Autonome Personen haben ein zentrales, von ihrem Anspruch auf Wahrung ihrer Menschenwürde geschütztes Interesse daran, „ihren” Tod sterben zu können. Aus diesem geschützten Interesse resultieren Dispositionsbefugnisse über das eigene Sterben, die auch das Recht beinhalten, sich hierzu der freiwillig geleisteten Hilfe Dritter zu bedienen. (...) Soweit das Argument eines möglichen Missbrauchs erlaubter aktiver Sterbehilfe ernst zu nehmen ist, stehen wir jedoch einer unausweichlich dilemmatischen Entscheidung gegenüber, die das bisherige Verständnis des Menschenwürdeprinzips des Grundgesetzes in Frage stellt. Legal restrictions of the right to self-determination increasingly pretend to be compatible with the liberal concept of autonomy: they act upon a ‘soft’ or autonomy-orientated paternalistic rationale. Conventional liberal critique of paternalism turns out to be insensitive to the intricate normative problems following from ‘soft’ or ‘libertarian’ paternalism. In fact, these autonomy-oriented forms of paternalism could actually be even more problematic and may infringe liberty rights even more intensely than hard paternalistic regulation. This paper contributes to the systematic differentiation of (...) soft and hard paternalism by discussing the (legal) concept of autonomy and elaborates the moral and legal limits of autonomy-orientated paternalism. Definition of the problem. Voluntary active euthanasia is, in certain circumstances, morally permissible and should be permitted by law. Autonomous persons may have a fundamental interest in experiencing ”death in dignity” in accordance with their own preferences. This interest is protected by the concept of human dignity assumed by German law. Some prerequisites being met, the moral and legal autonomy right to determine the time and manner of one’s own death includes a right to secure active euthanasia from a willing (...) physician, and a physician’s acceding to the patient’s request be may morally the right thing to do. Arguments and conclusion: Most arguments against the justifiability of voluntary active euthanasia unveil their weakness when scrutinized. However, insofar as legalized voluntary active euthanasia would be subject to intolerable abuse, our policy options are dilemmatic, and the concept of human dignity as it has been taken for granted in German legal discourse, is questioned. There is no option other than seeking safety in legal procedures for every single case. (shrink)

During the last two decades a broad and intensive discussion has taken place in the field of medical ethics. Especially in the English-speaking countries, “Biomedical Ethics” have developed as a part of secular, philosophical moral theory. Two ethical problems in organ transplantation – living organ donation and organ allocation – illustrate that this transition reflects both the complex ethical questions raised by rapid changes in the biological sciences and in health care, and the fact that traditional Hippocratic ethics have proven (...) to be inadequate in several respects. The notion of human dignity fulfils different normative functions, making demands on heterogeneous resources for justification. After a short summary of Kant’s concept of dignity and its meta-ethica/ content which defines “Kantianism”, we will deal with three problematic aspects of the Kantian concept of dignity and provide a sketch of its reception in the German Constitution. Then we will present an ascriptivistic concept as an alternative to the Kantian one and discuss its limitations.

Medical law and Biopolitics shed specific light on the relationship of subject and power/violence in legal contexts. For our species, medicine is an essential endeavour vis-à-vis nature which is „red in tooth and claw“. Medicine, however, is driven by autopoietic systemic imperatives and marked by relations of domination. Guaranteeing robust individual rights and legal powers is a remedy against both.

Dealing with the reform of the Transplantation Law, the first issue of the new rubric “Philosophie aktuell” met with strong and lively interest from our readers. Subsequent to this discussion a growing number of reports were published dealing with violations of mandatory rules of conduct in transplantation medicine. Therefore the topic is revisited here from the slightly different vantage point “organ transplantation II: elucidation and confidence”.

Service-Robotic—mainly defined as “non-industrial robotics”—is identified as the next economical success story to be expected after robots have been ubiquitously implemented into industrial production lines. Under the heading of service-robotic, we found a widespread area of applications reaching from robotics in agriculture and in the public transportation system to service robots applied in private homes. We propose for our interdisciplinary perspective of technology assessment to take the human user/worker as common focus. In some cases, the user/worker is the effective subject (...) acting by means of and in cooperation with a service robot; in other cases, the user/worker might become a pure object of the respective robotic system, for example, as a patient in a hospital. In this paper, we present a comprehensive interdisciplinary framework, which allows us to scrutinize some of the most relevant applications of service robotics; we propose to combine technical, economical, legal, philosophical/ethical, and psychological perspectives in order to design a thorough and comprehensive expert-based technology assessment. This allows us to understand the potentials as well as the limits and even the threats connected with the ongoing and the planned implementation of service robots into human lifeworld—particularly of those technical systems displaying increasing grades of autonomy. Ist Leben mehr als eine Leistung „natürlicher Systeme“? Wie unterscheiden sich Lebewesen von Artefakten? Lassen sich Lebewesen genauso herstellen wie Maschinen? Diese Fragen werden mit dem Siegeszug der „converging technologies“ besonders dringlich, denn je mehr Biologie, Ingenieurswissenschaften, Informatik und Physik zusammenfinden, desto weniger scheinen gewohnte Unterscheidungen zu treffen. Doch zeigt eine systematische Rekonstruktion der Lebenswissenschaften in ihrer aktuellen Form als Systembiologie und synthetische Biologie, daß es sich dabei um ein Selbstmissverständnis der Logik wissenschaftlicher Darstellung handelt. Eine alternative Auffassung der begrifflichen (...) Struktur unserer Rede über Lebendiges ist Anliegen dieses Buches. Leben ist danach eine Formbestimmung von Tätigkeitsverhältnissen, die sowohl theoretische wie praktische Begründungen ermöglicht. Die Entfaltung der spezifisch technischen Form dieses Wissens über das Lebendige gestattet es nicht nur, szientistische Verkürzungen zu vermeiden, sondern zudem den methodischen Ort wissenschaftlicher Strukturierungen von Lebendigem auszuzeichnen. Auf dieser Grundlage wird schließlich auch „der Menschen“ durch Lebenswissenschaften darstellbar – und zwar so, wie es der historischen Form des Gegenstandes angemessen ist. (shrink)

