Rule of law and constitutionalist ideals are understood by many, if not most, as necessary to create a just political order. Defying the traditional division between normative and positive theoretical approaches, this book explores how political reality on the one hand, and constitutional ideals on the other, mutually inform and influence each other. On the 16th of May 2002, the Belgian House of Representatives approved of a Bill on euthanasia. Belgium is now the second country in the world, next to the Netherlands, that has legislation which under certain conditions legitimizes euthanasia. In this article the Belgian legislative procedure on euthanasia is looked upon from a political point of view. To be able do so first of all the legal context on euthanasia before the new bill was approved of has to be discussed. (...) Although the neural systems that underlie spoken language are well-known, how they adapt to evolving social cues during natural conversations remains an unanswered question. In this work we investigate the neural correlates of face-to-face conversations between two individuals using functional near infrared spectroscopy and acoustical analyses of concurrent audio recordings. Nineteen pairs of healthy adults engaged in live discussions on two controversial topics where their opinions were either in agreement or disagreement. Participants were matched according to their a priori opinions (...) on these topics as assessed by questionnaire. Acoustic measures of the recorded speech including the fundamental frequency range, median fundamental frequency, syllable rate, and acoustic energy were elevated during disagreement relative to agreement. Consistent with both the a priori opinion ratings and the acoustic findings, neural activity associated with long-range functional networks, rather than the canonical language areas, was also differentiated by the two conditions. Specifically, the frontoparietal system including bilateral dorsolateral prefrontal cortex, left supramarginal gyrus, angular gyrus, and superior temporal gyrus showed increased activity while talking during disagreement. In contrast, talking during agreement was characterized by increased activity in a social and attention network including right supramarginal gyrus, bilateral frontal eye-fields, and left frontopolar regions. Further, these social and visual attention networks were more synchronous across brains during agreement than disagreement. Rather than localized modulation of the canonical language system, these findings are most consistent with a model of distributed and adaptive language-related processes including cross-brain neural coupling that serves dynamic verbal exchanges. Since William Jones announced the kinship of Sanskrit and the European languages, a massive body of scholarship has illuminated the development of the so-called "Indo-European" language group. This new historical philology has enormous technical achievements to its credit. But almost from the start, it became entangled with prejudices and myths--with efforts to recreate not only the lost language, but also the lost--and superior--civilization of the Indo-European ancestors. This drive to determine the identity and nature of the first language of humanity (...) was deeply rooted in both near eastern and western traditions. The Bible described the perfect, transparent language of Adam and followed its degeneration, caused by human sin, into the multiple, opaque languages of later nations. The three sons of Noah became, for Jewish and early Christian writers, the founders of three distinct human groups. By the sixth and seventh centuries, historians began to magnify the deeds of certain later peoples, such as the Scythians and Goths, and to connect them with the biblical genealogy of languages and races. And in the Renaissance, speculative historical etymology took root and flourished, as national pride led European intellectuals to assert that their own modern languages--for example, Flemish--either could be identified with the original one or offered the closest surviving approximation to it. Japheth, Noah's favorite son and the forefather of the Europeans, emerged as the hero who had preserved the original language in its purity. A new history of the European languages developed, one which traced them back to the language of the barbarian Scythians and emphasized the connections between Persian and European languages. It came to seem implausible that the European languages derived from Hebrew. By the eighteenth century, in short, all the preconditions were present for a discovery that the ancestors of the Europeans, like the common ancestor of their languages, had been independent of Semitic influence. A modern scholarly thesis whose political and intellectual consequences are still working themselves out reveals the continuing impact of a millennial tradition of speculation about language and history. From the Church Fathers to the nineteenth century, countless libraries bear witness to the quarrels in which scholars, using the exegetical and philological techniques of their times (notably those of etymology), had striven to make out the Adamic vestiges which have remained intact in post-Babelian languages. For them, languages were to remain outside historical time. However, at the same time there existed other currents of knowledge. Authors use diverse metaphors – bodily, botanical, etc. – to formulate a dynamic history of (...) languages. Through the evocation of a few problematic metaphors, which create relationships between diverse forms of temporality employed to indicate the historicity of languages, this study underlines the tensions which presided over the genesis and the