BackgroundIn specific situations it may be necessary to make an exception to the general rule of informed consent for scientific research with an intervention. Earlier reviews only described subsets of arguments for exceptions to waive consent.MethodsHere, we provide a more extensive literature review of possible exceptions to the rule of informed consent and the accompanying arguments based on literature from 1997 onwards, using both Pubmed and PsycINFO in our search strategy.ResultsWe identified three main categories of arguments for the acceptability of (...) a consent waiver: data validity and quality, major practical problems, and distress or confusion of participants. Approval by a medical ethical review board always needs to be obtained. Further, we provide examples of specific conditions under which consent waiving might be allowed, such as additional privacy protection measures.ConclusionsThe reasons legitimized by the authors of the papers in this overview can be used by researchers to form their own opinion about requesting an exception to the rule of informed consent for their own study. Importantly, rules and guidelines applicable in their country, institute and research field should be followed. Moreover, researchers should also take the conditions under which they feel an exception is legitimized under consideration. After discussions with relevant stakeholders, a formal request should be sent to an IRB. (shrink)

We argue that explainable artificial intelligence (XAI), specifically reason-giving XAI, often constitutes the most suitable way of ensuring that someone can properly be held responsible for decisions that are based on the outputs of artificial intelligent (AI) systems. We first show that, to close moral responsibility gaps (Matthias 2004), often a human in the loop is needed who is directly responsible for particular AI-supported decisions. Second, we appeal to the epistemic condition on moral responsibility to argue that, in order to (...) be responsible for her decision, the human in the loop has to have an explanation available of the system’s recommendation. Reason explanations are especially well-suited to this end and we examine whether – and how – it might be possible to make such explanations fit with AI systems. We support our claims by focusing on a case of disagreement between human in the loop and AI system. (shrink)

Cofactor squelching is the term used to describe competition between transcription factors (TFs) for a limited amount of cofactors in a cell with the functional consequence that TFs in a given cell interfere with the activity of each other. Since cofactor squelching was proposed based primarily on reporter assays some 30 years ago, it has remained controversial, and the idea that it could be a physiologically relevant mechanism for transcriptional repression has not received much support. However, recent genome‐wide studies have (...) demonstrated that signal‐dependent TFs are very often absent from the enhancers that are acutely repressed by those signals, which is consistent with an indirect mechanism of repression such as squelching. Here we review these recent studies in the light of the classical studies of cofactor squelching, and we discuss how TF cooperativity in so‐called hotspots and super‐enhancers may sensitize these to cofactor squelching. ZusammenfassungDieser Artikel beleuchtet die tragende Rolle, die Umweltdenken und Umgebungswissen für die Legitimation traditioneller Geschlechterrollen im 20. Jahrhundert spielten. Gezeigt wird, auf welche Weise einflussreiche psychologische und psychoanalytische Konzepte der Kindes- und Persönlichkeitsentwicklung Frauen dazu anhielten, sozio-naturale Umwelten herzustellen, ja, selbst Umwelt zu sein. Expertinnen und Experten verschiedener Denkrichtungen und Generationen propagierten ein ganz ähnliches Bild femininer „Environmentalität“, das heißt: der Disposition und Bestimmung der Frau, Umwelten zu erzeugen und zu verkörpern, die eine gesunde Kindesentwicklung ermöglichen und das Wohlbefinden und (...) den Erfolg des Mannes, gar den Erhalt der gesellschaftlichen Ordnung begünstigen sollten. Dieses Konstrukt weiblichen Umwelt-Seins verpflichtete Frauen auf Ehe und Vollzeitmutterschaft und fixierte sie in Raum und Zeit. Sein reaktionärer Gebrauch in Auseinandersetzungen über alternative weibliche Lebensentwürfe demonstriert, dass leitende Konzeptionen von Entwicklung, Wohlergehen und Identität nicht nur androzentrisch, sondern antifeministisch waren. To successfully learn using open Internet resources, students must be able to critically search, evaluate and select online information, and verify sources. Defined as critical online reasoning, this construct is operationalized on two levels in our study: the student level using the newly developed Critical Online Reasoning Assessment, and the online information processing level using event log data, including gaze durations and fixations. The written responses of 32 students for one CORA task were scored by three independent raters. The resulting (...) score was operationalized as “task performance,” whereas the gaze fixations and durations were defined as indicators