I argue that metaethicists should be concerned with two kinds of alienation that can result from theories of normativity: alienation between an agent and her reasons, and alienation between an agent and the concrete others with whom morality is principally concerned. A theory that cannot avoid alienation risks failing to make sense of central features of our experience of being agents, in whose lives normativity plays an important role. I argue that the social dimension of alienation, as discussed by Williams and Railton, has been underappreciated. The lesson typically drawn from their exchange is that moral theory poses a threat to the internal integrity of the agent, but there is a parallel risk that moral theory will implicitly construe agents as constitutively alienated from one another. I argue that a satisfying account of agency will need to make room for what I call ‘genuine ethical contact’ with others, both as (...) concrete objects in the world external to ourselves and as subjects who can recognize us reciprocally. Iris Murdoch’s The Sovereignty of Good—especially the first essay, “The Idea of Perfection”—is often associated with a critique of a certain picture of agency and its proper place in ethical thought. There is implicit in this critique, however, an alternative, much richer one. I propose a reading of Murdochian agency in terms of the continuous activity of cultivating and refining a distinctive practical standpoint, and I apply this reading to her account of moral progress. For Murdoch moral progress depends on (...) transcending egoism and achieving clear perception of a normatively-saturated reality, but it would be a mistake to think of egoism in terms of selfishness, or clarity in terms of altruism. Rather, I argue, Murdochian moral progress requires overcoming socially-conditioned and often ideological forms of alienation, and making the social conditions that inform our practical standpoints self-conscious. An investigation of public support for coastal adaptation options and public finance options in Florida evaluated stakeholder judgments and how they changed through a participatory engagement process. The study found that public finance mechanisms that imposed fiscal burdens on those who directly benefit from hazard reduction were rated as more acceptable than others. Significantly, visualisations and data on local economic damage and return on investment of potential adaptation options further increased acceptability ratings. The question of whether a development fee for (...) adaptation or any other public purpose supported by private funds is a legal issue that depends on a test called the rational nexus. One concern of this article is to explore options for such fees to cover adaptation to climate change. This raises issues about the potential conflict with the community-wide and intergenerational nature of long-term adaptation. We also explore the relevance of environmental attitudes using the 'new environmental paradigm' (NEP) scale and political party affiliation. Results have implications for infrastructure improvements that require public approval for financing. (shrink)

This essay is a critical notice of David Dyzenhaus's book, The Long Arc of Legality. I argue that Dyzenhaus’s criterion for distinguishing legal pathologies that undermine law's contractarian claim to legitimacy and political pathologies that do not is unsustainable. It relies on a categorical distinction between the threat to law's legitimacy posed by treating some subjects as de jure second-class citizens, whose formal legal status is compromised, and other threats to political legitimacy grounded in the treatment of some subjects as (...) de facto second-class citizens, who retain full formal legal equality but suffer from thoroughgoing substantive subordination. But some forms of de facto second-class citizenship are a greater threat to contractarian legitimacy than some forms of full formal equality. So formal equality for subjects and legal legitimacy come apart. I consider and respond to several responses on Dyzenhaus's behalf, and conclude by proposing a version of his jurisprudential theory that relaxes this distinction. (shrink)

The conventional wisdom regarding the aims and shortcomings of Kantian constructivism is mistaken. The aim of metaethical constructivism is not to provide a naturalistic account of the objectivity of normative facts by deriving substantive morality from a conception of agency so thin as to be uncontroversial (a task at which it is generally regarded to have failed). Its aim is to explain the “grip” that normative facts have on us—to avoid what I call the problem of normative alienation. So understood, (...) Kantian constructivism faces two problems: that determinate normative facts cannot be derived from agency and that its individualistic conception of agency cannot account for the sociality of morality. I propose and elaborate a social conception of agency that is better able to address the latter problem while still avoiding normative alienation, and evaluate two different strategies for responding to the former problem. Metaethical constructivism aims to explain morality’s authority and relevance by basing it in agency, in a capacity of the creatures who are in fact morally bound. But constructivists have struggled to wring anything recognizably moral from an appropriately minimal conception of agency. Even if they could, basing our reasons in our individual agency seems to make other people reason-giving for us only indirectly. This paper argues for a constructivism based on a social conception of agency, on which our capacity to (...) recognize ourselves as having reasons ties us inescapably to others. It argues that mutual recognition is a pervasive feature of linguistic concepts, and builds this into a view called transformative expressivism. (shrink)

