Objectives: The objectives of the study were to assess similarities and differences between breast cancer patients and their husbands in terms of doctor-patient/spouse relationships and shared decision making; and to investigate the association between breast cancer patients and husbands in terms of preference of type of doctor, doctor-patient relationship, and shared decision making regarding medical treatment. Method: Fifty-seven women with breast cancer, and their husbands, completed questionnaires measuring doctor-patient/spouse relationships, and decision making regarding medical treatment. Results: Patients believe they have (...) a key role in the medical decision-making process and that the participation of their husbands, and their agreement with the decision, is important. Both breast cancer patients and their husbands prefer a shared decision-making process to paternalistic or autonomy-based approaches. Conclusion: In contrast to legal and bioethical approaches, which focus on the patient as the primary decision maker, this study reflects a practical recognition of the role of the breast cancer patient's husband in the decision-making process. It also reflects a relational rather than an individualistic perception of patient autonomy. (shrink)

As in other areas of medical practice, relatives accompany patients to genetic consultations. However, unlike in other areas, the consultations may be relevant to the relatives’ health because they may be at risk of developing the same genetic condition as the patient. The presence of relatives in genetic consultation may affect the decision‐making process and it raises questions about the perception of patient autonomy and the way it is practiced in genetics. However, these issues have not been examined in previous (...) empirical studies. This article aims to fill this gap by reporting findings from a qualitative study with clinicians working in the area of inherited breast cancer. The findings indicate that family presence has an impact on the patient's decisions to undergo genetic testing and preventative operations when she is diagnosed as a carrier. The findings further indicate that, unlike in other areas of medical practice, blood relatives who are present in consultations are perceived by clinicians as patients or potential patients, and this in turn increases their involvement in discussions in the consultation room. Finally, the findings indicate that in genetics, a relational approach to autonomy is applied. Decisions are made in a social context, where the relatives’ views are heard and taken into account. The findings suggest that the conventional bioethical approach to autonomy, which perceives the decision‐making unit as comprising a clinician and an individual patient, is challenged in genetics. The findings thus suggest that bioethicists, lawyers and policy‐makers should consider whether this individualistic approach is still valid and applicable. (shrink)

Leading research projects are evidence of the growing public interest in genetic diagnosis and treatment. In this context, disclosure of genetic information to relatives has become a prominent issue. However, this involves patient confidentiality, which is grounded in law and conflicts with disclosure to relatives. When conducting a legal and bioethical discussion in this context, it is first necessary to examine how clinicians perceive the role of law in their practice and how they interpret it. A qualitative study was therefore (...) conducted among clinicians in Israel. The findings indicate that the clinicians’ approach is more relational than that of the law, in view of their pro-active steps to ensure that familial information reaches the relatives when the patient is reluctant to convey this information themselves. In light of these findings the authors argue that the law can resolve situations of explicit and implicit refusal to inform relatives. (shrink)

The posthumous retrieval and use of gametes is socially, ethically, and legally controversial. In the countries that do not prohibit the practice, posthumous assisted reproduction is usually permitted only at the request of the surviving spouse and only when the deceased left written consent. This paper presents the recommendations of an ethics committee established by the Israeli Fertility Association. In its discussions, the committee addressed the ethical considerations of posthumous use of sperm—even in the absence of written consent from the (...) deceased—at the request of either the spouse or the deceased’s parents who wish to become the offspring’s parents or grandparents. It is concluded that under certain conditions, a request by the deceased’s parents to posthumously use the deceased’s sperm is justified and should be granted. (shrink)

