The Inner Touch presents the archaeology of a single sense: the sense of being sentient. Aristotle was perhaps the first to define this faculty when in his treatise On the Soul he identified a sensory power, irreducible to the five senses, by which animals perceive that they are perceiving: the simple "sense," as he wrote, "that we are seeing and hearing." After him, thinkers returned, time and again, to define and redefine this curious sensation. The pirate is the original enemy of humankind. As Cicero famously remarked, there are certain enemies with whom one may negotiate and with whom, circumstances permitting, one may establish a truce. But there is also an enemy with whom treaties are in vain and war remains incessant. This is the pirate, considered by ancient jurists considered to be "the enemy of all."In this book, Daniel Heller-Roazen reconstructs the shifting place of the pirate in legal and political thought (...) from the ancient to the medieval, modern, and contemporary periods presenting the philosophical genealogy of a remarkable antagonist. Today, Heller-Roazen argues, the pirate furnishes the key to the contemporary paradigm of the universal foe. This is a legal and political person of exception, neither criminal nor enemy, who inhabits an extra-territorial region. Against such a foe, states may wage extraordinary battles, policing politics and justifying military measures in the name of welfare and security. Heller-Roazen defines the piracy in the conjunction of four conditions: a region beyond territorial jurisdiction; agents who may not be identified with an established state; the collapse of the distinction between criminal and political categories; and the transformation of the concept of war. This volume constitutes the largest collection of writings by the Italian philosopher Giorgio Agamben hitherto published in any language. With one exception, the fifteen essays, which reflect the wide range of the author’s interests, appear in English for the first time. The essays consider figures in the history of philosophy and twentieth-century thought. They also examine several general topics that have always been of central concern to Agamben: the relation of linguistic and metaphysical categories; messianism in Islamic, Jewish, and Christian (...) theology; and the state and future of contemporary politics. Despite the diversity of the texts collected here, they show a consistent concern for a set of overriding philosophical themes concerning language, history, and potentiality. In the first part of the book, Agamben brings philosophical texts of Plato and Benjamin, the literary criticism of Max Kommerell, and the linguistic studies of J.-C. Milner to bear upon a question that exposes each discipline to a limit at which the possibility of language itself is at stake. The essays in the second part concern a body of texts that deal with the structure of history and historical reflection, including the idea of the end of history in Jewish and Christian messianism, as well as in Hegel, Benjamin, and Aby Warburg. In the third part, the issues confronted in the first and second parts are shown to be best grasped as issues of potentiality. Agamben argues that language and history are structures of potentiality and can be most fully understood on the basis of the Aristotelian theory of _dynamis_ and its medieval elaborations. The work of Giorgio Agamben, one of Italy's most important and original philosophers, has been based on an uncommon erudition in classical traditions of philosophy and rhetoric, the grammarians of late antiquity, Christian theology, and modern philosophy. Recently, Agamben has begun to direct his thinking to the constitution of the social and to some concrete, ethico-political conclusions concerning the state of society today, and the place of the individual within it. In _Homo Sacer,_ Agamben aims to connect the problem of (...) pure possibility, potentiality, and power with the problem of political and social ethics in a context where the latter has lost its previous religious, metaphysical, and cultural grounding. Taking his cue from Foucault's fragmentary analysis of biopolitics, Agamben probes with great breadth, intensity, and acuteness the covert or implicit presence of an idea of biopolitics in the history of traditional political theory. He argues that from the earliest treatises of political theory, notably in Aristotle's notion of man as a political animal, and throughout the history of Western thinking about sovereignty, a notion of sovereignty as power over "life" is implicit. The reason it remains merely implicit has to do, according to Agamben, with the way the sacred, or the idea of sacrality, becomes indissociable from the idea of sovereignty. Drawing upon Carl Schmitt's idea of the sovereign's status as the exception to the rules he safeguards, and on anthropological research that reveals