This concluding essay offers reflections on core components of the faculty fellowship program, its outcomes and results, and program design and administration. Amid the current calls for reform in legal and other professional education, the lessons we learned and perspectives we gained during this fellowship program may be relevant to any faculty members and university administrations that are seeking to create more effective and engaged professional and graduate school programs, whatever may be their subject-matter discipline.

Most donated organs in the United States come from brain dead donors, while a small percentage come from patients who die in “controlled,” or expected, circumstances, typically after the family or surrogate makes a decision to withdraw life support. The number of organs available for transplant could be substantially if donations were permitted in “uncontrolled” circumstances–that is, from people who die unexpectedly, often outside the hospital. According to projections from the Institute of Medicine, establishing programs permitting “uncontrolled donation after circulatory (...) determination of death,” or uDCDD, throughout the United States has the potential to provide 22,000 more donation opportunities annually. In contrast, U.S. controlled donation after circulatory determination of death, or cDCDD, cases have increased progressively over the past decade from 87 to 848 donors, but currently account for only 10.6 percent of all deceased donors. Following the IOM recommendations, several projects exploring the feasibility of uDCDD were funded by the federal government, including a grant from the Health Resources and Services Administration that supported a pilot project in New York City in which the authors of this article participated.A key feature of our protocol, and indeed of many uDCDD protocols, is the initiation of preservation methods such as chest compressions and extracorporeal membrane oxygenation shortly after death in order to perfuse and preserve the donor's organs. Critics of uDCDD argue that the means of determining death deviates from generally ascribed principles. They assert that reinstituting circulation in order to preserve organs has the effect of “undoing” the prior determination of death. The result is that cDCDD is widely accepted and practiced routinely even though it only marginally increases the number of organs available for transplantation, and uDCDD is widely considered unacceptable despite being ethically embraced and proven to significantly increase organ donation opportunities in other countries. This article explores the evolution of this counterintuitive state of affairs and calls for a policy that, in line with the IOM report, allows for both cDCDD and uDCDD protocols. (shrink)

Appropriately trained legal counsel serving as legal advisors on the health officer's team facilitate clear understanding of the legal basis for public health interventions and access to legal tools for carrying them out.Legal counsel serve public health agencies via different organizational arrangements — e.g., internal staff counsel, external counsel from the state attorney general's office, state health (...) department, county or city, or private counsel under contract, or in combination. As of 2011, most state health departments employ their own counsel, and 56% use AG counsel, while 17% contract with independent attorneys; most local health departments work with attorneys and legal staff assigned by local government, by the state health agency, or contract with outside attorneys and legal staff. E-cigarettes, sometimes referred to as ENDS, include a broad range of products that deliver nicotine via heating and aerosolization of the drug. ENDS come in a variety of forms, but regardless of form generally consist of a solution containing humectant, flavorings, and usually nicotine ; a battery-powered coil that heats the solution into an aerosol in an atomizing chamber; and a mouthpiece through which the user draws the vapor into the mouth and lungs. The devices may be closed systems containing (...) prefilled cartridges, or open systems, where the user manually refills a 1-2 ml. tank with solution. What started as closed-system cigarette-shaped devices marketed as an adjunct for smoking cessation, has transitioned rapidly to literally thousands of hip and funky-designed open-system hookah pens, vape pens, and modifiable devices. For younger people, these forms are the “in” thing, while traditional cigarette-shaped devices are “out.”. (shrink)