Bioethicists, medical professionals and lawyers who support Posthumous Assisted Reproduction as an ethical procedure in the case of the deceased’s spouse often oppose it in the case of the deceased’s parents. In addition, supporters of PAR usually rely on an individualistic version of liberalism, thus focusing on a personal rather than relational approach to autonomy. This article proposes an alternative and comprehensive theoretical framework for the practice of PAR, based on the concepts of solidarity and relational autonomy. By analyzing empirical (...) data on people’s attitudes towards PAR, we reveal an important distinction between the deceased’s wish and the deceased’s consent. In addition, we show that in the majority of cases individuals report that the well-being of their relatives is paramount once they are dead. This finding, as will be demonstrated in the article, is not fully in line with Tremellen and Savulescu’s position who allow PAR in the case of the deceased’s spouse but not in the case of his parents. We also suggest that a relational autonomy perspective can be used to evaluate the choices and actions of the deceased, and to justify the requests for PAR by his spouse or parents. Furthermore, the discussion leads us to analyze both Sandel’s account of solidarity and the more recent account of Prainsack and Buyx. We conclude that PAR can be considered as a solidarity-based practice, both at the familial and societal level, an aspect that should be given more emphasis in the discourse surrounding PAR. Communicating genetic information to family members has been the subject of an extensive debate recently in bioethics and law. In this context, the extent of the relatives’ right to know and not to know is examined. The mainstream in the bioethical literature adopts a liberal perception of patient autonomy and offers a utilitarian mechanism for solving familial tensions over genetic information. This reflects a patient-centred approach in which disclosure without consent is justified only to prevent serious harm or death to (...) others. Based on a legal and bioethical analysis on the one hand, and an examination of empirical studies on the other, this paper advocates the adoption of a relational perception of autonomy, which, in the context of genetics, takes into account the effect that any decision—whether to disclose or not to disclose—will have on the familial relationship and the dynamics of the particular family. Adding this factor to the criteria usually advocated by lawyers and ethicists will facilitate reaching a sensitive decision, which recognises the various interests of family members beyond the risk to physical health. Taking this factor into account will require a process of deliberation both between doctors and patients, and in the family. It will also require a relaxation of medical confidentiality, as the family rather than the patient is gradually perceived as the unit of care. Moreover, adopting such a relational approach will accord with current views of doctors and patients who base their decision primarily on the nature of the familial relationship. (shrink)

Logical pluralism is the view that there is more than one formal logic that correctly (or best, or legitimately) codifies the logical consequence relation in natural language. This essay provides a taxonomy of different variations on the logical pluralist theme based on a five-part structure, and then identifies an unoccupied position in this taxonomy: perspectival logical pluralism. Perspectival pluralism provides an attractive position from which to formulate a philosophy of logic from a feminist perspective (and from other, identity-based perspectives, such (...) as critical race theory). An example of how such an account might be developed is sketched. The essay concludes by defusing an obvious objection to the perspectival approach: the claim that the correct logic (or logics), in virtue of the formal nature of logic, should be independent of considerations regarding the identity of the reasoner. The No-No Paradox consists of a pair of statements, each of which ?says? the other is false. Roy Sorensen claims that the No-No Paradox provides an example of a true statement that has no truthmaker: Given the relevant instances of the T-schema, one of the two statements comprising the ?paradox? must be true (and the other false), but symmetry constraints prevent us from determining which, and thus prevent there being a truthmaker grounding the relevant assignment of truth values. Sorensen's view (...) is mistaken: situated within an appropriate background theory of truth, the statements comprising the No-No Paradox are genuinely paradoxical in the same sense as is the Liar (and thus, on Sorensen's view, must fail to have truth values). This result has consequences beyond Sorensen's semantic framework. In particular, the No-No Paradox, properly understood, is not only a new paradox, but also provides us with a new type of paradox, one which depends upon a general background theory of the truth predicate in a way that the Liar Paradox and similar constructions do not. The process of advisement in the research of a doctoral dissertation is prolonged and harbors a variety of ethical aspects and issues. In some cases it gives rise to dissatisfaction on the part of both advisor and student regarding the process itself and/or the publication of the dissertation. To ameliorate these problems, the Dissertation Committee of the School of Social Work at the University of Haifa recently set out guidelines for both advisor and doctoral student, in accordance with which both (...) parties will draw up an agreement in advance to suit the student’s research. The present article discusses the components of the advisement process and presents recommendations for an advisor-doctoral student agreement. Although no evaluation was undertaken by the authors to assess the impact of the guidelines agreement, our brief experience with these guidelines reinforces the importance of such an agreement, which can help assure mutual satisfaction on the part of both the advisor and the student. The purpose of this article is to analyse the mathematical practices leading to Rafael Bombelli’s L’algebra (1572). The context for the analysis is the Italian algebra practiced by abbacus masters and Renaissance mathematicians of the fourteenth to sixteenth centuries. We will focus here on the semiotic aspects of algebraic practices and on the organisation of knowledge. Our purpose is to show how symbols that stand for underdetermined meanings combine with shifting principles of organisation to change the character of algebra.

