We investigate how the just cause principle is applicable to contingency planning about armed interventions in civil wars that are somewhat likely to occur in the future. According to a 2005 peace agreement that formally ended a civil war between the Sudanese government in Khartoum and the Sudan People’s Liberation Army, a referendum on South Sudan independence is to be held no later than January 9, 2011. Close observers of Sudan warn that this promise of an independence referendum might not (...) be correctly fulfilled, and that a North-South civil war is somewhat likely to recur. Focusing on the case of Sudan, we discuss the following key question, from the temporal standpoint of August 2010, the month this paper was completed: How may the just cause principle be used prospectively to decide whether there would be a just cause for armed intervention in Sudan, if a renewed North-South civil war were to occur there during the years 2010–2014? To illuminate this question of application, we also discuss a question of theory. What is the just cause principle? A core thesis is that the deterrent threat of armed intervention is an essential tool for preventing such a civil war. By means of deterrent threats of limited forms of armed intervention—for instance, the deterrent threat of imposing no-fly zones—the balance of cost/benefit calculations by the Sudanese government about the prospect of civil war might be tipped in favor of acceptance of South Sudan independence. We recommend that responsible actors in the international community should plan contingently about such armed intervention in Sudan, with the goal of preventing a renewed North-South civil war there. Shanker & King argue for a shift in the focus of ape language research from an emphasis on information processing to a dynamic systems approach. We differ from these authors in our understanding of how this “new paradigm” emerged and in our perceptions of its limitations. We see information processing and dynamic systems as complementary approaches in the study of communication.

These depict all things in the environment as sharing a common ancestry, and as thereby required, ideally, to exhibit certain virtues of respect and responsibility for each other. These environmental virtues are expressed in terms of distinctively Maori concepts: respect for mauri and tapu, kaitiakitanga, whanaungatanga, manaakitanga, and environmental balance. I briefly explore these Maori environmental virtues, and draw from them some messages for the world at large.

This sequel to Exploring Maori Values develops the idea that humans can and need to become 'people of the land' in the Maori sense, developing a harmonious interdependence with the environment in which we live rather than continuing to dominate it. Although arising out of Maori concepts, this is a model for human life which is available to any culture.

We can gain standing or mana in the world through cooperation (yin mana) or through competition (yang mana). Drawing on both Maori and Daoist ideas, the way of yin mana is explored, whereby all parties can gain through new and meaningful participatory activities.

Formalised knowledge systems, including universities and research institutes, are important for contemporary societies. They are, however, also arguably failing humanity when their impact is measured against the level of progress being made in stimulating the societal changes needed to address challenges like climate change. In this research we used a novel futures-oriented and participatory approach that asked what future envisioned knowledge systems might need to look like and how we might get there. Findings suggest that envisioned future systems will need (...) to be much more collaborative, open, diverse, egalitarian, and able to work with values and systemic issues. They will also need to go beyond producing knowledge about our world to generating wisdom about how to act within it. To get to envisioned systems we will need to rapidly scale methodological innovations, connect innovators, and creatively accelerate learning about working with intractable challenges. We will also need to create new funding schemes, a global knowledge commons, and challenge deeply held assumptions. To genuinely be a creative force in supporting longevity of human and non-human life on our planet, the shift in knowledge systems will probably need to be at the scale of the enlightenment and speed of the scientific and technological revolution accompanying the second World War. This will require bold and strategic action from governments, scientists, civic society and sustained transformational intent. (shrink)

Empirical claims are factual claims validated by the methods of science. Conceptual claims involve matters of sense. Empirical inquiry that proceeds from conceptual confusion can never yield fruitful results (i.e., knowledge). John Mikhail's speculations about UMG are an example of conceptual confusions that lead not to knowledge but to claims and assertions that lack sense.

This celebratory Festschrift dedicated to Charles Kahn comprises some 23 articles by friends, former students and colleagues, many of whom first presented their papers at the international "Presocratics and Plato" Symposium in his honor. The conference was organized and sponsored by the HYELE Institute for Comparative Studies, Parmenides Publishing, and Starcom AG, with endorsements from the International Plato Society, and the Dean of the School of Arts and Sciences, University of Pennsylvania. John Hyman makes a good case for the proposition that duress defeases what would otherwise be a voluntary act. In this article, I consider Hyman's arguments in the context of economic duress and conclude that while Hyman makes an excellent case for the proposition that duress vitiates voluntariness, there may be cases where the law might not want to allow the defence of duress.

