This chapter discusses three different ways of talking about mood enhancement. First, if we do want to enhance, what is good enhancement? Second, if one wants to enhance, what is the usefulness of enhancement? Third, if we want to enhance, what might be the beneficial (or harmful) effects? To illustrate the conceptual analysis in this chapter, two classes of drugs to enhance mood are used. First is the class of selective serotonin reuptake inhibitors (SSRIs) and the other class is of (...) beta blocking agents, which are claimed to be good as “memory‐smoothing” drugs. Three different ways of using the terms “good” or “bad” are shown to be in play in mood enhancement: instrumental goodness and badness, utalitarian goodness and badness, and benefactorial goodness and badness. Mood‐improving and memory‐smoothing drugs may serve different purposes, which are linked to the general purpose of improving the mood or smoothing memories. (shrink)

In reference to the different approaches in philosophy(of medicine) of the nature of (medical) technology,this article introduces the topic of this specialissue of Theoretical Medicine and Bioethics, that is,the way the different forms of medical technologyfunction in everyday medical practice. The authorselaborate on the active role technology plays inshaping our views on disease, illness, and the body,whence in shaping our world.

It is important and urgent to question therelationship between evidence-based medicineand power shifts in health care systems.Although definitions of EBM are phrased as ascientific approach to medicine, EBM is anormative concept: it aims to improve medicineand health care. Both proponents and opponentsuse a normative concept. More particularly,they provide particular views on positions,responsibilities, possibilities, norms andrelationships between professionals, patientgroups, governments and other parties in healthcare and society. From this perspective, wewant to analyse the role of EBM in modernwestern societies. By using (...) citizenshiptheory, we will argue that the role of EBM isnot fixed but depends on the relation betweenstate and society. We will first analyse thefundamental change in western societies duringthe past decades, from modern to post-modernsocieties. Then, we will elaborate a fourfoldmodel of possible relationships between stateand society, and discuss the issue of how EBM mayfit in, by giving some examples of the practiceof EBM in different European countries. On thisbasis, we conclude to consider EBM as a publicforum where proponents and opponents of EBMdiscuss diverse and possibly conflicting waysof changing medicine, health care, and healthpolicy. This requires the incorporation of theperspective of citizens and their socialnetworks, professionals with practical andtacit knowledge, and diverse public views onwhat is regarded as `a good life'. Inasmuch asEBM is expected to be practically relevant, itought to be tied to rather than separated fromthe normative world of emancipated patients anddiverse health care practices. Proponents andopponents of EBM should be prepared to defendthe normative claims and power effects that areinherently tied to any presentation ofevidence. (shrink)

The rise of genetic techniques presents a great promise as well as some difficult dilemma's about how genetics will affect the way we will be able to live our lives. For this reason, in many countries, public debates are organized to reflect upon the development of predictive medicine. In this essay we focus on economist A. Hirschman's work on “exit, voice and loyalty” to analyse and enrich these public debates. We first introduce Hirschman's triad of concepts and focus on the (...) concept of “voice,” which refers to an institution's ability to allow clients to give feedback about products or services, and its ability to listen to the feedback given. We argue that voice is particularly important for the health care system in which predictive medicine is developing. Voice is crucial because how predictive medicine will become institutionalised is now in the process of becoming determined. However, in public debates about predictive medicine, voice tends to be reduced to providing people with the option of making a choice whether to use genetic techniques or not. We argue that this reduction of voice to choice is not very informative about predictive medicine and suggest an amendment of Hirschman's concept of voice, which we call “hesitant voice.” Hesitant voice attempts to be informative about the uncertainty people experience in addressing predictive medicine and topicalises the gradual, the embodied, the tentative character of voice in