This paper traces the manner in which the word ‘psychotherapy’ was invented and how it became taken up and disseminated in the English-, French- and German-speaking medical worlds at the end of the 19th century. It explores how it was used as an appellation for a variety of practices, and then increasingly became perceived as a distinct entity in its own right. Finally it shows how the fate of the word ‘psychotherapy’ enables Freud’s invention of ‘psychoanalysis’ to be located.

This book is parapsychological study of the meaningful coincidence of events, extrasensory perception, and similar phenomena.

How did psychoanalysis attain its prominent cultural position? How did it eclipse rival psychologies and psychotherapies, such that it became natural to bracket Freud with Copernicus and Darwin? Why did Freud 'triumph' to such a degree that we hardly remember his rivals? This book reconstructs the early controversies around psychoanalysis and shows that rather than demonstrating its superiority, Freud and his followers rescripted history. This legend-making was not an incidental addition to psychoanalytic theory but formed its core. Letting the primary (...) material speak for itself, this history demonstrates the extraordinary apparatus by which this would-be science of psychoanalysis installed itself in contemporary societies. Beyond psychoanalysis, it opens up the history of the constitution of the modern psychological sciences and psychotherapies, how they furnished the ideas which we have of ourselves and how these became solidified into indisputable 'facts'. In this article we introduce an argument developed in Borch-Jacobsen and Shamdasani (2006). We attempt to draw some consequences from several decades of work in Freud history. We argue that such work has had the cumulative effect of showing up the legendary nature of Freud's epistemology, and has demonstrated the direct linkages between his interpretive procedures and rewriting of history. The Freud legend was by no means a supplementary accessory which accompanied substantive advances, akin to the legend of Newton's (...) apple: rather, it was constitutive of the very identity of psychoanalysis, and enabled its differentiation from rival psychologies and psychotherapies, and promoted the claim that it formed the only viable science of mind and the most advanced form of psychotherapy. Historical research enables one to grasp the legendary nature of Freud's achievement. (shrink)

Should a liberal constitution constrain the racially discriminatory actions of state as well as nonstate employers? This essay answers in the affirmative, arguing that once we take seriously the right to nondiscrimination on the basis of race in terms of employment, we realize that such a constitution must constrain the actions of both. In doing so, this essay draws from John Rawls’s four-stage sequence, a sequence that suggests one way philosophical principles translate into constitutional design. A Theory of Justice is (...) the go-to theory for a wide range of political issues from a perspective of liberal theory, but scholars have paid less attention to it and comparative constitutional law. I take up this neglected inquiry by focusing on the distinction between the horizontal and vertical effect of a right not to be discriminated against on the basis of race in matters of employment. My analysis draws from the United States Constitution and the Constitution of the Republic of South Africa. A vertical effect constrains state power: a right to nondiscrimination is violated only when a state or public body discriminates on the basis of race. A horizontal effect constrains nonstate actors: a private employer may violate rights by discriminating on the basis of race. I argue that, in line with the South African Constitution, Rawls importantly adopts a horizontal effect of the right not to be discriminated against on the basis of race by ensuring formal equality of opportunity. His theory of justice suggests that a liberal constitution ought to constrain the racially discriminatory actions of both state and nonstate employers. This, in turn, represents an important response to racism that occurs in the private sphere. (shrink)

