In 2012, a new and promising gene manipulation technique, CRISPR-Cas9, was announced that seems likely to be a foundational technique in health care and agriculture. However, patents have been granted. As with other technological developments, there are concerns of social justice regarding inequalities in access. Given the technologies’ “foundational” nature and societal impact, it is vital for such concerns to be translated into workable recommendations for policymakers and legislators. Colin Farrelly has proposed a moral justification for the use of patents (...) to speed up the arrival of technology by encouraging innovation and investment. While sympathetic to his argument, this article highlights a number of problems. By examining the role of patents in CRISPR and in two previous foundational technologies, we make some recommendations for realistic and workable guidelines for patenting and licensing. (shrink)

An ‘Information Centre’ has recently been established by law which has the power to collect, collate and provide access to the medical information forall patients treated by the National Health Service in England, whether in hospitals or by General Practitioners. This so-called ‘care.data’ scheme has given rise to major and ongoing controversies. We will sketch the background of the scheme and look at the responses it has elicited from citizens and medical professionals. In Autumn 2013, NHS England set up a (...) care.data website where citizens could record their concerns regarding the collection of health-related data by the Information Centre. We have reviewed all the comments on this website up until June 2015. We have also analysed the readers’ comments on the coverage of the care.data scheme in one of the main national UK newspapers. When discussing the responses of citizens, we will make a distinction between the problems that citizens detect and the solutions they propose. The solutions that are being perceived as the most relevant ones can be summarized as follows: citizens wish to further the common good without being manipulated into doing it, while at the same time being safeguarded against various abuses. The issue of trust turns out to figure prominently. Our analysis of reactions to the scheme in no way pretends to be exhaustive, yet it provides various relevant insights into the concerns identified by citizens as well as medical professionals. These concerns, moreover, have a more general relevance in relation to other contexts of medical data-mining as well as biobank research. Our analysis also offers important pointers as to how those concerns might be addressed. (shrink)

Since the adoption of the WTO-TRIPS Agreement in 1994, there has been significant controversy over the impact of pharmaceutical patent protection on the access to medicines in the developing world. In addition to the market exclusivity provided by patents, the pharmaceutical industry has also sought to further extend their monopolies by advocating the need for additional ‘regulatory’ protection for new medicines, known as data exclusivity. Data exclusivity limits the use of clinical trial data that need to be submitted to the (...) regulatory authorities before a new drug can enter the market. For a specified period, generic competitors cannot apply for regulatory approval for equivalent drugs relying on the originator's data. As a consequence, data exclusivity lengthens the monopoly for the original drug, impairing the availability of generic drugs. This article illustrates how the pharmaceutical industry has convinced the US and the EU to impose data exclusivity on their trade partners, many of them developing countries. The key arguments formulated by the pharmaceutical industry in favor of adopting data exclusivity and their underlying ethical assumptions are described in this article, analyzed, and found to be unconvincing. Contrary to industry's arguments, it is unlikely that data exclusivity will promote innovation, especially in developing countries. Moreover, the industry's appeal to a property rights claim over clinical test data and the idea that data exclusivity can prevent the generic competitors from ‘free-riding’ encounters some important problems: Neither legitimize excluding all others. Advancements in the field of biotechnology have accelerated the development of drugs that are manufactured from cultures of living cells, commonly referred to as “biologics.” Due to the complexity of the production process, generic biologics are unlikely to be chemically identical to the reference product, and accordingly are referred to as “biosimilars.”Encouraging the development of biosimilars has been presented as the key solution to decrease prices and increase access to biologics, but the development and use of biosimilars continues to raise (...) problems, none of which can easily be addressed. Developing a biosimilar requires considerable time and financial resources, and legitimate safety concerns necessitate elaborate clinical testing of biosimilars. As a consequence, the introduction of biosimilars onto the market has not resulted in significant price reductions, and concerns regarding the substitution and interchangeability of original biologics with biosimilars persist.This article will explain how the biologics production process distorts the trade-offs that traditionally guided both patent protection and regulatory exclusivities: disclosure as a key condition for benefiting from the corresponding monopoly position. Hence, we propose establishing a mechanism of mandatory deposit of the original biologic's cell line at the stage of the regulatory approval as the most effective remedy. (shrink)

23andMe not only sells genetic testing but also uses customer data in its R&D activities and commercial partnerships. This raises questions about transparency and informed consent. Based on a online survey conducted in 2017–18, we examine attitudes of 368 customers of 23andMe toward the company's use of their data. Our findings point at divides in the context of customers' awareness of the two-sided business model of DTC genetics and their attitudes toward consent. While most of our respondents (68%) were aware (...) that 23andMe could store their data and use it for certain purposes without their consent, over 40% were not aware that using and sharing customer data was part of the business model. Views were also divided regarding what type of consent was most appropriate. We explore the implications of these divides for participatory research and for the importance of transparency and trust in commercially-driven scientific knowledge production. (shrink)

