By putting existential phenomenology into conversation with virtue ethics, this book offers a new interpretation of human flourishing. It rejects characterizations of flourishing as either a private subjective state or an objective worldly status, arguing that flourishing is rather a successfully negotiated self-world fit – a condition involving both the essential dependence of the self upon the world and others, and the lived normative responsiveness of the agent striving to be in the world well. A central argument of the book (...) is that there is an irreducible normative plurality arising from the different practical perspectives we can adopt – the first, second, and third-person stances – all of which make different kinds of normative claim that we understand ourselves as having reason to meet. Flourishing is human excellence within each of these normative domains achieved in such a way that success in one domain does not compromise success in another. Existential Flourishing provides a correspondingly transformed interpretation of the virtues as solutions to various existential problems we face in responding to these normative domains. The book also addresses traditional problems in virtue ethics and analyzes the structure of four virtues in detail: justice, patience, modesty, and courage. (shrink)

Recent attempts to explain why modesty should be considered a virtue have failed. A more adequate account is that modesty involves understanding how far one's accomplishments ought to be taken as definitive of one's value. Modest people communicate this self-understanding through behaviour motivated by the desire to ensure that their accomplishments do not cause pain to others. This virtuous mode of self-awareness involves recognizing that one is both defined by social standards of success and irreducible to these assessments. Modest agents (...) do not think themselves ‘better’ than others, but recognize that they rank higher on the particular social standard in question. They thus both avoid causing pain and serve as exemplars of virtuous self-responsibility. (shrink)

The notion of radical evil plays a more important role in Kant's moral theory than is typically recognized. In Religion Within the Limits of Mere Reason, radical evil is both an innate propensity and a morally imputable act – a paradoxical status that has prompted commentators to reject it as inconsistent with the rest of Kant's moral theory. The received view of Martin Heidegger’s work is that he leaves little room for reason in the practice of philosophy or the conduct of life. Citing his much-scorned remark that reason is the “stiff-necked adversary of thought”, critics argue that Heidegger’s philosophy effectively severs the tie between reason and normativity, leaving anyone who adheres to his position without recourse to justifying reasons for their beliefs and actions. Transcending Reason is a collection of essays by leading Heidegger scholars that challenges this (...) view by exploring new ways to understand Heidegger’s approach to the relationship between reason, normativity, and the philosophical methodology that gives us access to these issues. The volume points to Heidegger’s novel approach to reason understood in terms of what he calls Dasein’s ‘transcendence’—the ability to occupy the world as a space of normatively structured meanings in which we navigate our striving to be. By examining the strengths and weaknesses of this new and innovative take on Heidegger’s philosophy, this collection considers the possibility that he does not sever but rather reconceives the relation between reason and normativity. -/- . In this paper I respond to the view that Heidegger is unable to account for the possibility of immediately experiencing others in their concrete particularity. Critics have argued that since Mitsein characterizes Dasein’s mode of being regardless of the presence or absence of others, Heidegger has essentially granted it the status of an a priori category. In doing so, they argue, Heidegger reduces the other to a mere interchangeable token whose uniqueness is subsumed under the generality of the established category. (...) In contrast, I argue that the Heideggerian ‘a priori’ must be understood as a living responsiveness to particularity, not a top-down imposition of abstract categoriality. The argument further shows that this responsiveness must be understood in terms of temporal particularity. The bulk of the paper then demonstrates the nature of such responsiveness when it is the temporal particularity of the other Dasein that is being encountered. I show that such encounters are a necessary condition for the possibility of world time and the worldly space of shared significance. Because my encounter with the other Dasein is a direct experience of her originary temporality—the fundamental expression of her concrete care-defined way of being—such encounters are not simple subsumptions of the other to an a priori category. They are, rather, a temporal responsiveness to the unique mode of intuitive givenness characterizing other Dasein. (shrink)

In response to Mark D. White's Kantian critique of my article "A Modest Proposal: Accounting for the Virtuousness of Modesty," I argue that invoking Kant's notions of dignity and respect in order to provide an egalitarian account of modesty brings with it conceptual commitments that are not always easy to reconcile with the moral phenomenology of that virtue. In light of this I question White's claim that a Kantian account of modesty offers a better explanation than the existential phenomenological approach (...) that I endorse. (shrink)