the close interlinking of the sacred and the taboo, Agamben defines the sacred person as one who can be killed and yet not sacrificed—a paradox he sees as operative in the status of the modern individual living in a system that exerts control over the collective "naked life" of all individuals. Aristotle's text establishes, in this way, that vocal utterances are signs of things. The philosophical significance of this gesture could not be more decisive. Once De interpretatione determines the canonical form of the statement as a "meaningful sentence [logos se¯mantikos]" and, more precisely, as a "proposition [logos apophantikos]" bearing truth or falsity, and once it asserts that truth and falsity reside in the composition (synthesis) of elements [16a10-15], 1 the consequence is inevitable: the paradigmatic form of true speech must be that of the "statement of one thing concerning another thing [legein ti kata tinos]" [17a25]. 2 Here it matters little whether the relation of speech to things is grasped as one of imitation or constitution, reproduction or production; it matters little, moreover, whether the things at issue--that which language means--are understood as sensible objects or supersensuous entities, material beings or logical idealities. _Dark Tongues _constitutes a sustained exploration of a perplexing fact that has never received the attention it deserves. Wherever human beings share a language, they also strive to make from it something new: a cryptic idiom, built from the grammar that they know, which will allow them to communicate in secrecy. Such hidden languages come in many shapes. They may be playful or serious, children's games or adults' work. They may be as impenetrable as foreign tongues, or slightly different from (...) the idioms from which they spring, or barely perceptible, their existence being the subject of uncertain, even unlikely, suppositions. The first recorded jargons date to the time of the Renaissance, when writers across Europe noted that obscure languages had suddenly come into use. A varied cast of characters -- lawyers, grammarians, and theologians -- denounced these new forms of speech, arguing that they were tools of crime, plotted in tongues that honest people could not understand. Before the emergence of these modern jargons, however, the artificial twisting of languages served a different purpose. In epochs and regions as diverse as archaic Greece and Rome and medieval Provence and Scandinavia, singers and scribes also invented opaque varieties of speech. They did so not to defraud, but to reveal and record a divine thing: the language of the gods, which poets and priests alone were said to master. _Dark Tongues _moves among these various artificial and hermetic tongues. This book explores ways in which educational leaders can apply the wisdom of the Tao in their day-to-day work in schools. It offers an alternative to the standard ways of western thinking to give the leader more possibilities when confronting a situation. We tend to value immediate and decisive action, winning, directing, and getting one’s way. Taoist Lessons for Educational Leaders offers another way of approaching the workplace. We can also value waiting and reflection before acting, seeing all participants as (...) winners or at least no one as a loser, following as a form of leadership, and giving away some victories, as beneficial to the governance of a school. Prolonging working hours and presenteeism have been conceptualized as self-endangering coping behaviors in employees, which are related to health impairment. Drawing upon the self-regulation of behavior model, the goal achievement process, and Warr's vitamin model, we examined the antecedents and moderation effects regarding quantitative demands, autonomy, emotion regulation, and self-motivation competence of university students' self-endangering coping behaviors. Results from a cross-sectional survey of 3,546 German university students indicate that quantitative demands are positively related and autonomy has a u-shape connection with (...) self-endangering coping. Emotion regulation was shown to be a protective factor for prolonging working hours. Moreover, self-motivation moderated the relationship between quantitative demands and prolonging of working hours, but not in the assumed direction. Self-motivation showed a systematic positive relationship with prolonging of working hours, but no relationship with presenteeism. Autonomy moderated the relationship of quantitative demands with both self-endangering behaviors. We found no moderating effects for emotion regulation of quantitative demands or autonomy and self-endangering behaviors. Besides further practical implications, the results suggest that lecturers should design their courses accordingly with less time pressure and university students should be trained in the use of autonomy. In “The Choice Theory of