Ethics in the West too often equates morality with universal moral principles, thus imposing lifestyles and moral criteria that do not respect differences and local histories. Even Christianity proposes ethics that is based on eternal, absolute and universal truths or principles, independent of sociocultural and historical contexts. The problem is that these universal moral laws become a means of social control to exclude those who are different: non-Christian religions, nonwhite races, non-Western cultures, and poor and marginalized social classes everywhere. To (...) these can be added minorities marginalized because of sexual orientation, physical handicaps, and women of all sectors and cultures. Another kind of ethics is urgent. For these reasons, Christians in Latin America and other parts are seeking innovative ways of envisioning ethics from their marginalized and discriminated social locations in order to find another possible ethics, an ethics that is not universal and not based on eternal truths or principles, but rather is contextual and historical and that takes into account real-life realities. Only an ethics that does this will be liberative. Important steps toward this other possible ethics have been taken by the theology of liberation by developing a contextual and intercultural morality. (shrink)

_Dialectic_ is now widely regarded as a classic of contemporary philosophy. This book, first published in 1993, sets itself three main aims: the development of a general theory of dialectic, of which Hegelian dialectic can be seen to be a special case; the dialectical enrichment and deepening of critical realism, viz. into the system of dialectical critical realism; and the outline of the elements of a totalizing critique of Western philosophy. The first chapter clarifies the rational core of Hegelian dialectic. (...) Chapter two then proceeds to develop a general theory of dialectic. Isolating the fallacy of 'ontological monovalence', Roy Bhaskar then shows how absence and other negating concepts such as contradiction have a legitimate and necessary ontological employment. The primary narrative problem of the analyst is, then, not how to tell a normative chronological life history; rather, it is how to tell the several histories of each analysis. From this vantage point, the event with which to start the model analytic narration is not the first occasion of thought—Freud's wish-fulfilling hallucination of the absent breast; instead, one should start from a narrative account of the psychoanalyst's retelling of something told by an analysand and the analysand's response to that (...) narrative transformation. In the narration of this moment of dialogue lies the structure of the analytic past, present, and future. It is from this beginning that the accounts of early infantile development are constructed. Those traditional developmental accounts, over which analysts labored so hard, may now be seen in a new light: less as positivistic sets of factual findings about mental development and more as hermeneutically filled-in narrative structures. The narrative structures that have been adopted control the telling of the events of the analysis, including the many tellings and retellings of the analysand's life history. The time is always present. The event is always an outgoing dialogue. L'immeuble du mobile invite à faire l'expérience d'une manière de penser, par gestes et par diagrammes. Il est une poursuite du travail de Gilles Châtelet soutenue par un approfondissement de la conception du virtuel et de l'événement propre à Gilles Deleuze. Refusant le face-à-face de la nature et de la pensée, il déploie un projet de renouveau de la Naturphilosophie dans le cadre du physico-mathématique, de Galilée jusqu'à la physique quantique. Il expose une dialectique comprenant des centres d'indifférence au cœur (...) des gestes et de leurs dimensions (symétries). Ces dimensions spatiales-temporelles-intensives de l'effectuation du virtuel sont des paliers de la nature et de la pensée, avec des modes différents de mobilité. Des expériences de gestes en pensée sont proposées au lecteur-acteur pour accéder à chacun des paliers, suivant une narration induisant les passages par les subjectivités propres à chacune de ces mises en scène.
