The author does not aim to take up the whole of Quine’s philosophy here. Rather, the aim is to “focus on a few central themes...and to treat them thoroughly.” Continental Europe (...) not only recognizes Quine’s importance, then, but it is prepared to talk back: a point which has become increasingly evident in the wake of several recent works on Quine by W.K. Essler (1975), J. Largeault (1980) and Henri Lauener (1982). Gochet has made an earlier contribution to this in the form of his Quine en Perspective (1978) and its German translation (1984). This paper examines normative elements in Henri Lauener’s “open transcendentalism,” with an eye to evaluate distinctive theses. After setting out some of Lauener’s basic positions in this area, in comparison with related views in Quine’s work, I argue that the views surveyed converge on a normative and contextualist cognitivism in Lauener’s methodological and epistemological perspective. Though he resists similar conclusion in the name of anti-naturalism, I argue that his “open transcendentalism” is plausibly construed as a non reductive (...) naturalism. (shrink)

After setting out some basic elements in Henri Lauener's open transcendentalism, in comparison with related views in Quine and Davidson, the two views surveyed converge on a moderately holistic, normative cognitivism in Lauener's philosophy of science. Though resisting similar conclusions in the name of anti-naturalism, Lauener's "open transcendentalism" is plausibly constmed as a non-reductive naturalism, with important implications for the normative determination of meanings. At the last Lauener's criticism is yet to come to terms with central (...) questions of the naturalist tradition. Crucial in this is the "principle of continuity" in Dewy's (non-reductive) naturalism, the relation of fallibilism to the pragmatic continuity of inquiry, and normative consequentialism in the scientific aims, methods, and meanings. In 1946 Ferdinand Gonseth founded, together with Paul Bernays, Karl Dürr, and Sir Karl Popper, the International Society for Logic and Philosophy of Science. In the next year the first number of Dialectica, a philosophical review devoted mainly to epistemological subjects, was issued. Gonseth's bibliography presents more than 190 items — roughly 25 books, several prefaces, and, for the rest, papers published in numerous reviews. A good deal of his publications concern mathematics — he was appointed professor of mathematics first (...) in Berne and then in Zurich at the well‐known Swiss Federal Institute of Technology — but he has never completely separated his mathematical activities from his philosophical work. This incisive book deals with the use of the criminal law to enforce morality, in particular sexual morality, a subject of particular interest and importance since the publication of the Wolfenden Report in 1957. Professor Hart first considers John Stuart Mill's famous declaration: "The only purpose for which power can be rightfully exercised over any member of a civilized community is to prevent harm to others." During the last hundred years this doctrine has twice been sharply challenged by two great (...) lawyers: Sir James Fitzjames Stephen, the great Victorian judge and historian of the common law, and Lord Devlin, who both argue that the use of the criminal law to enforce morality is justified. The author examines their arguments in some detail, and sets out to demonstrate that they fail to recognize distinction of vital importance for legal and political theory, and that they espouse a conception of the function of legal punishment that few would now share.