Contracts,” we explain contractual freedom and celebrate the plurality of contract types. Here, we reply to critics by refining choice theory and showing how it fits and shapes what we term the “Contract Canon”. I. Freedom. (1) Charles Fried challenges our account of Kantian autonomy, but his views, we show, largely converge with choice theory. (2) Nathan Oman argues for a commerce-enhancing account of autonomy. We counter that he arbitrarily slights noncommercial spheres central to human (...) interaction. (3) Yitzhak Benbaji suggests that choice theory’s commitment to autonomy is overly perfectionist. Happily, in response to Benbaji, we can cite with approval Charles Fried’s point that contract types are “enabling our liberties.” II. Choice. (4) Aditi Bagchi criticizes our inattention to impediments to choice. We show how choice theory’s commitments to both multiplicity and relational justice ameliorate these impediments. (5) Gregory Klass explores parol evidence to highlight the mechanisms of choice. We substantially concur with his position, and show how such mechanisms can ensure voluntariness, an essential element of choice. (6) Oren Bar-Gill and Clayton Gillette question the institutional capacity of existing legal actors to implement choice theory. Working from the example of cohabitation, we offer a somewhat more optimistic view. III. Contracts. (7) Peter Benson contends our focus on the rational slights the reasonable. Although we did not use this Rawlsian vocabulary, choice theory complies with its strictures — more so than transfer theory. (8) Daniel Markovits and Alan Schwartz claim provocatively that contract theory must: capitulate before pluralism (as they endorse); leverage it; or fall victim to a so-called “embracing” approach (their charge against us). We reject the charge that choice theory is foundationally value-pluralist. Instead, we cabin pluralism and put it to work. (9) The Contract Canon starts on the next big step for choice theory by explaining existing doctrine (rebutting Benson on lack of fit) and helping adjudicate contract practice (countering Markovits and Schwartz on the vices of our pluralism). Each Article in this Issue advances the field; each prompts us to refine choice theory — all steps, we hope, toward a more just and justified law of contract. (shrink)

Beliefs once limited to the extremes of the North American gun culture have become mainstream, while the US Supreme Court’s ruling in District of Columbia v. Heller and a spate of right-to-carry laws have contributed to the proliferation of guns in public life. These changes in political discourses, legislative agendas, and social practices are indicative of an emergent and pernicious form of subjectivity, which is here defined as self-defensive. Such subjectivity is characterized by a pathological identification with the right (...) of self-defense, which undermines the social conditions of individual freedom and renders subjects unable to comprehend the function of abstract rights within an informal normative order. Practically speaking, this raced and gendered subjectivity relies on extra-legal relations of domination for its reproduction. The rapid expansion of gun rights and the recent loosening of restrictions on self-defensive violence are argued to be responses to a perceived threat to these identity-constituting relations, rather than to the threat of violent crime, which has long been on the decline. Referring to the video testimony of Holocaust survivor Mrs. K. and interviewer and psychoanalyst Kurt Grünberg, I propose to analyse the body movement behavior in interaction in this interview as the “Gestalt” of memory units. According to the theory of embodiment and following Daniel Stern, I show how it is possible to co-construct sense while watching nonverbal aspects of giving testimony. Using different methods of movement analysis such as KMP, LMA, NEUROGES and MEA, this study was conducted by means (...) of phenomenological inquiry. I suggest that a hermeneutic perspective on movement aspects can thus be used to enrich the transcript and provide a broader and highly specific understanding of this testimony. Movement can thus be seen as an integral part of transmission. (shrink)

Private law theory must confront the plurality of values that inform the problems that private law addresses in practice. We consider Hanoch Dagan’s and Michael Heller’s The Choice Theory of Contracts as a case-study in the promise and perils that embracing plural values poses for private law theory. We begin by arguing that private law theory cannot ignore value pluralism and identify three approaches that theory might take to pluralism. We call these approaches capitulating to, leveraging, and embracing value (...) pluralism. We illustrate each approach and assess its strengths and weaknesses. Theories that capitulate to pluralism simultaneously limit their scope and hamper their persuasiveness even within their restricted domains. Theories that leverage pluralism limit their domains more dramatically still. And theories that embrace pluralism are difficult to operationalize in practice without abandoning their pluralist roots. We briefly illustrate the drawbacks of capitulating to and leveraging pluralism with examples from recent contract theory. We then take up theories that embrace pluralism in greater detail, by studying Dagan and Heller’s approach. We argue that Dagan and Heller do not solve the deep problems that operationalizing their embrace of pluralism inevitably engenders. (shrink)

