Stand-up specials seem to resemble news reporting and documentary film in that they appear prima facie to be mere documentation of an event designed to give viewers the sense of what happened at a place at a time. Closer examination, however, throws doubt upon this transparency claim and it is argued that filmic realism is not the proper lens through which to understand stand-up specials, that they represent a more artistic medium in which the director of the special needs to (...) be seen as an artist along with the comedian. Stand‐up specials are not identical to the sets they contain. Nor are they of a kind with either fiction films or documentaries. I argue here that the properties of specials that make them ontologically distinct also demand that we treat them as distinct for the purpose of their evaluation. I then offer some evaluative criteria for specials as well as suggestions for becoming better critics of specials.

The stand-up special is growing cultural significance just as it is maturing and becoming more distinct as an art form. Philosophical treatments of the special are therefore neither frivolous nor redundant. I argue here that such inquiry can be aided by a definitional account of “special” and that an essential definition – if one is available- would serve us best. I then offer a candidate definition of this kind and reply to some likely objections to it.

A number of recently-offered examples demonstrate that it is possible for films to be works of philosophy, but do not speak to just how many films are. Here I suggest one way in which a great number of films could be reasonably interpreted this way. My focus is on what I take to be our most crucial criterion for a film’s being philosophy: that it must present a philosophical argument. I present here a form that is plausibly shared by a (...) good number of arguments made by films, and provide a number of examples of films that present arguments of this form in favor of philosophical conclusions. A number of objections to the style matrix that Arthur Danto introduced in “The Artworld” seem to have quelled most discussion of it. So telling have these arguments been that Danto himself later recanted the idea entirely. This situation is somewhat unfortunate. It may be that Danto's own interpretation of the style matrix is not tenable, but I believe we can articulate an alternative reading of it that escapes the aforementioned objections. While the interpretation I suggest cannot provide all that (...) Danto initially imagined for his style matrix, it does maintain much that was theoretically beneficial in it. (shrink)

What sort of thing is film? Before we can answer this question, we’ll have to first determine which things count as “films” in the relevant sense and work out what we ought to look for in an acceptable answer. There is little consensus among philosophers of film on any stage of this process. Here I make the case for a particular understanding of “film” to investigate as well as a particular set of criteria to use in that investigation. I then (...) apply those criteria to a number of available candidate theories. In the end, I do not offer an answer to our question so much as an approach to it, along with some strategies for future research. (shrink)

Certain artworks are––whatever else they are––statements about the value of art. A particularly striking form of such a statement is made by a class of artworks we can call “high-cost art.” High-cost artworks are those with greater costs relative to benefits for their artists or displayers. I will argue here that those art forms that are most likely to include high-cost works are particularly effective at communicating artistic value-claims, and suggest that by so championing the value of art, these artworks (...) themselves increase in artistic value. The story in "The Facts Concerning the Recent Carnival of Crime in Connecticut" and its telling are above all funny, but Twain himself was keenly interested in its philosophical content. Writing about the first reading of “Carnival” Twain referred to the “exasperating metaphysical question which I mean to lay before them in the disguise of a literary extravaganza.” There are at least two candidates for the operative “metaphysical question,” both of them quite “exasperating.” The first concerns the origin and valuation (...) of moral values. On this reading Twain may appear to be making a point similar to the central thesis of a number of Nietzsche’s most important works. Indeed, this Nietzschean reading of Carnival has been suggested before. Another possible interpretation is that Twain’s first concern was not with the nature of moral values so much as moral psychology. On this reading, “Carnival” may seem at first to be making a more or less Humean point about moral motivation. I argue that that Twain is presenting neither a Nietzschean nor a Humean position so much as presenting the questions that these theories purport to answer. Certain details of “Carnival” suggest that Twain had a remarkably nuanced understanding of these questions and the problems they produce. (shrink)

