John Rawls’s distinction between a comprehensive liberalism and his political version remains unclear to even his sympathetic critics. They stress his over-reliance on intuitive ideas of a liberal political culture in formulating the original position and its principles of justice. In this article, I argue that Rawls defends his liberal intuitions in a way philosophers might least expect. He conveys the sense of justice that motivates political liberalism through his metaphors. Rawls draws his concept of a well-ordered society – a (...) social union of social unions – from Wilhelm von Humboldt, a seldom-noticed source. Paralleling von Humboldt’s use of musical metaphors, Rawls characterizes liberal democracy as a symphony orchestra. Analyzing this metaphor, I argue, reveals the cultural limitations of Rawls’s overlapping consensus and the political project which undergirds his theory of justice. (shrink)

This article complicates the idea that lesbian and gay kinship is based primarily on friendship, voluntarism and being free from duty and obligation. It also offers a more nuanced understanding of wills as a rich source of evidence for making claims about kinship, family and relationships. It analyses conversations about will-writing with fifteen older lesbians and gay men, taken from interviews which formed part of a wider socio-legal study on the intersection of ageing, gender and sexuality. The analysis identifies a (...) wide range of kinship formations and composition going beyond “family of choice” narratives, and also both connections and disconnections between ties of love and affection and disposal of assets in wills. Participants’ will-writing reflected four types of prioritisation: prioritising children; prioritising friends; prioritising siblings; mixed priorities. In contrast with accounts of “families of choice” as being duty-free, a sense of duty, especially towards biological family members, was evident in a number of interviews. I suggest that wills can sometimes be a rich source of evidence about kinship, but only when analysis takes into account the complexities and contingencies which can be involved. (shrink)

One of the first priority questions of the day concerns their meals. The resident selects the lunch and dinner choice. If a resident is not sure what they would like to choose for their meals, I help them choose from what is available to them. I write their selection down for the dietary department and I always thank the resident and smile as I leave the area. Now that they know what their choices are for the day, they have something to look forward to. [End Page 139]Another decision a resident has for the day is their choice of what they would like to wear for the day. He or she may have a favorite article of clothing they like to wear. Given the coterie of philosophers focused on everyday aesthetics, it's fascinating that gift reception has heretofore managed to escape their scrutiny. To enact a gift, recipients begin by imagining its use. On this level, gifts serve as a litmus test. In luring us, we're taken out of our normal ways of being to experience a different side of ourselves. Enacting a gift is thus a kind of performance, whose value depends on the donee’s interpretation, just as exhibitions, concerts, staged plays (...) or books are performances of visual art, scores, scripts or texts, whose interpretations demonstrate their aesthetic value. To develop the relationship between enacting gifts and performing artworks, I begin by surveying junctures along the gift-event’s arc: reply, imagination, trust, recognition, transformation and memory. Transformations arising from agonistic gifts strike me as significant because they characterise the way gifts challenge our beliefs, eventually altering our values. That we grow to love gifts, which we originally rejected out of hand, casts doubt on self-knowledge. Enacted gifts handily challenge self-knowledge’s twin features: authority and transparency. As this paper indicates, gift reception helps both to understand ourselves better and to remove the obstacles to what Quassim Cassim calls Substantive Self-Knowledge. (shrink)

Hume claims that moral assessments refer to character; it is character of which we morally approve and disapprove. This essay explores what Hume means by “character.” Is it true that moral assessments refer to character, and should Hume think this given his other commitments in moral philosophy and moral psychology? I discuss two prominent themes—namely, Hume’s views on moral responsibility; and Hume’s comparison of moral feelings with feelings of love—to see what light these themes can shed on Hume’s broader (...) views about moral assessment. I argue that at least according to a traditional understanding of the term, character could not plausibly have a role to play in Hume’s account of moral assessment, but that Hume’s moral theory could require a conception of character different from this traditional one: a conception according to which character need not be the standard one that holds character to be consistent, stable, and well-integrated. In morally assessing others, we do not do so on the basis of their characters , but on the basis of their motivational states. My account of Hume’s theory of the responsibility, passions and the moral sentiments leaves intact the central Humean insights about the conditions for action and the arousal of the moral sentiment, suggesting what Hume could have said, both more plausibly and without undermining the key features of his moral psychology. And it also shows that Hume’s moral theory has no need for a robust conception of character. (shrink)

