The assumption that coercion is largely responsible for our legal systems’ efficacy is a common one. I argue that this assumption is false. But I do so indirectly, by objecting to a thesis I call “(Compliance)”, which holds that most citizens comply with most legal mandates most of the time at least partly in virtue of being motivated by legal systems’ threats of sanctions and other unwelcome consequences. The relationship between (Compliance) and the efficacy of legal systems is explained in (...) section 1. There I also show that (Compliance) must be rejected for it relies on unsubstantiated empirical assumptions. In section 2, I claim that an alternative, and more refined, formulation of (Compliance) also lacks adequate support. I conclude with a few general remarks about the centrality of coercion in our thought and talk about legal systems. (shrink)

In discussing whether legal systems are necessarily coercive, legal philosophers usually appeal to thought experiments involving angels or other morally driven beings who need no coercion to organise their social lives. Such appeals have invited criticism. Critics have not only challenged the relevance of such thought experiments to our understanding of legal systems; they have also argued that, contrary to the intuitions of most legal philosophers, the ‘man on the Clapham Omnibus’ would not hold that there is law in a (...) society of angels because the view that law is necessarily coercive ‘enjoys widespread support among laypersons’. This is obviously an empirical claim. Critics, however, never systematically polled the ‘man on the Clapham Omnibus’. We boarded that bus. The relationship between law and coercion has been, and still is, a central topic in legal philosophy. Despite this, discussion about it is immersed in confusion. Some philosophers have noticed this, but hardly any work has been done to attempt to solve or even identify the confusions. This paper aims to fill this gap. Here I propose distinctions and qualifications that help us clarify the relationship between law and coercion and avoid confusion. Up until recently, most legal philosophers have argued that an action is a token of sanctioning if, and only if, (i) its performance brings about unwelcome consequences to the targets, and (ii) it is performed as a response to the breach of a duty. In this paper I take issue with this account. I first add some qualifications to it in order to present it in its most plausible form. After doing this, I advance a series of hypothetical cases which (...) suggests that this account fails. I then propose a new account of sanctioning, whereby an action is a token of sanctioning if, and only if, it is performed in an appropriate context and is apt for punishing wrongdoers. (shrink)

The idea that legal systems conditionally threaten citizens is taken by most legal and political philosophers as ‘reasonably uncontroversial,’ ‘obvious,’ or as portraying ‘a large part of how law operates.’ This paper clarifies and ultimately rejects this idea: our legal systems, it is argued, rarely address citizens via conditional threats. If correct, the conclusion defended in this paper might force us to re-examine core debates in legal and political philosophy that rely on the assumption that legal systems often threaten citizens: (...) debates about the justification of the state, global justice, and the coerciveness of law. Whether legal systems are necessarily coercive raises normative concerns. Coercion carries a presumption of illegitimacy and a special justificatory burden. If legal systems are necessarily coercive, coerciveness necessarily taints our legal institutions. Traditionally, legal systems have been regarded as contingently coercive. This view is mainly supported by the society of angels thought experiment. For the past few years, however, this traditional view has been under attack. Critics have challenged the reliability of the thought experiment and have urged us to centre (...) the discussion on typical legal systems: legal systems made by humans to address human needs. Once we do so – they claim – we would inevitably reject the traditional view. This paper argues that the critics are wrong. After discussing key features of the society of angels thought experiment and responding to objections, it is argued that even typical legal systems are contingently coercive. Introduction to the Law and Coercion Symposium.

My aim in this essay is to show that some of the arguments usually offered by the feminist movements and conservatists against the pornography are not sound, and so, are not sufficient to hold that pornography is morally wrong.