Realism has a significant place in the history of film theory. The claim that film is essentially a realistic art form has been employed to justify the art-status of films as well as the distinctness of film as a form. André Bazin and others once used realist ontologies of film to try to establish realist teleologies and universal critical standards. I briefly sketch this history before considering the prospects for various versions of realism: Bazin’s, as well as Kendall Walton’s and (...) Gregory Currie’s less ambitious but more plausible accounts. I argue that these theories, though they are the best cases we have for realism, are not adequate ontologies of film. However, while prior realist philosophers and critics were wrong to think that realism can provide a critical standard for all films, realism is nonetheless a praiseworthy filmic achievement - one that the opponent of ontological realism should not dismiss. A number of current controversies involve questions about the cognitive value of fiction. In each of these contexts, we find skepticism about what might be called the “strong thesis,” that we can non-trivially gain determinate propositional knowledge from fictions by virtue of their narrative contents. I offer two ways in which fictions can (and often do) provide us with propositional knowledge in just this way. I make the case that these models help answer much of the skepticism mentioned above. One common way of framing the recent history of definitional theories of art has it that Wittgensteinian challenges to the definitional project were not successful in establishing the impossibility of a successful definition, but they were successful in providing limits on the kinds of theories that can work. A key part of this story concerns Morris Weitz’s argument that “art” is indefinable because art is – as he calls it – an “open concept”. The argument has since been refuted by (...) definitional theories that account for art’s openness. Doing so, in fact, has become something of a motivation for and a requirement of subsequent theories. I argue here, however, first that accepting Weitz’s premise that art is open has led to an unfortunate pessimism about providing thoroughly informative definitional theories, and second that such pessimism is unwarranted. Art is not, in fact, open in the way Weitz suggests. Recognizing this should enable us to once again seek more informative definitional theories. (shrink)

Kyosei, a traditional Japanese concept, has been applied to a variety subjects, from biology to business. It has more recently become synonymous with the concepts of corporate responsibility, ethical decision making, stakeholder maximization, and responsible reciprocity. The purpose of this paper is to trace kyosei's modern business application back to ancient Confucian thought. The ideals associated with Confucianism were instrumental in the creation of Japanese business codes of ethics during the early part of the seventeenth century. A short history of (...) this period is presented to provide a contextual framework for understanding these codes. A specific code of ethics, called the shuchu kiyaku, is presented for the first time in English and shown to have direct roots in Confucian writings. Statements from modern company codes and from modern Japanese and American businessmen are presented to reflect the philosophy of business embodied in that ancient code of ethics. (shrink)

Metaphysics-first approaches dominate the current literature in the epistemology of modality. According to metaphysics-firsters, metaphysical theses have an important role in the justification of modal epistemologies. For example, the thesis that essentialist truths constitute the metaphysical grounds of modal truths is meant to have an important role in the justification of essentialist modal epistemologies. In this article, we argue against this approach. We first pick up some of the groundwork on behalf of the metaphysics-firsters and explicitly spell out potential arguments (...) for their view. However, despite some initial plausibility, these arguments are ultimately found wanting. We conclude that the metaphysics-first approach lacks motivation and puts far too stringent demands upon modal epistemologists. (shrink)

In Miniland USA, the nation itself takes on many of the characteristics of the fan developed theme (FDT): vignettes of LEGO bricks, thematically unified as "American", based on representations of locations throughout the United States. Frequently referred to as the "heart" of the LEGOLAND theme parks, Miniland is a section made up of scaled‐down versions of national landmarks and icons, artfully arranged around winding paths. Contemporary domestic tourism envisions the United States as several distinct geographic zones, differentiated by metropolitan centers (...) and regional characteristics (primarily climate, food, and dialect). Tourist guides and maps reinforce this configuration, highlighting roughly the same delineation of regions: The Northeast,Mid‐Atlantic, Southeast, Southwest, Midwest, and Pacific Northwest. Echoing this conception of the national itinerary, LEGOLAND California's Miniland USA contains miniature versions of six different American locations: New York City, Washington DC, "New England", New Orleans, Las Vegas, and California. Frank E. Zachos offers a comprehensive review of one of today's most important and contentious issues in biology: the species problem. After setting the stage with key background information on the topic, the book provides a brief history of species concepts from antiquity to the Modern Synthesis, followed by a discussion of the ontological status of species with a focus on the individuality thesis and potential means of reconciling it with other philosophical approaches. More than 30 different species concepts (...) found in the literature are presented in an annotated list, and the most important ones, including the Biological, Genetic, Evolutionary and different versions of the Phylogenetic Species Concept, are discussed in more detail. Specific questions addressed include the problem of asexual and prokaryotic species, intraspecific categories like subspecies and Evolutionarily Significant Units, and a potential solution to the species problem based on a hierarchical approach that distinguishes between ontological and operational species concepts. A full chapter is dedicated to the challenge of delimiting species by means of a discrete taxonomy in a continuous world of inherently fuzzy boundaries. In this study, the author shows new entry points to the dialogue between Kant and Heidegger. Schalow takes up the question: "Why should a philosopher like Kant, for whom language seemed to be almost inconsequential, become the crucial counter point for a thinker like Heidegger to develop a novel way to understand and express the most perennial of all philosophical concepts, namely, 'being' as such?" This approach allows for addressing issues which are normally relegated to the periphery of the exchange (...) between Heidegger and Kant, including spatiality and embodiment, nature and art, religion and politics. This note is a postscript to Ramsey's 'Truth and Probability'. It replaces that article's psychological reading of subjective probability with a reading of it as a consistency condition on the theory that we act to maximise expected utility.