developing situations like that of predictive medicine. Design research programs attempt to bring together the properties of available materials and the demands derived from intended applications. The logic of problem states and state transitions in such programs, including assessment criteria and heuristic principles, is described in settheoretic terms, starting with a naive model comprising an intended profile and the operational profile of a prototype. In a first concretization the useful distinction between structural and functional properties is built into the model. In two further concretizations the inclusion of (...) potential applications is motivated and described for the case of drug research as well as the inclusion of potential realizations for the case of complex products. Next, another line of concretization of the naive model, the incorporation of potentially relevant properties, is sketched. Then the partial analogy between product- and truth-approximation is indicated. We conclude with some remarks about the usefulness of our models for products reaching the market in comparison to the the so-called social construction of technology approach. (shrink)

Since the introduction of Prozac (fluoxetine), a number of so‐called selective serotonin reuptake inhibitors (SSRIs) have been developed and introduced. These mood enhancers are being presently prescribed for people whose problems are not recognized mental illnesses. It is probable that in the near future the combination of data from advanced biochips and brain imaging will accelerate the development of neurotechnology. So‐called neuroceuticals, used for therapy and enhancement, and to improve different aspects of mental health, will be efficient neuromodulators. The scientific, (...) ethical, and social issues raised by mood enhancement and alteration of personal resilience require further exploration. The chapter talks about the notion of personal autonomy, cosmetic psychopharmacology, power for autonomous, and moral accountability in this context. It suggests that empirical research should also cover psychological and sociological research into perceptions and experiences of individuals who have used these drugs. (shrink)

Der Jenenser Philosoph Heinrich Köhler versucht in seinen Exercitationes Juris Naturalis, eiusque cumprimis cogentis, methodo systematica propositi eine rationalistische Begründung des Naturrechts auf der Basis der Metaphysik von Gottfried Wilhelm Leibniz. Die Rekonstruktion dieser metaphysischen Begründung, die mit dem Aufweiß der Erkennbarkeit des obersten Prinzips des Naturrechts rein aus der Vernunft zusammenfällt, ist Gegenstand der vorliegenden Studie. Ausgehend von der Identifikation jenes Erkenntnisgrundes mit der Natur des Menschen zeigt sich vermittels einer Analyse der von Köhler in Anschlag gebrachten Methode, (...) daß diese Begründung unter Ausschluß bloßer empirischer Erkenntnis auf einen metaphysisch fundierten teleologischen Begriff der menschlichen Natur führt. Der verpflichtende Charakter des Naturrechtsprinzips erwächst demnach daraus, daß seine Achtung dem Menschen eine artgemäße Existenz aller erst ermöglicht. Vor diesem Hintergrund erweist sich auch die Schwäche einer solchen Theorie bei der Beurteilung einzelner Handlungen als moralisch, auf die Alexander Gottlieb Baumgarten in seinem Ius Naturae indirekt und kritisch aufmerksam macht. In his Exercitationes Juris Naturalis, eiusque cumprimis cogentis, methodo systematica propositi , the Jena philosopher Heinrich Köhler attempts to provide a rational foundation for natural law based on Gottfried Wilhelm Leibniz's metaphysics. This paper examines a reconstruction of this metaphysical foundation, which coincides with demonstrating that pure reason can recognize the supreme principle of natural law. Assuming that this recognition can be identified with human nature, an analysis of Köhler's methodology shows that if mere empirical recognition is excluded his foundation leads to a metaphysically based teleological concept of human nature. The principle of natural law imposes obligations because only through respecting it can a human being live in a manner adequate for his species. Against this background, the weakness of this type of theory for determining whether an act is moral becomes apparent, which Alexander Gottlieb Baumgarten indirectly and critically notes in his Ius Naturae. The lives of non-human animals, their ways of being and seeing, their experiences and knowledge, and their relationships with each other, continue to be ignored, discounted, written over and destroyed by anthropocentric practices and endeavours. Within the vestiges of