Technology scholars and journalists have recently called attention to digital platforms’ and devices’ ability to influence users based on their present moods, stress level, hunger, and other transient features. For them, such influence based on users’ present status – what the chapter calls “real-time profiling” – is not only a clear form of wrongful manipulation but also online manipulation’s future. The chapter aims to explain what makes real-time profiling wrong (when wrong) and discusses problems associated with its regulation. After explaining (...) what real-time profiling consists in and showing that it can be presumed to be a form of manipulation, the chapter argues that real-time profiling is wrong both because the profiler psychologically hijacks profiled subjects and because it works as a gateway to further wrongs. Towards the end, the chapter discusses some implications of the proposed account for the legal regulation of online manipulative technologies like real-time profiling. It is argued that existing legal frameworks are not fine-grained enough to deal with the wrongs associated with real-time profiling and related forms of online manipulation. (shrink)

In this paper we extend Heidi Hurd’s “correspondence thesis” to the termination of pregnancy debate and argue that the same reasons that determine the permissibility of abortion also determine the justifiability of acts involving conscientious objection against its performance. Essentially, when abortion is morally justified, acts that prevent or obstruct it are morally unjustified. Therefore, despite conscientious objection being legally permitted in some global south countries, we argue that such permission to conscientiously object would be morally wrong in cases of (...) morally justifiable termination of pregnancy. After presenting and defending our “correspondence argument” we suggest that conscientious objection should be denied as a matter of public health policy in developing counties, even in cases where adequate referral services are possible. Towards the end, we extend our argument to midwives, nurses, and prospective students in the field. Given their essential position in resource‐poor contexts; they too have no claim to conscientious objection. (shrink)

In the past few years, health and human rights scholars have stressed upon the need for rebuilding or reforming our health systems to make them both more resilient to health emergencies and less prone to nurturing inequalities. Discussions about health reform often centre on the ends of reform: the kind of health systems that should be built and the demands of justice that they should be able to satisfy once reformed. However, little has been said about the demands of justice (...) in or during health reforms. This chapter intends to start that discussion. Borrowing from the literature on transitional justice, we argue that an analogous problem of transitional justice exists in the context of health. We outline some of the key elements of transitional health justice, including some of its key demands, practices, and corresponding institutional framework. We conclude by highlighting an important relationship between transitional health justice and transitional justice. (shrink)

This is an introductory handbook for some of the main themes around the notion of predication in Aristotle. It does not aim at being exhaustive, but only sketches some important lines about the subject; it contains an introductory essay, besides the translation (into Portuguese) and commentary of basic texts (such as Posterior Analytics I-22, Categories 1-5, Interpretation 1-6 etc.).

This book examines phenomenal conservatism, one of the most influential and promising internalist conceptions of non-inferential justification debated in current epistemology and philosophy of mind. It also explores the significance of the findings of this examination for the general debate on epistemic justification. According to phenomenal conservatism, non-inferential justification rests on seemings or appearances, conceived of as experiences provided with propositional content. Phenomenal conservatism states that if it appears to S that P, in the absence of defeaters, S thereby has (...) some justification for believing that P. This view provides the basis for foundationalism and many ordinary epistemic practices. This book sheds new light on phenomenal conservatism by assessing objections to it and examining epistemological merits and advantages attributed to it. In a nutshell, phenomenal conservatism is actually compatible with Bayesian reasoning, and it is unaffected by bootstrapping problems and challenges that appeal to the cognitive penetrability of perception. Nevertheless, appearance-based justification proves unstable or elusive and its antisceptical bite is more limited than expected. These difficulties could be surmounted if phenomenal conservatism were integrated with a theory of inferential justification. The book appeals to scholars and postgraduates in the field of epistemology and philosophy of mind who are interested in the rational roles of appearances. (shrink)

Translation of Aristotle's Physics I-II into Portuguese, with commentaries. Tradução para o português dos livros I e II da Física de Aristóteles, com comentários.