How could ectogestative technology disrupt gender roles, parenting practices, and concepts such as ‘birth’, ‘body’, or ‘parent’? In this chapter, we situate this emerging technology in the context of the history of reproductive technologies and analyse the potential social and conceptual disruptions to which it could contribute. An ectogestative device, better known as ‘artificial womb’, enables the extra-uterine gestation of a human being, or mammal more generally. It is currently developed with the main goal of improving the survival chances of (...) extremely premature neonates. We argue that the intended use of the technology in neonatal intensive care units, as an alternative to current incubators (’partial-ectogestation’), challenges concepts such as ‘birth’, ‘fetus’, and ‘neonate’, and has several ethico-legal implications. We moreover address a more futuristic scenario where the entire embryological and fetal development could happen within an artificial womb (’full-ectogestation’). Such a scenario reveals the disruption of gender roles, parenting practices, and concepts such as ‘mother’, ‘father’, and ‘parent’. Both full- and partial-ectogestation would have implications for engineering and design, law-making, ethics, and philosophical anthropology. (shrink)

How should we react to the contention that there is empirical evidence showing that many judge Gettier cases to be cases of knowledge, contrary to the verdict of most analytical philosophers about these cases? I argue that there is no single answer to this question. The discussion is set inside a view about how to view the role and significance of intuitive responses to some of philosophy's famous thought experiments. We enter here upon a history of conversational traffic between the respective departments of philosophy and law in the old academy of liberalism, where lawyers hear much from philosophers, yes-and philosophers hear from lawyers, too, in what has fruitfully been a both-ways exchange. Our philosophical protagonist is John Rawls. This book comprises a study of the rise and workings, within the Rawlsian political-liberal philosophy, of the idea of a country's higher-legal constitution as a public platform for the justification of political (...) coercion. A study of Rawls on constitutionalism can help us, I believe, in scoping out and managing a cluster of constitutional lawyers' debates-interminable ones, it seems, in the constitutional-democratic precincts of our times-that I will catalogue soon below. But conversely, I believe, those seeking the best and truest readings of Rawls might have something to learn from the controversies of the lawyers. My approach to Rawls has accordingly been that of a critically leavened (while no doubt broadly sympathetic) exegesis, while with the legal-discursive materials I take more of a diagnostic turn. My hope is that a treatment of these two discourses in relation to each other will prove an aid to both political-philosophical and legal-practical reflection. (shrink)

Sohn-Rethel’s great idea was to ‘socialise’ Kant’s transcendental subject by combining it with Marx’s commodity-form. In so doing, he took on three challenges simultaneously: a) the timeless validity of modern natural science; b) the social genesis of empirically pure forms of cognition; and c) socialisation occurring through a purely social synthesis. However, Sohn-Rethel construed Marx’s value-form analysis as an empirical exchange of commodities and held that such exchange performs a real abstraction – in this way, he laboured under the very (...) semblance that money engenders at the surface of society by virtue of its function qua means of exchange. This semblance can be rendered transparent by, on the one hand, explaining value in terms of capitalist valorisation rather than as a product of abstraction, and, on the other, developing money as the measure and form of this valorisation. This is a comprehensive study of the far-reaching changes that led to a re-shaping of the philosophical discourse in Islam during the sixth/twelfth century. Whereas earlier Western scholars thought that Islam's engagement with the tradition of Greek philosophy ended during that century, more recent analyses suggest its integration into the genre of rationalist Muslim theology (kalam). This book proposes a third view about the fate of philosophy in Islam. It argues that in addition to this integration, Muslim theologians picked up (...) the discourse of philosophy in Islam (falsafa) and began to produce books on philosophy. Written by the same authors, books in these two genres, kalām and philosophy, argue for opposing teachings on the nature of God, the world's creation, and on the afterlife. This study explains the emergence of a new genre of philosophical books called "hikma" that stand opposed to Islamic theology and at the same wishes to complement it. Offering a detailed history of philosophy in Iraq, Iran, and Central Asia during the sixth/twelfth century together with an analysis of the circumstances of practicing philosophy during this time, this study can show how reports of falsafa, written by major Muslim theologians such as al-Ghazali (d. 505/1111), developed step-by-step into critical assessments of philosophy that try to improve philosophical teachings, and eventually become fully fledged philosophical summas in the work of Fakhr al-Din al-Razi (d. 606/1210). The book ends in a discussion of the different methods of kalam and hikma and the coherence and ambiguity of a Muslim post-classical philosopher's œuvre. (shrink)