Ethical training in graduate programs is an important part of the professional development process. Such training has taken a position of prominence in both counseling and clinical psychology but seems to be lagging behind in the field of sport psychology. A debate exists about whether such training is necessary and, if so, how it should be provided. An important step in better understanding these issues is to identify how such training is currently taking place. This study surveyed the program directors (...) of sport psychology programs listed in the Directory of Graduate Programs in Applied Sport Psychology about the ethical training that takes place in their programs and their perceptions of the preparedness of the students in their programs. Of those contacted, 54% responded to the e-mail based survey. The results from these respondents indicated that 64.4% of programs require training in ethics and that the training was most commonly integrated into other nonethics courses. Overall, respondents did not feel as if students were completely prepared for either the ethical or legal issues that they will face in their professional careers. The importance of ethical training and suggestions for improving ethical training are discussed. (shrink)

This book offers solutions to two persistent and I believe closely related problems in epistemology. The first problem is that of drawing a principled distinction between perception and inference: what is the difference between seeing that something is the case and merely believing it on the basis of what we do see? The second problem is that of specifying which beliefs are epistemologically basic (i.e., directly, or noninferentially, justified) and which are not. I argue that what makes a belief a (...) perceptual belief, or a basic belief, is not any introspectible feature of the belief but rather the nature of the cognitive system, or "module", that is causally responsible for the belief. Thus, even zombies, who in the philosophical literature lack conscious experiences altogether, can have basic, justified, perceptual beliefs. -/- The theories of perceptual and basic beliefs developed in the monograph are embedded in a larger reliabilist epistemology. I use this theory of basic beliefs to develop a detailed reliabilist theory: Inferentialist Reliabilism, which offers a reliabilist theory of inferential justification and which solves some longstanding problems for other reliabilist views by demanding inferential support for some—but not all—beliefs. The book is an instance of a thoroughgoingly naturalistic approach to epistemology. Many of my arguments have an empirical basis, and the view that I endorse reserves a central role for the cognitive sciences—in particular, cognitive neuroscience—in filling in the details of an applied epistemological theory. Is perception cognitively penetrable, and what are the epistemological consequences if it is? I address the latter of these two questions, partly by reference to recent work by Athanassios Raftopoulos and Susanna Seigel. Against the usual, circularity, readings of cognitive penetrability, I argue that cognitive penetration can be epistemically virtuous, when---and only when---it increases the reliability of perception.

This paper develops the account of our experience and knowledge of time put forward by Russell in his Theory of Knowledge manuscript. While Russell ultimately abandons the project after it receives severe criticism from Wittgenstein (though several chapters derived from it appear as articles in The Monist), in producing this manuscript time, and particularly the notion of the present time, play a central role in Russell’s account of experience. In the present discussion, I propose to focus largely on Russell’s writing (...) in 1912–3, comparing this with some of the remarks made about memory by Moore in 1910–11. My motivation is twofold. First as a matter of scholarship, to reveal an original interpretation of Russell’s notion of immediate memory and of his view of our experience and knowledge of time over this period. Second as a matter of philosophical curiosity. There has been an increase in interest in temporal experience in contemporary discussions of the philosophy of mind, from memory and the imagination to the temporal aspects of perceptual experience. Russell’s writing in 1912–3 provides us with a philosophically interesting account of temporal experience which has points of contact with contemporary debates. (shrink)

The “looks” of things are frequently invoked (a) to account for the epistemic status of perceptual beliefs and (b) to distinguish perceptual from inferential beliefs. ‘Looks’ for these purposes is normally understood in terms of a perceptual experience and its phenomenal character. Here I argue that there is also a nonexperiential sense of ‘looks’—one that relates to cognitive architecture, rather than phenomenology—and that this nonexperiential sense can do the work of (a) and (b).

Much of the intuitive appeal of evidentialism results from conflating two importantly different conceptions of evidence. This is most clear in the case of perceptual justification, where experience is able to provide evidence in one sense of the term, although not in the sense that the evidentialist requires. I argue this, in part, by relying on a reading of the Sellarsian dilemma that differs from the version standardly encountered in contemporary epistemology, one that is aimed initially at the epistemology of (...) introspection but which generalizes to theories of perceptual justification as well. To what extent are cognitive capacities, especially perceptual capacities, informationally encapsulated and to what extent are they cognitively penetrable? And why does this matter? Two reasons we care about encapsulation/penetrability are: (a) encapsulation is sometimes held to be definitional of modularity, and (b) penetrability has epistemological implications independent of modularity. Nearly everyone agrees that perception gives us justification and knowledge, and a great number of epistemologists endorse a particular two-part view about how this happens. The view is that perceptual beliefs get their justification from perceptual experiences, and that they do so by being based on them. Despite the ubiquity of these two views, I think that neither has very much going for it; on the contrary, there’s good reason not to believe either one of them.

