This paper examines moral misconduct and recidivism at the corporate level. We analyze the factors that facilitate moral transgressions and why some companies appear to be serial offenders. We propose that negative learning is a core process that encourages repeat misconduct. We offer a framework of negative learning, grounded in a case example. The framework also suggests circumstances that reverse the vicious selfreinforcing cycle of negative learning, so companies learn to adopt a more ethical stance when faced with moral choices.

"Cult of ugliness," Ezra Pound’s phrase, powerfully summarizes the ways in which modernists such as Pound, T. S. Eliot, Wyndham Lewis, and T. E. Hulme—the self-styled "Men of 1914"—responded to the "horrid or sordid or disgusting" conditions of modernity by radically changing aesthetic theory and literary practice. Only the representation of "ugliness," they protested, would produce the new, truly "beautiful" work of art. They dissociated the beautiful from its traditional embodiment in female beauty, and from its association with Walter Pater (...) and Oscar Wilde. Their cultivation of ugliness displaced misogyny and homophobia. Higgins takes in texts such as John Ruskin’s art criticism, Eliot’s literary journalism, Lewis’s pro-fascism pamphlets, and the poetry of Pound, Conrad Aiken, and Langston Hughes. She demonstrates that even vigorous champions of beauty were committed to aesthetic practices that disempowered female figures in order to articulate new truths of male artistic mastery. (shrink)

The systemic role of corruption and its link to low human development is explored. The extractive resource industry is presented as anarena where conditions for corruption—monopoly and discretion without accountability—are especially intense. Corruption is maintainedby a self-reinforcing cycle. Multiple stakeholders are involved in the maintenance of and/or opposition to the cycle: investing corporations, host country regimes and officials, inter-governmental bodies like the OECD, industry associations, non-governmental organization (NGO) watchdogs like Transparency International, and international agencies facilitating global investment like the World (...) Bank. Complementarity of interests between the demand and supply sides provides strong incentives for entrenched players to maintain corruptive relationships, to protect past gains and sustain current ones. Compulsory international regulation, maximum transparency, effective detection, and enforcement are recommended to enhance accountability, thereby reversing the cycle. It is also necessary to create a corporate culture built on integrity, if regulation itself is to succeed. (shrink)

The view that we are animals -- animalism -- is often misunderstood. It is typically stated in unhelpful or misleading ways. Debates over animalism are often unclear about what question it purports to answer, and what the alternative answers are. The paper tries to state clearly what animalism says and does not say. This enables us to distinguish different versions of animalism.

An important contribution to the foundations of probability theory, statistics and statistical physics has been made by E. T. Jaynes. The recent publication of his collected works provides an appropriate opportunity to attempt an assessment of this contribution.

With so much attention being paid to the development and refinement of appropriate criteria and tests for death, little attention has been given to the broader conceptual issues having to do with its definition or with the relation of a definition to its criterion. The task of selecting the correct criterion is, however, virtually impossible without proper attention to the broader conceptual setting in which the definition operates as the key feature. All of the issues I will discuss arise because (...) of this lack of concern with conceptual matters. Such problems as incorrectly diagnosing a patient as dead prior to the harvesting of his or her organs, defending the idea that death is reversible, and advocating a brainstem criterion of death, are all, I believe, errors that derive from this misplaced emphasis. In four experiments, we offer evidence that virtues are often judged as uniquely important for some business practices (e.g., hospital management and medical error investigation). Overall, actions done only from virtue (either by organizations or individuals) were judged to feel better, to be more praiseworthy, to be more morally right, and to be associated with more trustworthy leadership and greater personal life satisfaction compared to actions done only to produce the best consequences or to follow the correct moral rule. These (...) results accord with claims made by some virtue ethicists. The current data contribute to a small but growing body of literature emphasizing both empirical soundness and philosophical rigor in the scientific study of virtue. Results also offer some guidance concerning how businesses, employees, and executives are evaluated and perceived. Implications for theory and practice are discussed. (shrink)

The pioneering work of Edwin T. Jaynes in the field of statistical physics, quantum optics, and probability theory has had a significant and lasting effect on the study of many physical problems, ranging from fundamental theoretical questions through to practical applications such as optical image restoration. Physics and Probability is a collection of papers in these areas by some of his many colleagues and former students, based largely on lectures given at a symposium celebrating Jaynes' contributions, on the occasion of (...) his seventieth birthday and retirement as Wayman Crow Professor of Physics at Washington University. The collection contains several authoritative overviews of current research on maximum entropy and quantum optics, where Jaynes' work has been particularly influential, as well as reports on a number of related topics. In the concluding paper, Jaynes looks back over his career, and gives encouragement and sound advice to young scientists. All those engaged in research on any of the topics discussed in these papers will find this a useful and fascinating collection, and a fitting tribute to an outstanding and innovative scientist. The essay starts with a survey of thevarious approaches which can be distinguished: the logical approach, therhetorical approach, and the dialogical approach. Then it identifies varioustopics in the research, which constitute the various components of aresearch programme of legal argumentation: the philosophical component, thetheoretical component, the reconstruction component, the empiricalcomponent, and the practical component. This article reports on an exploratory study that used metaphoric objects as a therapeutic aid. During Rogerian therapy sessions, a metaphoric object was handed to clients. The metaphoric object was used as a reflection of an aspect of the client's being. The clients were asked to describe the effect the object had on them. The protocols obtained were subjected to a phenomenological analysis. The study indicates that metaphoric objects can be a useful therapeutic aid.

The "gang of four" — Wang Hung-wen, Chang Ch'un-ch'iao, Chiang Ch'ing and Yao Wen-yuan — have created great chaos by confusing the relations between ourselves and the enemy, obliterating the differences between the two kinds of contradiction, wrecking Chairman Mao's policy of uniting with, educating and reforming intellectuals, calling intellectuals the "stinking number nine," smothering the revolutionary initiative of the broad masses of intellectuals, and destroying the ranks of revolutionary intellectuals.
