Traditional whistleblowing theories have purported that whistleblowers engage in a rational process in determining whether or not to blow the whistle on misconduct. However, stressors inherent to whistleblowing often impede rational thinking and act as a barrier to effective whistleblowing. The negative impact of these stressors on whistleblowing may be made worse depending on who engages in the misconduct: a peer or advisor. In the present study, participants are presented with an ethical scenario where either a peer or advisor engages (...) in misconduct, and positive and the negative consequences of whistleblowing are either directed to the wrongdoer, department, or university. Participant responses to case questions were evaluated for whistleblowing intentions, moral intensity, metacognitive reasoning strategies, and positive and negative, active and passive emotions. Findings indicate that participants were less likely to report the observed misconduct of an advisor compared to a peer. Furthermore, the findings also suggest that when an advisor is the source of misconduct, greater negative affect results. Post-hoc analyses were also conducted examining the differences between those who did and did not intend to blow the whistle under the circumstances of either having to report an advisor or peer. The implications of these findings for understanding the complexities involved in whistleblowing are discussed. (shrink)

A great need for systematic evaluation of ethics training programs exists. Those tasked with developing an ethics training program may be quick to dismiss the value of training evaluation in continuous process improvement. In the present effort, we use a case study approach to delineate how to leverage formative and summative evaluation measures to create a high-quality ethics education program. With regard to formative evaluation, information bearing on trainee reactions, qualitative data from the comments of trainees, in addition to empirical (...) findings, can ensure that the training program operates smoothly. Regarding summative evaluation, measures examining trainee cognition, behavior, and organization-level results provide information about how much trainees have changed as a result of taking the ethics training. Research has examined various cognitive processes underlying ethical decision-making, and has recently begun to focus on the differential effects of specific emotions. The present study examines three self-focused moral emotions and their influence on ethical decision-making: guilt, shame, and embarrassment. Given the potential of these discrete emotions to exert positive or negative effects in decision-making contexts, we also examined their effects on ethical decisions after a cognitive reappraisal emotion regulation intervention. Participants in the study were presented with an ethical scenario (...) and were induced, or not induced, to feel guilt, shame, or embarrassment, and were asked to reappraise, or not reappraise, the situation giving rise to those emotions. Responses to questions about the ethical case were evaluated for the quality of ethical sensemaking, perceptions of moral intensity, and decision ethicality. Findings indicate that guilt, shame, and embarrassment are associated with different sensemaking processes and metacognitive reasoning strategies, and resulted in different perceptions of moral intensity. Additionally, cognitive reappraisal had a negative impact on each of these factors. Implications of these findings for ethical decision-making research are discussed. (shrink)

This article demonstrates how instructors of professionalism and ethics training programs can integrate a professional decision-making tool in training curricula. This tool can help trainees understand how to apply professional decision-making strategies to address the threats posed by a variety of psychological and environmental factors when they are faced with complex professional and ethical situations. We begin by highlighting key decision-making frameworks and discussing factors that may undermine the use of professional decision-making strategies. Then, drawing upon findings from past research, (...) we present the “SMART” professional decision-making framework: seeking help, managing emotions, anticipating consequences, recognizing rules and context, and testing assumptions and motives. Next, we present a vignette that poses a complex ethical and professional challenge and illustrate how each professional decision-making strategy could or should be used by characters in the case. To conclude, we review a series of educational practices and pedagogical tools intended to help trainers facilitate trainee learning, retention, and application of “SMART” decision-making strategies. State Medical Boards (SMBs) can take severe disciplinary actions (e.g., license revocation or suspension) against physicians who commit egregious wrongdoing in order to protect the public. However, there is noteworthy variability in the extent to which SMBs impose severe disciplinary action. At the onset of the COVID-19 pandemic in the United States, stay-at-home orders disrupted normal research operations. Principal investigators (PIs) had to make decisions about conducting and staffing essential research under unprecedented, rapidly changing conditions. These decisions also had to be made amid other substantial work and life stressors, like pressures to be productive and staying healthy. Using survey methods, we asked PIs funded by the National Institutes of Health and the National Science Foundation (N = 930) to rate how (...) they prioritized different considerations, such as personal risks, risks to research personnel, and career consequences, when making decisions. They also reported how difficult they found these choices and associated symptoms of stress. Using a checklist, PIs indicated those factors in their research environments that made their decisions easier (i.e., facilitators) or more difficult (i.e., barriers) to make. Finally, PIs also indicated how satisfied they were with their decisions and management of research during the disruption. Descriptive statistics summarize PIs’ responses and inferential tests explore whether responses varied by academic rank or gender. PIs overall reported prioritizing the well-being and perspectives of research personnel, and they perceived more facilitators than barriers. Early-career faculty, however, rated concerns about their careers and productivity as higher priorities compared to their senior counterparts. Early-career faculty also perceived greater difficulty and stress, more barriers, fewer facilitators, and had less satisfaction with their decisions. Women rated several interpersonal concerns about their research personnel more highly than men and reported greater stress. The experience and perceptions of researchers during the COVID-19 pandemic can inform policies and practices when planning for future crises and recovering from the pandemic. (shrink)

