In the 1960s, the BD concept and organ transplants were instantly linked when the first kidney transplant using a brain-dead donor was performed; Schwab proposed to use EEG in BD; the Harvard Committee report and the Sydney Declaration appeared; the first successful kidney, lung and pancreas transplants using cadaveric donors were achieved; Barnard performed the first human heart transplant. This historical review demonstrates that the BD concept and organ transplantation arose separately and advanced in parallel, and only began to progress together in the late 1960s. On 5 August 1968, publication of the Harvard Committee’s report on the subject of “irreversible coma” established a standard for diagnosing death on neurological grounds. On the same day, the 22nd World Medical Assembly met in Sydney, Australia, and announced the Declaration of Sydney, a pronouncement on death, which is less often quoted because it was overshadowed by the impact of the Harvard Report. To put those events into present-day perspective, the authors reviewed all papers published on this subject and (...) the World Medical Association web page and documents, and corresponded with Dr A G Romualdez, the son of Dr A Z Romualdez. There was vast neurological expertise among some of the Harvard Committee members, leading to a comprehensible and practical clinical description of the brain death syndrome and the way to diagnose it. This landmark account had a global medical and social impact on the issue of human death, which simultaneously lessened reception of the Declaration of Sydney. Nonetheless, the Declaration of Sydney faced the main conceptual and philosophical issues on human death in a bold and forthright manner. This statement differentiated the meaning of death at the cellular and tissue levels from the death of the person. This was a pioneering view on the discussion of human death, published as early as in 1968, that should be recognised by current and future generations. (shrink)

The main problem of the Spanish local finance system derives from the existence of two opposite models: LOFCA model versus Floral system. As a result of this opposition, the Spanish system has moved some distance away from the theoretical principles of sound fiscal federalism. The analysis carried out in the article points out clearly the need to improve the fiscal mechanisms of responsibility and financial autonomy and to introduce a system of interjurisdictional responsibility which should palliate the defects detected in (...) the actual system in order to maximise the political and economic advantages of an authentic fiscal decentralisation.Le problème majeur du système espagnol de finances locales réside dans l’existence de deux modèles opposés: le modèle LOFCA et le système Floral. En raison de cette opposition, le système espagnol s’est considérablement écarté des principes affirmés par la théorie d’un authentique fédéralisme fiscal. L’analyse conduite dans l’article met en évidence la nécessité d’améliorer les mécanismes fiscaux de responsabilité et d’autonomie financière des collectivités locales espagnoles en introduisant un système de responsabilité inter-juridictionnelle capable d’éliminer les incohérences du système ; ce qui permettra de tirer pleinement partie des avantages politiques et économiques inhérents à la décentralisation fiscale. In this paper, we study the effects of using an algorithm-based risk assessment instrument (RAI) to support the prediction of risk of violent recidivism upon release. The instrument we used is a machine learning version of RiskCanvi used by the Justice Department of Catalonia, Spain. It was hypothesized that people can improve their performance on defining the risk of recidivism when assisted with a RAI. Also, that professionals can perform better than non-experts on the domain. Participants had to predict whether (...) a person who has been released from prison will commit a new crime leading to re-incarceration, within the next two years. This user study is done with (1) general participants from diverse backgrounds recruited through a crowdsourcing platform, (2) targeted participants who are students and practitioners of data science, criminology, or social work and professionals who work with RisCanvi. We also run focus groups with participants of the targeted study, including people who use RisCanvi in a professional capacity, to interpret the quantitative results. Among other findings, we observe that algorithmic support systematically leads to more accurate predictions from all participants, but that statistically significant gains are only seen in the performance of targeted participants with respect to that of crowdsourced participants. Among other comments, professional participants indicate that they would not foresee using a fully-automated system in criminal risk assessment, but do consider it valuable for training, standardization, and to fine-tune or double-check their predictions on particularly difficult cases. We found that the revised prediction by using a RAI increases the performance of all groups, while professionals show a better performance in general. And, a RAI can be considered for extending professional capacities and skills along their careers. (shrink)