The conventional interpretation of equality under the law singles out certain groups or classes for constitutional protection: women, racial minorities, and gays and lesbians. The United States Supreme Court calls these groups 'suspect classes'. Laws that discriminate against them are generally unconstitutional. While this is a familiar account of equal protection jurisprudence, this book argues that this approach suffers from hitherto unnoticed normative and political problems. The book elucidates a competing, extant interpretation of equal protection jurisprudence that avoids these problems. (...) The interpretation is not concerned with suspect classes but rather with the kinds of reasons that are already inadmissible as a matter of constitutional law. This alternative approach treats the equal protection clause like any other limit on governmental power, thus allowing the Court to invalidate equality-infringing laws and policies by focusing on their justification rather than the identity group they discriminate against. ABSTRACT Because of the irresolvable disagreement between the Federalists and Anti-Federalists, the U.S. Constitution both embodies value pluralism and has encouraged it ever since its adoption. Rather than ignoring the nation-centered, dynamic ideas of the Federalists or the state-centered, static ideas of the Anti-Federalists, the Constitution incorporated both views, giving rise to plentiful opportunities for interpretive disagreements that have not, however, stood in the way of the interpreters’ shared commitment to the document itself. In a sex selective abortion, a woman aborts a fetus simply on account of the fetus’ sex. Her motivation or underlying reason for doing so may very well be sexist. She could be disposed to thinking that a female child is inferior to a male one. In a hate crime, an individual commits a crime on account of a victim’s sex, race, sexual orientation or the like. The individual may be sexist or racist in picking his victim. He or she (...) could be disposed to thinking that one race or sex is inferior to another. I argue that while a prohibition on sex selective abortions is anomalous in a liberal, criminal legal framework, hate crime legislation may not be. The former but not the latter constitutes a thought crime. I define a thought crime as one where an agent’s motivation is not just relevant but sufficient to take an act from the domain of the non-punishable to the domain of the punishable. Ignoring a woman’s sexist motivation in procuring an abortion suddenly renders her act of abortion legal. On the other hand, discounting an agent’s bias in committing a hate motivated assault or murder does not transform the act from a punishable one to a non-punishable one. Assaulting or murdering is already a crime. (shrink)

In the autumn of 1912, C. G. Jung, then president of the International Psychoanalytic Association, set out his critique and reformulation of the theory of psychoanalysis in a series of lectures in New York, ideas that were to prove unacceptable to Freud, thus creating a schism in the Freudian school. Jung challenged Freud's understandings of sexuality, the origins of neuroses, dream interpretation, and the unconscious, and Jung also became the first to argue that every analyst should themselves be analyzed. In 1925, while transcribing and painting in his Red Book, C. G. Jung presented a series of seminars in English in which he spoke for the first time in public about his early spiritualistic experiences, his encounter with Freud, the genesis of his psychology, and the self-experimentation he called his "confrontation with the unconscious," describing in detail a number of pivotal dreams and fantasies. He then presented an introductory overview of his ideas about psychological typology and the archetypes of the (...) collective unconscious, illustrated with case material and discussions concerning contemporary art. He focused particularly on the contra-sexual elements of the personality, the anima and the animus, which he discussed with the participants through psychological analyses of popular novels, such as Rider Haggard's She. The notes from these seminars form the only reliable published autobiographical account by Jung and the clearest and most important account of the development of his work. Jung was intrigued from early in his career with coincidences, especially those surprising juxtapositions that scientific rationality could not adequately explain. He discussed these ideas with Albert Einstein before World War I, but first used the term "synchronicity" in a 1930 lecture, in reference to the unusual psychological insights generated from consulting the I Ching. A long correspondence and friendship with the Nobel Prize-winning physicist Wolfgang Pauli stimulated a final, mature statement of Jung's thinking on synchronicity, originally published in 1952 (...) and reproduced here. Veba, kızamık, sıtma, kolera, İspanyol gribi gibi salgın hastalıklar Osmanlı’yı her açıdan etkilemiş ve dönemin konjonktürüne göre çeşitli alanlarda çeşitli tedbirler alınmıştır. Bu çalışmada özellikle son dönemin seçilme sebebi, hem daha fazla salgın tespitinin yapılmış olması hem de bu dönem kayıtlarının fazla olmasıdır. 