There is an apparent ambiguity in Thomas Hobbes’s account in Leviathan1 of the source of the sovereign’s right to punish. Hobbes appears to both claim and deny that the prospective sovereign is granted the right to punish by prospective subjects. In claiming that the sovereign is granted the right to punish, we understand Hobbes to hold that the acquisition of the right follows from authorization—a process by which a representative is commissioned to act on the behalf of another person. This paper has a threefold purpose: first, to criticize the customary application of Hohfeld’s theory of rights to Hobbes’s juridical/political theory that reduces all Hobbesian rights to Hohfeldian privileges; second, to defend the appropriateness of a proper application of a Hohfeldian analysis of rights to Hobbes’s theory by responding to criticisms offered by Eleanor Curran; and, lastly, to reveal the value a Hohfeldian analysis offers in clarifying a Hobbesian right that has been generally misunderstood in the literature. I argue that (...) a Hohfeldian analysis helps make sense of the complex juridical relationships between the sovereign, the perpetrator of crime, and the victim of crime involved in Hobbes’s treatment of the sovereign’s right to punish. Hylomorphists hold that substances are, in some sense, composites of matter and form. The form of a substance is typically taken to play a fundamental role in determining the unity or identity of the whole. Staunch hylomorphists think that this role is of a kind that precludes the ontological reduction of form to the physical and thus take their position to be inconsistent with physicalism. Forms, according to staunch hylomorphism, play a fundamental role in grounding their bearers’ proper parts and (...) that, it seems, rules out the physical grounding of form itself. I shall develop a physicalist version of hylomorphism that treats form as geometric structure and which, I shall argue, entails many of the central theses endorsed by staunch hylomorphists. Based on Shoemaker’s notion of conditional powers, I shall argue that the geometric structures of complex wholes are the conditions on at least some of the conditional powers of their bearers’ proper parts, transforming those powers into powers simpliciter. Thus, forms play a fundamental role in the dynamical evolution of the physical world, but without bestowing causal powers themselves and hence without violating the causal closure of the physical domain. If a substance’s proper parts are taken to be individuated by their powers simpliciter, then they derive their identities from their places in the substantial whole, which thus determines the identities of its proper parts without changing their intrinsic natures. This collection presents policy and research that addresses digital inequalities, access, and skills, from multiple international perspectives. With a special focus on the impact of the COVID-19, the collection is based on the 2021 Digital Inclusion, Policy and Research Conference, with chapters from both academia and civic organizations. The COVID-19 pandemic has changed citizens’ relationship with digital technologies for the foreseeable future. Many people’s main channels of communication were transferred to digital services, platforms, and apps. Everything ‘went online’: our families, (...) friends, partners, health, work, news, politics, culture, arts and protesting. Yet access to digital technologies remained highly unequal. This brought digital inclusion policy and research to the fore, highlighting to policymakers and the public the ‘hidden’ challenges and impacts of digital exclusion and inequalities. In recent essays, Jürgen Habermas endorses an account of political liberalism much like John Rawls'. Like Rawls, he argues that laws and public policies should be justified only in neutral terms, i.e. in terms of reasons that people holding conflicting world-views could accept. Habermas also, much like Rawls, distinguishes reasonable religious citizens, whose views should be included in public discourse, from unreasonable citizens in his expectation that religious citizens self-modernize. But in sharing these Rawlsian features, Habermas is vulnerable to some (...) of the same objections posed to Rawls. In this article I assess Habermas' ability to overcome two objections frequently posed to Rawls: (1) that religious citizens are unfairly expected to split their identities in public discourse, and (2) that the burdens of citizenship are asymmetrically distributed. I conclude that while he may be able to overcome the second, the first remains a problem for him. (shrink)

