This article critically examines the relationship between shared residence and contact after the breakdown of the parents’ relationship. It examines the background to the government’s main emphasis on methods of monitoring, facilitating and enforcing contact as the most efficacious method of proceeding in respect of the law reform agenda, focussing particularly on the potential impact of punitive enforcement measures on primary carers, usually mothers. The article sets the discussion within its wider cultural context in respect of fathers’ rights claims that (...) family law currently favours mothers, and shows how recent legal developments constitute part of a package to manage post-separation relationships between parent and children. It also examines some of the emerging case law to show how the judiciary is using shared residence orders and transfer of residence to deal with protracted and very difficult contact disputes, and in ways which were not anticipated when shared residence orders were first introduced. Drawing on feminist legal commentaries the argument will be made that the use of transfer of residence and shared residence orders in these disputes is extremely worrying, especially in light of the growing body of empirical research which heralds caution. The article will conclude by suggesting that far from favouring mothers, both the law reforms and the case law effectively construct mothers as integral to the problem of contact. They are treated as the site of and solution to the ‚problem’ of contact, and the means of dealing with the problem is by increasingly punitive measures which are inappropriate in a family law context. At the same time non-residential fathers who do not uphold contact escape legal sanctions. (shrink)

In this piece I have stated my case for the importance of the inclusion of subjectivity in the study of women's poverty. The relevance of the ideas discussed herein is not confined to this one research area, for the project of incorporation is crucial to any field of research which has a pertinence to the practical realities of women's lives. I have noted how through talking and prioritising principles we run the danger of evacuating the subject, for principles cannot take (...) into account the diversity of women's experiences based upon class, race, ethnicity, religion and sexual affiliation. I have also outlined the benefits that accrue to both researcher and participant, with the researcher gaining better insight and understanding of the women she is concerned with and accountable to in her work, and the participant being given the opportunity to tell her own story of her life, rather than have it told solely by the outsider interpreting it. As such she is actively participating in her life rather than simply being led through it, resulting in a form of empowerment that might otherwise be denied her. Subscription has been made to interviewing as a means of incorporating subjectivity into the research project. But the interview as a technique has been problematised, for only through problematisation can we hope to improve our research and strive to ensure that we heed the lessons we and others have learned through our practical activities. I am indebted to those more experienced feminist researchers whose work has influenced this project. And finally, this piece serves as a reminder to others engaged in work about or with women, that women in all diversity are the subjects we should be concerned with in debates on the subject of poverty. This article discusses section 156 of the Criminal Justice and Public Order Act 1994 which prohibits the use of eggs from aborted female foetuses for the purposes of reproduction. I argue that the pre-legislative debates focus only on the biological relationship between the aborted foetus and any ensuing child and foreclose the possibility of useful discussion about the potential merits of such technology. Kristeva's theory of abjection has been used in order to elucidate the strength of feeling about the use (...) of eggs from the expelled foetus. I suggest that the ‘yuk’ factor stems from the potential for the blurring of the boundaries between life and death. In addition, I suggest that the stress placed on the biological link means that the foetus is ascribed special properties not given to live donors. Woman's very crucial role in reproductive technologies is therefore erased. The article argues that there are very good reasons why the debate on the subject should remain open. At present women donors have to undergo highly intrusive procedures in order to give eggs and the process is not without its health risks. The use of eggs from aborted foetuses certainly raises important consent issues but these could be addressed by placing women at the centre of the decision making process, starting with the recognition that it is women and not foetuses who have the remit and responsibility for giving consent for the use of their genetic material. Moreover, there should be an acknowledgement that women are perfectly capable of making informed decisions about donation and of considering the potential implications of participating in egg donation. Broadly speaking, an entity has moral status if and only if it or its interest matters morally for its own sake. Some philosophers, who think of moral status in terms of duties and rights owed to an entity, allow that moral status can come in degrees, with only some beings having status of the highest degree – that is, full moral status (FMS). We critically review the competing accounts of what qualifies one for FMS. Some accounts demand cognitive sophistication, which (...) excludes many children, while others are inclusive of children but fail by (a) putting children morally on a par with most animals (experiencing subject of a life), (b) invoking criteria of dubious moral relevance (potentiality, membership in a biological species), or (c) not securing impartial moral status (special relationships). We end with our own account, which attempts to rectify such problems, addressing specifically the moral status of children. (shrink)

