The article aims to introduce the issue of legal luck and set the direction for further research on this topic. It contains an answer to the question about the relationship between moral luck and legal luck. Three positions are analyzed. The first one, represented by Arthur Ripstein, says that moral luck and legal luck are autonomous issues. The second one, represented by David Enoch, states that legal luck is the result of applying moral luck to law. The third one, on (...) the contrary, refers to the concept of moral luck as a result of applying legal luck to morality. The author discusses diverse conceptions, indicating their strong and weak points, and finally opts for one of them, which leads to a certain view of further research on legal luck. (shrink)

In the paper, I aim to reconstruct a charitable interpretation of Durkheimian utilitarianism, a normative theory of public morality proposed by well-recognised American moral psychologist – Jonathan Haidt, which might provide reasons to justify particular legal regulations and public policies. The reconstruction contains a coherent theory that includes elements of rule-utilitarianism, value pluralism, objective list theory and perfectionism, as well as references to Emile’s Durkheim views on human nature. I also compare Durkheimian utilitarianism with two similar theories – Brad Hooker’s (...) rule consequentialism and Krzysztof Saja’s institutional function consequentialism. (shrink)

This article aims at presenting to the Polish reader a number of different conceptions of justice in health care, represented by the advocates of liberal egalitarianism. The author has given an overview of the most relevant, influential and representative theories, held by the liberal egalitarians, in order to present the way in which, in a democratic state, both just health care and respect for freedom and moral equality of individuals can be provided. The following issues will be discussed: John Rawls’s (...) theory of justice, Norman Daniels’s theory of justice including health possibilities, varieties of luck egalitarianism, Ronald Dworkin’s “prudent insurance” ideal, Elizabeth Anderson’s democratic egalitarianism, a family of theories of egalitarianism of all kinds of luck and the theory of Shlomi Segall. In the opening remark of Nicomachean Ethics VIII 1 Aristotle notices that the next step would be a discussion of philia, since it is a certain aretē or is associated with aretē (NE VIII 1 1155a 1–2). This article is an attempt to determine how the real object of philia and aretē are related from Aristotle’s point of view. The author performs a study into two sections. The first section is focused on the analysis of aretē and its various types, (...) in particular the human one. The second section is concentrated on the typology of philia, namely friendship and its particular kinds. The author shows that the relation between philia and aretē can be described in two ways: if both philia and aretē play the crucial role in leading a eudaimonic life, then philia is the aretological friendship and aretē—the human one, namely the whole consists of the aretē of character in the full sense and the practical wisdom on condition that the aretological friends equate eudaimonia with life focused on the political or practical activity, or even of the theoretical wisdom, providing that they identify it with the highest form of eudaimonic life, that is, the theoretical one. If, however, philia is to be a term said in many ways (pleonachōs legetai) and aretē is to be understood in a broad sense, that is, as “being good at something”, then philia can signify every kind of friendship, namely the aretological, the hedonistic and the utilitarian one, whereas aretē—qualification or skill that makes these friendships perform their functions well. The first possibility is that the relation between philia and aretē is limited to the aretological friendship at the expense of narrowing the meaning of aretē to the human one. The second possibility is that every kind of friendship is considered as the functional thing and, in consequence, defined by their proper function. From this point of view, all friendships are accompanied by appropriate aretai, namely by qualifications or skills that guarantee the perfect fulfillment of their proper function and, therefore, the achievement of the set goal by two persons in question. This paper differentiates between two readings of Aristotle’s argument that unity and being are not “genē” (UBANG for short). On the first reading – proposed by commentators such as Ackrill, Shields, Loux, and McDaniel – UBANG entails the proposition that there are no features that characterise all beings insofar as they are, referred to by its contemporary proponents, including McDaniel, as ‘ontological pluralism’. On the second reading – proposed here – UBANG does not entail this proposition. The paper argues that (...) only on the second reading does Aristotle’s argument secure its conclusion, that the second reading is, in fact, the correct reading of UBANG, and that anyone who thinks that UBANG succeeds and entails ontological pluralism probably equivocates between two different senses of ‘genos’. This paper explores the wandering during the Night of Culture, which I consider an essential practice for the people's experience of this event. Looking at this particular form of movement of those participating in this initiative between various event locations also allows us to see the implications of the Night of Culture for urban public spaces. The empirical base of the paper is the visual documentation of the events carried out during the Night of Culture during the 2023 edition. While (...) interpreting the material, I refer to the situationist theory of drift and then reconstruct the structure of the festival's wandering, its rhythm, the type of attention bestowed on the city by the participants, and the form of this ephemeral community. In conclusion, I propose that the atmosphere of places can be used to analyse the city-forming effects of the Night of Culture, to grasp better the specificity of the event and its risks and potentials. Staram się podjąć z Witkiewiczem „dialog” niepozbawiony elementów krytycznych i odniesień do współczesnego stanu badań. Traktuję więc jego propozycję filozoficzną nie jako obiekt jedynie muzealny, ale żywą myśl, z którą można i należy dziś podjąć dyskusję. Wynika to z przeświadczenia, że myślenie filozoficzne stanowi kontinuum i „rozmowa” z filozofami przeszłości może wnieść sporo do badań prowadzonych obecnie. System stworzony przez Witkiewicza nie był nigdy projektem jednorodnym, jego badania stanowiły raczej splot wątków, trudno jest wskazać jedno, dominujące zagadnienie. Jeśli jednak miałbym (...) wymienić taki leitmotiv jego filozofii, to byłby to problem istnienia ożywionego, upsychicznionego i cielesnego bytu, jakim jesteśmy my sami, a w przekonaniu Witkiewicza również wszystkie inne byty, z których składa się materia (stąd tylko pozornie) nieożywiona. Zawężając zakres tego zagadnienia, dochodzimy do klasycznego problemu psychofizycznego w wersji jednak dość oryginalnej z racji wspominanego odrzucenia materii martwej. O ciągłym zainteresowaniu problemem stosunku ciała do umysłu świadczy tytuł ostatniej większej rozprawy filozoficznej Witkiewicza: Zagadnienie psychofizyczne. Prezentowana praca jest próbą pokazania drogi, którą przebył polski filozof, poszukując odpowiedzi na pytanie o problem psychofizyczny, aż do swoistej wersji cielesno-biologicznego panpsychizmu. We study a class of finite models for the Lambek Calculus with additive conjunction and with and without empty antecedents. The class of models enables us to prove the finite model property for each of the above systems, and for some axiomatic extensions of them. This work strengthens the results of [3] where only product-free fragments of these systems are considered. A characteristic feature of this approach is that we do not rely on cut elimination in opposition to e.g. [5], (...) [9]. (shrink)

