This paper examines the problems that may arise, particularly for military personnel, when the requirements of doing one's duty seem to come into conflict with the demands of loyalty. This conflict is especially problematic because loyalty is often seen, especially by serving military personnel, as the highest of military virtues. The paper introduces a categorisation of ethical issues into two main types, which are referred to as ‘ethical dilemmas’ and ‘tests of integrity’ which is then used to clarify the issues (...) involved when duty and loyalty come into conflict. It is argued that a true understanding of loyalty and disloyalty means that the demands of loyalty can never legitimately override a genuine duty to follow orders. (shrink)

Thought experiments are profitably compared to compasses. A compass is a simple but useful device for determining direction. Nevertheless, it systematically errs in the presence of magnets ...it becomes unreliable near the North Pole, in mine shafts, when vibrated, in the presence of metal ...experts will wish to use the compass as one element in a wider portfolio of navigational techniques. Analogously, thought experiments are simple but useful devices for determining the status of propositions. Ectogenesis, the gestation of the foetus outside of the human body, will not for much longer be in the realm of science fiction; a number of projects attempting to develop ectogenetic technology are currently under way. This book examines the ethical implications of the development of ectogenesis. Examining the implications for abortion ethics in particular, this book also deals with the ethical objections to developing such a technology and the uses to which it may be put, such as creating embryos (...) to supply donor organs for transplantation. It has been suggested by many philosophers that the cosmos cries out for explanation. They base this claim on the fact that many of the fundamental characteristics of the cosmos seem to have to be incredibly ’fine-tuned’ to permit the existence of intelligent life. They further claim from this ’fine-tuning’ that the cosmos is highly improbable, and thus requires an explanation. In recent times, these views have been criticized by writers, such as Quentin Smith, who suggest that no explanation for (...) the universe is really required at all, that the universe just is. I wish in this paper to criticize this view, for I believe that we have reached a point in our history where the only defensible way to maintain that the universe requires no explanation at all, is to suggest that intelligent life is in no way special. This paper discusses privacy and the monitoring of e-mail in the context of the international nature of the modern world. Its three main aims are: (1) to highlight the problems involved in discussing an essentially philosophical question within a legal framework, and thus to show that providing purely legal answers to an ethical question is an inadequate approach to the problem of privacy on the Internet; (2) to discuss and define what privacy in the medium of the Internet actually is; (...) and (3) to apply a globally acceptable ethical approach of international human rights to the problem of privacy on the Internet, and thus to answer the question of what is and is not morally permissible in this area, especially in light of recent heightened concerns about terrorist activities. It concludes that the monitoring of e-mail is, at least in the vast majority of cases, an unjustified infringement of the right to privacy, even if this monitoring is only aimed at preventing the commission of acts of terrorism. From its earliest beginnings, American conditioning research using human subjects had to deal with the possibility that subjects might voluntarily control the reaction that the experimenter attempts to condition, with the result that voluntary control contaminates the study of conditioning in humans. A preliminary solution to the problem was achieved around 1940, ending the time frame of this survey. This article provides an historical survey of the conceptual background of the opposition of volition and reflexes; describes manifestations of the problem (...) in conditioning research; and critically examines earlier efforts to solve the problem as well as the presumptive solution that disposed of the issue by 1940. When the benefits of surgery do not outweigh the harms or where they do not clearly do so, surgical interventions become morally contested. Cutting to the Core examines a number of such surgeries, including infant male circumcision and cutting the genitals of female children, the separation of conjoined twins, surgical sex assignment of intersex children and the surgical re-assignment of transsexuals, limb and face transplantation, cosmetic surgery, and placebo surgery.