In this paper we focus on transmission and failure of transmission of warrant. We identify three individually necessary and jointly sufficient conditions for transmission of warrant, and we show that their satisfaction grounds a number of interesting epistemic phenomena that have not been sufficiently appreciated in the literature. We then scrutinise Wright’s analysis of transmission failure and improve on extant readings of it. Nonetheless, we present a Bayesian counterexample that shows that Wright’s analysis is partially incoherent with our analysis of (...) warrant transmission and prima facie defective. We conclude exploring three alternative lines of reply: developing a more satisfactory account of transmission failure, which we outline; dismissing the Bayesian counterexample by rejecting some of its assumptions; reinterpreting Wright’s analysis to make it immune to the counterexample. I discuss a short string of five sentences in Metaphysics V.5, 1015b6-9 relating demonstration to necessity. My proposal is that Aristotle focuses his attention on the demonstration as a demonstration. Other interpretations reduce the necessity in question to the modality of the component sentences of the demonstrations (the conclusion and the premises). My view does not deny that the modality of the component sentences is important, but takes seriously the idea that a demonstration itself should be understood as necessary—as not (...) capable of being otherwise. A demonstration cannot be different from what it is in the sense that [i] its components cannot be different from what they are, [ii] its components must be related to each other exactly in the way they are related. Demonstrations aim at the fully appropriate explanation of a given explanandum—and each demonstration is individuated by the explanandum it takes. Thus, the basic idea is that, for the target explanandum that individuates a given demonstration, the premises delivering the fully appropriate explanation cannot be replaces with different ones. I show how this proposal, which explains Aristotle’s language in 1015b6-9 accurately, does not make demonstrations ‘melt down into conditional necessity’, first, because the modality of the component sentences is still importantly involved, second, because the explanatory relation expressed in a demonstration is a necessary fact in the real world, so that the demonstration itself is also necessary (in the way I have explained) inasmuch as it captures that fact. The Simulation Theory (ST) is one of the main approaches to mindreading. ST draws on the common-sense idea that we represent and reason about others’ mental states by putting ourselves in their shoes. More precisely, we typically arrive at representing others’ mental states by simulating their mental states in our own mind. Translation of Aristotle's Metaphysics IV and VI, with notes. The translation is preliminary and intended as a provisional teaching tool to be also used in seminars and discussions with peers in order to reach a more elaborated version.

This chapter has two main sections. In the first section I briefly sketch Immanuel Kant’s moral theory as laid out in his Groundwork of the Metaphysics of Morals (1785). I explain Kant’s claim that morality must be grounded on what he calls a categorical imperative and examine his three formulations of this categorical imperative. In the second section I explain the distinction between “deontological” and “teleological” ethical theories. Kantian ethics is often presented as the paradigm example of a deontological ethical (...) theory, but I question whether Kant’s ethics should be understood as purely deontological. (shrink)

Transmission of justification across inference is a valuable and indeed ubiquitous epistemic phenomenon in everyday life and science. It is thanks to the phenomenon of epistemic transmission that inferential reasoning is a means for substantiating predictions of future events and, more generally, for expanding the sphere of our justified beliefs or reinforcing the justification of beliefs that we already entertain. However, transmission of justification is not without exceptions. As a few epistemologists have come to realise, more or less trivial forms (...) of circularity can prevent justification from transmitting from p to q even if one has justification for p and one is aware of the inferential link from p to q. In interesting cases this happens because one can acquire justification for p only if one has independent justification for q. In this case the justification for q cannot depend on the justification for p and the inferential link from p to q, as genuine transmission would require. The phenomenon of transmission failure seems to shed light on philosophical puzzles, such as Moore's proof of a material world and McKinsey's paradox, and it plays a central role in various philosophical debates. For this reason it is being granted continued and increasing attention. (shrink)