Książka ta jest poświęcona analizie filozofii politycznej Johna Deweya osadzonej w kontekście kryzysu liberalizmu po pierwszej wojnie światowej. Jedną z dróg wyjścia z impasu, w jakim znalazła się myśl liberalna, był radykalny liberalizm reprezentowany przez takich intelektualistów, jak John Dewey, Bertrand Russell, Karl Polanyi i Karl Mannheim. Wymienieni myśliciele upatrywali szans na odrodzenie liberalizmu w odrzuceniu koncepcji wolnorynkowych i dialogu z myślą socjalistyczną. W pracy przedstawiono zręby ideologii radykalnego liberalizmu oraz stosunek lewicowych liberałów do innych ideologii, w szczególności zaś do (...) liberalizmu ekonomicznego i rewolucyjnego marksizmu. Osobny rozdział pracy poświęcony jest refleksji Johna Deweya na temat demokracji, która należy do najoryginalniejszych osiągnięć amerykańskiego filozofa. Przedstawiona interpretacja uwypukla związki myśli Johna Deweya z radykalizmem Nowej Lewicy oraz twórczością takich teoretyków, jak C. W. Mills Axell Honneth czy James Bohman. Drugim ważnym obszarem podejmowanych w pracy rozważań jest rekonstrukcja Deweyowskiej koncepcji myślenia jako rozwiązywania problemów. Pragmatyzm utrzymuje, że możliwe jest znalezienie mniej lub bardziej obiektywnych odpowiedzi na pytanie, co należy robić w danej problematycznej sytuacji. „Pragmatyczne oświecenie”, by posłużyć się terminem Hilarego Putnama, wyrzeka się oświeceniowego uniwersalizmu, ale nie rezygnuje całkowicie z roszczeń do obiektywności w dziedzinie rozstrzygnięć moralnych i politycznych. The present article analyzes Photius'Lexiconand Eustathius of Thessalonica'sCommentarii ad Homeri Iliademin order to trace the history and reconstruct the recipe of a dish called kandaulos/kandylos. It was a Greek delicacy, which appears to have been developed in Lydia before the middle of the VI th c. B.C. It is known to have been named after king Candaules, who ruled the Lydian territory in the VII th c. B.C. The dish was (via the Ionians) borrowed by the Helens and established itself (...) in Greece sometime in the V th c. B.C. It became popular in the Hellenistic periodThe testimony provided by Photius and Eustathius of Thessalonica contributes to our better knowledge of two varieties ofkandaulos/kandylos. The first was savoury and consisted of cooked meat, stock, Phrygian cheese, breadcrumbs and dill (or fennel). The other included milk, animal fat, cheese and honey. The dish is reported to have been costly, prestigious and indicated the social status of those who would eat it.Though there is much evidence suggesting its popularity in antiquity, we lack any solid proof thatkandaulos/kandyloswas eaten in Byzantine times. The aim of this paper was to analyze the relationship between attitudes toward physical activity and participation in water sports events and to recognize the main motives for involvement in these kinds of events. A written paper–pencil diagnostic survey was conducted among 394 participants in two traditional and two modern sports events on water held in Poland to ascertain whether innovative events are needed in society, and whether they cause an increase in interest in physical activity. The research results showed (...) that modern sports events on water did not have any more power to attract physically inactive people than traditional water events, did not produce a greater desire to lead an active lifestyle, and did not encourage people to more regularly practice water sports. Moreover, modern events, compared to traditional events, were only a one-time experience and the people who completed survey often wanted to return to traditional sports events which provided participants with greater positive emotions than a modern event. In the case of socio-demographical variables, there was no statistically significant relationship between gender and choice of modern or traditional event, but older people were more likely to choose a traditional event than younger people; modern water events were an attractive option primarily for young people under 30 years of age, furthermore, modern events more often attracted people who had completed higher education. However, it turned out that a modern event on water often attracted more people who had had no experience in this sport discipline rather than people who chose traditional water events. In a sense, modern events are therefore effective in promoting water sports in Polish society. We also distinguished five main groups of participants: healthy lifestyle managers, lovers of sports emotions, water sports malcontents, water sports enthusiasts, and neutrals to water sports. Additionally, we looked into gender-related motives for participation in modern and traditional water events: social and health-related motives proved to be more important for women and men who participated in modern water events. The research results presented in the article expand on the current state of knowledge about mass participation in sport, the impact of sporting events on the promotion of physical activity, and show the motivation behind participation in modern and traditional water sporting events. This paper discusses three different contemporary uses of philosophy and literature in non-philosophical and non-literary texts. Most often, both discourses are used as tools, and they are invoked instrumentally in popularizing literature or in teaching. Philosophy and literature can also be treated as a source or starting point for reflection outside its mother field, or even as a cause of various social and political processes. The most interesting usage of both discourses is to refer to them as the symptoms or (...) signs of the times allowing us to make diagnoses about the present. These uses of the two discourses show the similarities between literature and philosophy on a purely pragmatic level that is relevant to their contemporary functioning in a non-specialist sphere. The convergence in this regard is a testimony to the transformation of the position of both discourses in the contemporary humanities involving the loss of their privileged position. At the same time, literature and philosophy in this crisis situation are gaining new areas of influence in public discourse, realizing their cognitive and reflexive potential through their utilitarian use. This paper is a reflection on the legitimacy of commonly accepted opposition of the notions of “capitalism” and “socialism”. The leading thesis is that although they can be considered as antinomies, their real referents should not be treated analogously. Capitalism, as understood by its very name, emerged in the second half of the 19th century and evolved constantly from this moment, often changing its main features. Socialism, in contrast, was created as a notion opposing the capitalistic reality of the 19th (...) century. Yet it never really existed in this form. The actual economic system, referred to as “socialism”, was in fact a hybrid of capitalism and neo-feudal bureaucracy. (shrink)

