Drawing upon a range of theorists, photographers and literary texts, this article explores the role of memory in grounding identity. If the subject is constituted in language, it is argued, identity can be achieved only in the realm of the imaginary, through fixation in an imago of the self. It is memory above all that gives this being-in-denial its imagined solidity; but that solidity is an effect of language’s ability to create verisimilitude in an eternal present of signification, and not (...) of memory’s relation to a real past. Identity therefore always remains precarious, because the signifiers that furnish the points de capiton of what we remember always also defer elsewhere. (shrink)

An exercise in humour noir, this essay explores relations between the Paris and Prague surrealist groups from André Breton and Paul Éluard's visit to “the magic capital of old Europe” in 1935 to the aborted “Prague Spring” of 1968. It focuses on the famous “starry castle” of Breton's Mad Love — which Czechs know better as Letohrádek Hvězda at Bílá hora, the White Mountain — as a signifier whose wanderings, over the period, encapsulate the mutual myths and misunderstandings that were (...) constitutive of this most poignant of surrealist love affairs. The essay ends by suggesting that what makes the Czech capital a fitting object of the surrealist imagination (and a rich source of surreal art and literature in its own right) is less the “historic charms” that so seduced Breton in 1935 than the “geographical, historical, and economic considerations” of the city's modernity that he blithely put to one side. Early discussions of ?climate justice? have been dominated by economists rather than political philosophers. More recently, analytical liberal political philosophers have joined the debate. However, the philosophical discussion of climate justice remains in its early stages. This paper considers one promising approach based on human rights, which has been advocated recently by several theorists, including Simon Caney, Henry Shue and Tim Hayward. A basic argument supporting the claim that anthropogenic climate change violates human rights is presented. Four objections to this (...) argument are examined: the ?future persons? objection; the ?risk? objection; the ?collective causation? objection; and the ?demandingness? objection. This critical examination leads to a more detailed specification and defence of the claim that anthropogenic climate change violates human rights. (shrink)

I defend the thesis that most or all perceptual experiences are infused with imaginative contributions. While the idea is not new, it has few supporters. I begin by developing a framework for the underlying debate. Central to that framework is the claim that a perceptual experience is infused with imagination if and only if there are self-generated contributions to that experience that have ampliative effect on its phenomenal and directed elements. Self-generated ingredients to experience are produced by the subject as (...) opposed to being received from the world. Some form of stored content is an obvious starting point. Ampliative effects are aspects of perceptual experience that outstrip the content the senses get from the world. This conceptual framework is applied to three case studies: object-sameness and object-kind recognition (section 2), memory colour (section 3), and perceptual constancy and amodal completion (section 4). If the three cases and my overall analysis are accepted (a substantive if), then we have a forceful inductive argument for perception being infused with imagination. (shrink)

The book confronts the rapid changes to psychological science, neuroscience, healthcare, and philosophy that have occurred since the (...) model was first proposed and addresses key issues such as the model’s scientific basis, clinical utility, and philosophical coherence. The authors conceptualise biology and the psychosocial as in the same ontological space, interlinked by systems of communication-based regulatory control which constitute a new kind of causation. These are distinguished from physical and chemical laws, most clearly because they can break down, thus providing the basis for difference between health and disease. This work offers an urgent update to the model’s scientific and philosophical foundations, providing a new and coherent account of causal interactions between the biological, the psychological and social. This paper discusses varieties of normative phenomena, ranging from morality, to epistemic justification, to the rules of chess. It canvases a number of distinctions among these different normative phenomena. The most significant distinction is between formal and authoritative normativity. The prior is the normativity exhibited by any standard one can meet or fail to meet. The latter is the sort of normativity associated with phenomena like the "all-things-considered" ought. The effects of mental disorder are apparent and pervasive, in suffering, loss of freedom and life opportunities, negative impacts on education, work satisfaction and productivity, complications in law, institutions of healthcare, and more. With a new edition of the 'bible' of psychiatric diagnosis - the DSM - under developmental, it is timely to take a step back and re-evalutate exactly how we diagnose and define mental disorder. This new book by Derek Bolton tackles the problems involved in the definition (...) and boundaries of mental disorder. It addresses two main questions regarding mental illness. Firstly, what is the basis of the standards or norms by which we judge that a person has a mental disorder - that the person's mind is not working as it should, that their mental functioning is abnormal? Controversies about these questions have been dominated by the contrast between norms that are medical, scientific or natural, on the one hand, and social norms on the other. The norms that define mental disorder seem to belong to psychiatry, to be medical and scientific, but are they really social norms, hijacked and disguised by the medical profession? Secondly, what is the validity of the distinction between mental disorder and order, between abnormal and normal mental functioning? To what extent, notwithstanding appearances, does mental disorder involve meaningful reactions and problem-solving? These responses may be to normal problems of living, or to not so normal problems - to severe psycho-social challenges. Is there after all order in mental disorder? With the closing of asylums and the appearance of care in the community, mental disorder is now in our midst. While attempts have been made to define clearly a concept of mental disorder that is truly medical as opposed to social, there is increasing evidence that such a distinction is unviable - there is no clear line between what is normal in the population and what is abnormal. It’s intuitive to think that an intentional action requires that the agent knows that she’s doing so. In light of some apparent counterexamples, Setiya suggests that this intuitive insight is better captured in terms of credence: performing an intentional action requires the agent to have a higher credence that she’s doing so than she would have otherwise. I argue that there is no such thing as an agent’s credence for what she’s doing. After distinguishing this thesis from an idea some (...) defend under the slogan “deliberation crowds out prediction”, I explore the thesis’s broader epistemological implications for the belief-credence relation. Research ethics committees are charged with providing an opinion on whether research proposals are ethical. These committees are overseen by a central office that acts for the Department of Health and hence the State. An advisory group has recently reported back to the Department of Health, recommending that it should deal with inconsistency in the decisions made by different RECs. This article questions the desirability and feasibility of questing for consistent ethical decisions.

