The attention for Moral case deliberation has increased over the past years. Previous research on MCD is often written from the perspective of MCD experts or MCD participants and we lack a more distant view to the role of MCD in Dutch health care institutions in general. The purpose of this paper is to provide an overview of the state of the art concerning MCD in the Netherlands. As part of a larger national study on clinical ethics support in the (...) Netherlands, we will focus on the prevalence and characteristics of MCD in Dutch health. A mixed methods design was used in which we combined two survey questionnaires, two focus groups and 17 individual interviews with top managers or ethics support staff. The findings demonstrate that the prevalence of MCD is relatively high in Dutch health care, especially in mental health care. Institutions with MCD differ from institutions without MCD concerning size, kind of problems and importance of ideological background. Characteristic of MCD is that it often exists for 3 years or more, has a high participation of health professionals and middle managers and is both organized scheduled as unscheduled. As well integration in existing policy as key persons emerge as important issues in relation to the positioning of MCD. We conclude that MCD is a part of an integrated ethics policy and serves as a catalyst for such an integrated ethics policy. (shrink)

Ethics support is called for to improve the quality of care in elderly institutions. Various forms of ethics support are presented, but the needs for ethics support remain unknown. Using a mixed-methods design, this article systematically investigates the specific needs for ethics support in elderly care. The findings of two surveys, two focus groups and 17 interviews demonstrate that the availability of ethics support is limited. There is a need for ethics support, albeit not unconditionally. Advice-based forms of ethics support (...) are less appropriate as they are removed from practice. Ethics support should be tailored to the often mundane and easily overlooked moral issues that arise in long-term care. Attention should also be given to the learning styles of nurses who favour experiential learning. Raising awareness and developing a climate of openness and dialogue are the most suitable ways to deal with the mundane moral issues in elderly care. (shrink)

Internationally, the prevalence of clinical ethics support (CES) in health care has increased over the years. Previous research on CES focused primarily on ethics committees and ethics consultation, mostly within the context of hospital care. The purpose of this article is to investigate the prevalence of different kinds of CES in various Dutch health care domains, including hospital care, mental health care, elderly care and care for people with an intellectual disability. A mixed methods design was used including two survey (...) questionnaires, sent to all health care institutions, two focus groups and 17 interviews with managing directors or ethics support staff. The findings demonstrate that the presence of ethics committees is relatively high, especially in hospitals. Moral case deliberation (MCD) is available in about half of all Dutch health care institutions, and in two-thirds of the mental health care institutions. Ethics consultants are not very prominent. A distinction is made between explicit CES forms, in which the ethical dimension of care is structurally and professionally addressed and implicit CES forms, in which ethical issues are handled indirectly and in an organic way. Explicit CES forms often go together with implicit forms of CES. MCD might function as a bridge between the two. We conclude that explicit and implicit CES are both relevant for clinical ethics in health care. We recommend research regarding how to combine them in an appropriate way. (shrink)