In the first Critique, Kant raises two objections against Aristotle’s categories. Kant’s concern, in the first instance, is whether Aristotle generated all categories that there are and if he did not generate any spurious categories. However, for Kant, this is only a symptom of the second – deeper – flaw in Aristotle’s thinking. According to Kant, Aristotle generated his categories ‘on no common principle.’ This paper develops the two Kantian objections, offers an overview of Brentano's (1862. Von der Mannigfachen Bedeutung (...) des Seienden nach Aristoteles. Freiburg im Brisgau: Herder’sche Verlagshandlung.) reconstruction of Aristotle’s categories (which claims to have addressed them), develops three objections to this reconstruction, and recommends (Trendelenburg, A. 1846. Efforts to ban Autonomous Weapon Systems were both unsuccessful and controversial. Simultaneously the need to address the detrimental aspects of AWS development and proliferation continues to grow in scope and urgency. The article presents several regulatory solutions capable of addressing the issue while simultaneously respecting the requirements of military necessity and so attracting a broad consensus. Two much stricter solutions – regional AWS bans and adoption of a no first use policy – are also presented as fallback strategies in case (...) achieving AWS’ compliance with the Laws of Armed Conflict proved elusive. Together, the solutions presented form an outline of a flexible regulatory strategy able to adjust to different technological outcomes and providing a sensible compromise to solve the current deadlock on the AWS issue. In order to solve a system of nonlinear rate equations one can try to use some soliton methods. The procedure involves three steps: find a ‘Lax representation’ where all the kinetic variables are combined into a single matrix \, all the kinetic constants are encoded in a matrix H; find a Darboux–Bäcklund dressing transformation for the Lax representation \]\), where f models a time-dependent environment; find a class of seed solutions \ that lead, via a nontrivial chain of dressings \ (...) to new solutions, difficult to find by other methods. The latter step is not a trivial one since a non-soliton method has to be employed to find an appropriate initial \. Procedures that lead to a correct \ have been discussed in the literature only for a limited class of H and f. Here, we develop a formalism that works for practically any H, and any explicitly time-dependent f. As a result, we are able to find exact solutions to a system of equations describing an arbitrary number of species interacting through catalytic feedbacks, with general time dependent parameters characterizing the nonlinearity. Explicit examples involve up to 42 interacting species. (shrink)