This study explores the status quo regarding the interface between marketing, social and environmental issues, culture and consumers, and strategic management by integrating sustainability. A qualitative display network technique, based on the bibliometric methodology of co-citation analysis, was applied to examine research clusters. An integrative review was conducted to explain the connections within these clusters. To evaluate potential patterns among the studies through citations, different sets of relationships among applicable sustainability theories in marketing practice were paired in different sets and (...) analyzed. After mapping the scientific structure of journal publications and intellectual linkages, six cluster groups emerged, reflecting the important role of marketing in linking sustainability, society, environment, consumers, and corporate sustainable development. This study contributes to social and marketing research and corporate sustainability practice by categorizing the intellectual structural network within various streams and indicating the influence of social and cultural notions on consumer-focused sustainable marketing. It is commonly held that there is no place for the 'now’ in physics, and also that the passing of time is something subjective, having to do with the way reality is experienced but not with the way reality is. Indeed, the majority of modern theoretical physicists and philosophers of physics contend that the passing of time is incompatible with modern physical theory, and excluded in a fundamental description of physical reality. This book provides a forceful rebuttal of such claims. (...) In successive chapters the author explains the historical precedents of the modern opposition to time flow, giving careful expositions of matters relevant to becoming in classical physics, the special and general theories of relativity, and quantum theory, without presupposing prior expertise in these subjects. Analysing the arguments of thinkers ranging from Aristotle, Russell, and Bergson to the proponents of quantum gravity, he contends that the passage of time, understood as a local becoming of events out of those in their past at varying rates, is not only compatible with the theories of modern physics, but implicit in them. This note criticizes the political consequences Feyerabend draws from his ?epistemological anarchism?. Democratic relativism holds that since no traditions are ?true?, all must be given equal status in a free society. A basic protective structure is required, though, to keep the various institutions from overwhelming one another. I argue that Feyerabend provides no assurance that the protective structure would not be taken over by particular institutions; parallel problems exist for education. Hence Feyerabend's proposal is unworkable in principle. Furthermore it is (...) undesirable since members of traditions would not wish to have their beliefs regarded as ?one set among many?. The pluralism Feyerabend wants already exists naturally in nontotalitarian societies; hence the institutionalization of pluralism is unnecessary and would do more harm than good. (shrink)

On the Suffering of the World is a collection of the later aphoristic writings of Arthur Schopenhauer, known for their incisive, aphoristic style and dark, pessimistic view of human existence. Edited and with an introduction by Eugene Thacker, On the Suffering of the World comprises a core selection of Schopenhauer's later writings, gathered together for the first time in print. These texts, produced during the last decades of Schopenhauer's long life, reveal a unique kind of philosophy, expressed in a (...) singular style. Eschewing the tradition of dry, totalizing, academic philosophy prevalent during the time, Schopenhauer's later writings mark a shift towards a philosophy of aphorisms, fragments, anecdotes and observations, written in a literary style that is by turns antagonistic, resigned, confessional, and filled with all the fragile contours of an intellectual memoir. Here Schopenhauer allows himself to pose challenging questions regarding the fate of the human species, the role of suffering in the world, and the rift between self and world that increasingly has come to define human existence, to this day. It is these writings of Schopenhauer that later generations of artists, poets, musicians, and philosophers would identify as exemplifying the pessimism of their era, and perhaps of our own as well. On the Suffering of the World is presented with an introduction that places Schopenhauer's thought in its intellectual context, while also connecting it to contemporary concerns over climate change, the anthropocene, and the spectre of human extinction. Western music is characterized primarily by simple meters, but a number of other musical cultures, including Turkish, have both simple and complex meters. In Experiment 1, Turkish and American adults with and without musical training were asked to detect metrical changes in Turkish music with simple and complex meter. Musicians performed significantly better than nonmusicians, and performance was significantly better on simple meter than on complex meter, but Turkish listeners performed no differently than American listeners. In Experiment 2, members of (...) Turkish classical and folk music clubs who were tested on the same materials exhibited comparable sensitivity to simple and complex meters, unlike the American and Turkish listeners in Experiment 1. Together, the findings reveal important effects of musical training and culture on meter perception: trained musicians are generally more sensitive than nonmusicians, regardless of metrical complexity, but sensitivity to complex meter requires sufficient exposure to musical genres featuring such meters. Karen Warren claims that there is a “logic of domination” at work in the oppressive conceptual frameworks informing both sexism and naturism. Although her account of the principle of domination as a connection between oppressions has been an influential one in ecofeminist theory, it has been challenged by recent criticism. Both Karen Green and John Andrews maintain that the principle of domination,as Warren articulates it, is ambiguous. The principle, according to Green, admits of two possible readings, each of which she (...) finds flawed. Similarly, Andrews claims that the principle is fundamentally inadequate because it cannot distinguish cases of oppressive domination from cases of nonoppressive domination. In this paper, I elucidate Warren’s views and defend her against these and other criticisms put forward by Green and Andrews. I show that Warren’s account of “the logic of domination” successfully illuminates important conceptual features of oppression. (shrink)