Intensified and extensive data production and data storage are characteristics of contemporary western societies. Health data sharing is increasing with the growth of Information and Communication Technology platforms devoted to the collection of personal health and genomic data. However, the sensitive and personal nature of health data poses ethical challenges when data is disclosed and shared even if for scientific research purposes. With this in mind, the Science and Values Working Group of the COST Action CHIP ME ‘Citizen's Health through (...) public-private Initiatives: Public health, Market and Ethical perspectives’ identified six core values they considered to be essential for the ethical sharing of health data using ICT platforms. We believe that using this ethical framework will promote respectful scientific practices in order to maintain individuals’ trust in research. We use these values to analyse five ICT platforms and explore how emerging data sharing platforms are reconfiguring the data sharing experience from a range of perspectives. We discuss which types of values, rights and responsibilities they entail and enshrine within their philosophy or outlook on what it means to share personal health information. Through this discussion we address issues of the design and the development process of personal health data and patient-oriented infrastructures, as well as new forms of technologically-mediated empowerment. For the last 40 years or so the is/ought gap, the fact/value distinction and the naturalistic fallacy have figured prominently in ethical debates. This longevity, however, has had an adverse side effect. So familiar have they become that they—and their respective rationales—have tended to become blurred. It is the purpose of this paper to explain why they should be kept distinct.

Van Inwagen proposes that besides simples only living organisms exist as composite objects. This paper suggests expanding van Inwagen’s ontology by also accepting composite objects in the case that physical bonding occurs (plus some extra conditions). Such objects are not living organ-isms but rather physical bodies. They include (approximately) the complete realm of inanimate ordinary objects, like rocks and tables, as well as inanimate scientific objects, like atoms and mol-ecules, the latter filling the ontological gap between simples and organisms in (...) van Inwagen’s origi-nal picture. We thus propose a compositional pluralism claiming that composition arises if and on-ly if bonding or life occurs. (shrink)

The first ever global overview of philosophy: how it developed around the world and impacted the cultures in which it flourished.

2007 will be remembered as the year in which the Tour de France died. Race leader and likely eventual winner, Michael Rasmussen, was eliminated near the end on an allegation of doping. Since the 1960s, the idealistic drug crusaders have been on a mission to reverse the course of history, and eliminate drugs from the sport. But this “zero tolerance” strategy to drugs has failed, as 2007's Tour spectacularly showed. Only around 10–15% of professional athletes are drug tested. Currently, it (...) is illegal to use erythropoietin (EPO) or blood doping to move your haematocrit from 48 to 49% even though some people will have a normal level of 49%. A regulated permissive policy would paradoxically reduce risk to athletes. The present system creates an environment of risk to the athlete. A rational policy on doping would allow safe performance‐enhancing interventions which are consistent with the spirit of a particular sport. (shrink)

Julian Wolfreys starts with loss. All memory is the memory of loss... All that we are, all we experience, all we remember, all that we forget but which leaves nevertheless a trace on us, in us, a trace that countersigns and writes us as who we are (in effect the constellated matrix of Being's becoming): this is a process of loss. This just is loss. Loss is who we are. Loss is authentically the necessary and inescapable inessential essence of (...) Being. Loss names the ghosts, the revenants of Being, Being's others. Neither there nor not there, loss persists as the always already becoming of the thinking of Being. There is more than one loss. There is no one loss. Loss never arrives for a first time. All loss is the return of what is lost to Being's being in the world. From that starting point, the author explores the nature of being and dwelling... of memory and the nature of the traces of the past... of apparition and appearance and perception... of touch and being touched... of the material and the (a)material. In a book that draws in multiple threads from 19th- and 20th-century European literature, he references extensively Heidegger, Derrida, Lacan, Cixous, Celan, Husserl, Woolf, Joyce, Hegel, Badiou, Rilke, Merleau-Ponty, Winterson, Stockhausen and True Detective in an impressive and eclectic tour of the being-becoming-loss.". Mental explanations of behaviour are physical explanations of a special kind. Mental events are physical events. Mental explanations of physical behaviour are not mysterious, they designate events with physical causal powers. Mentalistic terms differ from physicalistic ones in the way they specify events: the former cite extrinsic properties, the latter intrinsic properties. The nature of explanation in general is discussed, and a naturalistic view of intentionality is proposed. The author shows why epistemological considerations rule out the elimination of "mentalistic talk" (...) from explanations of behaviour. (shrink)