early development of linguistic knowledge. The Adamic language, endlessly appealed to, was also regularly called into question, and even outright rejected. No matter: recovering the purity of these origins managed to work as a powerful impetus for historic scholarship, and not only in the seventeenth century. When a mother kills her child, we call her a bad mother, but, as this book shows, even mothers who intend to do their children harm are not easily categorized as "mad" or "bad." Maternal love is a complex emotion rich with contradictory impulses and desires, and motherhood is a conflicted state in which women constantly renegotiate the needs mother and child, the self and the other. Applying care ethics philosophy and the work of Emmanuel Levinas, Maurice Merleau-Ponty, and (...) Simone de Beauvoir to real-world experiences of motherhood, Sarah LaChance Adams throws the inherent tensions of motherhood into sharp relief, drawing a more nuanced portrait of the mother and child relationship than previously conceived. The maternal example is particularly instructive for ethical theory, highlighting the dynamics of human interdependence while also affirming separate interests. LaChance Adams particularly focuses on maternal ambivalence and its morally productive role in reinforcing the divergence between oneself and others, helping to recognize the particularities of situation, and negotiating the difference between one's own needs and the desires of others. Between 1934 and 1937 Maurice Blondel, the French Roman Catholic philosopher best known for his 1893 work, Action, published a trilogy of writings. Out of these writings came a theological ontology of tremendous force, creativity, and coherence. The purpose of the present dissertation is to reassess the viability of Blondel's ontology for contemporary theology. The retrieval begins with John Milbank's 1990 investigation of Blondel's early philosophy. While Milbank focuses on the strengths of Blondel, he also highlights some critical weaknesses. (...) The dissertation argues that Blondel later came to recognize and correct these weaknesses in his trilogy. ;La pensee, the first volume of the trilogy, discusses the nature and development of thought. Recognizing the ontological structure of thought leads Blondel to present his doctrine of the transnatural elan for assimilation to God. The transnatural desire for God is compared with Henri de Lubac's notion of naturae desiderium and then applied to the modern problem of the relationship between nature and supernature. ;The second installment of the trilogy, L'etre et les etres , explores the mysterious relation of Being and beings. Blondel situates the discussion within the language of creation, identifying Being as Creator and beings as creatures. The analogy of creation allows him to forge the proper relationship between Being and beings. After Blondel's death, two different schools of thought emerged on the mystery of being: Karl Rahner's Thomism and Jean-Luc Marion's new phenomenology. Each school is reviewed and critiqued from a Blondelian perspective. ;The trilogy concludes with a long-awaited revision of L'action . It begins by distinguishing the idea of action from action itself and establishing the ontological difference of action. Action is presented ontologically as enacted power, which is investigated in its individual, social, and metaphysical forms. Individual action is identified as making, practicing, and contemplating. Social action is studied next, with the conclusion that the social being of enacted power is determined by either a philosophy of peace or violence. Finally, divine action is evaluated with regards to the language of causality and absolute power. Blondel proposes instead to describe God's activity in terms of pure action. (shrink)

This paper aims to establish a distinction and relationship between two types of noise – active noise and passive noise – while giving emphasis to the latter. Active noise is the discourse of negativity and violence that some theorists associate with noise’s materiality, an association particularly pronounced in engagements with Japanoise. The problem with this discourse is that it relies on a culturally normative understanding of noise as well as novelty. This narrative inevitably leads to a dead end. Noise, and (...) artistic practices like Japanoise that draw on noise sounds, have a short lifespan if their entire purpose is one of shock and disturbance. However, Japanoise is not dead: it persists both as a genre and as a sonic idea/gesture. This article suggests that noise persists, and Japanoise remains relevant, because it comes from a region not exhausted by categories of negativity and violence. This article will show how underneath active noise there resounds a deeper, more profound a-cultural noise. Drawing on Maurice Blanchot’s account of passivity, which names the anarchic region of absence in his thought, this noise will be described as passive noise. In this context, passivity must be understood differently from the conventional sense as something opposed to activity. Likewise, passive noise does not refer to background noise. Instead, passive noise will be described as the interiority of excess that manifests as a breach in the closure of active noise. This breach will be shown to be consistent with Blanchot’s view of the inexhaustibility of art and will be described, specifically in the context of Japanoise, as the intimacy of excess that is the lifeblood of maximalist forms of noise-making. This will also amount to a reconsideration of the idea of transgression by reframing Japanoise in terms of inertia. (shrink)

From philosophy to theology -- Structure -- Mystery -- Power.

