Financially significant relationships between corporations and non-profit organizations have increased in recent years. NPOs offer access to interests and ideologies that are lacking within most for-profit organizations. These partnerships form a unique bridge between for-profit and non-profit goals and offer significant potential to produce innovative ways of “doing business by doing good.” Exploration of the structural implications of these relationships, however, has been limited. The potential for ideological imbalance in these relationships, particularly for the NPO, has been poorly described. Using data collected from 20 NPOs in Australia, we identified the use by NPOs of both formal and informal governance mechanisms within their partnerships. These mechanisms acted to align and defend important goals of the NPO. Voluntary management standards for social and environmental performance ideally help to define and improve firms’ related capabilities. These standards, however, have largely failed to improve such performance as intended. Over-emphasis on institutional factors leading to adoption of these standards has neglected the role of firms’ existing capabilities. External pressures can drive firms to adopt standards more than their technical capacity to employ them. This can lead to problems of “fit” between institutional requirements and a firm’s existing capabilities . We describe (...) a conceptual model that considers the impact of an interaction between a firm’s institutional requirements and its existing capabilities on standards failure. We suggest solutions that align institutional requirements to appropriate governance forms as a means to improve standards success. We contribute to theory by describing the role of firms’ internal capabilities to the success of voluntary management standards and the reliability of self-regulation generally. (shrink)

This book aims to develop the tradition of philosophical hermeneutics, the theoretical account of interpretive (as opposed to explanatory) understanding--the account of meanings and contexts rather than causes and predictions--usually restricted to the domain of literary and textual analysis, in new directions by exploiting its potential as an instrument of critique. It refutes commonly held claims that hermeneutic analyses are necessarily relativistic, Eurocentric, or critically impotent and demonstrates how hermeneutic procedures can inform analyses of urgent current and cross-cultural issues such (...) as the biology of race, female genital excision, and the so-called "culture of poverty" thesis. The Sentimental Life of International Law is about our age-old longing for a decent international society and the ways of seeing, being, and speaking that might help us achieve that aim. This book asks how international lawyers might engage in a professional practice that has become, to adapt a title of Janet Malcolm's, both difficult and impossible. It suggests that international lawyers are disabled by the governing idioms of international lawyering, and proposes that they may be re-enabled by speaking different (...) sorts of international law, or by speaking international law in different sorts of ways. In this methodologically diverse and unusually personal account, Gerry Simpson brings to the surface international law's hidden literary prose and offers a critical and redemptive account of the field. He does so in a series of chapters on international law's bathetic underpinnings, its friendly relations, the neurotic foundations of its underlying social order, its screened-off comic dispositions, its anti-method, and the life-worlds of its practitioners. Finally, the book closes with a chapter in which international law is re-envisioned through the practice of gardening. Few debates in environmental philosophy have been more heated than the one over the nature of wilderness. And yet, when one surveys the present scene, one finds that a variety of different conceptions of wilderness are still quite popular – some more so in certain professions than others. In this paper, I look at three popular conceptions of wilderness with an eye toward sussing out the good and the bad them. I look at what I call (1) the folk view (...) of wilderness, (2) Leopold’s conception of wilderness, and (3) the legal conception of wilderness (as found in the Wilderness Act of 1964). In the final part of the paper, I sketch out a sort of spectrum account of wilderness, one that I argue allows us to capture more cases of wilderness and might serve as a useful tool in future conservation efforts. Environmental philosophy uncovers the ethical relationships existing between humans and the living and non-living world. It reveals the nuances of our scientific ecological concepts. Across the country, legal and health care professionals who understand that health outcomes are most influenced by social and environmental conditions have improved patient health by adopting the interdisciplinary MLP health care delivery model. However, the MLP field cannot advance population health, let alone long-term health equity, until it addresses the structural determinants of health inequity that are rooted in discrimination, segregation, and other forms of racial and ethnic subordination.