of “process performance.” Following a person-oriented approach, we conducted a process mining analysis, as well as a latent class analysis to test whether—following the dual-process theory—the undergraduates could be distinguished into two groups based on both their process and task performance. Using PM, the process performance of all 32 students was visualized and compared, indicating two distinct response process patterns. One group of students, defined as “strategic information processers,” processed online information more comprehensively, as well as more efficiently, which was also reflected in their higher task scores. In contrast, the distributions of the process performance variables for the other group, defined as “avoidance information processers,” indicated a poorer process performance, which was also reflected in their lower task scores. In the LCA, where two student groups were empirically distinguished by combining the process performance indicators and the task score as a joint discriminant criterion, we confirmed these two COR profiles, which were reflected in high vs. low process and task performances. The estimated parameters indicated that high-performing students were significantly more efficient at conducting strategic information processing, as reflected in their higher process performance. These findings are so far based on quantitative analyses using event log data. To enable a more differentiated analysis of students’ visual attention dynamics, more in-depth qualitative research of the identified student profiles in terms of COR will be required. (shrink)

This article shows how environmental and ambient constructions were used to legitimate traditional gender roles in twentieth-century Europe and the United States. It demonstrates the normative and reactionary character of influential psychological and psychoanalytic theories of childhood and personality development, which instructed women to create, even embody social and emotional environments. This body of thought spanned diverse psychoanalytic schools and extended across generations of psychological experts. They put forth a notion of feminine “environmentality” postulating a woman’s disposition to create, even (...) personify an environment that facilitated normal child development as well as a man’s professional success—and, ultimately, sustained the social order. This construction of women as essentially environmental beings bound them to matrimony and full-time, at-home motherhood, fixing their lives in space and time. It provided a powerful weapon against alternative life-styles and feminist critiques, suggesting that leading conceptions of development, well-being, and identity were not just androcentric, but indeed anti-feminist. Critical reasoning (CR) when confronted with contradictory information from multiple sources is a crucial ability in a knowledge-based society and digital world. Using information without critically reflecting on the content and its quality may lead to the acceptance of information based on unwarranted claims. Previous personal beliefs are assumed to play a decisive role when it comes to critically differentiating between assertions and claims and warranted knowledge and facts. The role of generic epistemic beliefs on critical stance and attitude in (...) reflectively dealing with information is well researched. Relatively few studies have been conducted on the influence of domain-specific beliefs, i.e. beliefs in relation to specific content encountered in a piece of information or task, on the reasoning process, and on how these beliefs may affect the information-processing and decision-making processes. This study focuses on students’ task- and topic-related beliefs that may influence their reasoning when dealing with multiple and partly contradictory sources of information. To validly assess CR among university students, we used a newly developed computer-based performance assessment in which the students were confronted with an authentic task which contains theoretically defined psychological stimuli for measuring CR. To investigate the particular role of task- and topic-related beliefs on CR, a purposeful sample of 30 university students took part in a performance assessment and then were interviewed immediately afterwards. In the semi-structured cognitive interviews, the participants’ task-related beliefs were assessed. Based on qualitative analyses of the interview transcripts, three distinct profiles of decision-making among students have been identified. More specifically, the different types of students’ beliefs and attitudes derived from the cognitive interview data suggest their influence on information processing, reasoning approaches and decision-making. The results indicated that the students’ beliefs had an influence on their selection, critical evaluation and use of information as well as on their reasoning processes and final decisions. (shrink)

