Weimar: A Jurisprudence of Crisis.Arthur Jacobson & Bernhard Schlink (eds.) - 2000 - University of California Press.
This selection of the major works of constitutional theory during the Weimar period reflects the reactions of legal scholars to a state in permanent crisis, a society in which all bets were off. Yet the Weimar Republic's brief experiment in constitutionalism laid the groundwork for the postwar Federal Republic, and today its lessons can be of use to states throughout the world. Weimar legal theory is a key to understanding the experience of nations turning from traditional, religious, or command-and-control forms (...)

Duty to Family: Ethical Considerations in the Resuscitation Bay.Ashley Pavlic, Arthur R. Derse, Nancy Jacobson, Christopher Calciano & Colin Liphart - 2024 - Journal of Clinical Ethics 35 (1):54-58.
To examine the ethical duty to patients and families in the setting of the resuscitation bay, we address a case with a focus on providing optimal care and communication to family members. We present a case of nonsurvivable traumatic injury in a minor, focusing on how allowing family more time at the bedside impacts the quality of death and what duty exists to maintain an emotionally optimal environment for family grieving and acceptance. Our analysis proposes tenets for patient and family-centric (...)

The Longest Night: Polemics and Perspectives on Election 2000.Arthur Jacobson & Michel Rosenfeld (eds.) - 2002 - University of California Press.
The American presidential election of 2000 was perhaps the most remarkable, and in many ways the most unsettling, that the country has yet experienced. The millennial election raised fundamental questions not only about American democracy, but also about the nation's constitution and about the legitimate role of American courts, state and federal, and in particular about the United States Supreme Court. _The Longest Night _presents a lively and informed reaction to the legal aftermath of the election by the most prominent (...)

  9. The world as will and representation.Arthur Schopenhauer & E. F. J. Payne - 2010 - New York: Cambridge University Press. Edited by Judith Norman, Alistair Welchman & Christopher Janaway.
First published in 1818, The World as Will and Representation contains Schopenhauer's entire philosophy, ranging through epistemology, metaphysics, philosophy of mind and action, aesthetics and philosophy of art, to ethics, the meaning of life and the philosophy of religion, in an attempt to account for the world in all its significant aspects. It gives a unique and influential account of what is and is not of value in existence, the striving and pain of the human condition and the possibility of (...)

Abstract It is widely assumed that the meaning of at least some types of expressions involves more than their reference to objects, and hence that there may be co-referential expressions which differ in meaning. It is also widely assumed that ?syntax does not suffice for semantics?, i.e. that we cannot account for the fact that expressions have semantic properties in purely syntactical or computational terms. The main goal of the paper is to argue against a third related assumption, namely that (...)

A narrative review of the active ingredients in psychotherapy delivered by conversational agents.Arthur Herbener, Michal Klincewicz & Malene Flensborg Damholdt A. Show More - 2024 - Computers in Human Behavior Reports 14.
The present narrative review seeks to unravel where we are now, and where we need to go to delineate the active ingredients in psychotherapy delivered by conversational agents (e.g., chatbots). While psychotherapy delivered by conversational agents has shown promising effectiveness for depression, anxiety, and psychological distress across several randomized controlled trials, little emphasis has been placed on the therapeutic processes in these interventions. The theoretical framework of this narrative review is grounded in prominent perspectives on the active ingredients in psychotherapy. (...)

Essay on the freedom of the will.Arthur Schopenhauer - 1960 - Mineola, N.Y.: Dover Publications. Edited by Konstantin Kolenda.
The winning entry in a competition held by the Royal Norwegian Society of Sciences, Schopenhauer's 1839 essay brought its author international recognition. Its brilliant and elegant treatments of free will and determinism elevated it to a classic of Western philosophy, and its penetrating reflections still remain relevant. Schopenhauer makes a distinction between freedom of acting (which he endorses) and the freedom of willing (which he refutes) in a clear and rigorous treatment that reveals many basic features of his philosophy. A (...)

On the Suffering of the World is a collection of the later aphoristic writings of Arthur Schopenhauer, known for their incisive, aphoristic style and dark, pessimistic view of human existence. Edited and with an introduction by Eugene Thacker, On the Suffering of the World comprises a core selection of Schopenhauer's later writings, gathered together for the first time in print. These texts, produced during the last decades of Schopenhauer's long life, reveal a unique kind of philosophy, expressed in a (...)

Crito.Arthur Fowler Plato & Watt - 1940 - New York city,: R.N. Ascher & R.S. Rodwin at the Fieldston school press. Edited by Benjamin Jowett.
Crito is a dialogue by the ancient Greek philosopher Plato. It depicts a conversation between Socrates and his wealthy friend Crito regarding justice, injustice, and the appropriate response to injustice. Socrates thinks that injustice may not be answered with injustice, and refuses Crito's offer to finance his escape from prison. The dialogue contains an ancient statement of the social contract theory of government.

    Liberal Justification and the Limits of Neutrality.Arthur Ripstein - 1992 - Analyse & Kritik 14 (1):3-17.
This paper examines a style of political justification prominent in contemporary liberalism, according to which policies are legitimate only if they can be shown to be acceptable to all. Although this approach is often associated with neutrality about the good life, it is argued that liberalism cannot be neutral about questions of the role of various goods, such as work, play and community. The paper closes by exploring the implications and applicability of this account of justification to contemporary political practice.

Schopenhauer believed in the supremacy of will over intellect, and he wrote extensively on the motivations behind actions. These six essays, drawn from Parerga and posthumously published works, include observations on government, free will and fatalism, character, moral instinct, and ethics. They reflect the author's wide range of interests and offer an accessible approach to his_philosophy.

  40. An Unsolved Problem for Slote's Agent-Based Virtue Ethics.Jacobson Daniel - 2002 - Philosophical Studies 111 (1):53 - 67.
According to Slote's ``agent-based'' virtue ethics, the rightness orwrongness of an act is determined by the motive it expresses. Thistheory has a problem with cases where an agent can do her duty onlyby expressing some vicious motive and thereby acting wrongly. In sucha situation, an agent can only act wrongly; hence, the theory seemsincompatible with the maxim that `ought' implies `can'. I argue thatSlote's attempt to circumvent this problem by appealing to compatibilism is inadequate. In a wide range of psychologically (...)