In this paper, I present an interpretation of Wittgenstein's remarks on the experience of wonder at the existence of the world. According to this interpretation, Wittgenstein's feeling of wonder stems from perceiving the existence of the world as an absolute miracle, that is, as a fact that is in principle beyond explanation. Based on this analysis, I will suggest that Wittgenstein's experience is akin to what has been described by other authors such as Coleridge, Pessoa, Heidegger, Scheler, Sartre, and Hadot, (...) among many others. Through a comparison between Wittgenstein and Coleridge on the experience of existence, I shall highlight some core features of this experience, chief among them the use of the notion of nothingness in clarifying what is understood in the experience, the role of intuition, and the presence of a specific pathos. As a whole, this paper aims to provide a contribution to the project of a phenomenology of the experience of existence and intends to create a bridge for a dialogue between Wittgenstein and the phenomenological tradition on the enigma of existence. I discuss Aristotle's treatment of essence and definition in Metaphysics VII.4. I argue that it is coherent and perfectly in accord with its broader context. His discussion in VII.4 offers, on the one hand, minimal criteria for what counts as definition and essence for whatever kind of object, but also, on the other hand, stronger criteria for a primary sort of definition and essence—and thereby it serves the interest of book VII in pointing to the explanatory power of the essence (...) of composite substances. This paper discusses some issues concerning the definition of moral virtue in Nicomachean Ethics 1106b 36- 1107a 2. It is reasonable to expect from a definition the complete enumeration of the relevant features of its definiendum, but the definition of moral virtue seems to fail in doing this task. One might be tempted to infer that this definition is intended by Aristotle as a mere preliminary account that should be replaced by a more precise one. The context of the argument (...) Aristotle develops in Book II of his NE give us some help. I argue that the definition of moral virtue, once considered in the light of its context, is far from being an incomplete and provisional account: it rather introduces coherently the same notion of moral virtue that Aristotle employs in other texts (as in Nicomachean Ethics VI 13). My main proposal is that the way in which "hexis" is understood in the context of previous chapters allows Aristotle to encode in it the notion of an ability to do the right things regularly. Thus, moral virtue is a "hexis prohairetike etc.", but the ability to do the right things regularly is already encoded in the occurrence of "hexis" in the definiens account of moral virtue, as if Aristotle meant "hexis [praktike] prohairetike". Phenomenal conservatism (PC) is the internalist view that non-inferential justification rests on appearances. PC’s advocates have recently argued that seemings are also required to explain inferential justification. The most general and developed view to this effect is Huemer (2016)’s theory of inferential seemings (ToIS). Moretti (2018) has shown that PC is affected by the problem of reflective awareness, which makes PC open to sceptical challenges. In this paper I argue that ToIS is afflicted by a version of the same problem (...) and it is thus hostage to inferential scepticism. I also suggest a possible response on behalf of ToIS’s advocates. I discuss three kinds of relationship between ends and means (or "things that promote ends") in the Aristotelian ethical theory, in order to clarify how moral virtues and phronesis are related both in adopting ends and in determining means for virtuous actions. Phronesis seems to be mainly charged with determining means for an end given by the moral virtues, but it must involve some conception of ends too. Phronesis cannot be parasitic on moral virtue concerning the conception of ends, for (...) otherwise it will lack intrinsic moral value. I argue that the intrinsic moral value of phronesis can be better understood through a certain kind of relation between means and ends that has not received much attention. (shrink)

Translation of Aristotle’s Metaphysics IX and X (Theta & Iota) into Portuguese, with a few notes, experimental glossary and introduction. The translation, which was made at 2004, is preliminary and its publication was intended to provide a didactic tool for courses as well as a provisional resource in research seminars. It needs some revision. I am currently working (slowly...) on the revision of the translation and a new revised one will surely appear at some point.

This paper intends to address social robotics from the Actor-network theory (ANT) perspective. Starting from the critique of Seibt’s approach and the distinction between anthropomorphing and sociomorphing, the paper proposes a new methodological approach based on ANT and negotiation concepts. This approach allows us to: a) assume a more symmetrical ontology in which robots are considered as social agents, like humans; b) consider all the interactional elements as of equal importance; and c) overcome the dualistic limit that is often imposed (...) on social robotics studies, i.e., the tendency to consider only the one-to-one relationship, one man-one robot, inside the laboratory. Anthropomorphing and sociomorphing are the results of a negotiation process that cannot be reduced to a series of degrees of simulation, but must be understood as a complex interactional process between many agents and material mediations. Psychopaths have emotional and rational impairments that can be expressed in persistent criminal behaviour. UK and US law has not traditionally excused disordered individuals for their crimes citing these impairments as a cause for their criminal behaviour. Until now, the discussion of whether psychopaths are morally responsible for their behaviour has usually taken place in the realm of philosophy. However, in recent years, this debate has been informed by scientific and psychiatric advancements, fundamentally so with the development of Robert Hare's (...) diagnostic tool, the Psychopathy Checklist. Responsibility and Psychopathy explores the moral responsibility of psychopaths. It engages with problems at the interface between law, psychiatry, and philosophy, and is divided into three parts offering relevant interdisciplinary background information to address this main problem. The first part discusses the public policy and legal responses to psychopathy. It offers an introduction to the central practical issue of how public policy should respond to psychopathy, providing insights for those arguing about the responsibility of psychopaths. The second part introduces recent scientific advancements in the classification, description, explanation, and treatment of psychopathy. The third part of the volume includes chapters covering the most significant dimensions of philosophical debate on the moral and criminal responsibility of psychopaths. (shrink)