colonialism, this silence and occlusion co-opts and consumes animals, physically and culturally, into the servitude of human interests, and selective narratives of history and progress. Decolonising Animals brings together critical interrogations, case studies and creative explorations that identify and examine how non-human (...) animals are affected by and respond to colonial structures and processes. Included in this collection are the perspectives of Indigenous and non-Indigenous scholars, artists and activists and the ways in which they have questioned colonial ways of knowing, engaging with and representing animals. Poètes, comme Maurice Roche pour la France et Rein Bloem pour les Pyas-Bas. Psychanalyste: Anton Mooij. Sociologues: le néerlandais Pieter Nijhoff et le français Jean Duvignaud. Historiens: Robert Muchembled. Professeurs de (...) littérature française (Roger Kempf) et de linguistique (Teun van Dijk).Cette diversité dans la formation, cette convergence des points de vue, voilà peut-être ce qui a permis de cerner le difficile concept d'enfermement. S'agit-il bien d'ailleurs d'un concept? N'est-ce pas là un mythe à la mode? Toutes les civilisations, toutes les sociétés définissent et suscitent, chaque fois d'une manière différente et pour elles-même, une certaine expérience de l'enfermememnt. Pour la mort ou la sexualité sans doute, mais aussi pour l'art et le savoir: les idéologies ou les doctrines ne sont-elles pas aussi des formes de l'enfermement? Die Möglichkeit, Walter Benjamins Allegorie-Begriff in akademischen Untersuchungen mit der Prosa Jean Pauls in Verbindung zu bringen, wurde von Benjamin noch selbst abgewogen: in der Rezension einer frühen Abhandlung zu diesem Thema, die er für zu kurz gegriffen befand. Ein solches Vorhaben, das beste Chancen böte, dürfe sich nämlich nicht auf literaturwissenschaftliche und geistesgeschichtliche Perspektiven beschränken. Notwendig sei vielmehr, auch die Dimension der Alltagskultur einzubeziehen und Jean Pauls Hinabgreifen in Tiefen des Volkstums und der Tradition zu berücksichtigen. Diesem Hinweis Benjamins (...) folgt die vorliegende Untersuchung. Indem sie sich auf den Bereich der materiellen Kultur konzentriert, legt sie eine Geschichte der Theorie der Dingwelt offen. Jean Pauls ästhetische Überlegungen zur projektiven Belehnung der Dingwelt mit seelischen Regungen wurden von Aby Warburg aufgegriffen und für seine kulturwissenschaftliche Methode fruchtbar gemacht. Dabei erschliesst er unter anderem einen Traditionsstrang des Denkens von materieller Kultur im ästhetischen und kultur anthropologischen Kontext, der geprägt ist von aus der Antike herrührenden abergläubischen Vorstellungen über die Einflüsse der Planeten auf die menschliche Geistesverfassung wie etwa die Saturnfürchtigkeit. Although community is a core sociological concept, its meaning is often left vague. In this article it is pointed out that it is a social form that has deep connections with human social nature. Human social life and human social history can be seen as unflagging struggles between two contradictory behavioral modes: reciprocity and status competition. Relative to hunter-gatherer societies, present society is a social environment that strongly seduces to engage in status competition. But at the same time evidence increases (...) that communal living is strongly associated with well being and health. A large part of human behavior and of societal processes are individual and collective expressions of on the one hand succumbing to the seductions of status competition and one the other hand attempts to build and maintain community. In this article some contemporary examples of community maintaining, enrichment and building are discussed. The article concludes with a specification of structural conditions for community living and a short overview of ways in which the Internet affects these conditions. (shrink)

Humanitarian aid’s psycho-therapeutic turn in the 1990s was mirrored by the increasing emotionalization and subjectivation of fund-raising campaigns. In order to grasp the depth of this interconnectedness, this article argues that in both cases what we see is the post-Fordist production paradigm at work; namely, as Hardt and Negri put it, the direct production of subjectivity and social relations. To explore this, the therapeutic and mental health approach in humanitarian aid is juxtaposed with the more general phenomenon of psychologization. This (...) allows us to see that the psychologized production of subjectivity has a problematic waste-product as it reduces the human to Homo sacer, to use Giorgi Agamben’s term. Drawing out a double matrix of a