This paper sets Maurice Merleau-Ponty and Nishida Kitarō in dialogue and explore the interpretations of artistic expression, which inform their similar phenomenological accounts of perception. I discuss how both philosophers look to artistic practice to reveal multi-perspectival aspects of vision. They do so, I argue, by going beyond a “positivist” representational under-standing of perception and by including negative aspects of visual experience as constitutive of vision. Following this account, I interpret artworks by Cézanne, Guo Xi, Rodin, and Hasegawa according (...) to the versions of multi-perspectival vision articulated by Nishida and Merleau-Ponty. I conclude by highlighting a difference between Merleau-Ponty’s “depth” and Nishida’s “seeing without a seer” regarding the extent to which each of their philosophies de-substantialize and de-localize human vision. Both Nishida Kitarō and Maurice Merleau-Ponty wrote extensively about artistic expression in their early works, yet in the last period of their careers that consideration is put mostly aside as they engage more directly with abstract ontological concerns. As this happens, a curiously overlooked concept becomes prominent in their writings, namely “faith.” While Merleau-Ponty’s is a “perceptual faith”, and Nishida’s is, broadly speaking, a religious faith, neither is strictly secular nor spiritual, yet both entail a remarkably similar ontology of (...) the motor-perceptual body. This essay places Nishida Kitarō in dialogue with Maurice Merleau-Ponty regarding motor-perceptual aspects underlying their theories of artistic expression. The analysis begins by comparing their interpretations of negation as articulated in their later works and seeks to understand their poetic renderings of artistic practice as proposing a mutual and reciprocal form of negation. By analyzing their conceptions of negation as implicit to their depictions of artistic expression, this essay looks to expand their concepts of negation from a perceptual to (...) a motor-perceptual form of negation. Just as perceptual negation results in a multi-perspectival form of perception, motor-perceptual negation renders motion as a multi-volitional event outside and beyond the individuated body, and diffused throughout the motor-perceptual fabric. The artist is an exemplar for both Nishida and Merleau-Ponty because of their ability to create works that express themselves within this form of motor-perceptual negation. Doing so, expressing oneself as a motor-perceptualy negated body entails a bodily form of faith. This study thus expands Merleau-Ponty’s concept of “perceptual faith” (foi perceptive) to disclose its implicit motor aspects, while demonstrating how the expanded conceptions of expression and negation resonate with the faithful form of expression put forth in Nishida’s concept “interexpression” (表現的関係). Given that one-million species are currently threatened with extinction and that humans are undermining the entire natural infrastructure on which our modern world depends (IPBES, 2019), this dissertation will show that there is a need to provide an alternative approach to wildlife conservation, one that avoids anthropocentrism and wildlife valuation on an instrumental basis to provide meaningful and tangible success for both wildlife conservation and human well-being in an inclusive way. In this sense, The Value of Being Wild will showcase (...) the concept of eco-phenomenology as an important non-anthropocentric alternative to the current approach to wildlife conservation, namely sustainable development. The problem with this dominant paradigm, as Chapter Two will reveal, is that sustainable development has not only failed to provide humans and future generations of humans with their own needs but, as per the latest IPBES report, failed in arresting the freefall decline of wild species. The situation currently requires a radical overhaul of the current system. As emerged from the later work of French phenomenologist, Maurice Merleau-Ponty (1908-1961), eco-phenomenology is particularly well-suited as a practical alternative to sustainable development. The core reason is that eco-phenomenology moves away from a human-centred framework toward a far more inclusive approach that embraces the conservation of wild animals as well the wild environment they dwell in, beyond any human needs (although humans are embraced within the approach too). Merleau-Ponty helps us to move away from anthropocentrism to a more inclusive approach in conserving wildlife, since his phenomenology does not consider the human animal’s relationship in the world as exclusive (to use and exploit wild animals solely for their benefit), but inclusive (as an interconnected biological component in a broad ecological system). The strength of Merleau-Ponty’s concept of phenomenology is that it facilitates an understanding of all living and even non-living entities, such as air, water and soil, as interconnected and interrelated within a broad biosphere. While