This chapter explores two kinds of testimonial trust, what we call ‘evidential trust’ and ‘non-evidential trust’ with the aim of asking how testimonial trust could provide epistemic reasons for belief. We argue that neither evidential nor non-evidential trust can play a distinctive role in providing evidential reasons for belief, but we tentatively propose that non-evidential trust can in some circumstances provide a novel kind of epistemic reason for belief, a reason of epistemic facilitation. The chapter begins with an extensive discussion (...) of standard accounts of both kinds of trust and criticises especially the standard accounts of non-evidential trust. This book examines the contributions of seventeenth- and eighteenth-century French women philosophers and intellectuals to moralist writing. Moralist writing, a distinctively French genre, draws on philosophical and literary traditions extending back to classical antiquity. Closely connected to salon culture and influenced by Augustinianism, it engages social and political questions, epistemology, moral psychology, and virtue ethics. The first half of the book analyzes women’s use of moralist forms such as the essay, maxim, and “character” or portrait to explore classical topics: self-knowledge (...) and knowledge of the self, the ethics and obligations of friendship, the relation of the passions to happiness. The second half focuses on topics that relate directly to women’s lifeworld: the critique of the institution of marriage, the status of older women, and the question of women’s nature and capabilities. Each chapter traces the evolution of women’s moralist thought from the late seventeenth century to the Enlightenment and the decades immediately following the French Revolution, a period of tremendous change in the horizon of possibilities for women as public figures and intellectuals. This book offers a radical alternative to the positive orientation of popular psychology. This positive orientation has been criticized numerous times. However, there has yet to be a coherent alternative proposed. We all know today that life hurts and that there is no ultimate remedy to this pain. The positive approach feels to us as dishonest and irrelevant. We require a new, more negative, perspective and practice, one that is honest and does not pretend to offer an escape from the (...) agonies of the world. This book offers in three main chapters a ‘depressive realist’ perspective that explores the structural role of negativity and tragedy in relation to the individual psyche, society, and nature. Aestheticians have had a great deal to say recently in praise of (aesthetic) appreciation. This enthusiastic appreciation for appreciation may seem unsurprising given the important role it plays in many of our aesthetic practices, but we maintain that some prominent aestheticians have overstated the role of appreciation (and, perhaps more importantly, understated the role of other elements we will discuss) when it comes to the exercise of aesthetic taste. This is not, of course, to deny the obvious fact that appreciation (...) often plays an important role in our aesthetic practices but merely that it is a mistake to cast it in the role of the sine qua non of aesthetics. The field of Jewish political thought examines how Jewish individuals and communal organizations have behaved politically both within and beyond statehood. The study of Jewish political thought promises to expand received conceptions of what counts as "political.".

Self-deception may be a natural consequence of active goal operation instead of an adaptation for negotiating the social world. We argue that because autonomous goal programs likely drove human judgment and behavior prior to evolution of a central executive or “self,” these goal programs can operate independently to attain their desired end states and thereby produce outcomes that “deceive” the individual.

Sex selection in India and China is fostered by a limiting social structure that disallows women from performing the roles that men perform, and relegates women to a lower status level. Individual parents and individual families benefit concretely from having a son born into the family, while society, and girls and women as a group, are harmed by the widespread practice of sex selection. Sex selection reinforces oppression of women and girls. Sex selection is best addressed by ameliorating the situations (...) of women and girls, increasing their autonomy, and elevating their status in society. One might argue that restricting or prohibiting abortion, prohibiting sex selection, and prohibiting sex determination would eliminate sex selective abortion. But this decreases women's autonomy rather than increases it. Such practices will turn underground. Sex selective infanticide, and slower death by long term neglect, could increase. If abortion is restricted, the burden is placed on women seeking abortions to show that they have a legally acceptable or legitimate reason for a desired abortion, and this seriously limits women's autonomy. Instead of restricting abortion, banning sex selection, and sex determination, it is better to address the practice of sex selection by elevating the status of women and empowering women so that giving birth to a girl is a real and positive option, instead of a detriment to the parents and family as it is currently. But, if a ban on sex selective abortion or a ban on sex determination is indeed instituted, then wider social change promoting women's status in society should be instituted simultaneously. (shrink)

