The explicit ambition of this collection is to move `beyond' the Universal Pragmatics of Jurgen Habermas.

An interaction paradigm continues to predominate in social communication models to this day and yet often tends to be heavily intuitive, epistemologically conservative and acritical. This article seeks to examine some of the implications for our intuitive understanding of interaction when greater instability is introduced into social communication theory where communication is conceptualized as a complex uncertainty. The theoretical architecture of this undertaking is in itself interdisciplinary, comprising concepts from the fields of social theory, logic, information theory and constructivism. In (...) these interdisciplinary considerations, interaction is conceptualized as a fictional construction and thus disabused of the strong transcendental claims which accompany concepts of dialogism, consensus or intersubjectivity. Whereas uncertainty is customarily seen as the opposite of rational inclusive communication and a risk to be somehow avoided, this article explores a different theoretical modelling of the relationship between uncertainty and social communication. Here, communication is conceived as an extremely precarious undertaking. This very precariousness is a fact of everyday life where communication is social construction in progress and norms are constantly regenerated, negotiated and challenged. (shrink)

In this essay I set out to problematize the concepts of intersubjectivity and interaction in the theories of Germany's two foremost social philosophers: Jiirgen Habermas and Niklas Luhmann. To do so, I shall briefly reconstruct Husserl's phenomenological concept of intersubjectivity and its relationship with rational horizons and lifeworlds. I shall then demonstrate the importance of Husserl's thought in the theory of (rational) communicative action in Habermas. The third section deals with the radical rethinking of the subject (and hence intersubjectivity) in (...) the theory of Niklas Luhmann. My principal question will then be: is it possible to reconcile critical theory with systems theory? Or, alternatively: is intersubjectivity a reality or a useful fiction? (shrink)

This book shows the surprising dynamism of the field of civil procedure through its examination of a cross section of recent developments within civil procedure from around the world. It explores the field through specific approaches to its study, within specific legal systems, and within discrete sub-fields of civil procedure. The book reflects the latest research and conveys the dynamism and innovations of modern civil procedure - by field, method and system. The book's introductory chapters lay the groundwork for researchers (...) to appreciate the flux and change within the field. The concluding chapters bring the many different identified innovations and developments together to show the field's ability to adapt to modern circumstances, while retaining its coherence even across different legal systems, traditions, fields and analytic approaches. Specifically, in this book the presence of dynamism is explored in the legal systems of the EU, France, the US, Brazil, Australia, the UK and China. So too that dynamism is explored in the contributions' analyses and discussions of the changes or need for change of specific aspects of civil procedure including litigation costs, class actions, derivative actions, pleadings, and res judicata. Furthermore, most of the individual contributions may be considered to be comparative analyses of their respective subjects and, when considered as a whole, the book presents the dynamism of civil procedure in comparative perspective. Those discrete and aggregated comparative analyses permit us to better understand the dynamism in civil procedure - for change in the abstract can be less visible and its significance and impact less evident. While similar conclusions may have been drawn through examinations in isolation, employing comparative analytic methods provided a richer analysis and any identified need for change is correspondingly advanced through comparative analysis. Furthermore, if that analysis leads to a conclusion that change is necessary then comparative law may provide pertinent examples for such change - as well as methodologies for successfully transplanting any such changes. In other words, as this book so well reflects, comparative law may itself usefully contribute to dynamism in civil procedure. This has long been a raison d'être of comparative law and, as clear from this book's contributions, in this particular time and field of study we find that it is very likely to achieve its lofty promise. Corporate environmental ethics has moved from a niche issue within business strategy to a potential source of competitive advantage. Firms, however, are comprised of individuals who vary in their personal beliefs regarding environmental responsibility. Environmental stewards are those employees whose attitudes and actions reflect environmental concern. Top management can convey similar environmental values through the creation of eco-capabilities. Applying logic from the natural resource-based view of the firm, we build a model to test how the alignment of environmental values impacts (...) multiple outcomes. We conduct a time-lagged examination using multi-level data from frontline employees, their managers, and their customers. We find that firms can ‘activate’ their corporate environmental ethics through eco-capabilities. Specifically, environmental stewards find more meaning in their work when managers perceive high levels of eco-capabilities within the firm. This meaningful work increases employee brand advocacy and customer satisfaction. Together, we demonstrate how corporate environmental ethics translates to the frontline and the customers they serve. How should scientists react to anthropomorphism (defined for the purposes of this paper as the attribution of mental states or properties to nonhuman animals)? Many thoughtful scientists have attempted to accommodate some measure of anthropomorphism in their approaches to animal behavior. But Wynne will have none of it. We reject his argument against anthropomorphism and argue that he does not pay sufficient attention to the historical facts or to the details of alternative approaches.