Merleau-Ponty did not address the concept of wild animals or the biosphere directly, his later work points to the fact that human animals cannot exist outside a world that provides life-giving force to all living beings. Phenomenology, as developed by Merleau-Ponty, is a concept that recognises the axiological qualities of the natural world are inherent and ineliminable from the discipline of traditional phenomenology, hence the term ‘eco-phenomenology’, developed in one reception of his thinking. Eco-phenomenology offers a return to a world that humans have tried hard to alienate themselves from, in that it approaches the natural environment and wild animals, not as a complex set of objects and objective processes, but rather as they are experienced and lived from within by the attentive animal who is entirely a part of the world that he or she experiences. Merleau-Pontian eco-phenomenology thus emphasises a holistic dialogue within a more-than-human world (Abram, 1996: 65). Eco-phenomenology is a concept that points toward an applied strategy but so far this has not been attempted in earnest. This is specifically true when it comes to wildlife conservation. The Value of Being Wild, therefore, sets out to employ the concept of eco-phenomenology in order to provide a new practical wildlife conservation approach that challenges, and potentially replaces, the current prevailing policies as employed by global governmental and inter-governmental agencies. In particular, this alternative frame is posed as a replacement for the failing anthropocentric conservation practices currently in place in South Africa. This dissertation will therefore conclude by exploring strategies where conservation of wildlife is not taken as instrumentally-valued, or even intrinsically-valued, but rather as wild-valued in that the existence of wild animals as wild is conserved within a broader, more inclusive overall ecology that supports the survival and flourishing of all living beings that include plants, wild animals and human beings. At the turn of the century Sigmund Freud sought to translate the silent language of the unconscious, as Friedrich Nietzsche heralded an untimely voice that could not yet be heard.1 Ludwig Wittgenstein and Martin Heidegger, foundational thinkers in analytic and continental philosophy respectively, each placed silence at the core of his most influential works.2 In the phenomenological tradition, Maurice Merleau-Ponty and Emmanuel Levinas prominently thematized silence,3 while the subsequent generation of poststructuralist, [End Page 1] deconstructionist, and feminist thinkers such as Hélène Cixous, Jacques Derrida, Michel Foucault, Jean-François Lyotard, and Luce Irigaray all grappled with silence in various forms.4 Among these works, Lyotard’s theory of the differend, a term that describes an ontological gap of incommunicability, is now a standard term for addressing questions of silence, silencing, the ethics of sayability and trauma.5 Later, in queer theory, Eve Kosofsky Sedgwick’s closet became a complex synonym for many forms of silence and silencing.6Beyond this philosophical concern for silence and silencing, a number of similar themes emerged in the art and literature of the twentieth century, demonstrating both the creative and destructive force of silence.7 In literature, dramatists such as Samuel Beckett and Harold Pinter brought silence to the stage, while poets and novelists like Adrienne Rich and Virginia Woolf traced the presence of silence in language, each thematizing the power of silencing in unique ways.8 In music, John Cage famously utilized silence as an element of his compositions and filmmakers such as Ingmar Bergmann and Chantal Akerman likewise crafted silence to structure the cinematic spaces of their works.9 Silence became one of the most persistent themes of philosophy in the twentieth century, both implicitly and explicitly. Could one even go so far as to say that a certain silence haunted philosophy in the twentieth century?Amid this abundance of artistic and philosophical work on silence, “breaking the silence” became the watchword for emancipatory projects pursued by groups such as first-wave feminists, postcolonial scholars, race theorists, and campaigns for social justice.10 These emancipatory projects sought to disrupt processes of silencing by locating, recovering, and translating marginalized voices from the silencing of oppression and disenfranchisement. Though essential political interventions at the historical moment when they emerged, these projects of recovery soon met with the critique of the politics of representation best exemplified by thinkers such as Gayatri Chakravorty Spivak and Toril Moi.11 Spivak and Moi effectively argued that recovering and speaking for silenced and marginalized voices entails a further form of silencing. These critiques showed that projects of recovering silence from the archives, history, literature, art, culture, and everyday practices of living were constrained by the very concept