Patients belonging to ethnic, racial, and religious minorities have been all but excluded from the legal academy's on-going conversation about informed consent. This article repairs that egregious omission. It begins by observing the narrowing of ethical justifications that underlie our informed consent law, tracing the ethical literature from the ancients to modern formulations of autonomy-centered models. Next, this article reviews the vast body of empirical data available in social science literature, that demonstrates how distinct from the autonomy model the broad (...) range of values and priorities held by patients from racial, ethnic, and religious minority groups is. The conclusion that informed consent's focus on the western notion of autonomy affirmatively harms minority patients is inescapable. The article concludes by offering a fiduciary model of informed consent law that could improve the quality of health care for more than 100 million minority patients, potentially at risk under current law while also regulating the informed consent procedure and practice in a way that will bring balance and justice to all American patients and providers. Perhaps this is just as well, since the conversation appears to have concluded that the doctrine has failed to serve as a meaningful regulation of clinical relationships. Informed consent does not operate in practice the way it was intended in theory. More than a decade ago, Peter Schuck noted the “informed consent gap” that distinguishes the “proper” law of (...) informed consent “on the books” from the actual consent law in action, and called for a more contextualized approach to informed consent. Susan Wolf later called for a systemic approach to informed consent in order to accommodate multiple decision points in the managed care setting. This paper presents an account of the ethical and conceptual relationship between free speech and press freedom. Many authors have argued that, despite there being some common ground between them, these two liberties should be treated as properly distinct, both theoretically and practically. The core of the argument, for this “unbundling” approach, is that conflating free speech and press freedom makes it too easy for reasonable democratic regulations on press freedom to be portrayed, by their opponents, as part of a (...) programme of illiberal censorship. While we acknowledge the important grain of truth in that argument, we try to show how the alternative, “unbundling” approach can also be used to undermine or mischaracterise democratically justifiable opposition to media regulations in despotic regimes. In light of the problems on both sides, we defend a contextually-variable account of the relation between these two liberties. (shrink)

This chapter develops a social epistemological analysis of Web‐based search engines, addressing the following questions. First, what epistemic functions do search engines perform? Second, what dimensions of assessment are appropriate for the epistemic evaluation of search engines? Third, how well do current search engines perform on these? The chapter explains why they fulfil the role of a surrogate expert, and proposes three ways of assessing their utility as an epistemic tool—timeliness, authority prioritisation, and objectivity. “Personalisation” is a current trend in (...) Internet‐delivered services, and consists in tailoring online content to the interests of the individual user. It is argued here that personalisation threatens the objectivity of search results. Objectivity is a public good; so there is a prima facie case for government regulation of search engines. (shrink)

Mientras fue Jefe del Departamento de Literatura del INBA, impulsó unos ciclos de conferencias enfocados a estas cuestiones. Entre éstas destacó “La confidencia epistolar”, en donde invitó a autores renombrados a relatar frente al público algunos pasajes de su (...) correo. Antonio Acevedo Escobedo sólo fue organizador, pero con el tiempo se fue develando que su correspondencia era aparte de cuantiosa, profusa en datos que ayudarán, sin lugar a duda, a completar el panorama literario del siglo pasado. The confluence of racial unrest and Medicaid expansion in Virginia should inspire a national reimagining of how health care can contribute to health equity. Hospitals in particular can leverage their role as economic drivers in communities to equalize health and social outcomes for all. The urgent need for innovative opioid intervention presents a fertile proving ground for new ways that hospitals can act to reduce the impact of racial inequity. Inspired by the role hospitals played to achieve desegregation during the (...) This chapter sketches the outlines of what a reasonable form of nativism might look like. The neuroconstructivists' challenge indicates that some misunderstanding continues to exist among certain self-titled nonnativists over what it is that practicing nativists actually claim, together with a mistaken belief that current neurodevelopmental data is not or cannot be compatible with the nativist program. Both these issues are addressed by first providing further explication of the claims of practicing nativists, and then showing how these claims provide the (...) basis for a reasonable nativism that is fully cognizant of and consistent with empirical data from all the developmental sciences, neuroconstructivism included. Medieval interpretations of hylomorphism, in which substances are conceived as metaphysical composites of prime matter and substantial form, are receiving attention in contemporary philosophy. It has even been