While the obligation of confidentiality is integral to professional ethical codes and is also safeguarded under English law through the equitable remedy of breach of confidence, underpinned by the right to privacy enshrined in Article 8 of the Human Rights Act 1998, it has never been regarded as absolute. But when can and should personal information be made available for statistical and research purposes and (...) what if the information in question is highly sensitive information, such as that relating to the termination of pregnancy after 24 weeks? This article explores the case of In the Matter of an Appeal to the Information Tribunal under section 57 of the Freedom of Information Act 2000, concerning the decision of the Department of Health to withhold some statistical data from the publication of its annual abortion statistics. The specific data being withheld concerned the termination for serious fetal handicap under section 1(1)d of the Abortion Act 1967. The paper explores the implications of this case, which relate both to the nature and scope of personal privacy. It suggests that lessons can be drawn from this case about public interest and use of statistical information and also about general policy issues concerning the legal regulation of confidentiality and privacy in the future. L’érosion actuelle de la confiance du public envers les campagnes de vaccination et les décisions de politiques publiques qui y sont associées, aggravée par des scandales comme ceux relatifs à la pandémie H1N1 et l’utilisation du Tamiflu™, risque de diminuer de façon significative l’efficacité de ces interventions importantes pour la santé publique. Un manque de confiance de la population envers les acteurs de santé publique peut conduire à une méfiance accrue face aux interventions, pouvant ainsi compromettre l’atteinte des objectifs recherchés (...) par une intervention spécifique et, conséquemment, avoir un impact important sur les bénéfices attendus pour la population visée par cette intervention. Dans la production des avis d’experts, les membres des comités consultatifs d’experts en immunisation (CCEI) peuvent avoir une influence importante sur la prise de décision publique, notamment, sur la sélection par les décideurs de santé publique de vaccins en particulier et la façon dont les campagnes de vaccination seront déployées. En contrepartie de cette influence sur les décisions publiques, une indépendance et une transparence sont attendues de leur part puisque des mécanismes de divulgation et de gestion de conflits d’intérêts (CI) imparfaits peuvent affecter négativement la confiance du public à l’égard de telles décisions. Il apparaît donc important de s’assurer que des mécanismes de gestion des CI, transparents et robustes, existent pour ces comités. Dans cette étude, les avis ou rapports d’évaluation de la pertinence de la vaccination préparés par un CCEI au Québec ont été examinés pour quatre types de maladies évitables par la vaccination (infections invasives à méningocoques et à pneumocoques, coqueluche et virus du papillome humain). Le but était de : 1) identifier les CI divulgués par les membres du CCEI dans leurs rapports comparativement à ceux déclarés dans leurs publications scientifiques pour ces mêmes infections ; 2) analyser la nature des CI (réel, potentiel, apparent, personnel, financier, institutionnel, etc.) et l’impact potentiel (risque) sur la prise de décision impartiale et sur la confiance du public ; et 3) évaluer les mécanismes de gestion de CI actuellement utilisés par ce CCEI. Les résultats de cette étude montrent que très peu de rapports du CCEI contiennent une section sur les CI par rapport à la pléthore divulguée dans les publications scientifiques publiées par les membres du CCEI. De plus, les CI divulgués dans les rapports fréquemment ne correspondent pas à ceux décrits dans les publications scientifiques. Il serait donc important d’introduire des mesures visant à accroître la transparence des experts en immunisation et d’améliorer les mécanismes de divulgation et de gestion des CI afin de veiller à ce que la confiance du public envers les décideurs en santé publique soit maintenue et améliorée. Over the last decade there has been a noticeable increase in attention, on the part of public health scholars and professionals, to the important ethical challenges that arise in the context of public health policy, practice and research. This has arguably been a driver for the development of public health ethics as both a specialized field of study in bioethics and a subject for professional education. But how is PHE taught in public health programs and schools? Are current educational approaches (...) sufficient to provide future professionals with the necessary tools to address the diverse ethical challenges they will encounter? In this article, we examine the international public health and bioethics literatures regarding PHE education in public health programs and schools. Specifically, we 1) summarize the results from studies that describe PHE education in the United States, Europe, Canada and in some developing countries, 2) explore current attitudes and educational approaches toward ethics curricula in public health, and 3) identify and discuss reported barriers to PHE education. We conclude with some general recommendations and a research agenda to guide future work on implementing PHE into different public health programs. (shrink)

In Québec, the Act Respecting Access to Documents Held by Public Bodies and the Protection of Personal Information provides an exception to transparency to most public institutions where public health research is conducted by allowing them to not disclose their uses of personal data. This exceptionalism is ethically problematic due to important concerns and we argue that all those who conduct research should be transparent and accountable for the work they do in the public interest.