Abstract:This symposium includes thirteen personal narratives from people who have received at least one organ transplant from a living or deceased donor. These narratives foster better understanding of the experiences of life-saving organ recipients and their families, including post-transplant difficulties experienced—sometimes requiring multiple transplants. This issue also includes three commentaries by Macey L. Levan, Heather Lannon, and Vidya Fleetwood, Roslyn B. Mannon & Krista L. Lentine. Dr. Levan is a living kidney donor and associate professor of surgery and population health. (...) She writes and teaches on organ transplant and has expertise and experience in governance at the federal level as a member of the board of directors for the U.S. Organ Procurement and Transplantation Network. Dr. Lannon is a social worker and transplant advocate. Her work and interest in the topic were inspired by her husband who needed a heart transplant. Dr. Fleetwood is a surgeon specializing in liver transplantation, pancreas transplantation, kidney transplantation, as well as living donor nephrectomy. Dr. Mannon is a nephrologist and professor of medicine, pathology and microbiology. Her work focuses on understanding and improving long-term kidney transplant outcomes for patients, donors, and caregivers. Dr. Lentine is a nephrologist specializing in treatment of adult patients with kidney disease. ABSTRACT Prior studies have examined the impacts of sensemaking processes, such as forecasting, on ethical decision making but only a few have considered how aspects of the ethical issue itself, such as social consensus and magnitude of consequences, might interact with sensemaking processes to influence EDM. The present effort examines both forecasting and moral intensity, as well as their interactions, during the EDM process. Participants in this study were given an ethical scenario with either a high or low degree of (...) social consensus as well as a greater or smaller magnitude of consequences. They were then asked to forecast either many or few potential outcomes stemming from their actions before coming up with a final plan of action. Responses were rated for quality of forecasting, use of metacognitive reasoning strategies, perceived moral intensity, and ethicality. Results indicate that social consensus may not be beneficial for EDM if the magnitude of consequences is low or individuals are not engaged in extensive forecasting. ABSTRACT Researchers have increasingly acknowledged that affect plays a role in ethical decision making. However, the impact that specific affective states may have on the expression of decision biases in the context of ethical dilemmas has received limited empirical attention. To address this, the present effort examined the impact of happy and sad affective states on biases in ethical decision making. In an online experiment, undergraduate students read short stories that either induced happy, sad, or relaxed affective states, followed by (...) a covert measure of three types of biases held to inhibit ethical decision making. Results demonstrated that happy affective states increased the expression of regulation biases, and sad affective states increased the expression of simplification biases, compared to relaxed affective states. The question I wish to explore is this: Does idealism conflict with common sense? Unfortunately, the answer I give may seem like a rather banal one: It depends. What do we mean by ‘idealism’ and ‘common sense?’ I distinguish three main varieties of idealism: absolute idealism, Berkeleyan idealism, and dualistic idealism. After clarifying what is meant by common sense, I consider whether our three idealisms run afoul of it. The first does, but the latter two don’t. I conclude that while (...) And there certainly seems to be no special problem in conceiving of a scenario where all the author's experiences are a mere dream induced by a Maleficent‐like evil genius. The problem in the present context is that the possibility of a dream‐inducing Maleficent‐like evil genius guarantees that how things appear would be no different, whether she (...) is dreaming or not. But maybe there is a difference: does it not appear to her that there is a difference between dreaming and wakefulness? The very fact that she is aware of such a distinction at all suggests the distinction is real. People prefer a real life over an experientially identical dream life, or even a more pleasurable dream life, because there is more to life than just experience. (shrink)

According to the consensus view, neither science nor history can prove that the Turin Shroud shows signs of the Resurrection of Jesus of Nazareth. From a transcultural perspective contributions from Assyriology, Byzantine Studies, Classical Archaeology, Egyptology, German Medieval Studies and Jewish History look into the processes and mechanisms behind the transfer by people of certain values to animals, and the functions these animal-signs have within written, pictorial and performative forms of expression.

