One of the major prophecies in the Aeneid is given to Aeneas in the underworld by Anchises, who had ordered his son to come to him to learn of his whole race and the city which would be given to him . In the prophecy , which covers more than a thousand years, Anchises identifies the spirits who will be born as his descendants, from Aeneas' son Silvius to the young Marcellus, and describes how they will win glory and world (...) dominion for Rome. Aeneas sees the spirit of each man as he will appear in life, and hears Anchises' admonition to the Roman who embodies the race, in which he tells him how to rule the world . The speech is stirring, and one would expect that this vision of the future glory of his race would have some effect on Aeneas, but we may ask whether in fact it does. First, consider Aeneas' behaviour during his meeting with Anchises. At their first encounter all he asks is to embrace his father . Next, when he sees the spirits near the river Lethe, he shudders and asks who they are. When Anchises tells him that they are waiting to be reborn and that he is eager to point out his descendants, so that Aeneas will rejoice to have found Italy, Aeneas shows no curiosity about the spirits, but protests against the idea that they should have to leave Elysium and go back to the life of the body. Recognition memory performance reflects two distinct memory processes: a conscious process of recollection, which allows remembering specific details of a previous event, and familiarity, which emerges in the absence of any conscious information about the context in which the event occurred. Slow wave sleep and rapid eye movement sleep are differentially involved in the consolidation of different types of memory. The study assessed the effects of SWS and REM sleep on recollection, by means of the “remember”/”know” paradigm. Subjects studied three (...) blocks of 12 words before a 3-h retention interval filled with SWS, REM sleep or wakefulness, placed between 3 a.m. and 6 a.m. Afterwards, recognition and recollection were tested. Recollection was higher after a retention interval rich in SWS than after a retention interval rich in REM sleep or filled with wakefulness. The results suggest that SWS facilitates the process of recollection in recognition memory. (shrink)

This article analyses the evolution of penalties from Michel Foucault’s philosophy, verifying the departure of torture and giving rise to a disciplinary model. The aim is to find out the forms of power that society has exerted over the 19th century and the transition to ‘biopower’, where the purpose is to control all of society. In Brazil, the shift towards a punitive model becomes evident with the redemocratization that followed the National Constitution of 1988, which recognized the dignity of the (...) human person as the right to be upheld. In this context, the following question arises: Does the common Brazilian penitentiary system serve its corrective purpose? Is there a more effective way to deal with convicts, in terms of reducing recidivism rates? Mario Ottoboni founded the Association for the Protection and Assistance of Convicts (APAC). The present study proposes a study by APAC to answer these questions. APAC is an innovative institution that aims to fulfill the resocializing function of a sentence. This is a possible path for social reintegration. This study employed a deductive approach and was conducted using bibliographical research. (shrink)

The gratiarum actio of the acting consuls can be seen as a key political ritual of the High Empire and as an important aspect of the communication between senatorial aristocracy and princeps. The only surviving speech of this type from this period, Pliny’s Panegyricus, has, however, been judged very differently due to a lack of comparison. In this context, it is often overlooked that although the gratiarum actio of M. Cornelius Fronto has not survived, the Corpus Frontonianum contains both illuminating (...) references to this speech delivered in 142 AD in the absence of the princeps and Antoninus Pius’ reaction to its published version. In his influential article ‘Essence and Modality’, Fine proposes a definition of necessity in terms of the primitive essentialist notion ‘true in virtue of the nature of’. Fine’s proposal is suggestive, but it admits of different interpretations, leaving it unsettled what the precise formulation of an Essentialist definition of necessity should be. In this paper, four different versions of the definition are discussed: a singular, a plural reading, and an existential variant of Fine’s original suggestion and an alternative version proposed (...) by Correia which is not based on Fine’s primitive essentialist notion. The first main point of the paper is that the singular reading is untenable. The second that given plausible background assumptions, the remaining three definitions are extensionally equivalent. The third is that, this equivalence notwithstanding, Essentialists should adopt Correia’s version of the definition, since both the existential variant, which has de facto been adopted as the standard version of the definition in the literature, and the plural reading suffer from problems connected to Fine’s primitive essentialist notion. The most recent (Fifth) revision of the Declaration of Helsinki, adopted in October 2000 by the World Medical Association (WMA), reinforces the longstanding prohibition against offering placebo instead of effective therapy. The WMA left no doubt that if a beneficial treatment for a condition has already been recognised, it is unethical to offer placebo in place of such treatment to anyone in a study of the same condition. We have previously drawn attention to the discrepancy between the spirit of the (...) Declaration and the common practice of using placebo controls in randomised trials even if effective treatment exists. Despite the mandates of the Declaration of Helsinki and concern from ethicists and scientists, the US Food and Drug Administration (FDA) continues to demand and defend placebo‐controlled evidence of efficacy and safety for the development of many new pharmaceuticals, even if effective therapy exists. We suggest that the FDA's arguments defending their practice are insufficient to justify medical research that violates the Declaration of Helsinki. (shrink)

