In this Article we propose an analytical framework for allocating responsibility for the protection of worker’s rights in the global labor market. Since production and services have expanded globally, and the state’s ability to protect worker’s rights on the national level has been undermined, the main challenge today is to find the appropriate institutional arrangements that allocate responsibility in a manner that realizes basic labor standards. The Article argues that in the context of a global labor market, responsibility should be (...) perceived in terms of "shared responsibility," whereby responsibility is shared by a complex network of agents and institutions that take part in global production and services. Within these global social networks and connections, labor relations generate a unique type of social connection which implies a special type of commitment and obligation towards workers. We propose four principles to guide the allocation of responsibility for remedying the unjust conditions of workers in the world, based on measures of connectedness, capacity, benefit, and contribution. Freedom of association operates as an organizational "meta-norm," appreciated both as an independent value and as a touchstone for the institutional design of the International Labour Organization . Despite the renewed interest of the ILO in various aspects of the norm, its understanding of freedom of association lacks a comprehensive normative framework. This article presents such a conceptual framework and a critical in-depth analysis of current ILO freedom of association jurisprudence. Freedom of association should be understood in terms of equitable (...) dialogue , a term offered and developed herein, as an understanding that is already partly embedded in ILO jurisprudence. Despite the growing global consensus regarding the need to ensure minimal labour standards such as adequate safety and health conditions, freedom of association, and the prohibition of child labour, millions of workers across the world continue to work in horrific conditions. Who should be held responsible, both morally and legally, for protecting workers' rights? What moral and legal obligations should individuals and institutions bear toward foreign workers in their countries? Is there any democratic way to generate, regulate, and enforce labour (...) standards in a global labour market? This book address these questions by taking a fresh look at the normative assumptions underlying existing and proposed international labour regulations. By focusing on international labour as a particular sphere of justice, it seeks to advance both the contemporary philosophical debate on global justice and the legal scholarship on international labour. We argue that a comprehensive theory of reciprocals must rely on a general taxonomy of restrictions on the interpretation of relational expressions. Developing such a taxonomy, we propose a new principle for interpreting reciprocals that relies on the interpretation of the relation in their scope. This principle, the Maximal Interpretation Hypothesis (MIH), analyzes reciprocals as partial polyadic quantifiers. According to the MIH, the partial quantifier denoted by a reciprocal requires the relational expression REL in its scope to denote a maximal (...) relation in REL’s interpretation domain. In this way the MIH avoids a priori assumptions on the available readings of reciprocal expressions, which are necessary in previous accounts. Relying extensively on the work of Dalrymple et al. (Ling Philos 21:159–210, 1998), we show that the MIH also exhibits some observational improvements over Dalrymple et al.’s Strongest Meaning Hypothesis (SMH). In addition to deriving some attested reciprocal interpretations that are not expected by the SMH, the MIH offers a more restrictive account of the way context affects the interpretation of reciprocals through its influence on relational domains. Further, the MIH generates a reciprocal interpretation at the predicate level, which is argued to be advantageous to Dalrymple et al.’s propositional selection of reciprocal meanings. More generally, we argue that by focusing on restrictions on relational domains, the MIH opens the way for a more systematic study of the ways in which lexical meaning, world knowledge and contextual information interact with the interpretation of quantificational expressions. Are nonconscious processes sufficient to cause false memories of a nonstudied event? To investigate this issue, we controlled and measured conscious processing in the DRM task, in which studying associates causes false memories of nonstudied associates . During the study phase, subjects studied visually masked associates at extremely rapid rates, followed by immediate recall. After this initial phase, nonstudied test words were rapidly presented for perceptual identification, followed by recognition memory judgments. On the perceptual identification task, we found significant priming (...) of nonstudied associates, relative to control words. We also found significant false recognition of these nonstudied associates, even when subjects did not recall this word at study or identify it at test, indicating that nonconscious processes can cause false recognition. These recognition effects were found immediately after studying each list of associates, but not on a delayed test that occurred after the presentation of several intervening lists. Nonconscious processes are sufficient to cause this memory illusion on immediate tests, but may be insufficient for more vivid and lasting false memories. (shrink)