The present narrative review seeks to unravel where we are now, and where we need to go to delineate the active ingredients in psychotherapy delivered by conversational agents (e.g., chatbots). While psychotherapy delivered by conversational agents has shown promising effectiveness for depression, anxiety, and psychological distress across several randomized controlled trials, little emphasis has been placed on the therapeutic processes in these interventions. The theoretical framework of this narrative review is grounded in prominent perspectives on the active ingredients in psychotherapy. (...) Based on search terms derived from various theoretical perspectives, we conducted a systematic literature search of four scientific databases and identified 17 studies. Across the selected studies, three themes emerged: relationship variables, emotional venting, and cognitive factors. While methodological issues compromise the epistemic value of this evidence base, core questions also remain to be answered. Such questions include, but are not limited to, whether humans can form affectionate bonds to inanimate beings and whether these kind of mental health treatments should be understood as psychotherapy or something else. Researchers should therefore be cautious when applying theories of psychotherapy in the realm of conversational agents. We conclude the paper by introducing recommendations for future research, which we hope will help instigate methodologically sound studies in this field. (shrink)

Fred Alford contends that the manner in which I objected to Feyerabend's democratic relativism is vulnerable to Feyerabend's rhetorical strategy, and that a better strategy would be to show that Feyerabend fails to demonstrate that democratic relativism is desirable. I reply in defense of the ?plausibility? issue on the grounds that Feyerabend's theory lends itself to uses (and abuses) beyond Utopian critique (in Alford's sense). I argue that it is the fact that critics ? myself included ? have assumed (...) the burden of demonstrating the impossibility of Feyerabend's political theory that has led to the stalemate Alford describes, and that we may retain the ?plausibility? question while avoiding the stalemate by placing the burden of argument on Feyerabend to show that his theory is plausible. The winning entry in a competition held by the Royal Norwegian Society of Sciences, Schopenhauer's 1839 essay brought its author international recognition. Its brilliant and elegant treatments of free will and determinism elevated it to a classic of Western philosophy, and its penetrating reflections still remain relevant. Schopenhauer makes a distinction between freedom of acting (which he endorses) and the freedom of willing (which he refutes) in a clear and rigorous treatment that reveals many basic features of his philosophy. This paper examines a style of political justification prominent in contemporary liberalism, according to which policies are legitimate only if they can be shown to be acceptable to all. Although this approach is often associated with neutrality about the good life, it is argued that liberalism cannot be neutral about questions of the role of various goods, such as work, play and community. The paper closes by exploring the implications and applicability of this account of justification to contemporary political practice.

Schopenhauer believed in the supremacy of will over intellect, and he wrote extensively on the motivations behind actions. These six essays, drawn from Parerga and posthumously published works, include observations on government, free will and fatalism, character, moral instinct, and ethics. They reflect the author's wide range of interests and offer an accessible approach to his_philosophy.

In his 1926 lectures on metaphysical poetry, T. S. Eliot describes the work of Jules Laforgue as the “nearest verse equivalent to the philosophies of Schopenhauer and Hartmann,” a literary rendition of their philosophies of the unconscious and of annihilation.1 Yet, Eliot suggests, in Laforgue the system of Schopenhauer ultimately collapses; the poet does not find in the philosopher that metaphysical balance between thought and feeling he so desperately craves. The dialogue contains an ancient statement of the social contract theory of government.