Climate change involves changes in the climate system caused by polluting human activities and the social and natural effects of these changes. The historical and anthropogenic grounds of climate change play an important role in climate justice claims. Many climate justice scholars believe that principles of climate justice should account for the historical and anthropogenic sources of climate change. Two main backward-looking principles have been proposed: the polluter pays principle (PPP) and the beneficiary pays principle (BPP). The BPP emerged in (...) the literature on climate justice in response to certain objections raised against the PPP. In this paper, I focus on two of these objections: the causation objection and the excusable ignorance objection. Defenders of the BPP have traditionally assumed that this principle is not vulnerable to those objections, which renders the BPP superior to the PPP. In this paper, I challenge this underlying assumption. My argument here is simple: moving from the PPP to the BPP in response to any of these objections might be unjustified because the BPP is affected by at least some of the considerations giving rise to these objections. Debates about individual responsibility for climate change revolve mainly around individual mitigation duties. Mitigation duties concern future impacts of climate change. Unfortunately, climate change has already caused important harms and it is foreseeable that it will cause more in the future, in spite of our best efforts. Thus, arguably, individuals might also have duties related to those harms. In this paper, I address the question of whether individuals are obligated to provide compensation for climate related harms that have already occurred. (...) I explore two possible strategies to answer that question. The straightforward strategy answers in the affirmative. Two approaches embrace this strategy: the ‘ecological citizenship’ approach and the benefits-based approach. I challenge those two approaches and rule out an affirmative answer. The alternative strategy answers in the negative but provides a way to respond to why currently living individuals should pay for burdens created for past individuals. Two possible approaches embrace this alternative: the community-based approach and my own state-based benefits approach. I will argue that individual duties do not fall under the realm of compensatory justice, but they have nonetheless a duty to bear compensatory burdens allocated to their states. (shrink)

The Polluter Pays Principle (PPP) states that polluters should bear the burdens as- sociated with their pollution. This principle has been highly contested because of the pu- tative impossibility of considering individuals morally responsible for an important amount of their emissions. For the PPP faces the so-called excusable ignorance objec- tion, which states that polluters were for a long time non-negligently ignorant about the negative consequences of greenhouse gas emissions and, thus, cannot be considered morally responsible for their negative consequences. (...) This paper focuses on the concept of moral responsibility as it appears in the excusable ignorance objection. I claim that this objection stems from a narrow notion of moral responsibility and that a more fundamen- tal notion of moral responsibility would pave the way to overcome it. I show that it should be out of the question whether historical polluters should bear some burdens asso- ciated with climate change because of their historical emissions. The relevant question is which kind of burdens they can legitimately be asked to bear. I argue that this notion of moral responsibility allows us to assign burdens of symbolic reparation, which are at the core of ‘Loss and Damage’ policies. (shrink)

Climate scientists have proposed two methods to link extreme weather events and anthropogenic climate forcing: the probabilistic and the storyline approach. Proponents of the first approach have raised the criticism that the storyline approach could be overstating the role of anthropogenic climate change. This issue has important implications because, in certain contexts, decision-makers might seek to avoid information that overstates the effects of anthropogenic climate change. In this paper, we explore two research questions. First, whether and to what extent the (...) storyline approach overstates the effects of anthropogenic climate change. Second, whether the objections offered against the storyline approach constitute good reasons to prefer the probabilistic approach. Concerning the first question, we show that the storyline approach does not necessarily overstate the effects of climate change, and particularly not for the reasons offered by proponents of the probabilistic approach. Concerning the second question, we show, independently, that the probabilistic approach faces the same or very similar objections to those raised against the storyline approach due to the lack of robustness of climate models and the way events are commonly defined when applying the probabilistic approach. These results suggest that these objections might not constitute good reasons to prefer the probabilistic approach over the storyline approach. (shrink)

The present article aims to present how the different philosophical perspectives have tackled the problem of the foundations of our responsibility to future generations in the context of ecological crisis. The main theories addressed here will be Hans Jonas metaphysical foundation, utilitarianism, communitarianism, the rights theory and contractarian perspectives derived from John Rawls’s theory. By assessing these perspectives, I assert that, against jonasianianism and related perspectives, our responsibilities to future generations must be thought of in terms of “political, not metaphysical”. The foundation of these responsibilities must be based, not on God, nor compassion, nor benevolence, nor identity sentiments, but on a conception of ourselves as rational and reasonable persons. From my point of view, we must find our responsibilities to future generations in our respect for their necessities and interests as well as in the maintenance of their available opportunities. This point of view allows us to point out some of our future challenges in the intergenerational justice scope. (shrink)

Como alternativa, a teoria da dupla herança busca explicar o comportamento humano considerando tanto (...) a biologia quanto as ciências sociais. Segundo esta abordagem, a psicologia social humana é caracterizada por instintos sociais tribais e marcadores simbólicos, que resultam em uma mente que pressupõe princípios morais inatos e universais, selecionados para a vida em grupos orientados por normas sociais, mas que são plasticamente moldados à realidade cultural de cada sociedade. Human beings are the cause of many current environmental problems. This poses the question of how to respond to these problems at the national and international level. However, many people ask themselves whether they should personally contribute to solving these problems and how they could (best) do so. This is the focus of this Special Issue on Individual Environmental Responsibility. The introduction proposes a way to structure this complex debate by distinguishing three broad clusters of arguments. The first cluster tackles (...) the kind of ethical theory we need to properly address different aspects of individual responsibility. The second cluster asks what individuals should do from an ethical point of view. The third cluster investigates the role of contextual factors and the limits of demandingness in individual obligations. RESENHA: CAMAROTTI, Gerson. Segredos do Conclave: os bastidores da eleição do papa Francisco e a operação do Vaticano para estancar a hemorragia de fiéis na América Latina. 1ª ed. São Paulo: Geração Editorial, 2013.