We describe a recent approach for distinguishing between stochastic and deterministic sources of variability, focusing on the mammalian cell cycle. Variability between cells is often attributed to stochastic noise, although it may be generated by deterministic components. Interestingly, lineage information can be used to distinguish between variability and determinism. Analysis of correlations within a lineage of the mammalian cell cycle duration revealed its deterministic nature. Here, we discuss the sources of such variability and the possibility that the underlying deterministic process (...) is due to the circadian clock. Finally, we discuss the “kicked cell cycle” model and its implication on the study of the cell cycle in healthy and cancerous tissues. (shrink)

Trobar la forma d’expressar quelcom per al qual no hi ha paraules fou un dels reptes que assumí Levi quan volgué explicar la cruel deshumanització que va sofrir com a presoner al Lager. Nogensmenys, hi va trobar la solució mitjançant el concepte d’animal. En aquest sentit, el seu testimoni és ple de metàfores faunístiques que representen el patiment de la seua reducció cap al fons i la crueltat de ser tractat com una bèstia a la qual podien assassinar i que (...) patia com un esclau castigat. Levi confirma amb les seues analogies que la deshumanització és una metamorfosi animal. Tanmateix, la tesi d’aquest assaig és que la deshumanització no és convertir-se en una bèstia, sinó transformar-se en allò que nosaltres hem fet dels animals. Una proposició que afirmem gràcies a l’etologia, que ens evidencia que el comportament real de les feres no equival a estar pres ni a ser humiliat. De fet, creiem que la raó principal per la qual Primo Levi pensava que la deshumanització era animalitzar-se sorgeix arran d’una ideologia antropocèntrica. (shrink)

O artigo defende a validade dos argumentos transcendentais. Hilary Putnam fez uso deste tipo de argumento para fixar uma condição metafísica para a semântica. Seu raciocínio segue o estilo de inferência desenvolvido por Kant, na refutação do ceticismo fenomenista e idealista. Segue-se da argumentação de Putnam a necessidade metafísica do princípio externalista em semântica. Com isso, desarmam-se as tentativas de fixar condicionamentos exclusivamente intersimbólicos para a constituição do significado.

A teoria cartesiana da verdade é essencialmenteepistemológica. Por essa razão, seuempreendimento racionalista é filosoficamente revolucionário.Neste trabalho procuro analisar algumasdas mais importantes características desteempreendimento. Proponho uma abordagem que,de certo modo, separa as questões epistêmicocognitivasdesta teoria, dos compromissos ontológicosa partir dos quais Descartes julgava imprescindíveldesenvolvê-la. Com Descartes, o problemada verdade aparece pela primeira vez comosendo um problema sobre as condições de obtençãode juízos indubitáveis acerca do que somos edo que são as coisas externas que podemos conhecer.

A ontologia de Heidegger se caracteriza não apenas pela inovação conceituai e pelas perspectivas metodológicas originais. Ele também recoloca o problema do fundamento, operando uma importante transformação no eixo da Metafisica. Desta transformação emerge a redefinição das possibilidades intrínsecas do ser heideggeriano, o Dasein existencial, além da inauguração de uma função regressiva e não dialética para o paradoxo filosófico.