From the Supreme Court to the bedroom, privacy is an intensely contested interest in our everyday lives and privacy law. Some people appeal to privacy to protect such critical areas as abortion, sexuality, and personal information. Yet, privacy skeptics argue that there is no such thing as a right to privacy. I argue that we cannot abandon the concept of privacy. If we wish to avoid extending this elusive concept to cover too much of our lives or shrinking it to (...) cover too little, we must come to understand it. After exploring the privacy arguments of philosophers and constitutional and tort privacy law, I argue for a new definition of privacy and an explanation of its value that clarifies and resolves many of our conflicts. Privacy is critical because it allows us to protect a realm in which we can have intimate relations with others. (shrink)

Beyond Interdisciplinarity examines the broadening meaning of core concept across academic disciplines and other forms of knowledge. In this book, Associate Editor of The Oxford Handbook of Interdisciplinarity and internationally recognized scholar Julie Thompson Klein depicts the heterogeneity and boundary work of inter- and trans-disciplinarity in a conceptual framework based on an ecology of spatializing practices in transaction spaces, including trading zones and communities of practice. The book includes both "crossdisciplinary" work (encompassing multi-, inter-, and trans-disciplinary forms) as well (...) as "cross-sector" work (spanning disciplines, fields, professions, government and industry, and communities). The first section of the book defines and explains boundary work, discourses of interdisciplinarity, and the nature of interdisciplinary fields. In the second section, Klein examines dynamics of working across disciplines, including communication, collaboration, and learning with concrete examples and lessons from research projects and programs that transcend traditional fields. The closing chapter examines reasons for failure and success then presents gateways to literature and other resources. Throughout the book, Klein emphasizes the roles of contextualization and historical change while factoring in the shifting relationship of disciplinarity and interdisciplinarity, ascendancy of transdisciplinarity, and intersections with other constructs including Mode 2 knowledge production, convergence, team science, and postdisciplinarity. The conceptual framework she provides also includes the role of boundary objects, agents, and organizations in brokering differences and creating for platforms for change. Klein further explains why translation, interlanguage, and a communication boundary space are vital to achieving intersubjectivity and collective identity. They foster not only pragmatics of negotiation and integration but also reflexivity, transactivity, and co-production of knowledge with stakeholders beyond the academy. Rhetorics of holism and synthesis compete with instrumentalities of problem solving and transgressive critiques. However, typical warrants today include complexity, contextualization, collaboration, and socially-robust knowledge. Crossing boundaries remains complex, but this book guides readers through the density of pertinent literature while expanding understandings of crossdisciplinary and cross-sector work. (shrink)

Although performance pressure has desirable consequences, there is evidence that it can produce unintended outcomes as employees tend to engage in dysfunctional and unethical behaviors to meet performance goals. Thus, the process through which employees think and behave unethically under performance pressure deserves more research attention. This study goes beyond the stress-appraisal perspective and investigates whether and when performance pressure influences individual work mindsets and behaviors from a moral reasoning perspective. Specifically, we contend that performance pressure is related to employee (...) expediency through moral decoupling. We further hypothesize dialectical thinking and moral identity to be the boundary conditions of the proposed relationships. Analyses of data from a field study in three waves provide support for most of the hypotheses. In particular, we find that moral decoupling accounts for additional variance after we control for the stress-appraisal effect of performance pressure on employee expediency. The study offers several contributions to the literature on performance pressure and unethical behavior. (shrink)

The National Institutes of Health and other federal health agencies are considering establishing a national biobank to study the roles of genes and environment in human health. A preliminary public engagement study was conducted to assess public attitudes and concerns about the proposed biobank, including the expectations for return of individual research results. A total of 141 adults of different ages, incomes, genders, ethnicities, and races participated in 16 focus groups in six locations across the country. Focus group participants voiced (...) a strong desire to be able to access individual research results. Recognizing the wide range of possible research results from a large cohort study, they repeatedly and spontaneously suggested that cohort study participants be given ongoing choices as to which results they received.