The objective of the study is to verify the reliability and validity of the Factors Influencing Teaching Choice, as well as to determine the teaching of Early childhood and Primary education students’ motivations and perceptions for the choice of this degree. The sample consisted of 262 student teachers aged between 18 and 27. According to degree, 54.2% of the participants were enrolled in Early Childhood Education and 45.8% in Primary Education. The instrument used in the study was the Factors Influencing (...) Teaching Choice, FIT-Choice Scale, adapted to Spanish by Gratacós and López-Jurado. Results evidenced the high reliability and validity of the scale that is similar to the original model, presenting 12 motivational factors and 6 perceptions. The main reasons that lead to choose teaching profession, despite gender differences, are: having influence in the educational children’s process, the intrinsic value of the qualification, the fact that this profession contributes socially, or working with children. Also, students consider that teaching is a demanding profession and they are satisfied with the degree choice. The most important factors influencing the choice of education degree are intrinsic motivations and perceptions as the vocation, in contrast to external reasons such as economic incentives or social recognition. O Brasil foi um dos maiores traficantes de africanos destinados à escravidão nas Américas; e a Bahia um dos seus principais destinos. Porém, juntamente com a escravidão, os africanos trouxeram também a rebelião. Uma das principais formas de negação da escravidão pela revolta trazida pelos negros africanos às Américas foi o quilombo. O artigo discute as mudanças ocorridas na literatura histórica sobre a escravidão e suas formas de negação após o centenário da abolição, em 1988. O quilombo de Palmares surgido (...) no interior de Alagoas em finais do século XIV, veio a se constituir, durante o século XVII, no maior e mais bem organizado quilombo das Américas. Visto de formas diferentes pela historiografia ao longo do tempo, Palmares acabou por se transformar, no imaginário dos explorados de todos os matizes e dos negros de forma especial, num dos maiores símbolos de liberdade e de resistência a qualquer forma de exploração, opressão e discriminação. Nowadays, on national and international levels, the law has been increasingly considering local and traditional communities’ role for achieving conservation. In Brazil, for instance, one can see how recent legal rules promote benefits for those local groups who practice low environmental impact activities. Nevertheless, regarding traditional fishing communities that live on the coastal zone, a region where many protected areas have been created lately in Brazil, the positive social effects of those measures are often undermined by the economic and political (...) pressure they suffer. This becomes particularly clear when the problem is seen under the different grades of citizenship people face in Brazil: that is, considering how people can be over-included in the legal system to have mainly access to its benefits, while others are under-included to be mainly dependent on it. It seems that Brazilian coastal fishing communities fall into the latter case, and that would explain how they are subject to many different types of restrictions and responsibilities due to the new legal instruments that are being developed to protect such areas, sometimes causing, for instance, a pressure to remove them from their homes. Conservation in this context, then, is to be understood beyond legal texts and, especially, under the evaluation of the social conditions these populations are submitted to. Therefore, this paper sketches the legal development of Brazilian marine protected areas, points out some examples of conflicts involving traditional fishing communities affected by conservation policies, and conceptualizes the relations of over- and under-inclusion they can be considered as part of. Ingthorsson, McTaggart’s Paradox and the R-theory of Time L. Nathan Oaklander University of Michigan-Flint, USA [email protected] his provocative book, McTaggart’s Paradox, R.D. Ingthors- son argues that McTaggart’s argument for the unreality of time rests on the principle of temporal parity according to which all times or events in time exist equally or co-exist in a sense that is compatible with their being successive. Moreover, since temporal parity is also an essential tenet of the B-theory, McTaggart’s argument against the reality of (...) time can also be used to undermine the B-theory. Ingthorsson argues further that only by adopting an ontologically frugal presentist metaphysics can one avoid McTaggart’s paradox and account for identity through time and change. The aim of this paper is to clarify Russell’s authentic view of time in con- trast to the B-theory which is McTaggart’s misrepresentation of Russell and argue that temporal parity it is not a fundamental tenet of the Rus- sellian theory. For that reason, the R-theory is immune to objections that are based on temporal parity. I shall then offer my own interpretation of McTaggart’s paradox that renders Ingthorsson’s version of presentism subject to it. (shrink)
