Background The emergence of molecular HIV surveillance (MHS) and cluster detection and response (CDR) programs as key features of the United States (US) HIV strategy since 2018 has caused major controversies. HIV surveillance programs that re-use individuals’ routinely collected clinical HIV data do not require consent on the basis that the public benefit of these programs outweighs individuals’ rights to opt out. However, criticisms of MHS/CDR have questioned whether expanded uses of HIV genetic sequence data for prevention reach beyond traditional (...) public health ethics frameworks. This study aimed to explore views on consent within MHS/CDR among critical stakeholders.Methods In 2021 we interviewed 26 US HIV stakeholders who identified as being critical or concerned about the rollout of MHS/CDR. Stakeholders included participants belonging to networks of people living with HIV, other advocates, academics, and public health professionals. This analysis focused on identifying the range of positions among critical and concerned stakeholders on consent affordances, opt-outs, how to best inform people living with HIV about how data about them are used in public health programs, and related ethical issues.Results Participants were broadly supportive of introducing some forms of consent into MHS/CDR. However, they differed on the specifics of implementing consent. While some participants did not support introducing consent affordances, all supported the idea that people living with HIV should be informed about how HIV surveillance and prevention is conducted and how individuals’ data are used.Conclusions MHS/CDR has caused sustained controversy. Among critical stakeholders, consent is generally desirable but contested, although the right for people living with HIV to be informed was centrally supported. In an era of big data-driven public health interventions and routine uses of HIV genetic sequence data in surveillance and prevention, CDC and other agencies should revisit public health ethics frameworks and consider the possibility of consent processes. There is a gap between the methods and techniques discussed in planning and management literature, and practitioners’ experiences of agricultural research and extension. This gap is attributable to the fact that outcomes of research and extension (R&E) initiatives are shaped by the interactions of contending coalitions that form around issues or approaches and promote or oppose them. This framework is used to elucidate the development of technologies and methodologies in the past. Those involved in end-of-life decision making must take into account both legal and ethical issues. What might a theory of mental imagery look like, and how might one begin formulating such a theory? These are the central questions addressed in the present paper. The first section outlines the general research direction taken here and provides an overview of the empirical foundations of our theory of image representation and processing. Four issues are considered in succession, and the relevant results of experiments are presented and discussed. The second section begins with a discussion of the proper form (...) for a cognitive theory, and the distinction between a theory and a model is developed. Following this, the present theory and computer simulation model are introduced. This theory specifies the nature of the internal representations (data structures) and the processes that operate on them when one generates, inspects, or transforms mental images. In the third, concluding, section we consider three very different kinds of objections to the present research program, one hinging on the possibility of experimental artifacts in the data, and the others turning on metatheoretical commitments about the form of a cognitive theory. This book explores the impact of developments in pharmaceutical medicine in the twentieth century on a Christian ethical evaluation of transhumanism and future 'hi tech' medical enhancement technologies. It suggests that the Christian ethical assessment of proposed future radical transhumanist biomedical technologies should be conducted in the light of responses to past medical advances. Two specific case studies are featured, focusing on the oral contraceptive pill and on Prozac and SSRI antidepressants. Whilst future biomedical technologies may have therapeutic benefits for (...) the relief of disease and contribute to improving human health and welfare, the book considers the implications for society and their acceptability as therapies from a Christian perspective. Stressing the inadequacy of natural law alone, the author proposes an ethical framework for assessing novel biomedical technologies according to the effects on personal autonomy, embodiment and bodily life, and on the Imago Dei. This paper seeks to contribute to the debate around sustainability by proposing the need for an ecocentric stance to sustainability that reflexively embeds humans in—rather than detached from—nature. We argue that this requires a different way of thinking about our relationship with our world, necessitating a engagement with the sociomaterial world in which we live. We develop the notion of ecocentrism by drawing on insights from sociomateriality studies, and show how radical-reflexivity enables us to appreciate our embeddedness and responsibility for (...) sustainability by bringing attention to the interrelationship between values, actions and our social and material world. "Anton Wilhelm Amo is the first modern African philosopher to study and teach in a European university and write in the European philosophical tradition. We give an extensive historical and philosophical introduction to Amo's life and work, and provide Latin texts, with facing translations and explanatory notes, of Amo's two philosophical dissertations, On the Impassivity of the Human Mind and the Philosophical Disputation containing a Distinct Idea of those Things that Pertain either to the Mind or to our Living and (...) Organic Body, both published in 1734. The Impassivity is an extended argument that the mind cannot be acted on, that sensation is a being-acted-on by the sensed object, and therefore that sensation does not belong to the mind, and must belong instead to the body The Distinct Idea works