Vantassel Eugene, OR: Resource, 2009. 232pp. $26.00In Dominion over Wildlife?, Stephen Vantassel, a scholar with professional experience in animal damage control, provides a substantive examination of the neglected subject of human–wildlife relations. For this, he is to be commended. Although ultimately (...) disappointing, his argument indicates that much work remains to be done in this area.Vantassel’s subtitle is somewhat misleading since he devotes the bulk of the book to a polemic against a small group he terms “Christian Animal Rights (CAR) activists”—especially Anglican theologian Andrew Linzey and his followers—who question the idea that God grants humans dominion over creation (“Dominionism”), including the moral right to manage, kill, and eat animals. “The critical question... is whether CAR activists are correct in their belief that Scripture exhorts us to adopt a vegetarian and non-violent stance toward animals” (14). Vantassel’s response is more exegetical than theological, and in the mode of conservative evangelical apologetics, he devotes chapters to refuting CAR activists’ appeals to the Old Testament (specifically the covenant of Creation, the narratives of the Fall and Noah, the sacrificial system, and passages that support humane treatment of animals); the New Testament (Christ’s concern for animals, a Christus Victor view of the atonement, and an Edenic eschatology); ethics (compassion, restraint, and stewardship); and science (a case study of whether trapping is unnecessarily cruel and environmentally irresponsible). Only in the final chapter does he propose his model of “Shepherdism,” which “avoids the negative stereotypes held against Dominionism, while upholding God’s decree that humans maintain their superintendence over animals” (160). Shepherdism centers on the principles that creation is “God’s property,” that humans are charged with being its caretakers, and that Christ is a model for behavior toward it. Vantassel insists that humans should treat wildlife humanely and not exterminate species.For Vantassel, theology is a matter of individuals—largely apart from church or tradition—reading an inerrant Bible to discern God’s commands. Likewise, ethics is a matter of individuals using reason to construct arguments that “stand on their own merits” and “may still be sufficient to persuade, if not compel, Christian behavior even if Scripture does not mandate the behavior” (99). This [End Page 193] is not the forum for criticizing these approaches, but they not only distance Vantassel’s argument from scholarship in the field—which he does not engage—but also make it unlikely that it will persuade those who do not read the Bible or view God in the same way. To note two examples, on the basis of Amos 4, he contends that “some environmental problems are caused not through our direct abuse of the land but through our disobedience, which God then punishes through sending environmental catastrophes” (165n13), and on the basis of Christ’s acceptance of fishing with nets (Luke 5:4), he contends that “Christians are permitted to not only eat animals, they may employ means to capture them that will cause pain and injury” (171). Indeed, as a lifelong hunter who shares Vantassel’s basic position, I found myself more sympathetic to the CAR activists’ arguments toward which he is frequently uncharitable; he associates them with Darwinism and feminist and liberation theologies, labels their hermeneutics “modernistic” for stressing narrative, and variously calls their ideas “absurd,” “incredulous,” and “strange.”Vantassel discusses a number of helpful statistics and studies, and he rightly points out the problems posed by factory farming, the disproportionate effects of environmental degradation on the poor, and the practical difficulties of vegetarianism. Jules Coleman, one of the world's leading philosophers of law, here presents his most mature work so far on substantive issues in legal theory and the appropriate methodology for legal theorizing. In doing so, he takes on the views of highly respected contemporaries such as Brian Leiter, Stephen Perry, and Ronald Dworkin.

In this article I discuss a number of issues raised by Professor Jules Coleman's recent article "Beyond the Separability Thesis." I suggest, to begin, that Coleman is correct that neither a narrow nor a broad formulation of the separability thesis takes us very far towards a robust distinction between legal positivism and legal non-positivism. I then offer a brief discussion of methodology in jurisprudence, suggesting that Coleman accepts, at least implicitly, what I call a "methodology of necessary (...) features." Since there is reason to think that law possesses some necessary features that are non-normative (or descriptive) and others that are moral in character, the promise of this pluralistic approach is that it will be capable of bridging the gap between so-called "descriptive" and "normative" theories of methodology in jurisprudence. Since the distinction between descriptive and normative methodological theories is sometimes taken to be one way, among others, of drawing a distinction between positivist and non-positivist theories of law, the pluralism of the "methodology of necessary features" gives us yet one more reason to think that the distinction between positivism and non-positivism is not a theoretically fundamental one. Finally, I discuss Coleman's "moral semantics claim," i.e., the idea that "legal content is best understood as moral directives about what is to be done and who is to decide what is to be done." Coleman acknowledges that the moral semantics claim, when taken together with the social facts thesis, raises a well-known problem: How can social facts create content-independent reasons for action? I suggest that we are most likely to find the answer to this question by focusing directly on whether or not law's claimed moral authority—meaning its claimed moral power—can be justified, rather than by focusing indirectly, as many theorists have done, on the existence or non-existence of a general obligation to obey the law. Though some of the critical reviews of Frank M. Coleman's Hobbes and America have alluded to the affinities of his work to that of Strauss, Macpherson, Laslett, and Oakeshott, most have ignored Coleman's specifically philosophic treatment of Hobbes as the foundational thinker most responsive to political realities which emerge in the seventeenth century and still characterize American politics. Coleman's purpose is to demonstrate how the operative American constitutional philosophy can be recognized clearly only when understood in the (...) context of its Hobbesian origins. But, Coleman suggests, this does not necessarily exclude the possibility of gaining insight into the thought of Hobbes, Locke, and Madison in virtue of reflection on contemporary American political experience. A Brief History of Time: From the Big Bang to Black Holes is a popular-science book on cosmology (the study of the origin and evolution of the universe) by British physicist Stephen Hawking. It was first published in 1988. Hawking wrote the book for readers who have no prior knowledge of the universe and people who are interested in learning.