Combining philosophical analysis with qualitative empirical inquiry, this book provides a comparative case study of mono- and interdisciplinary research groups, offering insight into the day-to-day practice of scientists. There is a trade-off between specificity and accuracy in existing models of belief. Descriptions of agents in the tripartite model, which recognizes only three doxastic attitudes—belief, disbelief, and suspension of judgment—are typically accurate, but not sufficiently specific. The orthodox Bayesian model, which requires real-valued credences, is perfectly specific, but often inaccurate: we often lack precise credences. I argue, first, that a popular attempt to fix the Bayesian model by using sets of functions is also inaccurate, since it requires us to (...) have interval-valued credences with perfectly precise endpoints. We can see this problem as analogous to the problem of higher order vagueness. Ultimately, I argue, the only way to avoid these problems is to endorse Insurmountable Unclassifiability. This principle has some surprising and radical consequences. For example, it entails that the trade-off between accuracy and specificity is in-principle unavoidable: sometimes it is simply impossible to characterize an agent’s doxastic state in a way that is both fully accurate and maximally specific. What we can do, however, is improve on both the tripartite and existing Bayesian models. I construct a new model of belief—the minimal model—that allows us to characterize agents with much greater specificity than the tripartite model, and yet which remains, unlike existing Bayesian models, perfectly accurate. This paper sets out from the hypothesis that the embodied competences and expertise which characterise dance and sports activities have the potential to constructively challenge and inform phenomenological thinking. While pathological cases present experiences connected to tangible bodily deviations, the specialised movement practices of dancers and athletes present experiences which put our everyday experiences of being a moving body into perspective in a slightly different sense. These specialised experiences present factual variations of how moving, sensing and interacting can be like (...) for us as body-subjects. To use of these sources inevitably demands that qualitative research methodologies – especially short-term ethnographical fieldwork – form part of the research strategy and qualify the way the researcher involves a second-person perspective when interviewing dancers and athletes about their experiences. In the subsequent phases analysing the data generated, I argue that researchers first strive to achieve internal consistency of empirical themes identified in the case of movement practices in question thus keeping to a contextualised and lived perspective, also denoted as an emic perspective. In subsequent phases phenomenological insights are then actively engaged in the exploration and discussion of the possible transcendental structures making the described subjective experiences possible. The specialised and context-defined experiences of ‘what a moving body can be like’ are accordingly involved as factual variations to constructively add to and potentially challenge phenomenological descriptions. Lastly, I exemplify how actual research strategies have been enacted in a variety of projects involving professional dancers’, golfers’ and sports dancers’ practices and experiences, respectively. ABSTRACT: This paper serves two purposes: (i) it can be used by students as an introduction to chapters 1-5 of book iii of the NE; (ii) it suggests an answer to the unresolved question what overall objective this section of the NE has. The paper focuses primarily on Aristotle’s theory of what makes us responsible for our actions and character. After some preliminary observations about praise, blame and responsibility (Section 2), it sets out in detail how all the key notions (...) of NE iii 1-5 are interrelated (Sections 3-9). The setting-out of these interconnections makes it then possible to provide a comprehensive interpretation of the purpose of the passage. Its primary purpose is to explain how agents are responsible for their actions not just insofar as they are actions of this kind or that, but also insofar as they are noble or base: agents are responsible for their actions qua noble or base, because, typically via choice, their character dispositions are a causal factor of those actions (Section 10). The paper illustrates the different ways in which agents can be causes of their actions by means of Aristotle’s four basic types of agents (Section 11). A secondary purpose of NE iii 1-5 is to explain how agents can be held responsible for consequences of their actions (Section 12), in particular for their character dispositions insofar as these are noble or base, i.e. virtues or vices (Section 13). These two goals are not the only ones Aristotle pursues in the passage. But they are the ones Aristotle himself indicates in its first sentence and summarizes in its last paragraph; and the ones that give the passage a systematic unity. The paper also briefly consider the issues of freedom-to-do-otherwise, free choice and free-will in the contexts in which they occur (i.e. in the final paragraphs of Sections 6, 7, 12, 13). (shrink)