Proponents of epistemic partiality in friendship argue that friendship makes demands of our epistemic lives that are at least inconsistent with the demands of epistemic propriety, and perhaps downright irrational. In this paper, I focus on the possibility that our commitments to our friends distort how we respond to testimony about them, their character, and their conduct. Sometimes friendship might require us to ignore (or substantially underweight) what others tell us about our friends. However, while this practice might help promote (...) your friendship and protect your friends, refusing someone’s testimony can constitute a special kind of insult towards them, according to Allen Hazlett (2017) and Finlay Malcolm (2018). It seems to follow that friendship can require us to insult people by refusing their testimony. This should count against treating your friends with epistemic partiality, one might think. It’s plausible that we have moral reasons not to insult other people, whether they’re our friends or not. The risk of insulting non-friends, it turns out, is just the beginning of the problems for the epistemic partiality in friendship. Recent discussions in social epistemology, led by Miranda Fricker (2007), Kristie Dotson (2011) and José Medina (2012), among others, have brought renewed attention the distinctly epistemic nature of some kinds of injustice. Drawing on this work, I’ll suggest a principled way to determine when epistemic partiality in friendship is morally impermissible because of the genuine risk of harmful epistemic injustice. -/- The paper proceeds as follows. First, I’ll argue that treating our friends with epistemic partiality can involve insulting other people by refusing their testimony. Then I’ll consider whether we ever ought to commit more morally serious testimonial injustices in the name of friendship. After considering some putative cases, I’ll introduce the concept of testimonial injustice, referring primarily to the work of Dotson (2011). I’ll explain how and why the epistemic bias which I’ve prescribed in friendship could be thought to cause such injustice. Drawing on the work of Sheila Lintott (2015), I’ll consider some ways in which the extent of the testimonial injustice caused by bias in friendship might be worse yet, namely, because of the role that homophily plays in determining who we become (and remain) friends with. In particular, I’ll consider whether epistemic partiality perpetuates racist or sexist forms of testimonial injustice. Finally, I’ll attempt to alleviate some of these concerns and determine when we’re morally required to treat friends with epistemic partiality. I’ll argue that whilst protecting a friend’s well-being might require you to cause testimonial injustice, such injustice would be morally unjustified. Accordingly, if you commit such injustice in the name of friendship, you’re morally blameworthy for doing so. This, I suggest, imposes an additional limit on epistemic partiality in friendship. Phenomenology has been described as a “non-argumentocentric” way of doing philosophy, reflecting that the philosophical focus is on generating adequate descriptions of experience. But it should not be described as an argument-free zone, regardless of whether this is intended as a descriptive claim about the work of the “usual suspects” or a normative claim about how phenomenology ought to be properly practiced. If phenomenology is always at least partly in the business of arguments, then it is worth giving further attention (...) to the role and form of phenomenological argumentation, how it interacts with its more strictly descriptive component, and the status of phenomenological claims regarding conditions for various kinds of experience. I contend that different versions of phenomenological reasoning encroach upon argument forms that are commonly thought to be antithetical to phenomenology, notably abductive reasoning, understood in terms of its role in both hypothesis generation and in terms of justification. This paper identifies two main steps to making this case. The first step takes seriously the consequences of the intrinsically dialectical aspect of phenomenology in intersection with other modes of philosophy, the natural attitude, and non-philosophy. The second step focuses on transcendental reflection and arguments about the conditions/structures they contain. Together, these two steps aim to rescue phenomenology from the objection that it has an “ostrich epistemology” with regard to the ostensible purity of description, the intuition of essences, or the “conditions” ascertained through transcendental reflection. The history of the Frankfurt School cannot be fully told without examining the relationships of Critical Theorists to their Jewish family backgrounds. Jewish matters had significant effects on key figures in the Frankfurt School, including Max Horkheimer, Theodor W. Adorno, Erich Fromm, Leo Lowenthal and Herbert Marcuse. At some points, their Jewish family backgrounds clarify their life paths; at others, these backgrounds help to explain why the leaders of the School stressed the significance of antisemitism. In the post-Second World War (...) era, the differing relationships of Critical Theorists to their Jewish origins illuminate their distinctive stances toward Israel. This book investigates how the Jewish backgrounds of major Critical Theorists, and the ways in which they related to their origins, impacted upon their work, the history of the Frankfurt School, and differences that emerged among them over time. In this paper, I consider a challenge that naturalism poses for embodied cognition and enactivism, as well as for work on phenomenology of the body that has an argumentative or explanatory dimension. It concerns the connection between embodiment and emergence. In the commitment to explanatory holism, and the irreducibility of embodiment to any mechanistic and/or neurocentric construal of the interactions of the component parts, I argue there is (often, if not always) an unavowed dependence on an epistemic and metaphysical role (...) for emergence, especially concerning certain embodied capacities (motor-intentionality, know-how, skilful habits, affordances, etc.). While the problem of emergence is standardly dismissed as a problem for phenomenology, which brackets away the kind of materialist (and scientific) picture from which reflection on emergence derives, I argue that once a phenomenologist takes a fully-fledged embodied turn, they also have a genuine dilemma of emergence to confront, and I evaluate the relevant options. The Irish writer and Nobel Prize winner, Samuel Beckett, assembled for himself a history of western philosophy during the 1930s, just at the point at which his first novel, Murphy, was coming together. The 'Philosophy Notes', together with related notes taken at that time about St. Augustine, thereafter provided Beckett with a store of knowledge, but also with phrases and images, which he took up in the major work that won him international and enduring fame, from the dramas Waiting (...) for Godot and Endgame, through to the late prose works Worstward Ho and Stirrings Still. In a recent book and an article, Carl Craver construes the relations between different levels of a mechanism, which he also refers to as constitutive relations, in terms of mutual manipulability (MM). Interpreted metaphysically, MM implies that inter-level relations are symmetrical. MM thus violates one of the main desiderata of scientific explanation, namely explanatory asymmetry. Parts of Craver’s writings suggest a metaphysical interpretation of MM, and Craver explicitly commits to constitutive relationships being symmetrical. The paper furthermore explores the option of (...) interpreting MM epistemologically, as a means for individuating mechanisms. It is argued that MM then is redundant. In this paper, I argue that the negative injunctions against certain ways of conceiving of the ethico-political that we can draw explicitly from the methodological strictures of phenomenology are also consistent with some of the core more positive dimensions of contemporary virtue ethics (especially at the more anti-theoretical end of the virtue ethical spectrum), and that central aspects of virtue ethics are consistent with most of the explicit reflections on ethical matters proffered by canonical phenomenologists.