Significant disagreement remains in ethics about the duties we have towards wild animals. This paper aims to mediate those disagreements by exploring how they are supported by, or diverge from, the common-sense ethical principles of non-maleficence, beneficence, autonomy and justice popular in medical ethics. We argue that these principles do not clearly justify traditional conservation or a ‘hands-off ’ approach to wild-animal welfare; instead, they support natural negative duties to reduce the harms that we cause as well as natural positive (...) duties to promote the welfare of wild animals. Viewing emotion from an evolutionary perspective, researchers have argued that simple responses to affective stimuli can be triggered without mediation of cognitive processes. Indeed, findings suggest that positively and negatively valenced stimuli trigger approach and avoidance movements automatically. However, affective stimulus–response compatibility phenomena share so many central characteristics with nonaffective stimulus–response compatibility phenomena that one may doubt whether the underlying mechanisms differ. We suggest an “affectively enriched” version of the theory of event coding (TEC) that is able to account for (...) both affective and nonaffective compatibility, and that can account for the observation that both types of compatibility seem to be modulated by goals and intentions. Predictions from the model are tested in an experiment where participants carried out approach and avoidance responses to either the valence or the orientation of emotionally charged pictures. Under affective instruction the positive-approach/negative-avoid mapping yielded faster responses than the positive-avoid/negative-approach mapping, but no such effect was observed under spatial instruction. Conversely, spatial compatibility effects were obtained under spatial, but not under affective instruction. We conclude that affective and nonaffective compatibility effects reflect the same mechanism. (shrink)

Political philosophy was once dominated by discussion of the virtues of character and their importance to the good life and the good society. Contemporary political philosophers, however, following the towering influence of John Rawls, have primarily focused on a single virtue of institutions: justice, while largely avoiding controversial claims about the good life. As a result, political philosophy lacks a unified account of the virtues of institutions and the virtues of character. More importantly, we lack an understanding of the connection (...) between the just society and the good life. This book begins to mend this broken seam, which, on reflection, lies at the heart of our deepest political problems. The book’s central argument is that the virtues of character require institutions, while good institutions enable persons to live together virtuously. Political institutions are a necessary precondition for the moral agency exhibited by the virtues. But good institutions enable virtue to grow, while helping to constrain the excesses of vice. On this view, justice emerges primarily as a virtue of character, not institutions. The just person balances conformity to existing institutional norms with practically wise reforms. Ultimately, this book concludes that the just society and the good life are linked through the common good of virtuous activity within the shared institutions of a political community. (shrink)

Lecteur de Nietzsche et de Schopenhauer, ennemi déclaré des durkheimiens, socialiste non marxiste, farouche défenseur de l'individu, Georges Palante est un penseur iconoclaste qui n'a eu de cesse de développer une éthique individualiste et libertaire en vue du plein épanouissement des facultés et des potentialités individuelles. Cependant, par un étrange paradoxe, l'éthique palantienne prend sa source dans (...) une philosophie pessimiste qui offre à la révolte un caractère tragique et indompté : elle doit avoir lieu et ce, malgré la certitude de sa défaite. C'est précisément ce paradoxe que cet ouvrage entend questionner tout en offrant une introduction à l'oeuvre de Georges Palante. Interroger la possibilité d'une révolte pessimiste, c'est interroger ce moment de l'insoumission et de la désobéissance propre à la condition humaine. Palante ouvre la voie qui inscrit la révolte et le mouvement du refus dans la constitution même de l'homme. Avec Albert Camus, Palante pourrait affirmer : "Qu'est-ce qu'un homme révolté? Over the years, phenomenology has provided illuminating descriptions of discrimination, with its mechanisms and effects being thematised at the most basic levels of embodiment, (dis)orientation, selfhood, and belonging. What remains somewhat understudied is the lived experience of the discriminator. In this paper I draw on Husserl's phenomenological account of normality to reflect on the ways in which we discriminate at the prereflective levels of perceptual experience and bodily being. By critically reflecting on the intentional structures undergirding discriminatory practices, I argue (...) that discrimination is characteristic of a naïve normalising attitude which is habitually interested in securing a familiar experience of a static normality. I first demonstrate how this attitude problematically tends to reproduce, enforce, and further sediment discriminatory and exclusionary norms. Further, I provide an internal critique which problematises discrimination—without recourse to external normative standards—on three fronts: as epistemically unproductive, experientially obscuring, and normatively non-instantiating. In discriminatory acts we see an abnormal refusal to enrich, revise, and genetically establish new normative commitments, new ways of seeing, and a new normality. (shrink)

It is well known that Kant’s aesthetics is framed intersubjectively because he upholds the claim of taste to universality. However, the transcendental foundation of this shared universality is a supersensible ground which is taken for granted but which cannot be brought directly into communicative experience. Kant’s reliance on the synthetic a priori structure of aesthetic judgment also removes it from the sphere of observable personal interaction. This argumentative strategy exposes it to skeptical challenge and generates inaccessible references to inner representations (...) (be they intuitions, categories of the understanding or rational ideas). It is not sufficient, as Kant did, to propose a description of aesthetic experience that is subjectively plausible and thereby claim its intersubjective validity. It is indispensable to embody intersubjectivity in behavior and language. In practical intersubjectivity, aesthetic attitudes are dealt with in a concrete and accessible manner without relying on mentalistic assumptions as a foundation. Conceptual terms such as ‘agreeable’, ‘beauty’, ‘sublime’, ‘ugly’, ‘universality’ acquire new meaning. (shrink)

Criteria of historical assessment are applied to the Turin Shroud to determine which hypothesis relating to the image formation process is the most likely. To implement this, a ‘Minimal Facts’ approach is followed that takes into account only physicochemical and historical data receiving the widest consensus among contemporary scientists. The result indicates that the probability of the Shroud of Turin being the real shroud of Jesus of Nazareth is very high; historians and natural theologians should therefore pay it increased attention.