As in other fields, scholarly publication in sociology is not only the key to career success but also the route by which feminist analyses and perspectives become known to others in the discipline. A growing literature has analyzed women's and men's rates of publication, but the gender politics of the prepublication production of research and gender differences in reputation building after publication remain underexplored. This report reviews the current state of knowledge about sociological publishing at three phases: prepublication, the publication-seeking (...) phase, and postpublication. It concludes with critical questions to be addressed in developing a comprehensive model of gender effects on sociological publishing. (shrink)

Entrapment is defined and distinguished from related law enforcement practices. The subjective test of entrapment formulated by the Supreme Court and the objective test proposed by critics are discussed and evaluated. The argument is advanced that entrapment is a morally unjustifiable practice which is inconsistent with the rights of citizens in a democratic society. Guidelines are proposed for governing police conduct in potential entrapment situations and suggestions made regarding ways these guidelines might be implemented.

Milton Friedman's article, The Social Responsibility of Business Is To Increase Its Profits, owes its appeal to the rhetorical devices of simplicity, authority, and finality. More careful consideration reveals oversimplification and ambiguity that conceals empirical errors and logical fallacies. It is false that business does, or would, operate exclusively in economic terms, that managers concentrate obsessively on profitability, and that ethics can be marginalized. These errors reflect basic contradictions: an apolitical political base, altruistic agents of selfishness, and good deriving from (...) greed. (shrink)

Although Anders Nygren deserves a lot of the credit for launching the debate about the Christian understanding of love, his insistence on the distinctiveness of agape has been severely challenged by advocates for the sensuousness of eros and the mutuality of philia. The most serious challenge, however, may come from defenses of agape where the altruistic distinctiveness of the theological thrust is qualified by the claims of an ethical horizon. In spite of his disservice to eros and his neglect of (...) philia, Nygren deserves to be heard in his insistence that agape is a unique concept, and that this uniqueness is due particularly to its theological source and reference. Separated from its anchorage in religion, ethics has followed the social sciences in seeing human beings as fundamentally characterized by self-interest, so that altruism is either naively idealistic or arrogantly self-sufficient. Colin Grant contends that, as a modern secular concept, altruism is a parody on the self-giving love of Christianity, so that its dismissal represents a social levelling that loses the depths that theology makes intelligible and religion makes possible. The Christian affirmation is that God is characterized by (...) self-giving love, then expected of Christians. Lacking this theological background, the focus on self-interest in sociobiology and economics, and on human realism in the political focus of John Rawls or the feminist sociability of Carol Gilligan, finds altruism naive or a dangerous distraction from real possibilities of mutual support. This book argues that to dispense with altruism is to dispense with God and with the divine transformation of human possibilities. (shrink)

The self‐interest paradigm that has dominated and defined social science is being questioned today in all the social sciences. Frontline research is represented by C. Daniel Batson's experiments, which claim to present empirical evidence of altruism. Impressive though this is against the background of the self‐interest paradigm, its ultimate significance might be to illustrate the inadequacy of social science to deal with a transcendent reality like altruism.

The recovery of theological integrity effected by Karl Barth has very much to do with his polemic against natural theology. Theology has regained credibility, however, at the price of being made unnatural, severed from the world in its own ecclesiastical sphere. This actually represents an indirect endorsement of natural theology inasmuch as the naturalistic understanding of the world is taken for granted as the way the world is. One result of this is the virtual abandonment of nature for theology, reflected (...) in an alienation from science and a disinterest in ecology. The more specific object of Barth's critique of natural theology, Nazism, may also exert a reverse influence on Barth's theology, helping to account for its Christological exclusivism. The implication of this is that the critique of natural theology requires a renewed appreciation of the naturalness of theology. (shrink)

Neither the corporate view of whistle blowers as tattle-tales and traitors, nor the more sympathethic understanding of them as tragic heroes battling corrupt or abused systems captures what is at stake in whistle blowing at its most distinctive. The courage, determination and sacrifice of the most ardent whistle blowers suggests that they only begin to be appreciated when they are seen as the saints of secular culture. Although some whistle blowers may be attempting to deflect attention from their own deficiencies (...) and others may be disgruntled employees, the most serious instances involve a level of moral sensitivity that approaches religious proportions that are baffling for a culture that has dispensed with sainthood. The criminal conviction of Amway Corporation for evasion of Canadian customs duties not only belies the high ethical profession of its president, Richard DeVos, but his reissuing of the book which makes this profession, without mentioning the conviction, supports the view that ultimately ethics and business are pulling in opposite directions.