of silence they employed. As a result, any naive politics of granting a voice and breaking silence became impossible after the 1980s. From this point onward the deconstructive critique of representation folded silence back into itself, destroying any simple binary of empowered speech and disempowered silence. Even despite this powerful deconstruction of the speech/silence binary, philosophy, to the extent that it still operates within representational schemes and a speech/silence binary, still remains haunted by the specter of silence—a silence that carries with it a deeply gendered heritage. Pursuing rigorous analyses of the manifold structures of silence and silencing remains an urgent ethical and political task for feminist philosophy. We ask, ‘Is writing by means of online technologies affected in a manner that differs significantly from the older technologies of pen on paper, typewriter, or even the word processor in an off‐line environment?’ In writing online, the author is engaged in a spatial complexity of physical, temporal, imaginal, and virtual experience: the writing space, the space of the text, cyber space, etc. At times, these may provide a conduit to (...) a writerly understanding of human phenomena. We propose that an examination of the phenomenological features of online writing may contribute to a more pedagogically sensitive understanding of the experiences of online seminars, teaching and learning. During this amazing era of discoveries, Blondel encouraged the bold, encyclopedic spirit of science as well as the new standards coming into use for accumulating and judging observational evidence. However, he warned of reductionism, determinism, and phenomenism, trends which could be avoided or corrected if the nature and scope of (...) science were broadened. This study explores the primacy of interrelating and its ecopsychological significance. Grounded in evidence from everyday experience, and in dialogue with the phenomenology of Martin Buber, Emmanuel Levinas, and Maurice Merleau-Ponty, we discover that humans are inherently relational beings, not separate egoic subjects. When experienced intimately , this realization may transform our interrelationship with the beings and presences in the community of nature. Specifically, interrelating is primary in three ways: 1) interrelating is always already here, transpiring from the beginning (...) of the human species and human culture, from the beginning of every infant's life, and from the continuously arising beginning of every presencing moment; 2) the quality of our interrelating is truly what matters most, the most important expression of and facilitator of health, compassion, and justice for humankind and the rest of nature; and 3) interrelating is the ever-present path via which we discover/create and carry on our existence. Interrelating is an existential given—indeed we are our interrelating—yet we are summoned ethically to cultivate our way of interrelating so as to serve others and the non-human natural community. Thus interrelating is our essence, our calling, and our path. (shrink)

This essay unpacks Johann Arnason’s theory of culture. It argues that the culture problematic remains the needle’s eye through which Arnason’s intellectual project must be understood, his recent shift to foreground the interplay of culture and power (as the religio-political nexus) notwithstanding. Arnason’s approach to culture is foundational to his articulation of the human condition, which is articulated here as the interaction of a historical cultural hermeneutics and a macro-phenomenology of the world as a shared horizon. The essay discusses Arnason’s (...) elucidation of his theory of culture as a contribution to debates on the ‘meaning of meaning’. It traces its beginnings from his critique of Habermas’s theory of modernity to its development via a trialogue with Max Weber, Maurice Merleau-Ponty, and Cornelius Castoriadis. It argues that Arnason's theory of culture moves beyond socio-centric perspectives, and, in so doing, offers a critique of what we might call sociological solipsism. In decentring society/anthropos, a more nuanced understanding of the human condition as a unity in diversity is achieved. The essay concludes with a discussion of some tensions in Arnason’s understanding of culture, and argues for the importance for incorporating a qualitative notion of ‘movement’ in order to make sense of historical novelty and social change. The claim of this paper is that the everyday functions of knowledge make most sense if we see knowledge as contrastive. That is, we can best understand how the concept does what it does by thinking in terms of a relation “a knows that p rather than q.” There is always a contrast with an alternative. Contrastive interpretations of knowledge, and objections to them, have become fairly common in recent philosophy. The version defended here is fairly mild in that there (...) is no suggestion that we cannot think in terms of a simpler not explicitly contrastive