In this dissertation I argue that the concept of a moral right is best explicated by means of the concept of morally legitimate coercion. This thesis, which I call the enforceability thesis, says that to have a right is to have a claim such that one would be justified in pursuing a course of action up to and including harm should the claim be dissatisfied. I contend that this thesis, if it is true, explains much about our intuitions concerning moral (...) rights, accounts for the historical importance of rights-talk in the context of events such as revolutions and political reforms, and explains why rights are a necessary part of the moral vocabulary. If rights do not set out conditions under which coercion is morally appropriate, then they do nothing that other moral concepts could not do. ;Drawing on the work of H. L. A. Hart, John Rawls, and others, I argue that the philosophical strength and practical efficacy of rights on the enforceability thesis is best realized when rights are treated as action-guiding principles set within a framework of moral decision making under reflective equilibrium. Using the process of reflective equilibrium as a backdrop, I argue that rights can have sufficient normative force to play an important role in moral and political theory without being either impracticably stringent or subject to so many exceptions that they lose their efficacy. ;With this background in place I next set out and argue for a view of human rights which, because human rights turn out to be best understood as rights to primary goods, I call the theory of primary rights. The account I give of primary rights emphasizes their justificatory place in arguments for coercion, their importance to the moral integrity of the individual, and the practical applicability of the overarching theory of rights developed in this dissertation. The just war tradition is an evolving body of tenets for determining when resorting to war is just and how war may be justly executed. Rethinking the Just War Tradition provides a timely exploration in light of new security threats that have emerged since the end of the Cold War, including ongoing conflicts in the Middle East, threats of terror attacks, and genocidal conflicts within states. The contributors are philosophers, political scientists, a U.S. Army officer, and a senior analyst at (...) the Center for Defense Information. They scrutinize some familiar themes in just war theory from fresh and original angles, and also explore altogether new territory. In 1978 and 1979, while a visiting fellow at Cambridge University, Orlando Patterson engaged in a number of conversations about slavery with Cambridge ancient historian M. I. Finley. Both men were at the time writing influential books on slavery that would mark important benchmarks in their careers and defined two approaches to the study of slavery, one fading in significance, the other introducing a comparative approach to the institution more focused on dynamics of power and social alienation. At the (...) end of 1978, Finley delivered at the Collège de France four lectures that summarized his thinking on the topic over more than thirty years; two years later they appeared in print under the title Ancient Slavery and Modern Ideology. In 1982 Patterson published Slavery and Social Death, a ground-breaking study that to this day remains unparalleled in its attempt to establish a globally valid definition of slavery applicable to some sixty-six slave-owning societies across three millennia. This article explores the intersection of these two works, the intellectual currents of the times in which they were produced, and the influence each exerted on the study of slavery in subsequent decades, as models and paradigms of two approaches to understanding the significance of the institution. But David Patterson prefers to interpret the word “exile” in a wider metaphysical and existential sense, so connecting it with the problem of alienation and the question of human identity. His purpose is to demonstrate that “the fundamental problem of meaning in human life is a problem of homelessness; that the effort to emerge from exile is an effort to return meaning to the word and thus the self to the other; and that the exile of the word is an exile of human being” (p. xi). (Incidentally this quotation anticipates the rather curious style of English which the author will adopt, regrettably typical of many academics.) The neurosis engendered by this problem of homelessness is one to which Russians have always been particularly prone, perhaps because their geographical situation on a vast inhospitable plain, stretching uneasily between Europe and Asia, has always generated a feeling of insecurity. So it is not at all difficult to find abundant examples of it in Russian literature. As Patterson makes clear in his preface, there are many Russian writers other than the ones he has chosen who well demonstrate estrangement and alienation. Indeed, one is tempted to suggest that a Russian writer who does not suffer from the neurosis is the exception to the general rule. And, pursuing the idea further, it might be possible to show that any novel, any poem, any piece of writing in any language, contains elements of the problem, since it derives almost inevitably from the very occupation of a creative writer.Thus, from the outset, Patterson runs the risk of making his “exile” definition so wide that the term becomes almost meaningless. It may well be [End Page 514] that his book would have been less diffuse had he kept his definition rather narrower. And since he professes that his aim is “not only to make a point about Russian letters but to draw on these Russian texts in an effort to arrive at a deeper understanding of a much larger, more pervasive problem” (p. xi), Patterson runs the further risk of allowing the texts he uses for his demonstration simply to turn into pretexts for uncontrolled and unstructured digression. It has to be said at once that these risks he proves unable or unwilling to guard against.From the nineteenth century Patterson begins, inevitably, with the well-worn theme of the “superfluous man.” Nothing very original here, as this particular label has been applied so often and so indiscriminately to Russian literature that it has turned into a kind of critical rubber stamp. But at least Patterson does not go over the well-worn ground of the realist novel, preferring to concentrate on Dostoevsky’s non-fictional Winter Notes on Summer Impressions, as embodying its author’s post-Siberian sense of estrangement from Russia and his search for a new identity, brought into focus by his trip to Europe. However, in the case of Tolstoy, Patterson reverts to fiction, concentrating on The Death of Ivan Ilich and Resurrection. In this connection he is perhaps rather less scrupulous than he ought to have been over the distinction between fiction and non-fiction.Noting the comments on Tolstoy, the reader becomes increasingly aware that the book is in many respects a more extended sermon than scholarly analysis. This is confirmed by Patterson’s decision in Part Three to include two early twentieth-century religious thinkers, Florensky and Shestov. Here we are guided through comparatively uncharted territory, but with the uncomfortable feeling that we are plunging into an ever darkening and more oppressive jungle of ideas.