Les logiciels d’aide à la décision basés sur des techniques d’intelligence artificielle sont de plus en plus utilisés dans le domaine de la justice. Or ces techniques nécessitent souvent d’accéder à de grandes quantités d’informations personnelles afin de réaliser un apprentissage de qualité. En France, le cadre légal semble aujourd’hui favorable à l’ouverture des jugements, pourvu que la vie privée des personnes concernées soit respectée. Cependant, la protection des données personnelles destinées à être publiées reste difficile techniquement. Cet article a (...) pour objectif de décrire une attaque minimaliste qui a été réalisée en 2014 sur un jeu de données protégé par l’application d’un algorithme de pseudonymisation. L’originalité de cette attaque réside dans sa simplicité de fonctionnement – elle ne nécessite pas d’accès à un jeu de données auxiliaire – et dans sa cible – l’algorithme de pseudonymisation. Nous présentons la famille des algorithmes de pseudonymisation, décrivons et analysons l’attaque, et concluons sur la place de la pseudonymisation dans le Règlement Général sur la Protection des Données personnelles. L'objectif de cet article est de montrer dans quelle mesure, depuis la fin des années 1980, les théories de la mondialisation culturelle, nées d'une convergence dans le champ académique anglo-saxon entre certains tenants des Cultural Studies, de l'anthropologie et de la sociologie, ont marqué une rupture dans la façon d'appréhender les enjeux de l'internationalisation des médias. Nous appuyant sur quelques-uns des principaux textes ayant donné corps à ces théories de la mondialisation, nous retraçons les principaux déplacements du centre de gravité (...) de l'analyse qu'elles opèrent. Prenant acte des apports de ces théories pour la compréhension des processus d'appropriation des flux transnationaux, cet article souligne aussi leurs limites et conclut à la nécessité d'inclure les perspectives de l'économie politique dans l'étude des processus de transnationalisation pour que ceux-ci soient appréhendés dans toute leur complexité.The objective of this paper is to show how, since the late 1980s, theories of cultural globalization, born of a convergence in the Anglo-Saxon academic field between some proponents of cultural studies, anthropology and sociology, marked a break in the way of understanding issues of internationalization of the media. Drawing on some of the main texts that gave substance to these theories of globalization, we trace the main movements of center of gravity analysis they operate. Acknowledging the contributions of these theories for understanding the process of appropriation of transnational flows, this article also highlights limitations and concludes with the need to include the perspectives of political economy in the study of transnational processes that they are apprehended in all their complexity. Hydraulic fracturing ('fracking') has enabled the recovery of previously inaccessible resources and rendered new areas of the underground 'productive'. While a number of studies in the US and UK have examined public attitudes toward fracking and its various impacts, how people conceptualise the deep underground itself has received less attention. We argue that views on resources, risk and the deep underground raise important questions about how people perceive the desirability and viability of subterranean interventions. We conducted day-long deliberation workshops (two (...) in each country), facilitating discussions among diverse groups of people on prospective shale extraction in the US and UK. Themes that emerged in these conversations include seeing the Earth as a foundation; natural limits (a greater burden than the subsurface can withstand versus simply overuse of natural resources); and ideas about the fragility, instability and opacity of the deep underground. We find that concerns in both countries were not limited to specific, localised impacts but also addressed ecosystem links between surface and subsurface environments and broader questions about the use, identification and value of natural resources. Gillian Russell has recently proposed counterexamples to such elementary argument forms as Conjunction Introduction and Identity. These purported counterexamples involve expressions that are sensitive to linguistic context—for example, a sentence which is true when it appears alone but false when embedded in a larger sentence. If they are genuine counterexamples, it looks as though logical nihilism—the view that there are no valid argument forms—might be true. In this paper, I argue that the purported counterexamples are not genuine, on the grounds (...) that they equivocate. Having defused the threat of logical nihilism, I argue that the kind of linguistic context sensitivity at work in Russell’s purported counterexamples, if taken seriously, far from leading to logical nihilism, reveals new, previously undreamt-of valid forms. By way of proof of concept I present a simple logic, Solo-Only Propositional Logic, designed to capture some of them. Along the way, some interesting subtleties about the fallacy of equivocation are revealed. (shrink)