It has been argued that quantum mechanics forces us to accept the existence of metaphysical, mind-independent indeterminacy. In this paper we provide an interpretation of the indeterminacy involved in the quantum phenomena in terms of a view that we call Plural Metaphysical Supervaluationism. According to it, quantum indeterminacy is captured in terms of an irreducibly plural relation between the actual world and various misrepresentations of it.

Gideon Rosen has recently sketched an argument which aims to establish that the notion of metaphysical modality is systematically ambiguous. His argument contains a crucial sub-argument which has been used to argue for Metaphysical Contingentism, the view that some claims of fundamental metaphysics are metaphysically contingent rather than necessary. In this paper, Rosen’s argument is explicated in detail and it is argued that the most straight-forward reconstruction fails to support its intended conclusion. Two possible ways to save the argument are (...) rebutted and it is furthermore argued that the crucial sub-argument only supports a rather particular variant of Metaphysical Contingentism. (shrink)

Vaidya has recently argued that while Husserl’s method for acquiring knowledge of essence through use of our imagination is subject to a vicious epistemic circle, we can still use the method to successfully attain objectual understanding of essence. In this paper, I argue that the Husserlian objectual understanding-based epistemology envisaged by Vaidya suffers from a similar epistemic circularity as its knowledge-based foil. I argue that there is a straight-forward solution to this problem, but then raise three serious problems for an (...) amended version of Vaidya’s proposal and any similar Husserlian epistemology of essence. The paper closes with some general reflections on applying the Husserlian method to the contemporary notion of essence and on the idea of refocusing the epistemology of essence on understanding instead of knowledge. Este artigo, procurou verificar a presença e a influência das correntes filosóficas Marxismo e Fenomenologia em pensamentos do educador Paulo Freire. Neste estudo pôde-se refletir e compreender melhor essas correntes filosóficas e identificar como elas influenciaram o autor na elaboração dos conceitos sobre humanismo e educação. Na Fenomenologia a influência maior está na relação entre mundo/sujeito/coisas, e a busca pela cientificidade da filosofia, afirmando que essa ciência seria capaz de dar as respostas e definitivas aos problemas do conhecimento. No Marxismo (...) encontra fundamento para revelar o antagonismo presente na sociedade capitalista, autora de parte dos problemas sociais do mundo. En este artículo se intenta verificar la presencia y la influencia de la filosofía del marxismo y la fenomenología en el pensamiento del educador Paulo Freire. En este estudio se podría reflejar y comprender mejor estos filosófica e identificar la forma en que influyeron en el autor en la elaboración de los conceptos del humanismo y la educación. La fenomenología es una mayor influencia sobre la relación entre el mundo/sujeto/cosas, y la búsqueda de la filosofía científica, con el argumento de que la ciencia sería capaz de dar respuestas definitivas y los problemas del conocimiento. This paper motivates and defends a principle which captures a systematic connection between essence, truth, and grounding. It says that if a proposition expresses an essential truth, i.e., if it is true in virtue of the nature of some objects, then there are grounds for its truth which involve these objects. Together with the assumption that a fact can only be grounded in facts which are relevant to it, this principle is then applied in an argument against the monotonicity of (...) the Essentialist notion ‘true in virtue of the nature of’. The starting point of this paper is an argument to the conclusion that the definition of metaphysical possibility in terms of correct conceivability, conceivability informed by knowledge of relevant essences, found in Rosen (2006) is equivalent to a version of the essentialist definition of metaphysical necessity. This argument appears to show that correct conceivability is a notion of conceivability by name only and is therefore of no interest to epistemologists of modality. In this paper, I present the equivalence argument, explain (...) the idealizing assumptions involved in it and sketch a version of the conceivability approach which weakens these assumptions in order to show that the notion of correct conceivability can still play a specific limited role in the epistemology of modality. This paper provides an overview of the history of the notion of essence in 20th century analytic philosophy, focusing on views held by influential analytic philosophers who discussed, or relied on essence or cognate notions in their works. It in particular covers Russell and Moore’s different approaches to essence before and after breaking with British idealism, the (pre- and post-)logical positivists’ critique of metaphysics and rejection of essence (Wittgenstein, Carnap, Schlick, Stebbing), the tendency to loosen the notion of logical necessity (...) to accommodate certain metaphysical truths in Wittgenstein and others, Quine’s logical rehabilitation of metaphysics and criticism of de re modality, the modal view of essence promoted by the development of quantified modal logic (C. Divers (2014) argues that a Lewisian theory of modality which includes both counterpart theory and modal realism cannot account for the truth of certain intuitively true modal sentences involving cross-world comparatives. The main purpose of this paper is to defend the Lewisian theory against Divers’s challenge by developing a response strategy based on a degree-theoretic treatment of comparatives and by showing that this treatment is compatible with the theory.