Liberal theology has wanted to revise and reinterpret Christian faith in conformity with history, reason, a scientific worldview, and a sophisticated grasp of the significance of symbol, analogy, and metaphor in the lives of religious practitioners. Eliminating both supernaturalism and anthropomorphism, liberal theology would make Christianity more intellectually tenable, rescuing it from the literalist hands of fundamentalists, without collapsing it into the equally literalist arms of atheism.The extreme difficulty of evading the either-or dilemma of choosing either fundamentalism or atheism landed liberal theology in a catch-22: either it rejected the intellectually untenable elements of belief, in which case it eliminated just those beliefs that constituted its appeal to popular piety, or it retained certain supernaturalistic and anthropomorphic beliefs, understood as “symbolic,” in which case it forfeited intellectual intelligibility and any appeal to sophisticated moderns. That irony, as Wheeler knows, is that the more intellectual changes pragmatic historicists make to traditional Christian belief, the more they help to make unbelief viable. The question then arises as to whether pragmatic historicism is simply a half-way house on the road to an atheistic destination. Or, if the word “atheism” sounds too old-fashioned, like something that went out with steamships and girdles, then “agnosticism.” Or, if “agnosticism” still smacks too much of stale debates, why not “pantheism,” as recently revived by Mary-Jane Rubenstein?The detailed development, the verbal bravura, and the measured knowledge in this book are astonishingly impressive. Wheeler’s initial thesis is that liberal theology, particularly of the early Chicago School, and American pragmatism, particularly C. S. Peirce, William James, and John Dewey, provide important resources for meeting the challenges posed by the rise of historical consciousness. Sheila Davaney has designated this tradition “pragmatic historicism,” and Wheeler aims to show its compelling import for the future of theology itself. He does not simply call for a pragmatic historicist approach to theology, but he executes one as well, showing in more detail than his predecessors what it means for such topics as religious diversity (chapters 3 and 4), the nature of authority (chapter 5), the meaning of critical realism, fallibilism, and an altered correspondence theory of truth (chapters 6 and 7), and the doctrine of God (chapter 8). Artificial intelligence is a general-purpose technology (GPT), term given to technologies that shape an entire era and reorient innovations by reconfiguring the economy’s logic and functioning and bringing in new business models. AI offers unprecedented opportunities and risks. The benefits of AI are extraordinary, as are its potential harms. Potential damage does not have the same degree of problematization, since the intensity and extent of the damage varies according to the domain and the object of application. To address the scale (...) of this challenge, regulation is necessary but not sufficient. Standards, unwritten codes of compliance and arbitration procedures, supervision and auditability, AI governance, international agreements, compliance with current local and global standards and laws. All of this needs to be integrated. Society seems to have no alternative to facing the challenges of at least mitigating the damage already identified and trying to predict future damage in advance. The purpose of this article is to encourage reflection regarding the main initiatives that are available to society to protect its citizens and organizations from the potential harm caused by AI models, vis-à-vis the technology’s own limits to act in ethical and legal compliance. We lay groundwork for applying ethnographic methods in philosophy of science. We frame our analysis in terms of two tasks: to identify the benefits of an ethnographic approach in philosophy of science and to structure an ethnographic approach for philosophical investigation best adapted to provide information relevant to philosophical interests and epistemic values. To this end, we advocate for a purpose-guided form of cognitive ethnography that mediates between the explanatory and normative interests of philosophy of science, while maintaining openness and (...) independence when framing such an investigation to achieve robust unbiased results. Each year, more patients die as a result of medical mistakes than are killed by motor vehicle accidents, breast cancer, or AIDS. While most government and regulatory efforts are directed toward reducing and preventing errors, the actions that should follow the injury or death of a patient are still hotly debated. A cognitive ethnography of how bioengineering scientists create innovative modeling methods. In this first full-scale, long-term cognitive ethnography by a philosopher of science, Nancy J. Nersessian offers an account of how scientists at the interdisciplinary frontiers of bioengineering create novel problem-solving methods. Bioengineering scientists model complex dynamical biological systems using concepts, methods, materials, and other resources drawn primarily from engineering. They aim to understand these systems sufficiently to control or intervene in them. What Nersessian examines here is how cutting-edge (...) bioengineering scientists integrate the cognitive, social, material, and cultural dimensions of practice. Her findings and conclusions have broad implications for researchers in philosophy, science studies, cognitive science, and interdisciplinary studies, as well as scientists, educators, policy makers, and funding agencies. In studying the epistemic practices of scientists, Nersessian pushes the boundaries of the philosophy of science and cognitive science into areas not ventured before. She recounts a decades-long, wide-ranging, and richly detailed investigation of the innovative interdisciplinary modeling practices of bioengineering researchers in four university laboratories. She argues and demonstrates that the methods of cognitive ethnography and qualitative data analysis, placed in the framework of distributed cognition, provide the tools for a philosophical analysis of how scientific discoveries arise from complex systems in which the cognitive, social, material, and cultural dimensions of problem-solving are integrated into the epistemic practices of scientists. Specifically, she looks at how interdisciplinary environments shape problem-solving. Although Nersessian’s case material is drawn from the bioengineering sciences, her analytic framework and methodological approach are directly applicable to scientific research in a broader, more general sense, as well. The notions of duty and obligation constitute the central focus of Rawls's account of political authority. This chapter examines Rawls's accounts of (1) the justification of political authority; (2) the essential elements of a just constitutional regime; (3) the conditions under which resistance to just institutions is permissible or required; and (4) the conditions under which institutions cease to deserve fidelity and obedience. It commences with Rawls's accounts of duty and obligation, focusing on his accounts of (1) the duties and (...) obligation of citizens; and (2) the duty to obey unjust laws. Jean-Luc Nancy provides an analysis of the anti-Semitic aspects of Heidegger's recently published Black Notebooks. Nancy refers to a philosophical or "historial" anti-Semitism marked, nonetheless, by the "banality" of ordinary anti-Semitism pervading Europe. Heidegger's thought is placed in the broader context of the European (especially Christian) impulse toward new beginnings.