The difference illustrates how, in contrast to its professed neutrality, “ThePrisoner’s Dilemma” involves very definite views of humanity and the nature of life itself. Theodore Levitt criticizes John Kenneth Galbraith's view of advertising as artificial want creation, contending that its selling focus on the product fails to appreciate the marketing focus on the consumer. But Levitt himself not only ends up endorsing selling; he fails to confront the fact that the marketing to our most pervasive needs that he advocates really represents a sophisticated form of selling. He avoids facing this by the fiction that marketing is concerned only with the material level of existence, (...) and absolves marketing of serious involvement in the level of meaning through the relativization of all meanings as personal preferences. The irony is that this itself reflects a particular view of meaning, a modern commercial one, so that it is this vision of life that LevittÕs marketing is really SELLING. (shrink)

Charles Hartshorne is usually regarded as the developer of the theological approach initiated by Alfred North Whitehead. Justification for this view is to be found not only in the central focus of Hartshorne's voluminous writings, but also in his own references to Whitehead's accomplishments. He notes that Whitehead did not regard himself as a theologian, but rather saw his task as that of attempting to reconcile the professedly neutral burgeoning fields of science and the wider ideals necessary to civilized human (...) life. It is in the context of this pursuit that Whitehead makes his extremely suggestive, but tantalizingly vague, comments which provide a foundation for theological reconstruction. According to this approach, two dimensions, or natures, must be distinguished in God, a conceptual primordial nature which structures the possibilities for life and a concrete consequential nature which receives the actualities which result from the possibilities that are realized. Over the past two decades, the understanding of the roles of vitamin D has expanded to include many nonskeletal effects such as reduced risk of acute respiratory tract infections, autoimmune diseases, cancer, cardiovascular disease, diabetes mellitus, neurological diseases, and adverse pregnancy and birth outcomes. The role of vitamin D for optimal health is well known in Western developed countries but less so in Central Asian countries. This narrative review compares the status of vitamin D between Central Asian countries and Northern (...) European countries. The analysis also summarizes the evidence for the beneficial effects of vitamin D and recommendations for Central Asian countries. (shrink)

BackgroundElectronic patient record (EPR) technology is a key enabler for improvements to healthcare service and management. To ensure these improvements and the means to achieve them are socially and ethically desirable, careful consideration of the ethical implications of EPRs is indicated. The purpose of this scoping review was to map the literature related to the ethics of EPR technology. The literature review was conducted to catalogue the prevalent ethical terms, to describe the associated ethical challenges and opportunities, and to identify (...) the actors involved. By doing so, it aimed to support the future development of ethics guidance in the EPR domain.MethodsTo identify journal articles debating the ethics of EPRs, Scopus, Web of Science, and PubMed academic databases were queried and yielded 123 eligible articles. The following inclusion criteria were applied: articles need to be in the English language; present normative arguments and not solely empirical research; include an abstract for software analysis; and discuss EPR technology.ResultsThe medical specialty, type of information captured and stored in EPRs, their use and functionality varied widely across the included articles. Ethical terms extracted were categorised into clusters ‘privacy’, ‘autonomy’, ‘risk/benefit’, ‘human relationships’, and ‘responsibility’. The literature shows that EPR-related ethical concerns can have both positive and negative implications, and that a wide variety of actors with rights and/or responsibilities regarding the safe and ethical adoption of the technology are involved.ConclusionsWhile there is considerable consensus in the literature regarding EPR-related ethical principles, some of the associated challenges and opportunities remain underdiscussed. For example, much of the debate is presented in a manner more in keeping with a traditional model of healthcare and fails to take account of the multidimensional ensemble of factors at play in the EPR era and the consequent need to redefine/modify ethical norms to align with a digitally-enabled health service. Similarly, the academic discussion focuses predominantly on bioethical values. However, approaches from digital ethics may also be helpful to identify and deliberate about current and emerging EPR-related ethical concerns. (shrink)