There has been an explosion of interest in the metaphysics of fundamentality in recent decades. The consensus view, called metaphysical foundationalism, maintains that there is something absolutely fundamental in reality upon which everything else depends. However, a number of thinkers have chal- lenged the arguments in favor of foundationalism and have proposed competing non-foundationalist ontologies. This paper provides a systematic and critical introduction to metaphysical foundationalism in the current literature and argues that its relation to ontological dependence and substance should (...) be qualified in important ways. In a recent paper Weinberg (2007) claims that there is an essential mark of trustworthiness which typical sources of evidence as perception or memory have, but philosophical intuitions lack, namely that we are able to detect and correct errors produced by these “hopeful” sources. In my paper I will argue that being a hopeful source isn't necessary for providing us with evidence. I then will show that, given some plausible background assumptions, intuitions at least come close to being hopeful, if (...) they are reliable. If this is true, Weinberg's new challenge comes down to the claim that philosophical intuitions are not reliable since they are significantly unstable. In the second part of my paper I will argue that and why the experimentally established instability of folk intuitions about philosophical cases does not show that philosopher's expert intuitions about these cases are instable. I critically examine some deflationary theories of properties, according to which properties are ‘shadows of predicates’ and quantification over them serves a mere quasi-logical function. I start by considering Hofweber’s internalist theory, and pose a problem for his account of inexpressible properties. I then introduce a theory of properties that closely resembles Horwich’s minimalist theory of truth. This theory overcomes the problem of inexpressible properties, but its formulation presupposes the existence of various kinds of abstract objects. I discuss some ways (...) to reduce these existence assumptions, but ultimately suggest that deflationists can hardly avoid quantification over abstract objects of one sort or another. I conclude that property deflationism is perhaps not as deflationary as some philosophers want it to be, but that it’s still apt to call the position ‘deflationary’. (shrink)

Looking back on it, it seems almost incredible that so many equally educated, equally sincere compatriots and contemporaries, all drawing from the same limited stock of evidence, should have reached so many totally different conclusions---and always with complete certainty.

Issues concerning patients' rights are at the center of bioethics, but the political basis for these rights has rarely been examined. In Bioethics in a Liberal Society: The Political Framework of Bioethics Decision Making , Thomas May offers a compelling analysis of how the political context of liberal constitutional democracy shapes the rights and obligations of both patients and health care professionals. May focuses on how a key feature of liberal society -- namely, an individual's right to make independent (...) decisions -- has an impact on the most important relational facets of health care, such as patients' autonomy and professionals' rights of conscience. Although a liberal political framework protects individual judgments, May asserts that this right is based on the assumption of an individual's competency to make sound decisions. To protect the autonomy of these vulnerable patients, May emphasizes the need for health care ethics committees and ethics consultants to help guide the decision-making process in clinical settings. The Scottish philosopher Thomas Reid first published Essays on Active Powers of Man in 1788 while he was Professor of Philosophy at King's College, Aberdeen. The work contains a set of essays on active power, the will, principles of action, the liberty of moral agents, and morals. Reid was a key figure in the Scottish Enlightenment and one of the founders of the 'common sense' school of philosophy. In Active Powers Reid gives his fullest exploration of sensus communis as (...) the basis of all philosophical inquiry. He uses common sense realism to argue for the existence of a stable external world, the existence of other minds, and to offer a powerful challenge to versions of the Theory of Ideas advocated by Hume and Locke . This is a key work of the Scottish Enlightenment that made important contributions to fundamental debates about the basis of philosophical inquiry. (shrink)

What are the truth conditions of want ascriptions? According to an influential approach, they are intimately connected to the agent’s beliefs: ⌜S wants p⌝ is true iff, within S’s belief set, S prefers the p worlds to the not-p worlds. This approach faces a well-known problem, however: it makes the wrong predictions for what we call (counter)factual want ascriptions, wherein the agent either believes p or believes not-p—for example, ‘I want it to rain tomorrow and that is exactly what is (...) going to happen’ or ‘I want this weekend to last forever, but of course it will end in a few hours’. We solve this problem. The truth conditions for want ascriptions are, we propose, connected to the agent’s conditional beliefs. We substantiate this connection by pursuing a striking parallel between (counter)factual and non-(counter)factual want ascriptions on the one hand and counterfactual and indicative conditionals on the other.