The normative force of evidence can seem puzzling. It seems that having conclusive evidence for a proposition does not, by itself, make it true that one ought to believe the proposition. But spelling out the condition that evidence must meet in order to provide us with genuine normative reasons for belief seems to lead us into a dilemma: the condition either fails to explain the normative significance of epistemic reasons or it renders the content of epistemic norms practical. The first (...) aim of this paper is to spell out this challenge for the normativity of evidence. I argue that the challenge rests on a plausible assumption about the conceptual connection between normative reasons and blameworthiness. The second aim of the paper is to show how we can meet the challenge by spelling out a concept of epistemic blameworthiness. Drawing on recent accounts of doxastic responsibility and epistemic blame, I suggest that the normativity of evidence is revealed in our practice of suspending epistemic trust in response to impaired epistemic relationships. Recognizing suspension of trust as a form of epistemic blame allows us to make sense of a purely epistemic kind of normativity the existence of which has recently been called into doubt by certain versions of pragmatism and instrumentalism. Eva Schmidt argues that facts about incoherent beliefs can be non-evidential epistemic reasons to suspend judgment. In this commentary, I argue that incoherence-based reasons to suspend are epistemically superfluous: if the subjects in Schmidt’s cases ought to suspend judgment, then they should do so merely on the basis of their evidential reasons. This suggests a more general strategy to reduce the apparent normativity of coherence to the normativity of evidence. I conclude with some remarks on the independent interest (...) that reasons-first epistemology might have within an evidentialist framework. (shrink)

How can we be responsible for our attitudes if we cannot normally choose what we believe, desire, feel, and intend? This problem has received much attention during the last decades, both in epistemology and in ethics. Yet its connections to discussions about reasons and rationality have been largely overlooked. Responsibility for Rationality is the first book that connects recent debates on responsibility and on rationality in a unifying dialectic. It achieves four main goals: first, it reinterprets the problem of responsibility (...) for attitudes as a problem about the normativity of rationality; second, it breaks the stalemate between rationalist and voluntarist accounts of mental responsibility by defending a hybrid view; third, it provides novel support to recent accounts of the normativity of rationality by arguing that epistemic reasons and other ‘right-kind’ reasons are genuine normative reasons; fourth, it sets the foundations and the research agenda for an ‘ethics of mind’, including an illustration of how to approach applied issues in epistemology within the presented framework. Many of our attitudes are non-culpable: there was nothing that we should have done to avoid holding them. I argue that we can still be blameworthy for non-culpable attitudes: they can impair our relationships in ways that make our full practice of apology and forgiveness intelligible. My argument poses a new challenge to indirect voluntarists, who attempt to reduce all responsibility for attitudes to responsibility for prior actions and omissions. Rationalists, who instead explain attitudinal responsibility by appeal to reasons-responsiveness, can (...) make sense of blameworthiness for non-culpable attitudes. On March 11, 2020 the World Health Organization classified COVID‐19, caused by Sars‐CoV‐2, as a pandemic. Although not much was known about the new virus, the first outbreaks in China and Italy showed that potentially a large number of people worldwide could fall critically ill in a short period of time. A shortage of ventilators and intensive care resources was expected in many countries, leading to concerns about restrictions of medical care and preventable deaths. In order to be prepared for (...) this challenging situation, national triage guidance has been developed or adapted from former influenza pandemic guidelines in an increasing number of countries over the past few months. In this article, we provide a comparative analysis of triage recommendations from selected national and international professional societies, including Australia/New Zealand, Belgium, Canada, Germany, Great Britain, Italy, Pakistan, South Africa, Switzerland, the United States, and the International Society of Critical Care Medicine. We describe areas of consensus, including the importance of prognosis, patient will, transparency of the decision‐making process, and psychosocial support for staff, as well as the role of justice and benefit maximization as core principles. We then probe areas of disagreement, such as the role of survival versus outcome, long‐term versus short‐term prognosis, the use of age and comorbidities as triage criteria, priority groups and potential tiebreakers such as ‘lottery’ or ‘first come, first served’. Having explored a number of tensions in current guidance, we conclude with a suggestion for framework conditions that are clear, consistent and implementable. This analysis is intended to advance the ongoing debate regarding the fair allocation of limited resources and may be relevant for future policy‐making. (shrink)