Institutions are normative social structures that are collectively accepted. In his book Making the Social World, John R. Searle maintains that these social structures are created and maintained by Status Function Declarations. The article’s author criticizes this claim and argues, first, that Searle overestimates the role that language plays in relation to institutions and, second, that Searle’s notion of a Status Function Declaration confuses more than it enlightens. The distinction is exposed between regulative and constitutive rules as being primarily a (...) linguistic one: whereas deontic powers figure explicitly in regulative rules, they feature only implicitly in constitutive rules. Furthermore, he contends that Searle’s collective acceptance account of human rights cannot adequately account for the fact that people have these rights even when they are not recognized. Finally, It is argued that a conception of collective intentionality that involves collective commitment is needed in order to do justice to the normative dimension of institutions. (shrink)

In modern democracies, moral experts play an increasingly important role in law-making. Apart from the question of which competences characterize moral experts, their influence on the legitimacy of democratic procedures must be discussed. On the one hand, the contribution of moral experts promises to improve the quality of decision making. On the other hand, however, moral experts cannot claim to represent the will of the people. In this essay, at first a concept of the moral expert will be sketched which (...) does without the assumption of a privileged access to 'moral truths'. Then a procedural understanding of democratic legitimacy without epistemic components will be defended. Finally there will be a distinction between the purely consultative and the quasi-legislative tasks of ethics committees. Whereas councelling by moral experts does not influence the legitimacy of democratic procedures, giving them quasilegislative functions is connected to risks in this respect. (shrink)

Skill or control is commonly regarded as a necessary condition for intentional action. This received wisdom is challenged by experiments conducted by Joshua Knobe and Thomas Nadelhoffer, which suggest that moral considerations sometimes trump considerations of skill and control. I argue that this effect (as well as the Knobe effect) can be explained in terms of the role normative reasons play in the concept of intentional action. This explanation has significant advantages over its rivals. It involves at most a conservative (...) extension rather than a radical revision of what we tend to believe about intentional action, and it fits better with the way we conceive of the relation between intentional action and moral responsibility. John Dewey's Experience and Education is an important book, but first-time readers of Dewey's philosophy can find it challenging and not meaningfully related to the contemporary landscape of education. Jeff Frank's Teaching in the Now aims to reanimate Dewey's text--for first-time readers and anyone who teaches the text or is interested in appreciating Dewey's continuing significance--by focusing on Dewey's thinking on preparation. Frank, through close readings of Dewey, asks readers to wonder: How much of what we justify as (...) preparation in education is actually necessary? That is, every time we catch ourselves telling a student--you need to learn this in order to do something else--we need to stop and reflect. We need to reflect, because when we always justify the present moment of a student's education in terms of what will happen in the future, we may lose out on the ability to engage students' attention and interest now, when it matters. Dewey asks his readers to trust that the best way to prepare students for an engaging and productive future is to create the most engaging and productive present experience for students. We learn to live fully in the future, only by practicing living fully in the present. Although it can feel scary to stop thinking of the work of education in terms of preparation, when educators reclaim the present for students, new opportunities--for teachers, students, schools, democracy, and education--emerge. Teaching in the Now explores these opportunities in impassioned and engaging prose that makes Experience and Education come alive for readers new to Dewey or who have taught and read him for many years. This paper seeks to provide a basis for a fruitful correspondence between the projects of Nietzsche and Merleau-Ponty. It argues that both philosophers are committed to an ontology of relation and they both regards any terms to these relations as being hypostases of a horizontal movement. This commits them to very parallel views of history, politics, and perception.