suggested that a recovery of Aquinas's conception of prime matter as a ‘pure potentiality’, lacking any actuality apart from substantial form, may be expedient in hylomorphic interpretations of quantum mechanics. In this paper, we consider a recent hylomorphic interpretation of non-relativistic quantum mechanics, the theory of Cosmic Hylomorphism, which does not explicitly invoke (...) any notion of prime matter in its original formulation. We argue that prime matter does in fact play a role in constituting and individuating particles in this theory. However, we demonstrate that the notion of prime matter which features in the extended version of Cosmic Hylomorphism that we propose here is distinct from Aquinas's conception of prime matter, inasmuch as it has discrete metaphysical parts. Emphasizing the colonial relationship between the Inners and the Belt gives us insight into why attempts to forge a peaceful alliance between Earth, Mars, and the Belt fail time and time again. If we understand the Belt's attack as transcending mere bloodthirst and demolishing the unquestioned (...) colonial system that denies their very humanity, the case for anti‐colonial violence becomes much more compelling. Marco's vision of the future, in which Earth and Mars keep to their planets and a self‐determining Belt can finally live free of persecution, is juxtaposed against Avasarala's vision of peace in Luna Station. Moral expressivists think that moral thoughts and sentences don’t represent or describe the world, at least not in any interesting sense. Global expressivists think that _no_ thoughts or sentences represent the world; local expressivists think that some do and others don’t. Huw Price has influentially argued that local expressivism collapses into global expressivism, due both to the effects of minimalist theories of representation and similar concepts, and to an unappreciated consequence of the success of specific expressivist theories like moral expressivism. (...) In this paper I argue that Price’s arguments don’t succeed. While they can be fixed, doing so makes them miss their intended target. Cloth, $42.50.This important book is an interpretation and defense of Rousseau's theory of moral education, in which the author explains and justifies Rousseau's ideas about what virtue is, why it is important, and how it can be cultivated.Briefly, this is his reading: in (...) advanced societies, people come to possess intense and incoherent passions, enflamed by amour-propre, which set them at odds with themselves and with each other, making bourgeois existence unsatisfying and exploitive. To create a better life, people must learn to restrain their desires in a way that promotes their own happiness; they must be taught virtue, which Reisert defines as, "the strength of character to rule over one's passions, so that one can make oneself do what one knows one ought to do" (8). Finally, the best model for the moral educator is not ruler to ruled, but friend to friend.The book is both a defense of this interpretation of Rousseau, and a defense of Rousseau's social and psychological theory itself, most notably against Aristotle, Locke, and Buffon. While the two lines of argument do not go together seamlessly, Reisert offers a number of contributions to Rousseau scholarship and to social thought, especially as it intersects with liberal political theory. He divides the work into two parts. The first explains Rousseau's theory of human nature and his diagnosis of the ills of society. The second interprets and defends his ideas about how to remedy that condition through the cultivation of virtue by means of friendship. The final chapter discusses the importance of virtue for contemporary liberal politics.The first half of the book, on Rousseau's "physics of the soul," touches on self-love, pity, vanity, and conscience. For some reason, Reisert limits his discussion largely to the meaning of amour-propre in the second Discourse and Emile to the exclusion of other issues and other books. Even so, he gives an interesting interpretation of amour-propre, and how it leads to the restless, banal misery that both authors think is characteristic of modern life.The problems of this section come when Reisert attempts to defend Rousseau. He argues that his theory of human nature is to be preferred because it answers questions that others cannot, such as how essentially asocial beings have come to live in societies. Yet, this question and some others he discusses come into being only because of Rousseau's own assumptions, for example that people are asocial in the first place. So, Rousseau's ability to solve puzzles that exist only on the basis of his own principles cannot be taken as evidence for those principles without begging the question.The second half of the work is more innovative. Reisert makes two basic arguments: that only virtue can alleviate the dissatisfactions of bourgeois existence; and that only the relationship of friendship can bring about this "education to virtue" (141). The first is less controversial given that he defines virtue simply as the power to restrain irrational desires for the sake of happiness; yet he goes on to make an interesting distinction between the virtue of Socrates who does not have irrational desires to begin with, and that of Emile who has them but can control them.The most original part of the book is his argument that only the relationship of friendship can foster virtue. He says that the amour-propre which makes people miserable also makes them resistant to efforts to improve their character. "A friend," on the other