out the implications for the mind's actions, and tries to show how the mind understands, wills, and effects things through the body by 'intentions' which direct motions in our body intentionally toward external things. Both dissertations try to show how far each type of human act belongs to the mind, how far to the body, and expose and resolve earlier philosophers' self-contradictions on these questions"--. In this paper we review the factors alleged to be responsible for the creation of inaccurate reports among preschool-aged children, focusing on so-called "source misattribution errors." We present the first round of results from an ongoing program of research that suggests that source misattributions could be a powerful mechanism underlying children′s false beliefs about having experienced fictitious events. Preliminary findings from this program of research indicate that all children of all ages are equally susceptible to making source misattributions. Data from (...) a follow-up wave of data indicate that very young children may be disproportionately vulnerable to these kinds of errors when the procedure is changed slightly to create mental images more easily. This vulnerability leads younger preschoolers, on occasion, to claim that they actually experienced events that they only thought about. These preliminary findings are discussed in the context of the ongoing debate over the veracity and durability of delayed reports of early memories, repressed memories, dissociative states, and the validity risks posed by therapeutic techniques that entail repeated visually guided imagery inductions. Power is an inescapable aspect of all socialrelationships, and inherently is neither goodnor evil. Doctors need power to fulfil theirprofessional obligations to multipleconstituencies including patients, thecommunity and themselves. Patients need powerto formulate their values, articulate andachieve health needs, and fulfil theirresponsibilities. However, both parties canuse or misuse power. The ethical effectivenessof a health system is maximised by empoweringdoctors and patients to develop `adult-adult'rather than `adult-child' relationships thatrespect and enable autonomy, accountability,fidelity and humanity. Even in adult-adultrelationships, conflicts and complexitiesarise. Lack of (...) concordance between doctors andpatients can encourage paternalism but may bebest resolved through negotiated care. Afurther area of conflict involves the `doubleagency' of doctors for both patients and thecommunity. Studies of affect and emotions have blossomed in recent decades across the humanities, neurosciences, and social sciences. In music scholarship, they have often built on the discipline's attention to what music theorists since the Renaissance have described as music's unique ability to arouse passions in listeners. In this timely volume, the editors seek to combine this 'affective turn' with the 'sound turn' in the humanities, which has profitably shifted attention from the visual to the aural, as well as a more (...) recent 'philosophical turn' in music studies. Accordingly, the volume maps out a new territory for research at the intersection of music, philosophy, and sound studies. The essays in Sound and Affect look at objects and experiences in which correlations of sound and affect reside, in music and beyond: the voice as it speaks, stutters, cries, or sings; music, whether vocal, instrumental, or electronic; our sonic environments, whether natural or man-made, and our responses to them. As argued here, far from being stable, correlations of sound and affect are influenced by factors as diverse as race, class, gender, and social and political experience. Examining these factors is key to the project, which gathers contributions from a cross-disciplinary roster of scholars including both established as well as a wealth of new voices. The essays are grouped thematically into sections that move from politics and ethics, to reflections on pre-and post-human "musicking," to the notions of affective listening and music temporalities, to are examination of historical understandings of music and affect. A fundamental understanding of gain provided by motion prediction in wireless ad hoc routing is currently lacking. This paper examines benefits in routing obtainable via prediction. A theoretical best-case non-predictive routing model is quantified in terms of both message overhead and update time for non-predictive routing. This best- case model of existing routing performance is compared with predictive routing. Several specific instances of predictive improvements in routing are examined. Conscience and conscientious objections are important issues in medical law and ethics. However, discussions tend to focus on a particular type of conscience-based claim. These types of claims are based upon predictable, generalizable rules in which an individual practitioner objects to what is otherwise standard medical treatment. However, not all conscience based claims are of this type. There are other claims which are based not on an objection to a treatment in general but in individual cases. In other words, these (...) cases may involve practices which the doctor does not usually object to but does so in this instance on these facts. This paper will explore these types of conscience-based claims in two ways. First, it will explore whether these types of individualised conscience-based claims are really conscience claims at all. Second, it will explore how these claims interact with the other sorts of judgements we expect doctors to make in these cases. (shrink)