Revisionary ontologists are making a comeback. Quasi-nihilists, like Peter van Inwagen and Trenton Merricks, insist that the only composite objects that exist are living things. Unrestriced universalists, like W.V.O. Quine, David Lewis, Mark Heller, and Hud Hudson, insist that any collection of objects composes something, no matter how scattered over time and space they may be. And there are more besides. The result, says Eli Hirsch, is that many commonsense judgments about the existence or identity of highly visible physical (...) objects are a priori necessarily false. In a “last ditch effort” to bring revisionary ontologists back to their senses, Hirsch marshalls what he calls the Argument from Charity. We can be sure that there are tables and chairs and that there are no fusions of Plato’s nose and the Eiffel Tower, says Hirsch, because these commonsense platitudes are a logical consequence of the well-known principle of interpretive charity applied to natural languages, like English. In what follows, I assess the Argument from Charity. My conclusion is that if this is the best we can do to save revisionary ontologists, they are surely lost forever. (shrink)

In the eighteenth century the category of the aesthetic sought to bridge the gap between the prevalent dualities of Cartesian thought: art and science, history and science, prejudice and truth. This paper deals with Ágnes Heller’s suggestion, in A Theory of Modernity (1999), to ascribe to science a central role in the ongoing development of modernity. As we shall argue, this is not merely a historical issue but, rather, a historical-philosophical one that entails the problem of defining modernity, science and technology and their mutual interconnections. As for modernity, according to Heller, it is a free developmental project without any foundations other than freedom itself. In particular, the evolution (...) of science and technology is one of its main developmental tendencies. Science, she argues, has become the dominant world explanation while technological thought is the corresponding dominant (but not unique) imaginary institution. Her attempt to isolate the essential cultural features of science-technology owes much to Habermas’s analyses of the 1960s on the technocratic developments of contemporary societies legitimized through an ideological employment of science. Like Habermas, Heller embraces an instrumental and problem-solving conception of technology and ‘normal’ science which appears questionable, however, in the light of conclusions on the intrinsic creativity of the science-technology interface deriving from historical epistemology and an externalist history of science. Considerations and examples derived from the recent agenda of historical epistemology could integrate Heller’s philosophical and cultural analysis of the role of science in modernity while challenging some of her assumptions. Idea of ProseIn a preface written for the French translation of his Infancy and History: The Destruction of Experience, Giorgio Agamben states that"every written work can be regarded as the prologue (or rather, the broken cast) of a work never penned, and destined to remain so, because later works, which in turn will be the prologues or the moulds for other absent works, represent only sketches or death masks." 1 This remark, which describes every work of art as a preface, does not simply refer to the impossibility of translating the all of life into a single work. Nor does it simply refer to those purely empirical obstacles which stand in the way of creation, preventing the work of art from attaining the plenitude it might have hoped for had not greedy wine-merchants, harrying tailors, and eloquent panderers distracted the Great Minds from their tasks. Instead, in returning every work of art to its originary hesitation, in evoking the oscillation between work and draft, effort and accomplishment, Agamben invokes a much richer and darker potentiality lying at the heart of the work. It is this richer and darker potentiality that constitutes the central concern of Agamben's thought and that gives its name to this collection. Yet what is named in this potentiality? What is the nature of the potentiality of which Agamben speaks? What is this