations propose the notion of ‘AI audits’ as an enforcement mechanism for achieving transparency and accountability for artificial intelligence (AI) systems. Despite some converging norms around various forms of AI auditing, auditing for the purpose of compliance and assurance currently have little to no agreed upon practices, procedures, taxonomies, and standards. We propose the ‘criterion audit’ as an operationalizable compliance and assurance external audit framework. We model elements of this approach after financial auditing practices, and argue (...) that AI audits should similarly provide assurance to their stakeholders about AI organizations’ ability to govern their algorithms in ways that mitigate harms and uphold human values. We discuss the necessary conditions for the criterion audit, and provide a procedural blueprint for performing an audit engagement in practice. We illustrate how this framework can be adapted to current regulations by deriving the criteria on which ‘bias audits’ for hiring algorithms can be performed, as required by the recently effective New York City Local Law 144 of 2021. We conclude by offering critical discussion on the benefits, inherent limitations, and implementation challenges of applying practices of the more mature financial auditing industry to AI auditing where robust guardrails against quality assurance issues are only starting to emerge. Our discussion as informed by experiences in performing these audits in practice highlights the critical role that an audit ecosystem plays in ensuring the effectiveness of such methodology. (shrink)