I respond to the 4 commentaries by Awais Aftab & Kristopher Nielsen, Hane Htut Maung, Diane O’Leary and Kathryn Tabb under 3 main headings: “What is the BPSM really?” & Why update it?; “Is our approach foundationally compromised?”, and finally, “Antagonists or fellow travellers?”.

Mengzi states that our human nature consists of our ability to feel compassion, disdain, respect, and (dis-)approval: all human beings have them. But he also states that we lose these four emotional capacities if we don’t reflect on or attend to them. There is an apparent contradiction in saying that all humans have them, but some have lost them. This essay offers a close reading of Mengzi’s phrase “to lose it” that helps explain away this appearance of contradiction. In doing (...) so, Mengzi is interpreted to be offering an ethics of attention about how we should attend to ourselves and others selectively to have a functional social life. (shrink)

Liberalism and ecologism are widely regarded as incompatible. Liberalism and (anthropocentric) environmentalism might be compatible but liberalism and (non-anthropocentric) ecologism are not. A liberal state cannot promote policies for ecological or ecocentric reasons. An individual cannot be both a liberal and a committed advocate of ecologism. This paper challenges these claims. It is argued that Rawls’s ‘political liberalism’ is compatible with ecologism and, in particular, the idea of ‘ecological justice’. A Rawlsian state can promote ecological justice. A committed political liberal (...) can also be a committed advocate of ecological justice. The argument is developed through a close textual examination of Rawls’s brief discussion of our duties to ‘animals and the rest of nature’. Rawls leaves far more scope for liberal ecologism than his critics have suggested. The proposed version of liberal ecologism is defended against charges of substantive and procedural bias toward humans and against nonhuman nature. Liberal ecologism may not be enough for some ecologists-especially ‘ecological constitutionalists’ seeking constitutional protection for nonhuman nature-but it is a serious and defensible political and moral theory. Advance refusals of life-sustaining treatment involve three potentially conflicting interests: those of the patient; those of the doctor; and those of the law. The state's interest in protecting life can clash with the patient's right to self determination which, in turn, can conflict with the doctor's desire to act in the patient's best interests. Against this background, we present the case of a patient who was treated (arguably) contrary to his advance refusal but in accordance with English law.

This essay is an introduction to the Routledge Handbook of Philosophy of Colour. Objectives—To study the value of taking an ethics history as a means of assessing patients' preferences for decision making and for their relatives' involvement.Design—Questionnaire administered by six junior doctors to 56 mentally competent patients, admitted into general and geriatric medical beds.Setting—A large district general hospital in the United Kingdom.Main measures—To establish whether patients were adequately informed about their illness and whether they minded the information being communicated to their relatives. To establish their preference regarding truthful disclosure and participation in decision (...) making with risk attached. To establish whether they wished to be involved in CPR decision making, and if not, who should make the decision. To establish whether they knew of living wills and whether they had any advance directives.Results—Twenty-four were inadequately informed of their illness.Forty-six said they would want to know were something serious to be found. Twenty-eight wanted to make their own decision if requiring risky treatment and 11 wanted family members involved. Thirty-one wanted to make a cardiopulmonary resuscitation decision and five of these decisions differed from those made by the doctors. Twenty-five preferred the doctors to decide. Eleven of the patients had heard of living wills but only one had executed such a will. Seven of the patients wished to provide advance directives. Three did not find the history taking helpful but none were discomforted.Conclusion—Taking an ethics history is a simple means of obtaining useful information about patients' preferences. (shrink)