The doctrine of karma and rebirth is often praised for its ability to offer a successful solution to the Problem of Evil. This essay evaluates such a claim by considering whether the doctrine can function as a systematic theodicy, as an explanation of all human suffering in terms of wrongs done in either this or past lives. This purported answer to the Problem of Evil must face a series of objections, including the problem of anylackofmemoryofpastlives,the lack of proportionality between wrongdoing (...) and the observed suffering in the world, the problem of infinite regress of explanation, and the problem of compatibility of free will with karmic determinism. These objections, either separately or taken together, provide sufficient reason to doubt whether the doctrine of karma and rebirth can in fact provide a satisfactory theodicy. (shrink)

A topic of special importance when it comes to responsibility and implicit bias is responsibility for knowledge. Are there strategies for becoming more responsible and respectful knowers? How might we work together, not just as individuals but members of collectives, to reduce the negative effects of bias on what we see and believe, as well as the wrongs associated with epistemic injustice? Racial Climates, Ecological Indifference offers a powerful intervention to the field of climate justice scholarship by addressing a neglected aspect of the field of climate justice, namely systemic racisms. Building on the work of Black feminist theorists, the work develops an ecointersectional approach designed to reveal the depth and complexities of racial climates overlooked even in the environmental justice literature. The book’s conception of ecological indifference underscores the disposition of seeing the environment as a resource for human consumption and enjoyment, (...) a resource that is usable, fungible, disposable, and without intrinsic worth or standing. The many examples in the book offer new insights demonstrating that systemic racisms emerge out of and give rise to environmental degradation; that is, they are often mutually constitutive. The ecointersectional analyses provided throughout the book reveal that ecological indifference and climate injustice are two sides of the same coin. Three distinctive but interrelated domains in which the intersections between systemic racisms and ecological indifference are manifest are identified: (1) differential distribution of harms/benefits due to systemic racisms, (2) racist institutions and practices fueling or causing environmental degradation, and (3) the basic social structures that generate environmental degradation being the same ones that generate systemic oppression of certain groups of people. One of the aims of Racial Climates, Ecological Indifference is to underscore that any effort to protect the environment must also be a fight against systemic racisms and other forms of systemic inequity. Questions of whether anything exceeds reasonable sense and meaning have persisted throughout the history of philosophy. These questions have even continued in postmodern thought as well as in liberatory philosophies in which many kinds of events and lineages are experienced and seen as beyond philosophy. In this cowritten text, distinguished philosophers Nancy Tuana and Charles Scott pay particular attention to lineages and their dynamism as they develop the idea of things beyond philosophy, beyond norms. This is not a history (...) of philosophy or a critical study of a particular philosopher but a way to engage experience around dimensions of events that are beyond measuring, counting, meaning, and value. These attunements, they assert, are vitally important for the ways people orient themselves in the world and comport themselves in it. Tuana and Scott build on the alternatives to normative ethics that they find in the work of Nietzsche, Foucault, and Anzaldúa. They urge attunement to the world as a way to speak about what is impossible to give voice to, to live in the spaces between speech and the unspeakable, and to conceptualize and articulate the boundaries of rational sensibility.
