This book provides an overview of computer techniques and tools — especially from artificial intelligence (AI) — for handling legal evidence, police intelligence, crime analysis or detection, and forensic testing, with a sustained discussion of methods for the modelling of reasoning and forming an opinion about the evidence, methods for the modelling of argumentation, and computational approaches to dealing with legal, or any, narratives. By the 2000s, the modelling of reasoning on legal evidence has emerged as a significant area within (...) the well-established field of AI & Law. An overview such as this one has never been attempted before. It offers a panoramic view of topics, techniques and tools. It is more than a survey, as topic after topic, the reader can get a closer view of approaches and techniques. One aim is to introduce practitioners of AI to the modelling legal evidence. Another aim is to introduce legal professionals, as well as the more technically oriented among law enforcement professionals, or researchers in police science, to information technology resources from which their own respective field stands to benefit. Computer scientists must not blunder into design choices resulting in tools objectionable for legal professionals, so it is important to be aware of ongoing controversies. A survey is provided of argumentation tools or methods for reasoning about the evidence. Another class of tools considered here is intended to assist in organisational aspects of managing of the evidence. Moreover, tools appropriate for crime detection, intelligence, and investigation include tools based on link analysis and data mining. Concepts and techniques are introduced, along with case studies. So are areas in the forensic sciences. Special chapters are devoted to VIRTOPSY (a procedure for legal medicine) and FLINTS (a tool for the police). This is both an introductory book (possibly a textbook), and a reference for specialists from various quarters. (shrink)

‘AI & Law’ research has been around since the 1970s, even though with shifting emphasis. This is an overview of the contributions of digital technologies, both artificial intelligence and non-AI smart tools, to both the legal professions and the police. For example, we briefly consider text mining and case-automated summarization, tools supporting argumentation, tools concerning sentencing based on the technique of case-based reasoning, the role of abductive reasoning, research into applying AI to legal evidence, tools for fighting crime and tools (...) for identification. We discuss robotic art, emotion in robotic art, and compassion in the philosophy of art. We discuss a particular animated artwork, survivor, the walking chair, symbolising survivors of landmine blasts, learning to use crutches, and maimed emotionally as well as physically. Its control incorporates mutual relations between very rudimentary representations of distinct emotions. This artwork is intended for sensitising viewers to the horror experienced by those who survive, and those who don’t. We can only give a small sample, here, of (...) the reactions of viewers on various occasions when survivor was exhibited. Regardless of how much which pertains to human mental functions the tool embodies or doesn’t, it is the effect on the human perceivers which matters most to us, and enables us to understand something more about human cognition. Arguably this project is instructive in respect of the ethical-social implications of the synthetic method, i.e. the construction of inorganic systems in order to understand autonomous intentional action; in this project, the latter pertains to the humans involved. Sometimes, technological solutions to practical problems are devised that conspicuously take into account the constraints to which a given culture is subjecting the particular task or the manner in which it is carried out. The culture may be a professional culture (e.g., the practice of law), or an ethnic-cum-professional culture (e.g., dance in given ethnic cultures from South-East Asia), or, again, a denominational culture prescribing an orthopraxy impinging on everyday life through, for example, prescribed abstinence from given categories of workday (...) activities, or dietary laws. We use a graphic formalism to make explicit differences in the interpretation of temporal relations in natural-language text. Out of the panoply of computational representation methods for time or tense, we select Petri nets, and discuss why. We illustrate their potential for semantics and for sign theorists, by analyzing how some late antique and medieval exegeses understood the narrative of Moses and Pharaoh's magicians, and the former's rod swallowing up the rods of the other ones, once these rods had been (...) turned into crocodiles or snakes. We extend the treatment to another situation concerning the semantics of eating and being eaten. (shrink)

This paper reformulates Åqvist's model in terms of the probabilistic version of the kappa calculus. Proving its acceptability in the legal context is beyond the present scope, but the epistemological debate about Bayesian Law isclearly relevant. While the present model is a possible link to that lineof inquiry, we offer some considerations about the broader picture of thepotential of AI & Law (...) in the evidentiary context. Whereas probabilisticreasoning is well-researched in AI, calculations about the threshold ofpersuasion in litigation, whatever their value, are just the tip of theiceberg. The bulk of the modeling desiderata is arguably elsewhere, if one isto ideally make the most of AI's distinctive contribution as envisaged forlegal evidence research. (shrink)

Computational models of emotions have been thriving and increasingly popular since the 1990s. Such models used to be concerned with the emotions of individual agents when they interact with other agents. Out of the array of models for the emotions, we are going to devote special attention to the approach in Adamatzky’s Dynamics of Crowd-Minds. The reason it stands out, is that it considers the crowd, rather than the individual agent. It fits in computational intelligence. It works by mathematical simulation (...) on a crowd of simple artificial agents: by letting the computer program run, the agents evolve, and crowd behaviour emerges. Adamatzky’s purpose is to give an account of the emergence of allegedly “irrational” behaviour. This is not without problem, as the irrational to one person may seem entirely rational to another, and this in turn is an insight that, in the history of crowd psychology, has affected indeed the competition among theories of crowd dynamics. Quite importantly, Adamatzky’s book argues for the transition from individual agencies to a crowd’s or a mob’s coalesced mind as so, and at any rate for coalesced crowd’s agency. (shrink)