1800’lerden sonra Osmanlı’da belirli sebeplerle belirli süreçler ve sonuçlarıyla farklı salgınlar yaşanmıştır. Bunlardan bir kısmı mikro düzeyde bazıları ise makro düzeyde etkilemiştir devleti. Salgınlardan en çok etkilenen kesim şüphesiz çocuklar olmuştur, özellikle eğitim çağındaki çocukların hem hastalıktan etkilenme (...) süreci hızlanmış hem de en çabuk müdahale grubu olmuştur. Osmanlı salgınlarda eğitim ile ilgili ayrı tedbirler almıştır. Okulları, öğretmenleri, öğrencileri, kaldıkları yerleri ve ebeveynleri de zaman zaman içine alan bu önlem çabaları, devleti kurumsal anlamda etkilemiştir. Arşiv belgelerine baktığımızda, okulların tatil edilmeleri, aşılama politikaları, dezenfekte çalışmalarının yaygınlaştırılması, öğrencilerde ve ebeveynlerinde bu konuda bilinç oluşturma, bu konular için ayrı ödenekler ayarlanması, öğretmenlerin bu konuda maddi manevi desteklenmesi gibi hususlar salgın ve eğitim tedbirleri konusunda en çok dile getirilen meseleler olmuştur. Çoğunlukla Osmanlı ve Cumhuriyet arşiv belgeleri ve dönemin kroniklerine dayanarak, doküman analizi yöntemi ile hazırlayacağımız bu çalışma, dönemin salgınları karşısında eğitimin aksamaması için devletin aldığı tedbirleri ortaya çıkarmayı hedeflemektedir. Hicrî birinci yüzyılın sonu ile ikinci yüzyılın ortalarında yaşamış bulunan Ca‘fer-i Sâdık ve Ebû Hanîfe, akran iki âlimdir. Kûfe’de yetişen ve Ehl-i sünnet mezheplerinden birinin imamı olan Ebû Hanîfe’nin, Medine’de yetişen ve İsnâaşeriyye’nin altıncı imamı kabul edilen Ca‘fer ile bir araya geldiği ve onun talebesi olduğu hem sünnî hem Şiî kaynaklarda rivayet edilmektedir. Mukaddem kaynaklarda Ebû Hanîfe’nin Ca‘fer-i Sâdık’ın öğrencisi olduğu yönündeki ifadelerin, muahhar kaynaklarda abartılı bir şekilde yorumlandığı görülmüştür. Bu çalışmada Ebû Hanîfe ile Ca‘fer-i Sâdık arasındaki hoca-talebe ilişkisi (...) netleştirilmeye çalışılmıştır. Bu sebeple öncelikle kısaca her iki imamın hayatı ele alınarak onların ilmî birikimi tespit edilmiştir. Akabinde Ebû Hanîfe ile Ca‘fer’in ne zaman ve ne kadar süre birlikte oldukları, Ebû Hanîfe’nin Ehl-i beyt’e yönelik tutumunun Ca‘fer’den ilim almasında ne gibi bir etkisinin bulunduğu ve çeşitli ilim dallarında Ebû Hanîfe- Ca‘fer ilişkisi tespit edilmeye çalışılmıştır. Bu Araştırma, esas olarak İngiltere, Fransa ve Almanya'da yetişen Avrupa'nın erken aydınlanmasının dini ve felsefi düşüncelerinin doğasının bir araştırmasını yapmayı amaçlamaktadır. 17. yüzyılın sonu ve 18. yüzyılın başlangıcında İngiltere'de başlayan deistik düşünce hareketi, Matthew Tindal örnek alınarak özel olarak incelenmiştir. Tindal tarafından yapılmış orijinal eserler ve onun hakkında ikincil yazılar olan birincil kaynaklar, Tindal'ın Şanlı Devrim sonrası siyaset kurumunun bir destekçisi ve devrim öncesi sosyal, dini ve siyasi düzenin özellikle Katolik Hıristiyanlığın eleştirmeni olduğu sonucuna varmamıza yol açabilir. O Zamanın (...) felsefi ve dini sorularının çoğu için kendi deist yorumunu yaptı. Bu, esas olarak, Yaratılış Kadar Eski Hristiyanlık: Doğal Dinin Yeniden Yayınlanmasının İncili adlı ana çalışmasında gözlemlendi; burada akıl ve doğa yasaları, Hristiyanlığın temel öğretilerini eleştirmek ve reddetmek için kendi başlarına kullanılır. Bu, genel olarak İngiliz deistlerinin ve özellikle Matthew Tindal'ın akıl ve doğal dinin veya doğa yasalarının bizi ateistlerin şüpheciliğini ve nihilizmini veya kendilerini Hristiyan deist olarak adlandıran protestanları veya İslam'ınki gibi başka bir dini örtbas etmeye yönlendirdiğini ima eder. Süsleme teknikleri her sanat dalında olduğu gibi cilt sanatında da zaman içerisinde değişim göstermiştir. 