One of the earliest issues in cognitive ethology concerned the meaning of animal signals. In the 1970s and 1980s this debate was most active with respect to the question of whether animal alarm calls convey information about the emotional states of animals or whether they “refer” directly to predators in the environment (Seyfarth, Cheney, & Marler 1980; see Radick 2007 for a historical account), but other areas, such as vocalizations about food and social contact, were also widely discussed. In the (...) 1990s, ethologists largely came to a consensus that such calls were “functionally referential” (Evans & Marler 1995) even if they did not satisfy all the semantic requirements imposed by philosophers of language. More recently, though, it has been argued that ethologists should eschew the concept of reference and return to a focus on the affective aspects of animal communication (Rendall & Owren 2002). We propose to take a new look at this debate in the light of recent developments in the philosophy of language under the heading of “Neo-Expressivism” (Bar-On 2004). Dementia is a growing issue at the end of life that presents unique challenges for advance care planning. Advance directives are a useful and important component of end-of-life planning, but standard advance directives have less utility in cases of loss of capacity due to dementia. An advance directive designed to specifically address end-of-life issues in the setting of dementia can provide patients with increased autonomy and caregivers with improved information about the desires of the individual in question. The Dartmouth Dementia (...) Directive is a dementia-specific advance directive, available online, that seeks to address common concerns of individuals who are planning for dementia-related end-of-life care. This directive was piloted in a community-based workshop, which provided important details and perspective on the best use of dementia-specific advance directives in the greater population. (shrink)

In this comprehensive collection of essays, most of which appear for the first time, eminent scholars from many disciplines—philosophy, economics, sociology, political science, demography, theology, history, and social psychology—examine the causes, nature, and consequences of present-day consumption patterns in the United States and throughout the world.

Aims and background: Little is known about how participants perceive prevention trials, particularly trials designed to prevent mental illness. This study examined participants’ motives for participating in a trial and their views of randomisation and the ability to withdraw from a randomised controlled trial for prevention of depression. Methods: Participants were older adults reporting elevated depression symptoms living in urban and regional locations in Australia who had consented to participate in an RCT of interventions to prevent depression. Participants rated their (...) agreement with various statements describing motivations for enrolment in the trial and opinions regarding randomisation and withdrawal. Results: The majority of participants expressed a triad of altruistic motivation for participation, relative lack of concern about randomisation and commitment to the trial. Certain subgroups of participants, such as women and those with higher depression scores, reported higher levels of concern about specific issues. Conclusions: The findings suggest that participants enrolled in prevention trials for mental illness are likely to hold positive attitudes towards research trials. The identification of relationships between key person factors and trial-related attitudes enabled profiling of participant groups, which can inform recruitment strategies and interactions of participants and research projects in future prevention trials. Charney's dismissal of well-established methods in behavioral genetic research is misguided. He claims that studies of heritability and genetic association depend for their validity on six assumptions, but he cites no sources to support this claim. We explain why none of the six assumptions is strictly necessary for the utility of either method of genetic analysis.

BackgroundThis manuscript presents a framework to guide the identification and assessment of ethical opportunities and challenges associated with electronic patient records (EPR). The framework is intended to support designers, software engineers, health service managers, and end-users to realise a responsible, robust and reliable EPR-enabled healthcare system that delivers safe, quality assured, value conscious care.MethodsDevelopment of the EPR applied ethics framework was preceded by a scoping review which mapped the literature related to the ethics of EPR technology. The underlying assumption behind (...) the framework presented in this manuscript is that ethical values can inform all stages of the EPR-lifecycle from design, through development, implementation, and practical application.ResultsThe framework is divided into two parts: context and core functions. The first part ‘context’ entails clarifying: the purpose(s) within which the EPR exists or will exist; the interested parties and their relationships; and the regulatory, codes of professional conduct and organisational policy frame of reference. Understanding the context is required before addressing the second part of the framework which focuses on EPR ‘core functions’ of data collection, data access, and digitally-enabled healthcare.ConclusionsThe primary objective of the EPR Applied Ethics Framework is to help identify and create value and benefits rather than to merely prevent risks. It should therefore be used to steer an EPR project to success rather than be seen as a set of inhibitory rules. The framework is adaptable to a wide range of EPR categories and can cater for new and evolving EPR-enabled healthcare priorities. It is therefore an iterative tool that should be revisited as new EPR-related state-of-affairs, capabilities or activities emerge. (shrink)