The psychedelic psilocybin has shown promise both as treatment for psychiatric conditions and as a means of improving well-being in healthy individuals. In some jurisdictions (e.g., Oregon, USA), psilocybin use for both purposes is or will soon be allowed and yet, public attitudes toward this shift are understudied. We asked a nationally representative sample of 795 US Americans to evaluate the moral status of psilocybin use in an appropriately licensed setting for either treatment of a psychiatric condition or well-being enhancement. (...) Showing strong bipartisan support, participants rated the individual’s decision as morally positive in both contexts. These results can inform effective policy-making decisions around supervised psilocybin use, given robust public attitudes as elicited in the context of an innovative regulatory model. El prejuicio más aciago de la filosofía es que su historia jalona rivalidades sangrientas, conflictos insuperables, superaciones radicales, reinicios absolutos, fines y clausuras. Se trata de una concepción pobre y desangelada de esta pasión que impulsa mi viaje por la tierra. El paisaje de lo trascendental se anima cuando se lo concibe como el trabajo conjunto de una saga de artistas embriagados por el pensamiento. Esto no quiere decir que se trate de una suave danza de almas bellas; por el (...) contrario, esa misma embriaguez lleva a enfrentamientos salvajes: hay interpretaciones en las que se nos va la vida, hay conceptos cuya importancia nos desvela, hay posturas que nos parecen escandalosas. Sin embargo, también cuando la danza se hace tan turbulenta que se parece más bien a una brutal pelea de box, lo que importa es esa violencia que fuerza a pensar, y no quién tiene razón. Discutimos porque pensamos juntos, nos respetamos cuando nos criticamos de forma salvaje. Así se construye el pensamiento común: en la tensión y no en la calma, en la pasión de la embriaguez que alterna afinidades radicales y diferencias que parecen irreconciliables.Este libro se propone sostener tal visión de la filosofía a través de un experimento crucial: mostrar que entrelazando a Hegel y a Deleuze podemos construir una potente ontología práctica, que tome la multiplicidad como prius, para dar cuenta del mundo y de la experiencia, donde se conjugan movimiento y devenir con identidades y persistencias. The idea that humans are by nature social and political animals can be traced back to Aristotle. More recently, it has also generated great interest and controversy in related disciplines such as anthropology, biology, psychology, neuroscience and even economics. What is it about humans that enabled them to construct a social reality of unrivalled complexity? Is there something distinctive about the human mind that explains how social lives are organised around conventions, norms, and institutions? Joint attention is recognised by many philosophers and psychologists as a fundamental cornerstone of our engagement with one another and the world around us. The most familiar paradigm of joint attention is joint perceptual—specifically visual—attention to an object in the present environment. However, some recent discussions have focused on a potentially different form of joint attention: namely, ‘joint reminiscing’ conversations in which two or more people discuss something in the past which they both remember. These exchanges are in some ways (...) comparable to joint perceptual attention to something present, and have been characterised by some as a form of joint attention to the past. In this paper, I will assess the prospects for characterising joint reminiscing as a genuine form of joint attention to the past, as understood on the model of joint perceptual attention to something present. My conclusions will be tentative, and my primary aim will be to explore how different commitments regarding the nature of both joint attention and episodic memory give rise to different possibilities for characterising joint reminiscing as a distinctive form of collective engagement with the past. I will suggest that joint reminiscing is unlike ordinary joint attention at least insofar as joint reminiscing trades on the participants’ mutual recognition of one another as having been present at an earlier experience. This is connected with joint reminiscing’s social function, and its role in facilitating the special kind of relationship conveyed by the idea of knowing a person. (shrink)

This paper describes Wittgenstein's pre-theoretical transcendentalist conception of ethics and the challenge it presents for the kind of global cosmopolitan perspective required of any multinational social responsibility strategy. It is argued that this challenge can be overcome through establishing a sense of solidarity with all stakeholders via a corporate social compact rooted in what Wittgenstein refers to as spontaneous agreement and sympathy. Contemporary examples of successful strategies are provided.

There are 4 main arguments for euthanasia: (1) arguments appealing to consistency (e.g., from passive to active euthanasia); (2) the argument from respect for autonomy; (3) appeals to justice; and (4) the argument from interests (mercy or relief of suffering). I will argue that only the last is directly relevant to active euthanasia as a medical intervention, though arguments together from autonomy and justice can in practice (through the backdoor) provide a ground for voluntary active medical euthanasia (AME).