Within psychiatry, patients, family, and professionals are involved and interrelated. Yet it is not easy for healthcare professionals to involve family actively in patient care. Taking a feminist perspective, we investigate why health-care professionals experience ambivalence in involving family in attempts to reduce seclusion, suggesting how they can improve family involvement by adopting a relational view on autonomy. Professionals should view patients not only in terms of individual autonomy and rights, but also in terms of relations and dependencies that need (...) to be considered in fostering patient care. Recently, there has been increased interest in the involvement of family members in treating psychiatric patients who are involuntarily admitted into mental hospitals (Goodwin and Happel 2006; Wilkinson and McAndrew 2008). Family is, for instance, expected to be of use in preventing escalations and aggression on the wards by giving information about patient needs and providing support to the patient. In this book, as feminist, Marxist, postcolonial, and queer scholars, we argue that social reproduction is foundational to comprehending urbanization and urban transformations by contributing to the feminist project of writing social reproduction and everyday life into urban theory." Social reproduction is, of course, not just an analytical framing but also an organising call for feminist scholars and our contention is that if we want an urban theory for our time, it needs to be feminist. Feminism is not simply a (...) 'discipline,' 'theory', or 'ideology', but a worldview, a lived praxis that provides a platform for engaged analysis. The book's origins lie in our belief in the necessity of feminist urban knowledge production, a belief further endorsed by our prior critical engagement with the analytical framework of planetary urbanization and our collective ruminations during and post this engagement on the nature of urban theory (Reddy 2018; Ruddick et al. 2018). Not least the considerable response to the theme issue of Society and Space (Peake et al. 2018) showed us that there was an audience desirous of troubling the hegemony of urban theory. Moreover, our approach of working as a team across hierarchies of junior and senior scholars, generations, genders, sexualities, institutions, and disciplines-a praxis we refer to as "the intergenerational social reproductive labor of knowledge production" (Peake et al. 2018, p. 377)-had been fruitful and positive and we wanted it to continue. It was as much a pedagogical experience of reading and writing together, and sharing meals, as it was an exploration of our places within the academy and an intellectual foray into urban theory. Abstract In this paper I argue that to understand the ethics of belief we need to put it in a context of what we care about. Epistemic values always arise from something we care about and they arise only from something we care about. It is caring that gives rise to the demand to be epistemically conscientious. The reason morality puts epistemic demands on us is that we care about morality. But there may be a (small) class of beliefs which (...) it is not wrong to hold unconscientiously. I also argue that epistemic values enjoy a privileged place in the panorama of what we care about because they are entailed by anything we care about. That means that when there is a conflict between caring about knowledge or true belief and caring about something else, that conflict cannot be resolved simply by following the one we care about the most because caring about knowledge in any domain is entailed by caring about that domain. Finally, I argue that whereas caring demands different degrees of conscientiousness in different contexts, contextualism about knowledge is less plausible. (shrink)

This paper summarizes various interpretations of emotional arguments, with a focus on the emotional mode of argument introduced in the multi-modal argumentation model (Gilbert, 1994). From there the author shifts from a descriptive account of emotional arguments to a discussion about a normative framework. Pointing out problems with evaluative models of the emotional mode, a paradigmatic shift captured by the Amenable Argumentation Approach is explained as a way forward for the advancement of the emotional mode and multi-modal argumentation.

Women, Art, and Power?seven landmark essays on women artists and women in art history?brings together the work of almost twenty years of scholarship and speculation.