This chapter sets out several views of empathy that draw not only on psychology's literature but on philosophical and psychiatric writings. Empathy is a set of complex concepts involving perception, emotion, attitudinal orientation, and other cognitive processes as well as an activity that expresses character traits and, hence, one of the virtues. In other words, an examination of the philosophical and clinical literature reveals empathy to be not one unified concept but instead a set of related characteristics and qualities needed (...) to be an ethical and therapeutically effective clinician. To this end, the chapter offers reasons as to why empathy is important to clinical work: empathy is both epistemically and ethically necessary to good social relations and, in particular, clinical relations. It then distinguishes empathy from a related concept called "world"-traveling and situates its relevance to therapeutic relations. The moral principles prescribed for friendship, civil society, and democratic public life apply imperfectly to life around home, where we interact day to day without the formal institutions, (...) rules of conduct, and means of enforcement that guide us in other settings. In Good Neighbors, Nancy Rosenblum explores how encounters among neighbors create a democracy of everyday life, which has been with us since the beginning of American history and is expressed in settler, immigrant, and suburban narratives and in novels, poetry, and popular culture. During disasters, like Hurricane Katrina, the democracy of everyday life is a resource for neighbors who improvise rescue and care. Degraded, this framework can give way to betrayal by neighbors, as faced by the Japanese Americans interned during World War II, or to terrible violence such as the lynching of African Americans. Under extreme conditions the barest act of neighborliness is a bulwark against total ethical breakdown. The elements of the democracy of everyday life—reciprocity, speaking out, and "live and let live"—comprise a democratic ideal not reducible to public principles of justice or civic virtue, but it is no less important. In 1815, two benevolent organizations commenced operation in Antigua, the Female Refuge Society based in English Harbour and the Distressed Females’ Friend Society based in St John's. The driving force behind the establishment of the Female Refuge Society, on which the Distressed Females’ Friend Society was modelled, was Anne Hart Gilbert (1768–1834), the earliest known published African-Caribbean woman writer, the agent of the Female Refuge Society. The organizations were run on principle by women and the executive committees were multi-racial. They (...) accepted female subscribers only, but donations from women and men. For Gilbert, an affective poetics of life story and writing is crucial to the formation of an ethical community that she situates as an emerging and modernizing counter-culture to plantation slavery. Her civic ethic of caring centres on development and engagement of the ‘finer sensibilities’ in creating ‘bands of amity and love that are the ornament and glory of our nature’ (Female Refuge Society, 1822: 12). The annual reports of the Female Refuge Society had a profound impact on the direction of female anti-slavery activism in Britain. In this essay, I analyse the inscription of affect in extant letters, annual reports and published material about the work of the Female Refuge Society and Distressed Females’ Friend Society. I am interested in how the women in the Creole organizations and their male supporters represent their affective relations to the objects of their benevolence and appeals for funding, and how these relations are racialized, gendered and classed in the grounding of activism. I draw out the local and British affective reception of these relations. In the field of affect studies, the essay might be compared with projects that address ‘the cultural and historical contingency of emotions, and … emotions and emotion cultures as contingent technologies of subjects’ (Koivunen, 2010: 19). Wrongful life is an action brought by a defective child who sues to recover for pecuniary or emotional damages suffered as a result of being conceived or born with deformities. In such cases, plaintiff alleges that the negligence of a responsible third party,1 such as physician, hospital, or medical laboratory, is the proximate cause of plaintiff's being born or conceived and thus being compelled to suffer the debilitating effects of a deformity. The child does not sue to recover for the (...) deformity, but rather it is claimed in such cases that the child's life is itself a wrong to the child; hence, the name wrongful life.The present essay explores how the language of rights enters into wrongful life suits and critically evaluates rights appeals in these cases. In “Avoiding a ‘Death Panel Redux,” Nicole M. Piemonte describes how she tried to fire palliative care after first refusing to let it—and any mention of death, from any source—into her dying mother's room. One way to read this is as a familiar human story about the profound difficulty of facing death, a story that, too often, is reduced to the word “denial.” But Piemonte and Hermer suggest that there is another way to read this story, in terms of the (...) structure that was absent from the earliest conversations and relationship‐building among this patient, her daughter, and the doctors. If advance care planning had been part of the structure all along, if everyone—oncologists, patients, loved ones—talked about prognosis, preferences, benefits, burdens, and goals from the time a life‐threatening disease was diagnosed, as a normal part of good care, would Piemonte have understood her own role as caregiver and advocate differently? If, early on, her fifty‐year‐old mother had been asked, “what do you want to do with the rest of your life?” and had been assured that this question mattered and encouraged to talk about her hopes (such as attending her daughter's wedding), might her treatment and care have been organized in a different way? It is also a setting for the stories of patients whom Nuila encounters as a hospitalist at Ben Taub, a safety‐net hospital (in the shadow of the medical metropolis of Houston) that cares for all who arrive at its doors. Thus, instead of Polanyi’s double movement, she speaks of a «triple movement». This threefold movement forms the core of her theoretical reflections which cast the current crisis of capitalist societies in a new light. Every year, people make decisions based on trust in the certainty of diagnoses of brain death. These decisions range from signing an organ donation card to withdrawing life support from a loved one. Two recent developments have revived concerns about medical standards for determining brain death. One is a recent study on variability in brain death policies in the United States; the other is the filing of a federal lawsuit to rescind the death certificate of Jahi McMath, a teenager who (...) appears to have survived a 2013 declaration of brain death. The four talks collected here transcribe lectures delivered to an audience of children between the ages of ten and fourteen, under the auspices of the little dialogues series at the Montreuil's center for the dramatic arts. Modeled on Walter Benjamin's Aufklrung for Kinderradio talks, this series aims to awaken its young audience to pressing philosophical concerns. Each talk in God, Justice, Love, Beauty explores what is at stake in these topics as essential moments in human experience. (Indeed, the book (...) argues that they are constitutive of human experience.) Following each, Nancy's audience is given a chance to engage with him in a process of philosophical questioning; the texts of these touching and probing exchanges are included in the volume. Despite the fact that these lectures were delivered to an audience of children, the intellectual level they achieve-while remaining easily comprehensible-is astounding. No attempt is made to simplify Nancy's positions or to resolve the complexities that arise in the course of the talks or the question periods that follow. The work of opening performed here is fully in keeping with the strategy of Nancy's philosophy as a whole. Thus, for readers unfamiliar with his work, God, Justice, Love, Beauty will function as an excellent introduction to Nancy's larger corpus. As varied as the individual talks are, they share the motif of incalculability or the immeasurable. Broadly speaking, one could say that the various ways in which Nancy approaches this motif exemplify his deconstructive approach to think of human existence. As well, those treatments exemplify his conviction that the task of thinking is to develop original ways of communicating the incalculable.God, Justice, Love, Beauty is thus a skillful reminder that philosophy is important to all of us. The book is also a model of intellectual generosity and openness. Seamlessly moving from Schwarzenegger to Plato, from Kant, Roland Barthes, and Caravaggio to Caillou, Harry Potter, and the pages of Gala magazine, Nancy's wide-ranging references bear witness to his commitment to think of culturein its broadest sense.