This paper contributes to the debate on the question of whether a systematic connection obtains between one’s commitment to realism or antirealism and one’s attitude towards the possibility of radical theoretical novelty, namely, theory change affecting our best, most successful theories (see, e.g., Stanford in Synthese 196:3915–3932, 2019; Dellsén in Stud Hist Philos Sci 76:30–38, 2019). We argue that it is not allegiance to realism or antirealism as such that primarily dictates one’s response to the possibility of radical theoretical novelty: (...) what matters the most is, rather, the proposed alternative’s promise to realize one’s favored cognitive aim(s). Our argument tells not only against Stanford’s account of how adherence to realism or antirealism orients how one responds to possible radical theoretical novelty, but also against what we call the “natural pairing thesis.” According to such a thesis, which has kept resurfacing in the history of the philosophy of science, one-to-one pairings obtain between realism/antirealism, on the one hand, and theoretical conservatism/openness to radical theoretical novelty, on the other hand. As our argument suggests, however, when faced with the possibility of radical theoretical novelty, realists can respond either in a conservative way or by being open to theory change, not unlike antirealists. This paper explores the perversion of reality in the context of advanced technologies, such as AI, VR, and AR, through the lens of Jean Baudrillard’s theory of hyperreality and the precession of simulacra. By examining the transformative effects of these technologies on our perception of reality, with a particular focus on the usage of digital avatars, the paper highlights the blurred distinction between the real and the simulated, where the copy becomes more ‘real’ than the original. Drawing on Baudrillard’s concept (...) of hyperreality, the paper delves into the perversion of reality as individuals seek refuge in virtual pleasure paradises and embrace artificial pleasures through their digital avatars, disconnecting from genuine human experiences. The convergence of AI, VR, and AR technologies amplifies this hyperreal condition, where digital avatars mimic or surpass the depth of human relationships, challenging our understanding of what is real. In line with Baudrillard’s theory, the paper explores the objectification and commodification of reality within digital spaces, specifically examining the digital avatars’ role in the erosion of genuine human connections. It explores the implications of these avatars in terms of consent, exploitation, and loss of authenticity, echoing Baudrillard’s concerns about the distortion of reality in contemporary society. Recognizing the implications of these technologies, the paper calls for a critical reflection on their transformative power. It emphasizes the need for a nuanced understanding of the hyperreal condition and ethical responsibility in engaging with AI, VR, and AR, particularly in relation to the usage of digital avatars. By resisting the seductive allure of digital escapism and preserving genuine human connections, we can navigate the perversion of reality and cultivate empathy, compassion, and meaningful interactions that transcend the simulated experiences offered by technology. Elas pretendem se construir a partir das estruturas biológicas e reduzem seu objeto de estudo ao corpo ou o deduzem das funções orgânicas; a pesquisa psicológica não é mais que um ramo da fisiologia (ou de um domínio dela): a reflexologia. Ou então elas são reflexivas, introspectivas, fenomenológicas e o homem é puro espírito. Elas estudam as diversidades humanas e descrevem a evolução da criança, as (...) degradações do louco, a estranheza dos primitivos. Ora elas descrevem o elemento, ora pretendem compreender o todo. Às vezes se ocupam exclusivamente com a forma objetiva do comportamento, outras vezes vinculam as ações à vida interior para explicar as condutas, ou ainda pretendem apreender a existência vivida. Algumas deduzem, outras são puramente experimentais e utilizam estruturas matemáticas como forma descritiva. As psicologias diurnas querem explicar a razão da vida do espírito pelos clarões decisivos da inteligência, enquanto as outras visam as inquietantes profundezas da obscuridade interior. Naturalistas, elas traçam os contornos definitivos do homem; humanistas, reconhecem nele algo de inexplicável. Esta complexidade é, talvez, justamente a nossa. Pobre alma (as psicologias que hesitam sobre seus conceitos não sabem sequer nomeá-la), cercada de técnicas, remexida de questões, posta em formulários, traduzida em curvas. Auguste Comte acreditava, com algumas reservas, que a psicologia era uma ciência ilusória, impossível e a menosprezou. Não somos tão ousados. Apesar de tudo, há psicólogos, e que pesquisam. (shrink)