18. yüzyıl klâsik üslûpta ciltlerinin yapılmaya devam edildiği ancak aynı zamanda yeni tezyînat tekniklerinin denendiği bir dönemdir. Bu tekniklerden bir olan yekşah, cilt üzerine altınla işlenen motiflerin üzerine ucu düz veya oval olan demir aletin kakılması/bastırılması şeklinde uygulanan bir tezyînat tekniğidir. Bu süsleme tekniği, adını uygulamada kullanılan metal aletten almaktadır. Yekşah demiri olarak isimlendirilen bu alet, ortalama 15-16 cm uzunluğunda olup ağzı düz veya oval bir el (...) aletidir. Yekşah süsleme tekniği, yazma ciltler üzerine uygulanmaktadır. Yazma cilt, desenin fırça yardımıyla zermürekkep kullanılarak deri üzerine işlenmesi anlamına gelmektedir. Desenin yazma tekniğiyle (fırçayla) deriye nakşedilmesinin ardından yekşah demiriyle işlenmesi aşamasına geçilmektedir. Motiflerin üzerine, gidiş yönü esas alınarak yekşah demiriyle taramalar yapılmakta, desen üzerinden çizgiler halinde geçilmektedir. Deri bu tarama esnasında kısmen de çukurlaşmaktadır. Yekşah tezyînat tekniği, Türk cilt sanatına 17. yüzyıl sonu ile 18. yüzyıl başı itibariyle katılmıştır. 19. yüzyılda da örnekleri görülmeye devam edilmiştir. Ancak en yoğun kullanıldığı dönem 18. yüzyıldır. Yekşah tezyînatın çoğunlukla saray mücellitleri tarafından ve özellikle değeri yüksek eserlerin ciltlerinde tatbik edildiği bilinmektedir. Türk cilt sanatı literatüründe yayınlanmış ve müze ve kütüphanelerde tarafımızca tespit edilen yekşah cilt örneklerinin incelenmesi neticesinde, Türk ciltlerinde yekşah tezyînat tekniğinin 3 farklı desen üzerine tatbik edildiği tespit edilmiştir. Bunlar; rûmî, zerbahar ve barok-rokoko desenleridir. Rûmî desenli yekşah ciltlerde cilt kapağının tüm bölümlerinde yekşah tekniğinin uygulandığı görülmektedir. Ancak en yoğun ve çeşitli olarak şemselerde rastlanmaktadır. Bunun nedeni, yekşah tezyînatın görülmeye başlandığı 18. yüzyıl itibariyle cilt kapaklarında köşebentlere sıklıkla yer verilmemesi ve bezeme yoğunluğunun şemselerde görülmesi olabilir. Rûmî desenli yekşah ciltlerde şemselerin üç türü tespit edilmiştir. Bunlar; klâsik oval/beyzî formda dilimli şemse, dikdörtgen formda şemse ve dilimli dairevî formdaki şemsedir. Rûmî desenli yekşah ciltlerde desenin altınlarının daha net görülebilmesi amacıyla şemse ve salbek zemini sıklıkla bordo renkle boyanmıştır. Yekşah tekniğinin uygulandığı bir diğer desen türü ise zerbahardır. Zerbahar desen, 18. yüzyılın sonunda ve özellikle 19. yüzyılda görülen bir cilt tezyînat türü olup ciltlerin genellikle tüm yüzeyini kaplayacak şekilde uygulanmıştır. 18. yüzyıl itibariyle Türk ciltlerinde görülen realist üslûptaki çiçek veya Batı etkisindeki barok-rokoko motifleri üzerine de yekşah uygulaması yapıldığı belirlenmiştir. Türk Rokokosu, C ve S kıvrımlı motiflerle yüzeyin tamamen doldurularak süslendiği gösterişli bir bezeme üslûbudur. Kavisli ve yuvarlak şekillerle birlikte yaprak, çiçek motifleri ve çiçek demetleri bu bezeme üslûbunda yer almaktadır. Dayanıklılık bakımından zayıf olmasına rağmen yekşah tekniğin 18. yüzyıl ciltlerinde sıklıkla tercih edilmesinde, cildin sanat değerini arttırma çabası vardır. Bu teknik sayesinde, yazma olarak uygulanmış desen daha cazip hale getirilmiştir. Bu da cildin sanat değerini yükseltmiştir. (shrink)

Bu çalışma ilkin, ütopyacı düşünceye karşı istikrarlı bir muhalefet yürüten liberal düşüncenin sağ kanadındaki Karl Popper ve Francis Fukuyama gibi kanonik isimlerin yaklaşımlarının, zamanın sosyo-ekonomik gelişmelerinin katkısıyla genel siyaset düşüncesinin ana akımına bürünmesi sürecini ve ütopyaya ilişkin fikirlerini değerlendirecektir. Bir kez müesses nizam haline geldiği vakit menşeindeki ütopyacı niteliklerin hilafına değişimin ancak tedricen olması gerektiğini ve aksini savunan siyasal tavır alışların da yersiz radikalizmle malul siyaset dışı yönelimler olduğunu iddia eden ana akım liberal çizginin savunucuları olarak Popper ve Fukuyama, bu (...) çizgilerini radikal bir antikomünizmle taçlandırmışlardır. Aynı çizgide bu kez liberal düşüncenin sol cenahındaki sol-sosyalist fikri inkişaf döneminin ürünü çaplı toplumsal değişim taleplerini, radikal diye tabir ederek neredeyse affedilmez birer kusur gibi kabul eden kimi sol liberal feminist yaklaşımlar ile yenilginin sözde faturasını bu radikalizme keserek siyasal faaliyetini melankolik bir yazıklanmanın ötesine geçiremeyen birtakım liberal sol tavırların bu süreçteki rolü tartışılacaktır. Sonuç itibarıyla bu çalışma, çoğunlukla itham biçiminde zikredilen ütopyacılık tabirini, bu menfi kullanımın nesnesi olmaktan kurtarmak için alternatif ve daha iyi bir yaşama dair yolların çeşitlenmesinin önemli bir başlangıç noktası olarak bir paye gibi kabullenip sahiplenen Ernst Bloch’un umut mefhumu üzerinden yepyeni bir ontolojik ve epistemolojik inşaya tabi tutarak, ütopyacılığın bir tür iade-i itibarına odaklanacaktır.