This paper criticizes Soames’s main argument against a variant of two-dimensionalism that he calls strong two-dimensionalism. The idea of Soames’s argument is to show that the strong two-dimensionalist’s semantics for belief ascriptions delivers wrong semantic verdicts about certain complex modal sentences that contain both such ascriptions and claims about the truth of the ascribed beliefs. A closer look at the formal semantics underlying strong two-dimensionalism reveals that there are two feasible ways of specifying the truth conditions for claims of the (...) latter sort. Only one of the two yields the problematic semantic verdicts, so strong two-dimensionalists can avoid Soames’s argument by settling for the other way. (shrink)

In his treatment of the issues raised by the movements of women for equal rights a century ago, Michels anticipated controversies and conflicts about which people care deeply today. He took a clear position in support of the desirability of equality between the sexes. In consequence, it remains relevant to current debates within feminism over equality and difference and the corresponding challenge to, and feminist critique of, social science arising from the (re) emergence of "difference" feminism.Sexual Ethics constitutes both (...) an analysis of the "woman problem" and a document describing the wars between the sexes during this period and an important and overlooked piece of history of the classic sociological tradition. Michels observed that the national and economic conflicts in modern Europe were vast in scale and revealed sharply sensed injustices, and also that sex antagonisms are becoming more acute. He presented an argument, consistent with his theoretical position, about the seriousness of women's rights. Michels' discussions of sexuality, sexual morality, and the relations of the sexes had as its stimulus "the new sexual ethic" advocated by feminists. He pointed out that true equality required equality of rights to sexual liberty for women or chastity prior to marriage for men.Michels supported premarital chastity for men as an ideal, but he doubted that very many would practice it. Michels was virtually alone in the sociological tradition in seeking to illuminate the "struggle for love" between men and women by reference to the "erotic coquetry" in the sexual behavior of "lower animals." Despite his stand for equality of men and women in sexual matters, a recurrent theme in Sexual Ethics is that men are sexually more aggressive than women, at least in part due to social structures and cultural traditions. Michels advocated family planning (but opposed abortion) in the interests of marital and family happiness and economic well-being, especially for the poor.In his new introduction, Terry R. Kandal discusses Robert Michels' life. He explores, among other topics, Michels' treatment of the woman question and the reactions of Michels' contemporaries to the same question. He also discusses the feminist critique of social science, and the place of Michels in and the gender questions of our times. The “Goldwater rule,” a policy adopted by the American Psychiatry Association in 1973, prohibits organization members from diagnosing or offering professional opinions regarding the mental health of public figures without both first-hand evaluation and authorization. Initially developed in response to a controversial survey of APA members during the 1964 Presidential election campaign, the ethics rule faced few large scale challenges until the election of Donald Trump in 2016. Since that time, a significant number of psychiatrists have either violated or criticized (...) the rule openly. This paper argues that whatever the initial merits of the rule, the prohibition has since been rendered obsolete by the combined lack of professional consensus supporting the policy, absence of a meaningful enforcement mechanism, and the credible statements of non-APA members in the mental health professions regarding public figures. The purpose of this introduction is to give a rough overview of the discussion of the formalization of arguments, focusing on deductive arguments. The discussion is structured around four important junctions: i) the notion of support, which captures the relation between the conclusion and premises of an argument, ii) the choice of a formal language into which the argument is translated in order to make it amenable to evaluation via formal methods, iii) the question of quality criteria for such formalizations, (...) and finally iv) the choice of the underlying logic. This introductory discussion is supplemented by a brief description of the genesis of the special issue, acknowledgements, and summaries of each article. (shrink)