This review begins with a detailed focus on the Turnaway Study, which addresses associations among early abortion, later abortion, and denied abortion relative to various outcomes including mental health indicators. The Turnaway Study was comprised of 516 women; however, an exact percentage of the population is not discernable due to missing information. Extrapolating from what is known reveals a likely low of 0.32% to a maximum of 3.18% of participants sampled from the available the pool. Motivation for conducting the Turnaway (...) Study, methodological deficiencies (sampling issues and others), and bias are specifically addressed. Despite serious departures from accepted scientific practices, journals in psychology and medicine have published dozens of articles generated from the study’s data. The high volume of one-sided publications has stifled dialogue on potential adverse psychological consequences of this common procedure. Following a critical analysis of the Turnaway Study, an overview of the strongest studies on abortion and mental health is offered. This comprehensive literature comprised of numerous large-scale studies from across the globe has been largely overlooked by scientists and the public, while the Turnaway Study dominates the media, information provided to women, and legal challenges involving abortion restrictions. In the final section of this article, literature reviews by professional organizations are considered, demonstrating that the biased science characterizing the Turnaway Study is aligned with a pervasive and systemic phenomenon wherein deriving reliable and valid results via careful attention to methodology and scrutiny by the scientific community have been supplanted by politics. A comprehensive reassessment of the concept of mimesis in the history of ancient Greek aesthetics and philosophy of art, with particular attention to Plato, Aristotle, Hellenistic philosophy, and neoplatonism. There is also a wide-ranging review of arguments pro and contra the idea of artistic mimesis from the Renaissance to modern literar theory. The book challenges standard accounts in numerous respects and builds a new dialectical model with which to make sense of the entire history of mimeticist thinking in aesthetics.

This article examines the (bio) ethical and professionalism issues that may arise in the context of medical practice in low and middle income countries (LAMIC), and the challenges this poses for medical regulatory bodies in the regions, in upholding ethics in professional practice. A quadrangle of source of the problems given rise to the breach of ethics in medical practice is identified, and suggested steps, based on ethical principles and concept, is proposed towards the resolution of the problems presented. LAMIC progress to improve the health of its population, this endeavour should occur hand in hand with contemporary medical ethics theories, taking in context the region’s ethnographic and cultural beliefs and practices. Aboutness has been studied from any number of angles. Brentano made it the defining feature of the mental. Phenomenologists try to pin down the aboutness-features of particular mental states. Materialists sometimes claim to have grounded aboutness in natural regularities. Attempts have even been made, in library science and information theory, to operationalize the notion. But it has played no real role in philosophical semantics. This is surprising; sentences have aboutness-properties if anything does. Aboutness is the first book to examine through (...) a philosophical lens the role of subject matter in meaning. A long-standing tradition sees meaning as truth-conditions, to be specified by listing the scenarios in which a sentence is true. Nothing is said about the principle of selection--about what in a scenario gets it onto the list. Subject matter is the missing link here. A sentence is true because of how matters stand where its subject matter is concerned. Stephen Yablo maintains that this is not just a feature of subject matter, but its essence. One indicates what a sentence is about by mapping out logical space according to its changing ways of being true or false. The notion of content that results--directed content--is brought to bear on a range of philosophical topics, including ontology, verisimilitude, knowledge, loose talk, assertive content, and philosophical methodology.