Deflationists about truth hold that the function of the truth predicate is to enable us to make certain assertions we could not otherwise make. Pragmatists claim that the utility of negation lies in its role in registering incompatibility. The pragmatist insight about negation has been successfully incorporated into bilateral theories of content, which take the meaning of negation to be inferentially explained in terms of the speech act of rejection. We implement the deflationist insight in a bilateral theory by taking (...) the meaning of the truth predicate to be explained by its inferential relation to assertion. We combine this account of the meaning of the truth predicate with a new diagnosis of the liar paradox: its derivation requires the truth rules to preserve evidence, but these rules only preserve commitment. The result is a novel inferential deflationist theory of truth, which solves the liar paradox in a principled manner. We end by showing that our theory and simple extensions thereof have the resources to axiomatize the internal logic of several supervaluational hierarchies, including Cantini’s. This solves open problems of Halbach (2011) and Horsten (2011). (shrink)

When people want to identify the causes of an event, assign credit or blame, or learn from their mistakes, they often reflect on how things could have gone differently. In this kind of reasoning, one considers a counterfactual world in which some events are different from their real-world counterparts and considers what else would have changed. Researchers have recently proposed several probabilistic models that aim to capture how people do (or should) reason about counterfactuals. We present a new model and (...) show that it accounts better for human inferences than several alternative models. Our model builds on the work of Pearl (2000), and extends his approach in a way that accommodates backtracking inferences and that acknowledges the difference between counterfactual interventions and counterfactual observations. We present six new experiments and analyze data from four experiments carried out by Rips (2010), and the results suggest that the new model provides an accurate account of both mean human judgments and the judgments of individuals. Sets are central to mathematics and its foundations, but what are they? In this book Luca Incurvati provides a detailed examination of all the major conceptions of set and discusses their virtues and shortcomings, as well as introducing the fundamentals of the alternative set theories with which these conceptions are associated. He shows that the conceptual landscape includes not only the naïve and iterative conceptions but also the limitation of size conception, the definite conception, the stratified conception and the graph (...) conception. In addition, he presents a novel, minimalist account of the iterative conception which does not require the existence of a relation of metaphysical dependence between a set and its members. His book will be of interest to researchers and advanced students in logic and the philosophy of mathematics. (shrink)

This paper develops a hermeneutic technology assessment of quantum technologies. It offers a “vision assessment” of quantum technologies that can eventually lead to socio-ethical analysis. Section 2 describes this methodological approach and in particular the concept of the hermeneutic circle applied to technology. Section 3 gives a generic overview of quantum technologies and their impacts. Sections 4 and 5 apply the hermeneutic technology assessment approach to the study of quantum technologies. Section 5 proposes distinguishing three levels in the analysis of (...) the creation and communication of social meanings to quantum technologies: (a) fictions, (b) popularization, and (c) scientific journalism. Section 6 analyzes the results and defines some lines of action to increase social acceptance and trust in quantum technologies. The aim of this paper is to contribute to the debate on quantum technologies by enhancing the reflection on them and their potential, as well as illustrating the complexity of technological innovation and the need to shape it. Grouping severe mental disorders into a global category is likely to lead to a “theory of everything” which forcefully explains everything and nothing. Speculation even at the phenotypic level of the single disorder cannot be fruitful, unless specific and testable models are proposed. Inclusive fitness must be incorporated in such models.