This paper argues that an essential and often overlooked feature of jealousy is the sense that one is entitled to the affirmation provided by the love relationship. By turning to Sartre's and Beauvoir's analyses of love and its distortions, I will show how the public nature of identity can inhibit the possibility of genuine love. Since we must depend on the freedom of others to show us who we are, the uncertainty this introduces into one's sense of self can trigger (...) anxiety and pathological attempts to control those others upon whom one's self-value depends. In jealousy one tries to possess the other person's freedom in the hopes that a constant positive evaluation can be thereby secured. The belief that one is entitled to the self-perfection that such affirmation promises reveals both the important existential role that the beloved plays in the jealous person's psychic structure and the manner in which gender inequalities can promote such distortions of love. In this paper I consider the essential role that public memory plays in the establishment and maintenance of the political arena and its space of appearance. Without this space and the shared memory that allows it to appear, Hannah Arendt argues, transience and finitude would consume the excellence of word and deed—just as the "natural ruin of time" consumes its mortal performer. The modern era displays a kind of mnemonic failure, however, a situation arising not only from technological developments that (...) "outsource" memory but from several normative breakdowns that Arendt describes as characteristic of modernity. The consequence is the individual's loss of personal, living access to the community's memories, and the community's own failure to engage in the difficult choice of what counts as worthy of preservation. In failing to ask this question, however, the community abdicates responsibility for establishing the shared norms by which it will govern itself in times of crisis. (shrink)

For both Levinas and Løgstrup, the moral encounter is characterized by an asymmetrical prioritization of the other over the self. Some take Løgstrup’s account to be an improvement on Levinas’s, however, insofar as it appears to both foreswear the hyperbole of the latter’s view and ground the ethical claim in the natural conditions of human life. This paper argues, in contrast, that Løgstrup’s own account is equally hyperbolic in its characterization of the self as fundamentally evil, and that his attempt (...) to ground the ethical demand in structures of ‘life’ raises serious difficulties. I will argue that Levinas’s stronger commitment to phenomenology both rules out the problematic metaphysical claims on which Løgstrup’s ontological ethics depends and helps explain the methodological function of Levinas’s own hyperbole. Unlike Løgstrup, Levinas insists that the challenge is not eradicating the claims of the self, but rather resisting its pretention to a global normative priority. In making this case I refute the argument that Levinas, unlike Løgstrup, is committed to a ‘command’ view of morality—whereby it is the other person’s authoritative status that underwrites the moral force of the claim, not the content of the claim itself. But on Levinas’s view, ‘demand’ and ‘command’ accounts merge in his understanding of the face-to-face encounter because responding to the content of the demand—that I treat the other’s claim as reason-giving— just is to see the other person as an authority capable of making legitimate claims on me. This book offers the first edited volume to thematically foreground Heidegger’s complex relation to “the life of reason” and its relation to normativity. Authored by world-class phenomenologists and Heidegger scholars, it presents cutting-edge, convention-challenging scholarship on Heidegger’s relationship to the phenomenological traditions.

Irene McMullin’s Existential Flourishing (Cambridge University Press, 2018) weaves together virtue ethics and existential phenomenology: the influence of Heidegger and Levinas, in particular, is clear throughout. This paper provides a summary of McMullin’s elegantly argued position and raises a number of possible concerns, particularly regarding the interaction of Aristotelian and Phenomenological assumptions. I focus specifically on the role of the 2nd-person perspective, on the links between exemplars and socialisation, and on the problem of those who, as Nietzsche (...) put it, “are both evil and happy – a species on which the moralists are silent”. McMullin argues persuasively that individualized interpersonal encounters entail the mutual recognition of the particularity of each participant’s temporalizing way of Being-in-the-world.