We expose the implications of lexical innovation as supported by the ONOMATURGE knowledge-based paradigm, for policies intended to foster native or national languages. In certain cases, the survival of native cultures, as supported by their language, depends on their ability to fill lexical gaps due to the technological gap. In certain other cases, the native culture itself is not in crisis (e.g., in the case of the national language of a sovereign country), but the local technologists or translators participate in (...) lexical innovation in a specific technical domain, and can benefit from the ONOMATURGE paradigm. The present book is a sequel to Ephraim Chamiel's two previous works The Middle Way and The Dual Truth-studies dedicated to the "middle" trend in modern Jewish thought, that is, those positions that sought to combine tradition and modernity, and offered a variety of approaches for contending with the tension between science and revelation and between reason and religion. The present book explores contemporary Jewish thinkers who have adopted one of these integrated approaches-namely the dialectical approach. Some of these (...) thinkers maintain that the aforementioned tension-the rift within human consciousness between intellect and emotion, mind and heart-can be mended. Others, however, think that the dialectic between the two poles of this tension is inherently irresolvable, a view reminiscent of the medieval "dual truth" approach. Some thinkers are unclear on this point, and those who study them debate whether or not they successfully resolved the tension and offered a means of reconciliation. The author also offers his views on these debates. This book explores the dialectical approaches of Rav Kook, Rav Soloveitchik, Rabbi Abraham Joshua Heschel, Samuel Hugo Bergman, Leo Strauss, Ernst Simon, Emil Fackenheim, Rabbi Mordechai Breuer, his uncle Isaac Breuer, Tamar Ross, Rabbi Shagar, Moshe Meir, Micah Goodman and Elchanan Shilo. It also discusses the interpretations of these thinkers offered by scholars such as Michael Rosenak, Avinoam Rosenak, Eliezer Schweid, Aviezer Ravitzky, Avi Sagi, Binyamin Ish-Shalom, Ehud Luz, Dov Schwartz, Rabbi Yuval Cherlow, Lawrence Kaplan, and Haim Rechnitzer. The author questions some of these approaches and offers ideas of his own. This study concludes that many scholars bore witness to the dialectical tension between reason and revelation; only some believed that a solution was possible. That being said, and despite the paradoxical nature of the dual truth approach (which maintains that two contradictory truths exist and we must live with both of them in this world until a utopian future or the advent of the Messiah), increasing numbers of thinkers today are accepting it. In doing so, they are eschewing delusional and apologetic views such as the identicality and compartmental approaches that maintain that tensions and contradictions are unacceptable. (shrink)

The present article considers Giulio Racah’s contributions to general physical theory and his establishment of theoretical physics as a discipline in Israel. Racah developed mathematical methods that are based on tensor operators and continuous groups. These methods revolutionized spectroscopy. Currently, these are essential research tools in atomic, nuclear and elementary particle physics. He himself applied them to modernizing theoretical atomic spectroscopy. Racah laid the foundations of theoretical physics in Israel. He educated several generations of Israeli physicists, and put Israel on (...) the world map of physics. (shrink)

Philosophische Untersuchungen der mensch1ichen Freiheit hielten sich in den letzten J ahrzehnten zumeist in einem Rahmen, der durch die, sei es nachahmende sei es ablehnende, Orientierung an der empi rischen Naturwissenschaft festgelegt war. Innerhalb seiner bewegte sich das Nachdenken iiber die Freiheit in mehreren Richtungen, deren Ausgangspunkte kurz iiberblickt seien: Die allgemeine Psychologie hatte ihren Gegenstand an der Willens freiheit; sie analysierte deskriptiv und experimentell insbesondere das in Wahl, Entsch1uB, Zwecksetzung Erfahrene. Daneben standen die Bemiihungen um den Begriff der ethischen (...) Freiheit, um das Eigen tiimliche des, im Gegensatz zur Willkiir, einem als sittlich anerkannten Gesetz folgenden Willens zu bestimmen, wie um die Freiheit zu be greifen, die sich im BewuBtsein der Schuld, der Reue, der Verant wortung auftut. Zu anderen Freiheitsbegriffen wurden die historischen Geistes wissenschaften gefiihrt: im Leben der Individuen und der Volker, im Verlauf von Kulturen und Kulturzweigen tritt ein unableitbar Neues auf, - der Begrif£ des "Schopferischen" legte hier die Frage nach der Freiheit nahe. Aber auch fiir kontinuierliche Entwicklungs zusammenhange wurde der Freiheitsbegriff dort verwendet, wo sich ein historisches Objekt organisch, entelechieartig zu entfalten schien: als Freiheit galt das Determiniertsein durch ein immanentes Gesetz, das Hervorgehen des Mannigfaltigen aus der Einheit eines "Wesens". The Intellectualist thesis that know-how is a kind of propositional knowledge faces a simple problem: For any proposition p, it seems that one could know p without knowing how to do the activity in question. For example, it seems that one could know that w is a way to swim even if one didn't know how to swim oneself. In this paper I argue that this “sufficiency problem” cannot be adequately addressed by appealing to practical modes of presentation.