A Teoria da Ação Comunicativa resulta de uma investigação acerca dos fundamentos da racionalidade prática, desenvolvida por Habermas nos últimos 30 anos. Neste artigo, serão analisados os aspectos básicos desta teoria, com ênfase nos pontos que a referenciam como modelo explanatório das nossas práticas comunicativas. Pretendo discutir prioritariamente a tese segundo a qual nossas condutas linguísticas são conduzidas por compromissos pragmático-universais. A aceitação desta tese depende da possibilidade de explicitação dos compromissos determinantes das ações comunicativas válidas. Com base neste exame, (...) vou propor a discussão de alguns pontos que me parecem mais frágeis na teoria de Habermas. Finalmente, pretendo contrastar este programa de reconstrução racional da comunicação com modelos teóricos pragmáticos não alinhados a priori com premissas racionalistas. Concluirei, a partir daí, que o argumento central de Habermas se fragiliza quando aplicado ás condições multilaterais e difusas nas quais os usos da linguagem efetivamente ocorrem. (shrink)

In the vast literature centering on the Itinerarium Egeriae there is a serious lacuna. No attempt has been made to analyse the circle of readers to whom this remarkable document was addressed and for whose sake Egeria recorded so faithfully every detail of her journey. Yet if a full understanding of the IE is to be achieved, some definition of the circle of Egeria and of its relations with the pilgrim is essential. In other words, who in the West at (...) that point in the late fourth century, would have been so interested in Holy Land pilgrimage as to read attentively such a personal account as the IE? The following is a tentative essay to gauge the concerns, expectations and cultural background of Egeria's immediate circle of readers through her own emphasis on various aspects of her pilgrimage. In addition, the investigation will try to assess the place of pilgrimage in the life of western communities and the value of communications between the pilgrim on the road and the society back at home. The patient was a prison inmate, who engaged in a hunger strike to protest imagined abuses by prison guards. The court, reconciling conflicting provisions of California law, upheld the appointment of a conservator to make treatment decisions because the patient could not participate in those decisions “by means of a rational (...) thought process.” However, in tying mental capacity to the plausibility of a protestor’s claims, the court risks placing political dissent at the mercy of judicial discretion. One of the core debates concerning equity in the response to the threat of anthropogenic climate change is how the responsibility to reduce greenhouse gas emissions should be allocated, or, correspondingly, how the right to emit greenhouse gases should be allocated. Two alternative approaches that have been widely promoted are, first, to assign obligations to the industrialized countries on the basis of both their ability to pay and their responsibility for the majority of prior emissions, or, second, to assign emissions (...) rights on a equal per capita basis. Both these proposals ignore intra-national distributional equity. Instead, we develop a policy framework we call 'Greenhouse Development Rights' which allocates obligations to pay for climate policies on the basis of an individually quantified metric of capacity and responsibility . Crucially, the GDRs framework looks at the distribution of income within countries and treats people of equal wealth similarly, whatever country they live in. Thus even poor countries have obligations proportional to the size and wealth of their middle and upper classes, defined relative to a 'development threshold'. While this method nominally identifies the 'right to development' as applying to people, not countries, as a proposal for a treaty among sovereign nations, there is no obvious way to give legal meaning to that right. In this paper, then, we raise some of the philosophical and political questions that arise in trying to quantify capacity and responsibility and to use the 'right to development' as a principle for allocating costs.*. This paper presents a procedure designed to aid physicians and patients in the process of making medical decisions, and illustrates its implementation to aid pregnant women, who decided to undergo prenatal diagnostic test choose a physician to administer it. The procedure is based on a medical decision-making model of Karni (J Risk Uncertain 39: 1–16, 2009). This model accommodates the possibility that the decision maker’s risk attitudes may vary with her state of health and incorporates other costs, such as pain (...) and inconvenience, associated with alternative treatments. The medical decision problem was chosen for its relative simplicity and the transparency it affords. (shrink)

In set theory without the Axiom of Choice, we consider Ingleton’s axiom which is the ultrametric counterpart of the Hahn–Banach axiom. We show that in ZFA, i.e., in the set theory without the Axiom of Choice weakened to allow “atoms,” Ingleton’s axiom does not imply the Axiom of Choice. We also prove that in ZFA, the “multiple choice” axiom implies the Krein–Milman axiom. We deduce that, in ZFA, the conjunction of the Hahn–Banach, Ingleton and Krein–Milman axioms does not (...) imply the Axiom of Choice. (shrink)