In “A Modest Proposal: Accounting for the Virtuousness of Modesty,” Irene McMullin characterizes the modest person as striking a delicate balance between accurate self-assessment and sensitivity to the feelings of others. She criticizes ‘egalitarian’ understandings of this process as unrealistically demanding, and instead proposes an account based on Sartrean facticity and self-awareness. In this brief comment, I defend the egalitarian accounts, arguing for a specifically Kantian explanation of modesty that combines the best of both the egalitarian and Sartrean (...) views, and is based on basic Kantian concepts of dignity and autonomy. On this account, the modest person honestly assesses her own successes according to her autonomously determined standards, yet exhibits modesty to others out of the recognition of the equal worth and dignity of all persons. Irene Binini offers new ways of connecting Abelard's modal views with other parts of his logic, semantics, metaphysics and theology. Further, the work also provides a comprehensive study of the logical context in which Abelard's theories originated and developed, by presenting fresh evidence about many 11th- and 12th-century sources that are still (...) unpublished. This analysis sheds new light on the relations between Abelard and ancient authors such as Aristotle, Boethius, and Priscian, as well as between Abelard and his contemporaries, such as Anselm of Canterbury, William of Champeaux, Joscelin of Soissons, and Alberic of Paris. A fascinating account of exemplarity in the context of deconstruction.

The automatic prediction of court case judgments using Deep Learning and Natural Language Processing is challenged by the variety of norms and regulations, the inherent complexity of the forensic language, and the length of legal judgments. Although state-of-the-art transformer-based architectures and Large Language Models (LLMs) are pre-trained on large-scale datasets, the underlying model reasoning is not transparent to the legal expert. This paper jointly addresses court judgment prediction and explanation by not only predicting the judgment but also providing legal experts (...) with sentence-based explanations. To boost the performance of both tasks we leverage a legal named entity recognition step, which automatically annotates documents with meaningful domain-specific entity tags and masks the corresponding fine-grained descriptions. In such a way, transformer-based architectures and Large Language Models can attend to in-domain entity-related information in the inference process while neglecting irrelevant details. Furthermore, the explainer can boost the relevance of entity-enriched sentences while limiting the diffusion of potentially sensitive information. We also explore the use of in-context learning and lightweight fine-tuning to tailor LLMs to the legal language style and the downstream prediction and explanation tasks. The results obtained on a benchmark dataset from the Indian judicial system show the superior performance of entity-aware approaches to both judgment prediction and explanation. (shrink)