We study the representation of attitudes to risk in Jeffrey’s decision-theoretic framework suggested by Stefánsson and Bradley :602–625, 2015; Br J Philos Sci 70:77–102, 2017) and Bradley :231–248, 2016; Decisions theory with a human face, Cambridge University Press, Cambridge, 2017). We show that on this representation, the value of any prospect may be expressed as a sum of two components, the prospect’s instrumental value and the prospect’s intrinsic value. Both components have an expectational form. We also make a distinction between (...) a prospect’s overall intrinsic value and a prospect’s conditional intrinsic value given each one of its possible outcomes and argue that this distinction has great explanatory power. We explore the relation between these two types of intrinsic values and show that they are determined at the level of preferences. Finally, we explore the relation between the intrinsic values of different prospects and point to a strong restriction on this relation that is implicit in Jeffrey’s axioms. We suggest a natural interpretation to this restriction. (shrink)

Anti-Intellectualists about know-how , following Ryle, hold that knowing how to do something is simply having the ability to do it. With qualifications, I defend this traditional view. The central motivation is drawn from observations about what is involved in learning to do something. Two sorts of ability are distinguished and the thesis is defended against putative counterexamples.

Many philosophers in the field of meta-ethics believe that rational degrees of confidence in moral judgments should have a probabilistic structure, in the same way as do rational degrees of belief. The current paper examines this position, termed “moral Bayesianism,” from an empirical point of view. To this end, we assessed the extent to which degrees of moral judgments obey the third axiom of the probability calculus, ifP(A∩B)=0thenP(A∪B)=P(A)+P(B), known as finite additivity, as compared to degrees of beliefs on the one (...) hand and degrees of desires on the other. Results generally converged to show that degrees of moral judgment are more similar to degrees of belief than to degrees of desire in this respect. This supports the adoption of a Bayesian approach to the study of moral judgments. To further support moral Bayesianism, we also demonstrated its predictive power. Finally, we discuss the relevancy of our results to the meta-ethical debate between moral cognitivists and moral non-cognitivists. (shrink)

This book situates Levinas in the pantheon of modern Jewish thinkers, discussing a number of themes that frequently occur in Jewish thought. The author presents Levinas's oeuvre, which comprises two parts - his Jewish, "confessional" writings and his philosophical, "professional" writings - as a unity. The question of the exact relationship between these two types of writings is a lively discussion in present day scholarship. How does Levinas perceive the relationship between revelation and philosophy, the biblical address and the logos, (...) the Saying and the said, faith and reason? There is a long oppositional tradition which contrasts Athens with Jerusalem, yet Levinas does not take part in such an antithetical tradition. Without reconciling or harmonizing, he belongs to the philosophical tradition as well as to the Jewish tradition. This double allegiance explains the presence of philosophical terms and themes in his Jewish thought and the presence of Jewish words and ideas in his metaphysics. Levinas is presented by the author as a frequent traveler between Athens and Jerusalem and as a great translator from "Hebrew" to "Greek". However, the relationship between "Hebrew" and "Greek" in Levinas's writings is not one of prototext and phenotext or of subtext and text, but rather one of a primordial inspirational word and the conceptual discourse. In an inclusive reading, Meir shows that the acquaintance with Levinas's Jewish writings is helpful in understanding his subtle philosophical analyses and a necessary condition for the understanding of the whole Levinas.--Cover. An account of the distinction between singular and general propositions should reflect the core ideas that have motivated the distinction. Those core ideas can be appreciated independently of many commitments regarding the metaphysics of propositions, but theorists with differing views on the latter have given quite different explanations of what it is for a proposition to be singular or general. Many of those explanations turn out not to reflect the core ideas adequately after all, either by misclassifying certain propositions or (...) by failing to be sufficiently informative. A more satisfactory account can be formulated by more directly elaborating on the background ideas motivating the distinction. The resulting account not only does better than its competitors, but is compatible with various views on the metaphysics of propositions. (shrink)

This book explores three schools of fascinating, talented, and gifted scholars who absorbed into their thought the Jewish and secular cultures of their respective homelands. They include halakhists such as Rabbi Ettlinger and Rabbi Eliezer Berkowitz; Jewish philosophers from Isaac Bernays to Yeshayau Leibowitz; and biblical commentators such as Samuel David Luzzatto and Rabbi Umberto Cassuto. Running like a thread through the analysis of the different scholars, is the attempt to conciliate Jewish orthodoxy with a wish to connect with Western (...) culture and philosophy and to accept the conclusions of scientific research. Among these attempts is Luzzatto's famous "dual truth" approach. This book is the sequel to the Ephraim Chamiel's previous book The Middle Way, which focused on the challenges faced by the members of the "Middle Trend" in nineteenth-century Jewish thought. (shrink)