Bioethics experts played a key role in ensuring a coherent ethical response to the COVID-19 pandemic in the fields of healthcare, public health, and scientific research in Canada. In the province of Quebec, a group of academic and practicing bioethicists met periodically in the early months of the pandemic to discuss approaches and solutions to ethical dilemmas encountered during the crisis. These meetings created the opportunity for a national survey of bioethics practitioners from different fields. The survey, in which forty-five (...) Canadian bioethics practitioners (clinical ethicists, ethicist members of REBs and government health policy ethicists, or any bioethicist practicing outside of academia) participated, explored their concerns, challenges and opportunities during the first wave of the pandemic, with the objective of informing bioethics research about the difficulties experienced by bioethicists “in the field”. Participants reported increased stress levels, increased workloads, and a greater proportion of their work being devoted to public health ethics. Most of their concerns focused on groups other than themselves, such as health professionals, patients, research participants, and people in vulnerable socio-economic situations. An optimism about the future of bioethics was noted due to an increased awareness of the importance of bioethics by the public and by health and research institutions. (shrink)

Hutton made a geological collection to illustrate his theory of the Earth, and frequently cited phenomena displayed by specimens in it to support his arguments. His followers also considered that the evidence provided by the collection would help to establish his views. After Hutton's death it was given to the Royal Society of Edinburgh which, however, under the terms of its charter, was obliged to lodge it in the Natural History Museum of the University. The Museum's curator, the Wernerian, Robert (...) Jameson, thought the collection of little account, and neither displayed it nor kept it together. By the mid-1830s most of it had been dispersed or thrown away, and nothing is known of it since. The list of specimens compiled by its first trustees has also disappeared. By piecing together information in Hutton's writings and letters, and in those of his friends, we learn something about the contents of the collection and how it was formed, and also add to our knowledge of his acquaintance. The final section of the article brings together all Hutton's descriptions of his rocks and minerals and, in doing so, demonstrates the weight of proof that he rested on careful visual analysis of hand specimens. Promotion of prescription drugs may appear to be severely limited in some jurisdictions due to restrictions on direct-to-consumer advertising. However, in most jurisdictions, strategies exist to raise consumer awareness about prescription drugs, notably through the deployment of direct-to-consumer information campaigns that encourage patients to seek help for particular medical conditions. In Canada, DTCI is presented by industry and regulated by Health Canada as being purely informational activities, but their design and integration in broader promotional campaigns raise very similar ethical concerns (...) as those associated with DTCA. Specifically, DTCI can be an effective means of familiarizing the public with the scope and benefits of a particular prescription drug and so, like DTCA, can promote increased patient-consumer demand and thus a problematic rise in the prescribing and use of medications that may be neither the most appropriate nor the most cost-effective. Yet, with DTCI the industry is playing within the existing rules and regulations set by health regulators. To respond appropriately to this regulatory incoherence, we argue that DTCI should be regulated as a type of direct-to-consumer indirect advertising. Even if the case and specific regulations presented here are Canadian, the implications extend to every country that has a partial or total prohibition on DTCA. (shrink)

By bringing together information in published and unpublished works of the eighteenth and early nineteenth century, notably Hutton's unpublished manuscript the ‘Elements of Agriculture’, it is possible to augment our meagre knowledge of Hutton's agricultural activities. His decision to farm is discussed, as are his time as a student of agriculture in East Anglia and on the Continent , his life as a farmer at Slighhouses in Berwickshire , his research after he returned to Edinburgh , and his opinions on (...) the role of government in agricultural affairs. The section on Slighhouses deals not only with Hutton's agricultural experiments and improvements, but also with his personal life, travel, and scientific studies. Investigation shows that his interest in agriculture gave impetus to his studies in other disciplines, and that his years as a farmer were ones of great intellectual activity which laid the foundation for many of his future achievements, particularly in geology. James Hutton held shares in the company that built the Forth and Clyde canal, and was closely involved in its construction. For seven years he attended meetings on and off the site, helping to decide on the route, the supply of building stone and other problems. As far as we know it is the only occasion on which he used his geological knowledge in a public enterprise.