The article aims at addressing the question of representations of World War Two in Croatian and Serbian literature that were subversive in the sense that they queried the legend not simply by rejecting communism and affirming nationalism, but by emphasizing the uncertainty and sensibility of the human beings, a typical modern reaction to violence and, in general, modernist topoi. In this article I will focus on modernist novelistic representations of the 1960s in which the uncertainty and instability of collective warrants (...) are foregrounded. As a result a subversive meaning is produced which contradicts not only communism and revolution but more generally war as such, including the universal features of war such as confronting loneliness, love as an expression of an individual rather than a collective sense of existence, and the impossibility of a valid representation of past events. In this article, I consider the cases of religious Moorean propositions of the form ‘d, but I don't believe that d’ and ‘d, but I believe that ~d’, where d is a religious dogma, proposition, or part of a creed. I argue that such propositions can be genuinely and rationally asserted and that this fact poses a problem for traditional analysis of religious assertion as an expression of faith and of religious faith as entailing belief. In the article, I explore (...) the possibility of undermining these commonly held assumptions and argue that the assertability of religious Moorean propositions can be justified by an account of faith as an intention to form religious beliefs. In the end, I also consider the consequences of such a stance, especially concerning the debate on the ethics of religious belief and doxastic voluntarism. (shrink)

In this paper we present a solution to Saul Kripke’s Puzzle About Belief Meaning and use, Dordrecht, 1979) based on Kaplan’s metaphysical picture of words. Although it is widely accepted that providing such a solution was one of the main incentives for the development of Kaplan’s theory, it was never presented by Kaplan in a systematic manner and was regarded by many as unsatisfactory. We agree with these critiques, and develop an extension of Kaplan’s theory by introducing the notion of (...) “conservative” word uses, as well as arguing for the restriction of Kripke’s Disquotational Principle only to such uses. This restriction allows us to solve Kripke’s Puzzle by arguing that the assent of the puzzle’s protagonist does not allow disquotation and ascription of corresponding inconsistent belief, as it contains the non-conservative use of a proper name. At the end of the paper, we defend two of Kaplan’s theses that we find essential for our argument to work: that individuation of word tokens involves taking into account the intention of the speaker, and that different uniquely referring proper names of the same shape should be regarded as different homonymous words. Emotion Review, Volume 14, Issue 2, Page 132-160, April 2022. Autonomic nervous system activity is a fundamental component of emotional responding. It is not clear, however, whether positive emotional states are associated with differential ANS reactivity. To address this issue, we conducted a meta-analytic review of 120 articles, measuring ANS activity during 11 elicited positive emotions, namely amusement, attachment love, awe, contentment, craving, excitement, gratitude, joy, nurturant love, pride, and sexual desire. We identified a widely dispersed collection of studies. Univariate (...) results indicated that positive emotions produce no or weak and highly variable increases in ANS reactivity. However, the limitations of work to date – which we discuss – mean that our conclusions should be treated as empirically grounded hypotheses that future research should validate. (shrink)