The idea that qualities can be had partly or to an intermediate degree is controversial among contemporary metaphysicians, but also has a considerable pedigree among philosophers and scientists. In this paper, we first aim to show that metaphysical sense can be made of this idea by proposing a partial taxonomy of metaphysical accounts of graded qualities, focusing on three particular approaches: one which explicates having a quality to a degree in terms of having a property with an in-built degree, another (...) based on the idea that instantiation admits of degrees, and a third which derives the degree to which a quality is had from the aspects of multi-dimensional properties. Our second aim is to demonstrate that the choice between these account can make a substantial metaphysical difference. To make this point, we rely on two case studies (involving quantum observables and values) in which we apply the accounts in order to model apparent cases of metaphysical gradedness. (shrink)

Two approaches to elevating certain laws of nature over others have come to prominence recently. On the one hand, according to the meta-laws approach, there are meta-laws, laws which relate to laws as those laws relate to particular facts. On the other hand, according to the modal, or non-absolutist, approach, some laws are necessary in a stricter sense than others. Both approaches play an important role in current research, questioning the ‘orthodoxy’ represented by the leading philosophical theories of natural laws—Humeanism, (...) the DTA view, dispositional essentialism and primitivism. This paper clarifies the relations between these two emerging approaches, as well as their applicability to physical laws and the status of the challenges they pose for standard theories of laws of nature. We first argue that, despite some significant similarities between the two approaches (especially in the context of Lange’s counterfactual account of laws), they are in general distinct and largely independent of each other. Then, we argue that the support for meta-laws from physical theory and practice is more questionable than usually presented. (shrink)

A common feature of all standard theories of the laws of nature is that they are "absolutist": They take laws to be either all metaphysically necessary or all contingent. Science, however, gives us reason to think that there are laws of both kinds, suggesting that standard theories should make way for "non-absolutist" alternatives: theories which accommodate laws of both modal statuses. In this paper, we set out three explanatory challenges for any candidate non-absolutist theory and discuss the prospects of the (...) two extant candidates in light of these challenges. We then develop our own non-absolutist theory, the essentialist DTA account, which combines the nomic-necessitation or DTA account with an essentialist approach to metaphysical modality in order to meet the three explanatory challenges. Finally, we argue that the distinction between kinematical and dynamical laws found in physical theories supports both non-absolutism in general and our proposed essentialist DTA view in particular. In a recent paper, Tuomas Tahko has argued for a hybrid view of the laws of nature, according to which some physical laws are metaphysically necessary, while others are metaphysically contingent. In this paper, we show that his criterion for distinguishing between these two kinds of laws — which crucially relies on the essences of natural kinds — is on its own unsatisfactory. We then propose an alternative way of drawing the metaphysically necessary/contingent distinction for laws of physics based on (...) the central kinematical/dynamical distinction used in physical theorising, and argue that the criterion can be used to amend Tahko’s own account, but also that it can be combined with different metaphysical views about the source of necessity.