James Hutton is known to have regarded exploration as an important source of geological knowledge, and to have studied the accounts of travellers with close attention. Unpublished letters in the Fitzwilliam Museum, Cambridge, however, show that he was more actively involved in exploration than had been previously supposed. During the preparation for Cook's second voyage, he gave advice about both geological and marine research. He advised Banks against making a major voyage to Arctic regions, on the grounds that it would (...) be unprofitable geologically. He encouraged Banks and other friends to measure sea and air temperatures on their voyages, and there are indications that he himself took part in marine experiments. His interest in oceanography, which has not been discussed before, is found to complement his work in meteorology. (shrink)

There are eleven previously unpublished letters between James Hutton and James Watt in the Doldowlod collection, which Birmingham City Archives acquires from Lord Gibson-Watt in 1994. They were written between 1774 and 1795. Very little of Hutton's other correspondence survives, so these letters add significantly to our knowledge. The earliest letters together with two letters from Hutton to George Clerk-Maxwell , describe geological tours that Hutton made through Wales, the Midlands, and the south-west of England in 1774. The correspondence after (...) 1774 reveals Watt's expertise in geology, and also discusses meteorology, varnish making, Symington's steam engines, the first experiments with steam navigation, pneumatic medicine, and other topics. This chapter begins with the discussion of one of the earliest texts in the Western tradition to explore the relations between philosophy and pedagogy, Plato's Symposium. In this text, love (or more properly, eros) plays the mediating role, turning a love of wisdom into a pedagogical erotics that enables a journey of enlightenment. The author refers to the work of more recent thinkers, including Hannah Arendt, Jean‐François Lyotard and Luce Irigaray. The author's suggestion is that by approaching Symposium through (...) their work, this text can yield insights that are helpful for contemplating the educational process in a more contemporary context. In Symposium, the initial expulsion of the flute‐girl is undercut by Diotima's later inclusion as an apparently privileged female voice. ‘Diotima's speech’ is intriguing for many reasons, not least because it is the only place in Plato's known oeuvre where a woman takes on the part of the philosopher. The origins of philosophy of education as a discipline are relatively late, and can be traced in the Anglo-American academic world from the 1960s and a specific emphasis on conceptual problems deriving from the analytical tradition of philosophy. In more recent years, however, there has been a notable ‘Continentalist’ turn in the discipline, leading to a re-evaluation of key texts and philosophers from the French and German traditions and their relation to the discourse of education. One paradigmatic example here is (...) the work of the French postmodernist thinker Jean-Francois Lyotard. In this essay, I explore how Lyotard’s powerful critique of education in his early work, especially with regard to his influence on the May ‘68 events at Nanterre University, can be seen as crucially important, now again, to a current crisis in educational philosophy in the Western world. Moreover, Lyotard’s post-’68 work, with his paradigmatic The Postmodern Condition: A Report on Knowledge as especially important, can be seen as providing a very challenging riposte to both ‘managerialist’ and instrumentalist philosophies on the one side but also to overly simplistic ‘liberatory’ educational critiques on the other side. Mulliken proposed an Aufbauprinzip for the molecules on the basis of molecular spectroscopy while establishing, point by point, his concept of molecular orbit. It is the concept of electronic state which becomes the lever for his attribution of electronic configurations to a molecule. In 1932, the concept of orbit was transmuted into that of the molecular orbital to integrate the probabilistic approach of Born and to achieve quantitative accuracy. On the basis of the quantum works of Hund, Wigner, Lennard-Jones (...) and group theory, he suggested the fragment method to establish the characteristics of molecular orbital for polyatomic molecules. These developments make it possible to bring elements of thought on the relation between a molecular whole and its parts . An operational realism combined with the second law of thermodynamics can pave the way for interesting tracks in the mereological study of chemical systems. (shrink)

Offering a critique of the subjective idealism that lies at the centre of Toomer's oeuvre through the lens of Lukac's theory of reification, Robert B. Jones frames his analysis in terms of Kierkegaard's stages of development - the aesthetic, the ethical, and the religious.

This article considers a range of responses to Plato's Symposium, paying particular attention to Diotima's speech on eros and philosophy. It argues that Diotima's teachings contain resources for a relational pedagogy, but that these resources come more sharply into focus when Plato's text is read through the lens of contemporary (20th and 21st century) thinkers. The article therefore draws on the work of David Halperin, Hannah Arendt, Jean-François Lyotard and Luce Irigaray to argue that Diotima points us towards the (...) value of educative encounters as reciprocal and unpredictable events of initiation and becoming. Diotima's rhetorical emphasis on birth is shown to be especially important for refiguring pedagogical relations in terms of natality, understood as a capacity for new beginnings, and hence for reclaiming education as a potentially generative encounter, rather than one governed by the logic of reproduction. The final section of the article turns to work by Christine Battersby, bell hooks, Richard Smith and Morwenna Griffiths to resituate the discussion in relation to questions of autonomy. As a corrective to the modern bias towards the value of the autonomous individual, it argues that dependencies and unequal power relations can be a constitutive and enabling aspect of the educative process. Attention to such relations should thus form a key part of a relational pedagogy. (shrink)