relation “a knows that p.” Some, for instance Schaffer (2005) and Karjalainen and Morton (2003), have hinted that this stronger possibility may be right. But all that I am arguing now is that facts that are easily expressed in contrastive terms are vital to understanding why we need the concept of knowledge. When one encounters disagreement about the truth of a factual claim from a trusted advisor who has access to all of one's evidence, should that move one in the direction of the advisor's view? Conciliatory views on disagreement say "yes, at least a little." Such views are extremely natural, but they can give incoherent advice when the issue under dispute is disagreement itself. So conciliatory views stand refuted. But despite first appearances, this makes no trouble for *partly* conciliatory views: views (...) that recommend giving ground in the face of disagreement about many matters, but not about disagreement itself. Many favor representationalism about color experience. To a first approximation, this view holds that experiencing is like believing. In particular, like believing, experiencing is a matter of representing the world to be a certain way. Once you view color experience along these lines, you face a big question: do our color experiences represent the world as it really is? For instance, suppose you see a tomato. Representationalists claim that having an experience with this sensory character is necessarily connected with representing (...) a distinctive quality as pervading a round area out there in external space. Let us call it “sensible redness” to highlight the fact that the representation of this property is necessarily connected with the sensory character of the experience. In order to predict and explain behavior, one cannot specify the mental state of an agent merely by saying what information she possesses. Instead one must specify what information is available to an agent relative to various purposes. Specifying mental states in this way allows us to accommodate cases of imperfect recall, cognitive accomplishments involved in logical deduction, the mental states of confused or fragmented subjects, and the difference between propositional knowledge and know-how .

In this paper, I do a few things. I develop a (largely) empirical argument against naïve realism (Campbell, Martin, others) and for representationalism. I answer Papineau’s recent paper “Against Representationalism (about Experience)”. And I develop a new puzzle for representationalists.

How best to think about quantum systems under permutation invariance is a question that has received a great deal of attention in the literature. But very little attention has been paid to taking seriously the proposal that permutation invariance reflects a representational redundancy in the formalism. Under such a proposal, it is far from obvious how a constituent quantum system is represented. Consequently, it is also far from obvious how quantum systems compose to form assemblies, i.e. what is the formal (...) structure of their relations of parthood, overlap and fusion. In this paper, I explore one proposal for the case of fermions and their assemblies. According to this proposal, fermionic assemblies which are not entangled—in some heterodox, but natural sense of ‘entangled’—provide a prima facie counterexample to classical mereology. This result is puzzling; but, I argue, no more intolerable than any other available interpretative option. (shrink)

The problem of trust in social relationships was central to the emergence of the modern form of civil society and much discussed by social and political philosophers of the early modern period. Over the past few years, in response to the profound changes associated with postmodernity, trust has returned to the attention of political scientists, sociologists, economists, and public policy analysts. In this sequel to his widely admired book, The Idea of Civil Society, Adam Seligman analyzes trust as a fundamental (...) issue of our present social relationships. Setting his discussion in historical and intellectual context, Seligman asks whether trust--which many contemporary critics, from Robert Putnam through Francis Fukuyama, identify as essential in creating a cohesive society--can continue to serve this vital role. Seligman traverses a wide range of examples, from the minutiae of everyday manners to central problems of political and economic life, showing throughout how civility and trust are being displaced in contemporary life by new "external' system constraints inimical to the development of trust. Disturbingly, Seligman shows that trust is losing its unifying power precisely because the individual, long assumed to be the ultimate repository of rights and values, is being reduced to a sum of group identities and an abstract matrix of rules. The irony for Seligman is that, in becoming postmodern, we seem to be moving backward to a premodern condition in which group sanctions rather than trust are the basis of group life. (shrink)