It has been argued by disability advocates that supported decision-making must replace surrogate, or substituted, decision-making for people with cognitive disabilities. From a moral perspective surrogate decision-making it is said to be an indefensible form of paternalism. At the heart of this argument against surrogate decision-making is the belief that such paternalistic action expresses something fundamentally disrespectful about those upon whom it is imposed: that they are inferior, deficient or child-like in some way. Contrary to this widespread belief, I will (...) argue that surrogate decision-making sometimes expresses more respect for people with life-long, ‘severe’ or ‘profound’ cognitive disabilities than does the adoption of supported decision-making.. Specifically, I argue that in some cases supported decision-making can arguably express that people with severe or profound cognitive disabilities lack equal moral value. I also argue that supported decision-making for people with profound cognitive disabilities can arguably express that they lack complex and rich inner lives. If our aim is to ensure our behaviour and practices express respect for people with life-long ‘severe’ or ‘profound’ cognitive disabilities, then sometimes surrogate rather than supportive decision-making will be a better option. History education holds strong potential for students to examine how racism and other intersecting forms of oppression embedded within U.S. institutions have and still impact today’s social fabric. When rooted in Martell and Stevens’ “thinking like an activist” framework, history education provides opportunities for preservice teachers (PSTs) to see, understand, and disrupt the dominant narrative. They can begin to reimagine their roles as future leaders in the classroom and beyond to ensure that all students thrive and not just survive. Thus, (...) for this qualitative study, we engaged our PST in a book study of A Different Mirror for Young People: A History for Multicultural America. Through intentional content and pedagogical choices, we investigated the question, “ How do preservice teachers make sense of history using the ‘thinking like an activist’ framework?” Findings indicated how Takaki’s different mirror, as a counternarrative centering the perspectives and experiences of historically marginalized groups, allowed PSTs 1) to unlearn oppressive structures (cultural preparation), 2) begin to develop a sociopolitical consciousness of systemic oppression, albeit through an outsider’s perspective (critical analysis), and 3) to analyze how collective action in the past enacted change–although through an already, but not yet, understanding of their role in social change in the present (collective action). In this timely book, a Pulitzer Prize-winning reporter trains an autobiographical lens on a moment of remarkable transition in American journalism. Just a few years ago, the mainstream press was wrestling with whether labeling waterboarding as torture violated important norms of neutrality and objectivity. Now, major American newspapers regularly call the president of the United States a liar. Clearly, something has changed as the old rules of "balance" and "two sides to every story" have lost their grip. Is the change (...) for the better? Will it last? In Just a Journalist, Linda Greenhouse--who for decades covered the U.S. Supreme Court for The New York Times--tackles these questions from the perspective of her own experience. A decade ago, she faced criticism from her own newspaper and much of journalism's leadership for a speech to a college alumnae group in which she criticized the Bush administration for, among other things, seeking to create a legal black hole at Guantánamo Bay--two years after the Supreme Court itself had ruled that the detainees could not be hidden away from the reach of federal judges who might hear their appeals. One famous newspaper editor expressed his belief that it was unethical for a journalist to vote, because the act of choosing one candidate over another could compromise objectivity. Linda Greenhouse disagrees. Michel Foucault’s formative years included the study not only of history and philosophy but also of psychology: two years after he took license in philosophy at the Sorbonne in 1948, he took another in psychology, and then obtained, in 1952, a Diplôme de Psycho Pathologie . From his earliest years at the Ecole Normale Superieur he had taken courses on general and social psychology with one of most influential psychologists of the time, Daniel Lagache, who was attempting to integrate psychoanalysis (...) with clinical methods.(Eribon 1991, 42) Foucault’s studies included experimentation and clinical instruction in which patients were presented in an amphitheatre just as in the days of Charcot. For several years after he had received his Diplôme, Foucault continued research in psychopathology, observing practices in mental hospitals, reportedly sometimes volunteering in experiments himself. He purchased the material required to administer Roschach tests, subjecting numerous friends to the inkblots, and became, when it was founded, the honorary president of the French Rorschach organization. Foucault’s first books were on the topic of the psychological characterization of madness and the development of clinical medicine, and his last books addressed the development of psychological norms within the establishment of modern prisons as well as within an increasingly scientific approach to sex. Thus, he worked at the intersections of philosophy and psychology throughout his life. Nonetheless, Foucault reported feeling an intense aversion to psychology no less than to philosophy.(Sheridan 1980, 5) Foucault’s oeuvre is almost exclusively focused on particular knowledges in the human sciences, especially those aspects which pertained to psychological theories of human behavior, capacity, and normative functioning. His historical approach to these, and his emphasis on the role of discourse, is readily reminiscent of Thomas Kuhn’s similarly historical approach to scientific method with its emphasis on the role of paradigms and the untranslatability of paradigm dependent objects.. In previous literature, ethicists mention several goals of Clinical Ethics Support (CES). It is unknown what key persons in healthcare institutions see as main–—and sub-goals of CES. This article presents the goals of CES as perceived by board members and members of ethics support staff. This is part of a Dutch national research using a mixed methods design with questionnaires, focus groups and interviews. Quantitative and qualitative data were analyzed and combined in an iterative process. Four main clusters of goals (...) were found: 1) encouraging an ethical climate, 2) fostering an accountable and transparent organization, 3) developing professionalism and a final goal, overarching the previous three, 4) good care. Most important sub-goals of CES were: attention for ethical issues, raising awareness of ethical issues, fostering ethical reflection and supporting employees. The article ends with a discussion on the desirability to further operationalize the general goal of good care, the context-boundedness of our findings and the need to relate goals of CES to the features of organizational cultures to further improve the integration of CES in healthcare institutions. This chapter surveys the variety of ways in which people who may appear at first to be bystanders, or mere bystanders, to wrongdoing, harm or danger might instead share responsibility with other actors. My discussion divides cases into three rough, non- exclusive categories: (a) shared responsibility for wrongs and harms; (b) shared responsibility to provide aid; and (c) shared responsibility to enforce moral norms. The third category has received the least discussion to date. My modest goal for this portion of (...) the chapter is to highlight some ways in which the responsibilities of witnesses to wrongdoing need to be more thoroughly theorized. But, furthermore, I want to suggest that these cases show that active bystanders are not always preferable to passive ones. Sometimes, it is better for witnesses to wrongdoing to remain mere bystanders. (shrink)