Language skirts the somatic fringes of the moment, particularly in practices where the powers of human speech and writing seem nullified. Horse training is one such practice. We tell stories of horse training that sensitize us and bring us close to creatures whose movements, resonating with our own, connect us to a prelinguistic, animate world. In so doing, we bridge the gap between the reflective detachment of our customary, wordy practices and the wordlessness of pre-reflective animality. Yet a phenomenological discursiveness (...) shows us how vital moments of “becoming animal” can be consciously and linguistically sustained. “Becoming horse in the duration of the moment” addresses the corporeally-charged consciousness of being with horses on the ground and in the saddle. This paper describes a relationality and temporality that, though mostly wordless in strictly human terms, speaks a sophisticated language of moment resonance. In so doing, it contests the dualisms of verbal and non-verbal discourses, the separation of humans and other animals, and the divisions that keep somaticity on the fringes of consciousness. It responds to the ecological challenge to get beyond the linguistic appropriation of the other, human speciesism and anthropomorphic projections, in order to discern the kinesthetic and energetic expressivities of connecting with other beings and with the elements of animate existence. Horse training provides a case for “living” in the somatic fullness of the moment. (shrink)

Attention is drawn to the movements of the body and to the ethical imperative that emerges in compelling, flowing moments of teaching. Such moments of teaching are not primarily intellectual, discursive events, but physical, sensual experiences in which the body surrenders to its own movements. Teaching is recognized momentarily as a carnal intensity embedded in and emerging from the flesh. The ethical imperative to this teaching is felt proprioceptively and kinaesthetically when one holds in self-motion the well-being of another as (...) being of the same flesh. The teaching caress offers a primary example. This gesture of intimacy discloses an embodied ethic that contrasts with the transcendental ethics of curricular prescriptions, professional codes of conduct, and the presumptions of self-monitoring behavior. It is a gesture of care for another person, without fastidious carefulness. It is a gesture of pure duration, without sanctimonious purity, in its contact with the beauty, truth and value of the teachable moment. From earliest engagements with children to the dynamics of the university classroom, what makes for good teaching is essentially attentiveness to intimate gestures, such as the caress, that guide teachers kinethically in the moment. Despite a recent economic downturn, there is considerable political and industry pressure to retain or even increase the number of scientists in the UK and other developed countries. Claims are made that the supply of scientists (including engineers and mathematicians) is crucial to the economy and the health of the nation, and a large number of initiatives have been funded to address the problem. We consider these claims in light of a re-analysis of existing figures from 1986 to 2009, for (...) young scientists passing through education and into employment. Science graduates are heavily stratified by social origin, and this sorting takes place during initial schooling just as it does with other 'prestige' subjects. The majority of science graduates then move into initial occupations that are not directly related to their degree, suggesting that at this stage of life at least, the demand for scientists trained in specific areas is more than met by existing numbers. We have no reason to believe that the situation is different to other vocational and non-vocational subjects, so perhaps science is not as special as politicians and business leaders imagine. Perhaps young people are put off careers in science by their education. Or perhaps the incentives are not right, leading to the 'wrong' kinds of students in science, and so wastage and inefficiency in the supply process. More pertinently, perhaps this vocational outcome is not how a developed country should assess the value and importance of scientific knowledge among its population. (shrink)

The rules governing impaired transfers are widely thought to lie at the core of unjust enrichment law. This essay defends two propositions about these rules. First, there is no duty, in the common law, to make restitution of benefits obtained as the result of an impaired transfer . Rather than imposing duties to make restitution, or indeed duties of any kind, the rules governing impaired transfers impose only liabilities, in particular liabilities to judicial rulings. The only legal consequence of a (...) mistaken payment is that the recipient is liable to be judicially ordered to repay a sum of money equal to the payment. Second, it matters that the law governing impaired transfers imposes only liabilities, and not duties, because, inter alia, explaining and justifying liabilities is different from explaining and justifying duties. In particular, certain well-known objections to attempts to explain impaired transfer law can be avoided once it is recognized that this law is concerned exclusively with liabilities. In summary, then, this essay argues that the distinction between duty-imposing and liability-imposing rules has important implications for understanding the foundations of the law governing impaired transfers. Maurice Merleau-Ponty’s ‘flesh of the world’ speaks to an embodied connection to the spaces we inhabit deeply, primally, elementally. Flesh suggests water and its circulations, air and its respirations, earth and its conformations, fire and its inspirations. Flesh speaks to our bodily relations with the elements of a more-than-human world. This paper explores the felt imperative to these relations where, as Merleau-Ponty put it, ‘all distance is traversed’ and wherein movement arises not specifically in the body, but in the nexus (...) and intertwining of bodily engagement with the world. There is a primacy to movement that registers in the living body in its carnal ties to the elements of the world’s flesh. The ‘radical reflection’ on the ‘flesh of the world’ to which this analysis aspires in turn bears upon the general field of gestural reciprocities and connections, providing the insight that intimate gestures of the flesh, such as the embrace, are primordial attunements, motions of rhythm and reciprocity, that emanate from the world in identification with it. The embrace is fundamentally, elementally, a gesture of landscape dwelling. A phenomenology of elemental motions provides the textual reminder that to be at home in various landscapes means to know what it is to be embraced corporeally, sensually, within the human and especially the more-than-human folds of the world. We propose as a UCGIS research