Methods have been a controversial element in theories of knowledge for the last 40 years. Recent developments in theories of justification, concerning the identification and individuation of belief-forming processes, can shed new light on methods, solving some longstanding problems in the theory of knowledge. We needn’t and shouldn’t shy away from methods; rather, methods, construed as psychological processes of belief-formation, need to play a central role in any credible theory of knowledge.

I provide a theory of the metaphysical foundations of identity: an account what grounds facts of the form a=b. In particular, I defend the claim that indiscernibility grounds identity. This is typically rejected because it is viciously circular; plausible assumptions about the logic of ground entail that the fact that a=b partially grounds itself. The theory I defend is immune to this circularity.

The debate around epistemic partiality in friendship presents us with several tough philosophical puzzles. One of these has been articulated in two objections to the view that friendship can require epistemic partiality on the grounds it is incompatible with the nature of friendship. The first, owed to Crawford, argues that you should not treat your friends with epistemic partiality because your beliefs about your friends should be responsive to the facts about them, and epistemic partiality is incompatible with this demand. The second, owed to Mason, draws on a Murdochian account of love to argue that loving relationships—such as friendship—are ‘epistemically rich states’, which means that they are constituted by a drive towards ever greater and more intimate knowledge of our loved ones. In this paper, I shall argue that epistemic partiality may indeed limit what we know about our friends, but not in ways that diminish the quality of our love for them, and certainly not in ways that block us from being friends with them. Frege's picture of attitude states and attitude reports requires a notion of content that is shareable between agents, yet more fine-grained than reference. Kripke challenged this picture by giving a case on which the expressions that resist substitution in an attitude report share a candidate notion of fine-grained content. A consensus view developed which accepted Kripke's general moral and replaced the Fregean picture with an account of attitude reporting on which states are distinguished in conversation by their (private) representational properties. (...) I begin in support of the consensus by showing how a sort of de facto coordination on mental symbols is possible, even for unsophisticated agents. But I go on to argue that whenever conditions are ripe for de facto coordination on symbols, there is an inter-subjective relation that supports a fine-grained notion of content resistant to Kripke's challenge. Because moral understanding involves a distinctly first-personal grasp of moral matters, there is a temptation to think of its value primarily in terms of achievements that reflect well on its possessor: the moral worth of one's action or the virtue of one's character. These explanations, I argue, do not do full justice to the importance of moral understanding in our moral lives. Of equal importance is the value of moral understanding in our relations with other moral agents. In particular, I (...) argue that an understanding of moral matters is of central importance within relations of solidarity. In addition to highlighting an overlooked aspect of moral understanding's value, this view also has important implications for what solidarity requires of those who stand in that relationship. This Element, written for researchers and students in philosophy and the behavioral sciences, reviews and critically assesses extant work on number concepts in developmental psychology and cognitive science. It has four main aims.