Piotr Kropotkin był najważniejszym przedstawicielem tzw. darwinizmu rosyjskiego oraz teorii pomocy wzajemnej, która podkreślała znaczenie współpracy wewnątrzgatunkowej w procesie doboru naturalnego oraz walki o byt. Na jej kanwie rosyjski badacz wysunął tezę o ewolucyjnych źródłach moralności, będącej problem badawczym w niniejszym artykule. Stanowi to jednocześnie powód dlaczego poza przedstawieniem wspomnianej tezy i jej założeń, w publikacji zilustrowana została także teoria pomocy wzajemnej. Zaproponowana przez Kropotkina wizja moralności suponowała, iż stanowi ona „przyrodzoną” właściwość ludzkiej natury. Podstawę dla niej stanowić ma instynkt (...) społeczny oraz jego przejawy, takie jak: równość, solidarność, sprawiedliwość, itd., a także pomoc wzajemna. Stawiało to propozycję rosyjskiego darwinisty w opozycji wobec dominujących trendów w myśleniu o ludzkiej moralności na przełomie XIX i XX wieku, zwłaszcza wobec tzw. darwinizmu społecznego i charakterystycznego dlań dualizmu moralnego. Ponadto zrywała z antropocentryzmem zakładając, iż poza gatunkiem ludzkim, także inne gatunki cechują się uczuciami moralnymi. (shrink)

Muslims are a marginal minority in Poland, but research shows that they are often subject to negative perceptions and hostility from the majority. Orientalist stereotypes about Islam and the people associated with it are widespread and often reproduced in the media. Research from North America and the European Court of Human Rights suggests that such prejudices can affect the adjudication of cases involving Muslims. It may be presumed that Poland is no exception to that, and this assumption was the starting (...) point for our empirical study. To date, there have been no studies on the perception of Muslims and Islam in the Polish legal system. This article presents the results of a qualitative thematic analysis of 57 judicial opinions issued by the common courts in Poland and published online, in which Islam or being Muslim was mentioned. The cases were categorised and texts of the judicial opinions closely analysed (with computer-assisted qualitative data analysis software) to identify recurring themes. The findings of this first exploratory study show that stereotypical representations and the “‘Othering” of Muslims do indeed occur in Polish courts, with some judges repeating Orientalist tropes that have become normalised in Polish society. In this paper, I analyze the semantics of the first person pronoun “I” from the perspective of the user/producer distinction. In the first part of the paper, I describe the Simple View and propose three interpretations of its thesis. In the second part, I analyze the notions of use and production of a linguistic token. In the next part, I show that all of the interpretations of SV are sensitive to counterexamples. In the end, I discuss possible answers of the (...) proponents of SV and argue against them. The first aim of this paper is to show that SV is wrong, and the second is to convince the reader that the user/producer distinction is of high importance in the philosophy of language. (shrink)

The aim of this paper is to argue in favor of the view that some counterpossibles are false. This is done indirectly by showing that accepting the opposite view, i.e., one that ascribes truth to each and every counterpossible, results in the claim that every necessarily false theory has exactly the same consequences. Accordingly, it is shown that taking every counterpossible to be true not only undermines the value of debates over various alternative theories and their consequences, but also puts (...) into question the very possibility of such debates. In order to explicate this thesis, the close bond between counterpossibles and the so-called story prefix is explored. A number of possible responses to this criticism are also presented, and it is argued that none of them address the main problem. (shrink)

Just War Theory debates discussing the principle of the Moral Equality of Combatants involve the notion of Invincible Ignorance; the claim that warfi ghters are morally excused for participating in an unjust war because of their epistemic limitations. Conditions of military deployment may indeed lead to genuinely insurmountable epistemic limitations. In other cases, these may be overcome. This paper provides a preliminary sketch of heuristics designed to allow a combatant to judge whether or not his war is just. It delineates (...) the sets of relevant facts uncontroversially accessible and inaccessible to contemporary professional soldiers. Relevant facts outside these two sets should by default be treated as inaccessible until proven otherwise. Even such a rudimentary heuristic created in this way demonstrates that practical recommendations of MEC-renouncing Just War Theory are not too challenging to follow and still signifi cantly impact a compliant combatant’s behavior.