de-psychologizing psychologization connected to a politicizing de-politicization, it will further become possible to understand psycho-therapeutic humanitarianism as a case of how, in these times of globalization, psychology, subjectivity and money are all interrelated. Wittgenstein sieht Grammatik als gleichermaßen mit Willkürlichem und mit Nicht-Willkürlichem verwandt an, wobei der Willkür durch die menschliche Natur und soziale Praktiken Grenzen gesetzt sind. Dieses Buch untersucht genau diese Grenzen mit den Mitteln und Ergebnissen der neuesten linguistischen und kognitionswissenschaftlichen Forschung näher, um die zunächst recht spekulativ anmutenden Argumente Wittgensteins für die (...) It is a commonplace that Frege thought ordinary language to be seriously defective. Yet his remarks about ordinary language are not always unflattering. Comparing the relation between his formal language and ordinary language to the relation between the microscope and the eye, Frege remarked: ‘[the eye], because of the range of its applicability and because of the ease with which it can adapt itself to the most varied circumstances, has a great superiority over the microscope’. The point, of course, is (...) that, for Frege, the deficiencies of ordinary language arise in connection with the scientific endeavour: ordinary language is not an acceptable medium in which to pursue truth. As he goes on to observe: ‘… viewed as an optical instrument [the eye] reveals many imperfections … as soon as scientific purposes place strong requirements upon sharpness of resolution, the eye proves to be inadequate. Next SectionEvidence based medicine is rightly at the core of current medicine. If patients and society put trust in medical professional competency, and on the basis of that competency delegate all kinds of responsibilities to the medical profession, medical professionals had better make sure their competency is state of the art medical science. What goes for the ethics of clinical trials goes for the ethics of medicine as a whole: anything that is scientifically doubtful is, other things being equal, ethically (...) unacceptable. This particularly applies to so called orphaned fields of medicine, those areas where medical research is weak and diverse, where financial incentives are lacking, and where the evidence regarding the aetiology and treatment of disease is much less clear than in laboratory and hospital based medicine. Examples of such orphaned fields are physiotherapy, psychotherapy, medical psychology, and occupational health, which investigate complex syndromes such as RSI, whiplash, chronic low back pain, and chronic fatigue syndrome. It appears that the primary ethical problem in this context is the lack of attention to the orphaned fields. Although we agree that this issue deserves more attention as a matter of potential injustice, we want to argue that, in order to do justice to the interplay of heterogeneous factors that is so typical of the orphaned fields, other ethical models than justice are required. We propose the coordination model as a window through which to view the important ethical issues which relate to the communication and interaction of scientists, health care workers, and patients. Lying is an important moral phenomenon that most people are affected by on a daily basis—be it in personal relationships, in political debates, or in the form of fake news. Nevertheless, surprisingly little is known about what actually constitutes a lie. According to the traditional definition of lying, a person lies if they explicitly express something they believe to be false. Consequently, it is often assumed that people cannot lie by more indirectly communicating believed‐false claims, for instance by merely conversationally (...) implicating them. In this paper, we subject this claim to an empirical test. In a preregistered study of 300 participants, we investigate how people judge cases of implicit deceptions that would usually be excluded by the traditional definition of lying (i.e., conversational implicatures, presuppositions, and nonverbal actions). Our results show that people do in fact consider it possible to lie by indirect means, suggesting that people have a broader concept of lying than is usually assumed. Moreover, our findings indicate that lie judgments are closely tied to the extent to which agents are perceived as having committed themselves to the believed‐false claims they have communicated. We discuss the implications of our results for the traditional definition of lying and propose a new commitment‐based definition of lying that can account for the findings of our experiment. (shrink)