hand, "can, through force of personality and the power of example, exert a potent influence on his friend without thereby provoking resistance or inspiring resentment" (171). He gives a fascinating account of how a friend can be a kind of better self through whose eyes one sees the source of one's own dissatisfaction and the need for virtue to make life enjoyable. The last two decades have seen two significant trends emerging within the philosophy of science: the rapid development and focus on the philosophy of the specialised sciences, and a resurgence of Aristotelian metaphysics, much of which is concerned with the possibility of emergence, as well as the ontological status and indispensability of dispositions and powers in science. Despite these recent trends, few Aristotelian metaphysicians have engaged directly with the philosophy of the specialised sciences. This paper explores how law might conceive of the injury or harm of endocrine disruption as it applies to an aboriginal community experiencing chronic chemical pollution. The effect of the pollution in this case is not only gendered, but gendering: it seems to be causing the ‘production’ of two girl babies for every boy born on the reserve. This presents an opening to interrogate how law is implicated in the constitution of not just gender but sex. The analysis takes an (...) embodied turn, attempting to validate the real and material consequences of synthetic chemicals acting on bodies—but uncovers that finding a harm in a declining sex ratio depends on a static conception of the human form, based on unfounded assumptions of ‘naturalness’ and ‘normalcy’. Elizabeth Grosz’s theory of ‘becoming’ offers a compelling challenge, essentially pointing to the conclusion that we should find harm where we find illness and suffering and not simply where we find difference. At the same time, we cannot discount the political economy of the pollution: the paper concludes by returning the focus to the role of power, colonialism and the state in the perpetuation of the pollution on the landscape. In this follow up to The Eudemian Ethics of Aristotle, Peter L. P. Simpson centers his attention on the basics of Aristotelian moral doctrine as found in the Great Ethics: the definition of happiness, the nature and kind of the virtues, pleasure, and friendship. This work's authenticity is disputed, but Simpson argues that all the evidence favors it. Unlike the Nicomachean and Eudemian Ethics, Aristotle wrote the Great Ethics for a popular audience. It gives us insight less into (...) Aristotle the theoretician than into Aristotle the pedagogue. For this reason, the Great Ethics has distinct advantages as an introduction to Aristotelian ethical thinking: it is simpler and clearer in its argumentation, matters such as the intellectual virtues are made suitably secondary to the practical focus, the moral virtues come through with a pleasing directness, and the work's syllogistic formalism gives it a transparency and accessibility that the other Ethics typically lack. Arius' Epitome, which relies heavily on this work, helps confirm its value and authenticity. Because the Great Ethics is generally neglected by scholars, less has been done to clear up its obscurities or to expose its structure. But to ignore it is to lose another and more instructive way of approaching and appreciating Aristotle's teaching. The translation is prefaced by an analytic outline of the whole, and the several sections of it are prefaced by brief summaries. The commentary supplies fuller descriptions and analyses, sorting out puzzles, removing misunderstandings, and resolving doubts of meaning and intention. In recent years, several remarkable results have shown that certain theorems of finite combinatorics are unprovable in certain logical systems. These developments have been instrumental in stimulating research in both areas, with the interface between logic and combinatorics being especially important because of its relation to crucial issues in the foundations of mathematics which were raised by the work of Kurt Godel. Because of the diversity of the lines of research that have begun to shed light on these issues, there (...) was a need for a comprehensive overview which would tie the lines together. This volume fills that need by presenting a balanced mixture of high quality expository and research articles that were presented at the August 1985 AMS-IMS-SIAM Joint Summer Research Conference, held at Humboldt State University in Arcata, California.With an introductory survey to put the works into an appropriate context, the collection consists of papers dealing with various aspects of 'unprovable theorems and fast-growing functions'. While some scholars lamented a medical overreach into social domains, others hailed its promise for social justice advocacy. Against the backdrop of a growing commitment to health equity across the nation, this article reviews historical interpretations of medicalization, offers an application of the term to non-biologic risk factors for disease, and presents the case of housing the demonstrate the great potential of medicalizing poverty.

This chapter examines two ways in which liberal thinkers have appealed to claims about disagreement in order to defend a principle of free speech. One argument, from Mill, says that free speech is a necessary condition for healthy disagreement, and that healthy disagreement is conducive to human flourishing. The other argument says that in a community of people who disagree about questions of value, free speech is a necessary condition of legitimate democratic government.