This book offers a new account of what it is to act for a normative reason. The first part of the book examines the problems of causal accounts of acting for reasons and suggests to solve them by a dispositional approach. The author argues for a dispositional account which unites epistemic, volitional, and executional dispositions in a complex normative competence. This ‘Normative Competence Account’ allows for more and less reflective ways of acting for normative reasons. The second part of the (...) book clarifies the relation between the normative reason that an agent acts for and his or her motivating reasons. It refutes the widely held ‘identity view’ that acting for a normative reason requires the normative reason to be identical with a motivating reason. The author describes how normative reasons are related to motivating reasons by a relation of correspondence, and proposes a new understanding of how normative reasons explain those actions that are performed for them. Determined by Reasons engages with current debates from a wide range of different philosophical areas, including action theory, metaethics, moral psychology, epistemology, and ontology, to develop a new account of acting for normative reasons. Langer reviews, in this article, published by Fortune Magazine in 1944, some fundamental themes of her most renowned work, Philosophy in a New Key, firstly edited in 1942. The author sums up her anthropological conception, through an accessible language intended to a general public, examining topics such as the specific trait of our mentality; the distinction between signs and symbols, as well as between the domains of the real and the possible; symbolic transformation; the essence of language; the importance of non-discursive articulate forms for human expression and cognition; the relationship between reason and lunacy. In addition to that synthesis, Langer relates those aspects, in an insightful and opportune way, to the war period when this article was written, observing, as a symptom of the cultural crisis of that time, the loss of symbolic references and the substitution of the old symbols (mythical and religious) for the one of nationalism. Although artificial intelligence has been given an unprecedented amount of attention in both the public and academic domains in the last few years, its convergence with other transformative technologies like cloud computing, robotics, and augmented/virtual reality is predicted to exacerbate its impacts on society. The adoption and integration of these technologies within industry and manufacturing spaces is a fundamental part of what is called Industry 4.0, or the Fourth Industrial Revolution. The impacts of this paradigm shift on the human operators (...) who continue to work alongside and symbiotically with these technologies in the industry bring with it novel ethical issues. Therefore, how to design these technologies for human values becomes the critical area of intervention. This paper takes up the case study of robotic AI-based assistance systems to explore the potential value implications that emerge due to current design practices and use. The design methodology known as Value Sensitive Design (VSD) is proposed as a sufficient starting point for designing these technologies for human values to address these issues. (shrink)

When animal ethicists deal with welfare they seem to face a dilemma: On the one hand, they recognize the necessity of welfare concepts for their ethical approaches. On the other hand, many animal ethicists do not want to be considered reformist welfarists. Moreover, animal welfare scientists may feel pressed by moral demands for a fundamental change in our attitude towards animals. The analysis of this conflict from the perspective of animal ethics shows that animal welfare science and animal ethics highly (...) depend on each other. Welfare concepts are indispensable in the whole field of animal ethics. Evidence for this can be found by analyzing the structure of theories of animal ethics and the different ways in which these theories employ welfare concepts. Furthermore, the background of values underneath every welfare theory is essential to pursue animal welfare science. Animal ethics can make important contributions to the clarification of underlying normative assumptions with regard to the value of the animal, with regard to ideas about what is valuable for the animal, and with regard to the actions that should follow from the results of animal welfare science. We discuss the astronomical underpinning of the improved calendar of 1700. Starting from the astronomical motivation of the Gregorian calendar of 1582 and the rejection of this reform in Protestant states in Europe, we describe how the astronomical Easter reckoning based on Kepler’s Rudolphine tables led to the foundation of Berlin Observatory and enabled the founding of the Electoral Brandenburg Society of Sciences, which had to finance itself through a calendar monopoly.