potentiality the potential for?Before advancing in the investigation of this question, let us look briefly at what is gathered together under its name. Presenting an alternate history of the State of Israel as a space station orbiting Earth, the excitement of possibilities crackles across the texts and images. Like Chris Marker's La Jeteé , the accompanying static images distort the viewer's temporality: are these archaeological items, images from a past, or a future? Why isn't this our future? In Between States (...) can also be seen as complementing Larissa Sansour's provocative science fiction works, Space Exodus (2009) which "documents" the Palestinian space program, and her Nation Estate (2012), in which Palestine is relocated into a skyscraper. In 1941 an investigation by the US Justice Department exposed a marriage cartel between John D. Rockefeller’s Standard Oil (now ExxonMobil) and I.G. Farben. The two corporations had formed a joint operation in 1927 called Standard IG Farben. It was revealed that the two had shared patents in order to control prices and markets in their respective regions. Standard was accused of hiding patents from the US Navy and supplying fuel to German submarines, which lead to charges of criminal conspiracy. The Pentagon intervened, requesting that President Roosevelt stop the investigation in order to protect war production and oil supply. Roosevelt agreed, and the Senate committee investigating the matter, headed by Senator Harry Truman, was halted. Standard Oil paid a fine of $5000 and promised to stop supplying fuel to the enemies. Furious at the decision to terminate the investigation of acts he considered treason, Truman initiated a new inquiry into Standard Oil’s war-time practices after succeeding Roosevelt as president in 1945. With the chief executives of I.G Farben simultaneously on trial at Nuremburg, Truman brokered a deal with the Allies that reduced or withdrew criminal charges leveled against both corporations in exchange for Standard Oil and I.G. The third critical player in this bold experiment was the nascent North Atlantic Space Agency. Formed by Allied forces using the seized assets and engineering expertise of Hitler’s hitherto classified space program (conquer Earth, then the stars), the North Atlantic Space Agency was a pre-NATO foray into interstellar nation building, with orbital occupation as the first point of order. By 1947, NASA was nearly ready to deploy the first manned space station. Standard Oil and I.G. Diplomatic efforts to establish a Jewish homeland in Palestine were failing to gain traction, while post-colonial England held its ground on immigration restrictions and bands of Jews and Arabs battled over territory on the ground. More immediate was the issue of temporarily housing Holocaust survivors and refugees across scorched Europe. Leaders of the continental nations demonstrated, at best, reluctance to accommodate the Jews, who in turn were, at the least, resistant to returning to the same bloody cocktail from which they had fled. Truman used the impasse to advance a plan for NASA’s space station to be put to use as a temporary Jewish outpost, an orbital displaced persons camp, to be operated by the US Army. Viewing the orbital displaced persons (ODP) camp as a solution to their immigration problem both at home and abroad, England came on board as a willing partner. Spaceship Exodus was positioned for takeoff on German farmland 20 kilometers southwest of Frankfurt. On December 30, 1947, one month after the UN General Assembly voted down the separation plan for Palestine, Exodus rocketed into the atmosphere hauling the first module of barracks designed to house 1,500 refugees. Additional installations were positioned to form swollen clusters of interlocking units – sleeping quarters, schools, clinics, canteens. The UN was brought in to monitor the camp following two chaotic years of US Army control in which food shortages, pandemic diseases, and rampant black market trade had brought the camp to near total collapse. No less bureaucratic or ineffectual, the UN relief agency at least had prior experience facilitating contexts of a similar magnitude and could potentially predict outcomes. What had been unexpected was the degree to which the camp would evolve into its own self-regulated, hive-like ecosystem where previously accepted rules of conduct were not applicable. The ODP camp was an exceptional space, a riverboat casino, an offshore research lab of social experimentation and entrepreneurial innovation. No longer Earth-bound, touching soil knotted by prescripts of Talmudic law, the camp residents were able to rationalize loopholes and detonate barriers standing in the way of absolute production. The Jewish archipelago was renamed Israel after the ancient homeland. If the temple couldn’t be rebuilt in the motherland, a post-national rhizome would sprout up in its stead.