priority the topic of “Ontological Foundations for Geographic Information.” Under this umbrella we unify several interrelated research subfields, each of which deals with different perspectives on geospatial ontologies and their roles in geographic information science. While each of these subfields could be addressed separately, we believe it is important to address ontological research in a unitary, systematic fashion, embracing conceptual issues concerning what would be required to establish an exhaustive ontology of the geospatial domain, (...) issues relating to the choice of appropriate methods for formalizing ontologies, and considerations regarding the design of ontology-driven information systems. This integrated approach is necessary, because there is a strong dependency between the methods used to specify an ontology, and the conceptual richness, robustness and tractability of the ontology itself. Likewise, information system implementations are needed as testbeds of the usefulness of every aspect of an exhaustive ontology of the geospatial domain. None of the current UCGIS research priorities provides such an integrative perspective, and therefore the topic of “Ontological Foundations for Geographic Information Science” is unique. (shrink)

The standard account of method (SAM) describes business and management research as a choice between “two traditions”: “qualitative “phenomenological” interpretivism” and “quantitative ‘scientific’ positivism”; each the enemy of the other. Students assemble “advantages and disadvantages” of each, pledge their allegiance, or a preference for “mixed method” (wishing for a “truce” in the “paradigm war”). In our increasingly Fordist academies, these variants attract grade-weightings of typically 20%, defined by “marking schemes” which are also standardised. Fordism is the management strategy of standardisation, (...) deskilling, low unit-cost, simple assembly and central control. We argue that SAM “Fordises” the intellect and confounds our experience that inquiry entails the greatest customisation humanly possible. Moreover, unlike Ford’s River Rouge plant, SAM is plagued by faults: thousands of category mistakes caused by collapsing unrelated methodological dimensions into one simple-looking yet multiply mistaken dichotomy. Happily, natural language facilitates myriad methodological distinctions which untutored inquirers articulate with more facility, pluralism and precision than SAM. By providing better labelling for their easy instincts, naïve inquirers can recognise and revel in what they did not know. (shrink)

This book provides a major review of the state of international theory. It is focused around the issue of whether the positivist phase of international theory is now over, or whether the subject remains mainly positivistic. Leading scholars analyse the traditional theoretical approaches in the discipline, then examine the issues and groups which are marginalised by mainstream theory, before turning to four important new developments in international theory (historical sociology, post-structuralism, feminism, and critical theory). The book concludes with five chapters (...) which look at the future of the subject and the practice of international relations. This survey brings together key figures who have made leading contributions to the development of mainstream and alternative theory, and will be a valuable text for both students and scholars of international relations. BackgroundOne of the next frontiers in HIV research is focused on finding a cure. A new priority includes people with HIV (PWH) with non-AIDS terminal illnesses who are willing to donate their bodies at the end-of-life (EOL) to advance the search towards an HIV cure. We endeavored to understand perceptions of this research and to identify ethical and practical considerations relevant to implementing it.MethodsWe conducted 20 in-depth interviews and 3 virtual focus groups among four types of key stakeholders in the (...) United States (PWH, biomedical HIV cure researchers, HIV clinicians, and bioethicists) to obtain triangulated viewpoints because little was known about the ethics of this topic. Each group was queried as to ethical considerations, safeguards, and protections for conducting HIV cure-related research at the EOL to ensure this research remains acceptable.ResultsAll four key stakeholder groups generally supported HIV cure-related research conducted at the EOL because of the history of altruism within the PWH community and the potential for substantial scientific knowledge to be gained. Our informants expressed that: (1) Strong stakeholder and community involvement are integral to the ethical and effective implementation, as well as the social acceptability of this research; (2) PWH approaching the EOL should not inherently be considered a vulnerable class and their autonomy must be respected when choosing to participate in HIV cure-related research at the EOL; (3) Greater diversity among study participants, as well as multi-disciplinary research teams, is necessitated by HIV cure-related research at the EOL; (4) The sensitive nature of this research warrants robust oversight to ensure a favorable risk/benefit balance and to minimize the possibility of therapeutic misconception or undue influence; and (5) Research protocols should remain flexible to accommodate participants’ comfort and needs at the EOL.ConclusionBecause of the ethical issues presented by HIV cure-related research at the EOL, robust ethical safeguards are of utmost importance. The proposed ethical and practical considerations presented herein is a first step in determining the best way to maximize this research’s impact and social value. More much inquiry will need to be directed towards understanding context-specific and cultural considerations for implementing EOL HIV cure research in diverse settings. (shrink)

A particular research program on mental imagery is defended against certain sweeping methodological criticisms that have been advanced against it. The central claim is that the approach taken in the program is an appropriate response to the problem of doing empirical research in a theoretical vacuum, and that when it is viewed in this perspective, the criticisms are not merely unfounded, they are inappropriate.