This study uses a sample of 242 European professional purchasers to examine the six characteristics of the decision-making process developed by Jones. The illustration mobilizes six original scenarios reproducing typical purchasing situations. Two versions of each scenario were used, one representing low moral intensity and the other showing high moral intensity. Two populations were sampled: one of 120 purchasers responding to the first version of the questionnaire and a second of 122 different purchasers responding to version two. Each version (...) contained three low-moral-intensity scenarios and three high-moral-intensity scenarios. The research also investigates two concepts suggested by Hannah et al. :663–685, 2011): examining the complexity of ethical decision-making through scenarios and microsocial professional ethical contexts. The findings reveal that neither traditional individual characteristics nor standard company characteristics have a real impact on two stages of Rest’s model. They also show that internal locus of control and a high microsocial ethical environment have a positive impact on purchaser awareness and intention to act ethically for four of the six dimensions: magnitude of consequences, social consensus, temporal immediacy, and concentration of effect. Moral intensity factors also have a positive impact on these four dimensions. The two other dimensions are not related to the independent variables. (shrink)

This paper examines the ways in which Luce Irigaray and Jean-François Lyotard critique western metaphysics by drawing on notions of birth and infancy. It shows how both thinkers position birth as an event of beginning that can be reaffirmed in every act of initiation and recommencement. Irigaray's reading of Diotima's speech from Plato's Symposium is positioned as a key text for this project alongside a number of essays by Lyotard in which he explores the potency of infancy as the (...) condition of philosophy itself. Despite this potency, however, Lyotard suggests that metaphysics is haunted by a melancholia that is inseparable from the limits of thought. I argue that Irigaray is able both to explain why western metaphysics is constitutively melancholic and to offer a shift in perspective that means we are not inevitably condemned to melancholia. The paper concludes that while Lyotard's account of infancy challenges the terms of western metaphysics from within, Irigaray's reassessment of our beginnings in birth offers the possibility of an alternative metaphysical horizon. This collection presents, for the first time in English, Jean-Francois Lyotard's major essays on film: 'Acinema', 'The Unconscious as Mise-en-scene', 'Two Metamorphoses of the Seductive in Cinema' and 'The Idea of a Sovereign Film'. Then, eight critical essays by philosophers and film theorists examine Lyotard's film work and influence across two sections: 'Approaches and Interpretations' and 'Applications and Extensions'. These works are complemented by an introductory essay by leading French scholar Jean-Michel Durafour on Lyotard's film-philosophy, an overview of (...) Lyotard's practical film projects written by his collaborators Claudine Eizykman and Guy Fihman, and the synopsis for a later film project Memorial Immemorial, which Lyotard proposed but was not produced. Jean-Francois Lyotard was the most significant aesthetician of the poststructuralist generation, but this dimension of his thought is only recently beginning to receive the attention it deserves in the English-speaking world. He devoted a number of essays to film, and was involved in making several experimental short films. Lyotard's reflections on film offer a perspective which seeks to do justice to it as an art by focusing on its aesthetic, material qualities. His work in this area remains a largely untapped resource, with the potential for inaugurating exciting new directions in film-philosophy. (shrink)

Tamsin Jones believes that locating Jean-Luc Marion solely within theological or phenomenological discourse undermines the coherence of his intellectual and philosophical enterprise. Through a comparative examination of Marion’s interpretation and use of Dionysius the Areopagite and Gregory of Nyssa, Jones evaluates the interplay of the manifestation and hiddenness of phenomena. By placing Marion against the backdrop of these Greek fathers, Jones sharpens the tension between Marion’s rigorous method and its intended purpose: a safeguard against idolatry. At (...) once situated at the crossroads of the debate over the turn to religion in French phenomenology and an inquiry into the retrieval of early Christian writings within this discourse, A Genealogy of Marion’s Philosophy of Religion opens up a new view of the phenomenology of religious experience. I appropriate Deleuze and Guattari's concept of the refrain for a feminist analysis of the girl because it offers more insight into the ways girls construct themselves as performative networks than the death-by-culture or at-risk model preferred by such feminists as Jean Kilbourne, Carol Gilligan, and even Susan Bordo. I proffer that it costs women everything to practise a politics of difference that is by definition reactionary, a reaction to the cultural refusal of leaky gendered bodies that must be (...) overcome. Girl is mapped through such alternations as powerful aggregates of the tremulous, roaming emissions of monstrous particles most desired and desirous. (shrink)

In this book, Kristana Arp seeks to establish a new understanding of the ethical thought of Simone de Beauvoir. While placing Beauvoir within the school of existential phenomenology, Arp emphasizes Beauvoir’s unique contribution to existentialist ethics. Her thesis is that Beauvoir’s work moves beyond the ethical thought of other existentialists, particularly beyond that of Jean-Paul Sartre, and seeks to address fundamental problems left open by Sartre’s thinking. “Beauvoir’s breakthrough,” she claims, “is to change existentialism’s focus on one’s own freedom (...) into a focus on the freedom of others”.