El sistema penitenciario de Ecuador enfrenta una crisis estructural de proporciones preocupantes. Esta investigación se centra en analizar las diversas causas que han precipitado esta situación, con el objetivo de determinar la responsabilidad del Estado ecuatoriano en esta crisis. Se examina específicamente si el Estado cumple adecuadamente con su obligación de rehabilitar a los condenados y reintegrarlos a la sociedad tras el cumplimiento de sus penas. Se evidencia una ausencia significativa de programas efectivos de reinserción para las Personas Privadas de (...) Libertad (PPL), lo que directamente contribuye a la crisis carcelaria actúa. El propósito de este estudio es analizar críticamente la situación del sistema penitenciario ecuatoriano, identificando las deficiencias en los programas de rehabilitación y reinserción social ofrecidos a las PPL. Se busca determinar si el Estado es el principal responsable de la crisis carcelaria mediante el análisis de diversas fuentes bibliográficas y la evaluación de su cumplimiento de las obligaciones legales y humanitarias hacia este grupo vulnerable. Se llevó a cabo una investigación cualitativa, donde se analizaron diversas fuentes bibliográficas especializadas para abordar el problema del sistema penitenciario en Ecuador. Se examinaron informes gubernamentales, estudios académicos y documentos legales pertinentes para comprender a fondo las causas subyacentes de la crisis carcelaria. Esta metodología permitió una evaluación exhaustiva de las deficiencias institucionales y la falta de programas de rehabilitación adecuados para las PPL en el país. Los resultados de la investigación revelan una serie de factores que contribuyen a la crisis carcelaria en Ecuador. Entre ellos se destacan el hacinamiento, la sobrepoblación, el debilitamiento institucional, el tráfico de drogas y armas, entre otros. Se evidencia que el Estado no cumple adecuadamente con su obligación de rehabilitar a los condenados y reintegrarlos a la sociedad, lo que agrava la situación y hace más miserable la vida de las PPL dentro de los centros de reclusión. Este estudio confirma que el Estado ecuatoriano es el principal responsable de la crisis carcelaria existente en el país. La falta de programas efectivos de rehabilitación y reinserción social para las PPL, junto con otras deficiencias institucionales, ha exacerbado la situación. Es imperativo que el Estado tome medidas urgentes y efectivas para abordar estas deficiencias y garantizar el respeto de los derechos humanos y la dignidad de las personas privadas de libertad en Ecuador. Plato and the Metaphysical Feminine offers a new interpretation of the role of the female and the feminine in Plato's political dialogues--the Republic, Laws, and Timaeus--informed by Deleuze's film theory and Irigaray's psychoanalytic feminism. Irene Han reads Plato against the grain in order to close the gap between the vitalists and Plato, instead of magnifying their differences. Han explores the ambivalence that the vitalist tradition, Irigaray, and Derrida have towards Platonism. The application of Deleuzian and Irigarayan concepts to the (...) ancient texts produces a new reading of Plato, focusing on the centrality and importance of motion, change, sensuality, and becoming to Platonic philosophy and, thereby, reinterprets Platonic philosophy in the direction of Heraclitus rather than Parmenides: as feminist rather than masculinist, and as mimetic. It therefore prioritizes Heraclitean principles of movement and flux over Form, the feminine over masculine, and materiality, feeling, or sensation over abstraction and universal essence. Han's exploration illustrates how, in Plato's thought, the feminine maps itself onto the plane of phenomena--a plane associated with vitalist themes such as motion, tactility, and change (metabolē). Platonic metaphysics is recontextualized by illustrating how Being expresses itself through processes of (feminine) becoming. With this reformulation, the resulting account of Platonic Being destabilizes any purported Platonic dualism. (shrink)

For a few decades now, debates around the effects of 'new public measures' in education have pointed to how the emphasis on increased accountability and high stakes testing has led to some worrying phenomena, thus changing teachers' practices and roles. These include narrowing of the curriculum, gaming and teaching to the test. This chapter discusses these kinds of knowledge and abilities as fundamentally depending on our understanding of the role of teachers within an educational system and in relation to educational (...) aims. The particular standpoint from which it tackles these issues revolves around asking whether the notion of autonomy is significant to teachers' roles and activities, and hence bears on our conception of teaching expertise. The chapter argues that the notion of autonomy is problematic: it conflates rather different psychological, phenomenological and normative elements. The discussion in the chapter culminates in an analysis of current policy arrangements in England. (shrink)

From the beginning, the implications of quantum theory for our most general understanding of the world have been a matter of intense debate. Einstein argues that the theory had to be regarded as fundamentally incomplete. Its inability, for example, to predict the exact time of decay of a single radioactive atom had to be due to a failure of the theory and not due to a permanent inability on our part or a fundamental indeterminism in nature itself. In 1964, John (...) Bell derived a theorem which showed that any deterministic theory which preserved locality would have certain consequences for measurements performed at a distance from one another. An experimental check seems to show that these consequences are not, in fact, realized. The correlation between the sets of events is much stronger than any local deterministic theory could allow. What is more, this stronger correlation is precisely that which is predicted by quantum theory. The astonishing result is that local deterministic theories of the classical sort seem to be permanently excluded. Not only can the individual decay not be predicted, but no future theory can ever predict it. The contributors in this volume wrestle with this conclusion. Some welcome it; others leave open a return to at lease some kind of deterministic world, one which must however allow something like action-at-a distance. How much lit it? And how can one avoid violating relativity theory, which excludes action-at-a-distance? How can a clash between the two fundamental theories of modern physics, relativity and quantum theory, be avoided? What are the consequences for the traditional philosophic issue of causality explanation and objectivity? One thing is certain; we can never return to the comfortable Newtonian world where everything that happened was, in principle, predictable and where what happened at one measurement site could not affect another set of measurements being performed light-years away, at a distance that a light-signal could not bridge.