Objectives: To compare non-treatment decision making by general practitioners and geriatricians in response to vignettes. To see whether the doctors’ decisions were informed by ethical or legal reasoning.Design: Qualitative study in which consultant geriatricians and general practitioners randomly selected from a list of local practitioners were interviewed. The doctors were asked whether patients described in five vignettes should be admitted to hospital for further care, and to give supporting reasons. They were asked with whom they would consult, who they believed (...) ought to make such decisions, and whether the relatives’ preferences would influence their decision making.Main measures: To analyse the factors influencing the doctors’ decisions not to admit otherwise terminally ill patients to hospital for life prolonging treatment.Results: Seventeen GPs and 18 geriatricians completed the interview. All vignettes produced strong concordance in decision making between both groups. Ten per cent of the doctors would provide life prolonging treatment to patients with severe brain damage. Most would admit a surgical patient regardless of age or disability. Medical reasons were largely used to explain decision making. The wishes of relatives were influential and resource considerations were not. There was variability regarding decision making responsibility.Conclusions: Little attempt was made to link decision making with ethical or legal concepts and there may have been non-recognition, or denial, of the ethical consequences of failure to admit. The process of decision making may involve deception. This may be conscious, because of the illegality of euthanasia, or unconscious , because of deepseated medical and societal reluctance to accept that intentionally withholding life prolonging treatment may equate with intentionally causing death. The paper by Szasz is about mental illness and its meaning, and like Procrustes, who altered hapless travellers to fit his bed, Szasz changes the meanings of words and concepts to suit his themes.1 Refuting the existence of “mental illness”, he suggests that the term functions in an apotropaic sense. He submits that in this sense it is used to avert danger, protect society, and hence justify preventive detention of “dangerous” people.But his arguments misrepresent the precise meaning of the term (...) “apotropaic”, which is an adjective, defined in Webster’s, Chambers and the New Shorter Oxford dictionaries as averting or turning aside evil. It is possible that amulets and incantations ward off evil, in the same way as garlic repels vampires, but evil and danger are different concepts. Yet Szasz talks of using phrases like ‘“dangerousness to self and others’ as apotropaics to ward off dangers we fear”, and the word “evil” does not appear in his paper.I will argue that “dangerousness to self and others” and “psychiatric treatment” have a prosaic rather than an apotropaic function.The word “danger” is familiar rather than arcane, and includes many risks. A predatory paedophile is usually both dangerous and evil, but many dangerous people are not evil. For example, a child who plays with a box of matches is dangerous, as is a demented person who drives a car, or a schizophrenic who, acting on delusional beliefs, arms herself with a knife and roams the streets believing she is an avenging angel.Suppose …. The Intellectual Powers and its companion volume, Essays on the Active Powers of Man, constitute the fullest, most original presentation of the philosophy of Common Sense. In the process, Reid provides acutely critical discussions of an impressive array of thinkers but especially of David Hume. In Reid's eyes, Hume had driven a deep tendency in modern philosophy to its ultimate conclusions by creating (...) a phantom-world of so-called 'ideas' that sprang from objects of observation; the self was a conglomeration of perceived ideas; and the will as the source of action was nothing but the balance of passionate impulses. -/- Reid's Common Sense philosophy answers these problems by suggesting that sceptics, such as Hume, unavoidably affirm what they purport to deny, namely the existence of a stable external world, of other minds, of the continuity of their own minds, and of their own and other people's ability to ascribe and accept responsibility for actions. At first pass, colour constancy occurs when one sees a thing in one’s environment to have a stable colour despite differences in the way it is illuminated. The phenomenon is intuitively grounded for example in everyday experiences in which something is partly shadowed but, in some sense, looks to be uniformly coloured. After a brief introduction to the colour constancy concept (§0) and the science of colour constancy (§1), my focus is on the significance of colour constancy for two intertwined (...) philosophical issues. The first is colour ontology, where constancy has been used to argue for the objectivity of colour, and in particular for a reductive form of it (see §2). The second is colour constancy’s complicated connection to colour experience and colour epistemology. Colour constancy is a subtle phenomenon: it is situated at the intersection of perceptual experience and judgement; it is influenced by myriad forces within our visual-cognitive systems; and is likely a composite of interestingly disparate phenomena. I approach this suite of issues from the perspective of the given in colour perception (§3). As will become plain, the ontological and epistemic issues are related in important ways.