This chapter reviews and evaluates the most common strategies for defending the view that, whatever other reasons might support forgiving in a particular case, forgiveness is defective when the person purporting to forgive lacks standing. Various arguments in favor of limiting standing are used in order to clarify what standing might be. In the end, I endorse an interpretation of standing as the possession of a normative power, which allows for the possibility of third-party forgiveness in some circumstances.

The clinical literature on moral injury sometimes mentions the making of amends as part of a possible treatment plan. However, it is typically unclear how clinicians are conceiving of the making of amends or “atonement,” particularly in the context of the debilitating cluster of symptoms known as moral injury. This chapter reviews some culturally prominent conceptions of atonement. It then raises a number of objections to these and recommends an alternative model – a “reconciliation theory” of atonement – that can (...) avoid these objections. This theory conceives of wrongdoing as damaging relationships among victims, wrongdoers, and communities, and of atonement as repairing this damage. Atonement for serious wrongdoing isn't easy, but it isn't impossible either. Atonement comes in degrees. When pursued well, it offers benefits to victims and communities as well as to wrongdoers themselves. (shrink)

This chapter reflects on public apologies as means of moral repair by considering the various roles the public might play in these moral dramas. Audiences to public apologies include people who are related to the transgression in different ways. This chapter focuses on those parties in front of whom public apologies are intentionally performed but who are neither victims nor wrongdoers. Do such third parties add something of value to the apology? If so, how? How might they play their role (...) well? Under what circumstances might they forgive? How might things go poorly? Abstract:This field survey focused on two constructs that have been developed to represent the ethical context in organizations: ethical climate and ethical culture. We first examined issues of convergence and divergence between these constructs through factor analysis and correlational analysis. Results suggested that the two constructs are measuring somewhat different, but strongly related dimensions of the ethical context. We then investigated the relationships between the emergent ethical context factors and an ethics-related attitude (organizational commitment) and behavior (observed unethical conduct) for (...) respondents who work in organizations with and without ethics codes. Regression results indicated that an ethical culture-based dimension was more strongly associated with observed unethical conduct in code organizations while climate-based dimensions were more strongly associated with observed unethical conduct in non-code organizations. Ethical culture and ethical climate-based factors influenced organizational commitment similarly in both types of organizations. Normative implications of the study are discussed, as are implications for future theorizing, research and management practice. (shrink)

As this latest volume in the Peace & Policy series shows, sports can be an effective mechanism for peacebuilding, especially when incorporated into conflict-resolution programs. Such programs have been designed to bring children together in post-conflict situations with an ultimate goal of reducing future violence. In examining such programs, the volume's contributors ask key questions: "What are the programs achieving?" and "How are they measuring success?" Although such programs have by and large been successful, some issues need to be addressed (...) if these programs are to hone their effectiveness. Among the questions explored in the volume are: various aspects of culture and how they can help shape sports programs; the role of a coach in creating a culture of peace, and how this culture can fit into a peacebuilding process. Contributors also examine the role of sports in trauma relief programs in Rwanda; the role of universities in sports; and the role of sports in the demilitarization of child soldiers. The last three contributors tackle some of the legitimate concerns raised about using sports for peacebuilding, such as sports being competitive, violent, and focused on winning. Contributors look carefully at these and other issues that have arisen in sports as a tool of conflict resolution, discuss why they have become concerns, and consider some possible ways to deal with these concerns in the future.
